Dear Mr. Lilly: I am responding to Energy Minerals Corporation' s inquiry concerning whether Section 30 : Si , Township 8 North, Range 58 West is subject to a lease by oil and gas production. Weld County • is willing to offer this tract for an oil and gas lease through the bidding process . However, you are no doubt aware that Weld County does not warrant title to leased premises in its oil and gas leases. In that light, I have discovered some facts in the course of my investigation of your inquiry that I will disclose for your consideration. The original lease on this property was between C. N. Babcock and Weld County. This lease was executed on July 26 , 1949 (see Attachment #1) . On May 23 , 1968 , H. A. Needom, Vice President for Amerada Petroleum Corporation, filed an affidavit pursuant to Section 118-13-6 , C.R.S . , 1963 , proclaiming that all lands under the original lease were still subject to the lease (see Attachment #2) . On July 31 , 1968 , Amerada filed an assignment of its rights under the Babcock lease to Section 35 : Ei , Township 7 North, Range 59 West, to Longhorn Supply Company, Inc. (see Attachment #3) . Weld County records indicated that this portion of the original lease is presently under lease to Impact Energy, Inc. (see Attachment #4) . On November 29 , 1971 , Amerada Hess Corporation (formerly Amerada Petroleum Company) assigned its interest in Section 20 : SEI , Township 8 North, Range 58 West, and Section 30 : S , Township C North, Range 58 West, to Jet Oil Company, Tulsa, Oklahoma (see Attachment #5) . Weld County records show that Section 20 : SEi , R717tU Larry Lilly Page 2 July 21 , 1987 Township 8 North, Range 58 West, is subject to a lease with Diversified Operating Corporation, Denver, Colorado (see Attachment #6) . We have not determined whether Jet Oil Company subsequently assigned its interest in Section 30 : Si , Township 8 North, Range 58 West. However, Weld County records indicate that there has been no production on this tract since perhaps 1958 (see Attachment #7) . There is , therefore, an issue of whether production on the other lands under the original lease extends the original lease for the Si of Section 30 . Please notify me whether , in light of the above, you would like Weld County to place Section 30 : Si , Township 8 North, Range 58 West, up for bid.
