RE: DENIAL OF RECORDED EXEMPTION NO. 1095 - FRED H. AND PATRICIA
J. GREENFIELD
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, on July 20 , 1988 , the Board considered a request
from Fred H. and Patricia Greenfield for Recorded Exemption #1095
concerning a parcel of land located in part of the NW} of Section
8 , Township 2 North, Range 67 West of the 6th P.M. , Weld County,
Colorado, and
WHEREAS, the request was to divide the property into parcels
estimated to be approximately 3 acres and 2 acres, and
WHEREAS, the Board heard all of the testimony and statements
of those present, has studied the request of the applicant and the
recommendations of the Planning staff and considered all of the
evidence presented in this matter, and, having been fully
informed, finds that this request shall be denied for the
following reasons:
1 . The applicant has not demonstrated that the proposal is
consistent with efficient and orderly development.
2 . The applicant has not given sufficient reasons to
warrant creating an additional lot at this time. The
Department of Planning Services ' staff has concerns
above the level of development and the potential for
continued division occurring in this area.
3 . The proposed Recorded Exemption is not compatible with
the existing or future development of the area.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the request of Fred
H. and Patricia H. Greenfield for Recorded Exemption No. 1095 be,
and hereby is, denied.

Dear Commissioners:
This request for a recorded exemption is submitted by Fred H. and Patricia
J. Greenfield. The parcel of land on which this request is being made is
described as part of the NW} of Section 8, T2N, R67W of the 6th P.M. , Weld
County, Colorado. The property is located approximately two miles north of
the Town of Firestone, east of Weld County Road 15 and north of Weld County
Road 22. The request is to divide a 5 acre tract of land, which is the
total contiguous land of the applicants, into a 3 acre parcel and a 2 acre
parcel, more or less. Access to the lot is provided from Weld County Road
15, a county local gravel road. Water service to both lots is proposed to
be provided by Central Weld County Water District. Sewer service has been
proposed as septic systems. Water and septic service are both existing on
the proposed smaller parcel.
It is the opinion of the Department of Planning Services' staff that
sufficient reasons have not been given by the applicant to warrant creating
an additional lot at this time. The Department of Planning Services' staff
has concerns about the level of development and the potential for continued
division occurring in this area. This five acre parcel is one of ten lots
in this quarter section which were created before August 30, 1972. Each of
these ten lots accesses onto Weld County Road 15. The configuration of
these lots on the county road constitutes a linear subdivision which is not
consistent with orderly and efficient development. Any further division of
these lots will create additional accesses onto Weld County Road 15 and will
increase the density of the linear subdivision. Development in this area
has reached a level where continued divisions may evade the intent and
purpose of the Weld County Subdivision Regulations. In addition,
residential development in rural areas necessitates an increased demand for
road maintenance, police and fire protection, school busing, snow removal,
utilities, and other urban services. As density increases, so do service
demands.

application and determine if the standards of Section 9-2 E. (1) (a) through
(m) of the Weld County Subdivision Regulations have been met.

The recorded exemption requested would create another small tract of
land that would access onto Weld County Road 15 between County Road 24
and the Enchanted Hills Subdivision. If the exemption is granted, it
will add to the proliferation of residential development along this
stretch of road.
Weld County Road 15, as well as other access roads in the other area,
are not paved. We are presently experiencing maintenance problems on
those roads because of the traffic generated from residential
development in the area, as well as, from the subdivisions of Casa
Grande Estates and Enchanted Hills. Every additional residence adds
to the road maintenance problem.

This letter is in regard to the subdividing of the property of Mr.
Fred Greenfield, who resides at 10698 Weld County Road # 15 Longmont
Colorado.
Application Article No. 4
The payments on our present home are higher than I can afford on a
retirement income. I am getting close to retirement age and wish to
-sub-divide my 5 acres ; and sell the portion with the house on it. I
would like to use the equity from the sale of this property to buy a
manufactured home and put it on the remaining parcel of land, and have
a retirement home free and clear.

tracks. If I split my property up, it would be in 1 . 9 acres and 3. 1

where eventually the surrounding farms will be split into residential
sites. 'de are consistant with the Tri Area Planning commission. I have
met with the Tri Area Planning Commission on three different ocassions ,
and they have no objections with what I want to do.

The applicant shall submit a mylar plat to the Department of Planning
Services to be recorded in the office of the Weld County Clerk and Recorder.
The plat shall be prepared in accordance with the requirements of Section
9-2 C. (4) of the Weld County Subdivision Regulations. The plat shall be
submitted within sixty (60) days from the date of approval by the department
of Planning Services. The applicant shall be responsible for paying the
recording fees.
A Weld County Septic Permit is required for the proposed home and its septic
system shall be installed according to the Weld County Individual Sewage
Disposal Regulations.
An ISDS evaluation by the Weld County Health Department shall be necessary
prior to issuing the required septic permit on any existing systems.
