RE: APPROVE RIGHT-OF-WAY EASEMENT WITH US WEST COMMUNICATIONS AND
AUTHORIZE CHAIRMAN TO SIGN
WHEREAS , the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with a right-of-way
easement between Weld County and US West Communications, and
WHEREAS, said right-of-way easement concerns land described
as follows:
Commencing at the Northeast corner of Section 31 ,
Township 6 North, Range 65 West of the 6th Principal
Meridian, thence N 89°34 ' 39" W 400 feet, thence S 00°
00 ' 00" W 60 feet to the point of beginning, thence N
89°34 ' 39" W 12 feet, thence S 00°00 ' 00" W 10 feet,
thence S 89°34 ' 39" E 12 feet, thence N 00°00 ' 00" E 10
feet to the point of beginning.
WHEREAS , after review, the Board deems it advisable to
approve said Right-of-Way Easement, a copy of which is attached
hereto and incorporated herein by reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the Right-of-Way
Easement be, and hereby is , approved.
BE IT FURTHER RESOLVED by the Board that the Chairman be, and
hereby is, authorized to sign said Right-of-Way Easement.

and seconded, adopted by the following vote on the 26th day of

RIGHT-OF-WAY EASEMENT
CORPORATE
The Undersigned Grantor (and each and all of them if more than one) for and in consider-
ation of One dollars ($ 1.00) and other good and valuable consideration in
hand paid by the Grantee, the receipt whereof is hereby acknowledged, hereby grants,
bargains and conveys unto the Mountain States Telephone and Telegraph Company, a Colorado
corporation, 931 14th Street, Denver, Colorado, 80202, Grantee, its successors, assigns,
lessees, licensees and agents a Right-of-Way Easement and the right to construct, operate,
maintain and remove such communication and other facilities, from time to time, as said
Grantee may require upon, over, under and across the following described land which the
Grantor owns or in which the Grantor has any interest, to wit;
Commencing at the Northeast corner of Section 31, Township 6 North, gange 65 West of the
6th Principal Meridian, thence N 89 38'39"W 400 feet,thence S 00 00'00"W 60 feet
to the poin of beginning, thence N 89d 34' 39" W 12 feet, thence S 00 00' 00" W 10 feet,
thence S 89 34' 39" E 12 feet, thence N 00° 00' 00" E 10 feet to the point of beginning,
situate in County of Weld , State of Colorado, TOGETHER with the right of ingress and
egress over and across the lands of the Grantor to and from the above-described property,
the right to clear and keep cleared all trees and other obstructions as may be necessary,
and the right to permit other utility companies to use the right-of-way jointly with Grantee
for their utility purposes.
The Grantee shall restore grantors property damaged during its construction and maintenance
operations to as near original condition as possible.
The Grantor reserves the right to occupy, use, and cultivate said property for all purposes
not inconsistent with the rights herein granted.

Enclosed are two ( 2 ) copies of an easement description prepared by
George Mai of US West Communications. The purpose of this easement is
for setting a telephone pad. They had talked to me about it before
and I see no problems with it. It needs to be executed by the County
and then recorded.
