RE: APPROVAL OF RECORDED EXEMPTION NO. 753 - RUSSELL E. AND
COLLEEN M. TANBERG
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners, pursuant to its
authority under Section 30-28-101 (10) (d) , CRS, as amended, did
determine at a public meeting held in the Chambers of the Board,
that a certain parcel of land, to be divided into two parcels, as
shown on the plat known as Recorded Exemption No. 753 , does not
come within the purview of the definition of the terms,
"subdivision" and "subdivided land" , and
WHEREAS, the request for Recorded Exemption No. 753 was
submitted by Russell E. and Colleen M. Tanberg for property which
is located in part of the SW', Section 11 , Township 4 North, Range
66 West of the 6th P.M. , Weld County, Colorado, being more
particularly described in the plat which shall be provided by the
applicant and known as Exhibit "A" , said plat to be recorded, and
WHEREAS , this request is to divide the property into parcels
estimated to be approximately 1 acre and 1 acre.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the hereinabove
described parcel of land be, and hereby is, exempt from the
definition of the terms , "subdivision" and "subdivided land" .
BE IT FURTHER RESOLVED by the Board that this approval is
conditional upon the applicants submitting a mylar plat to the
Department of Planning Services to be recorded in the office of
the Weld County Clerk and Recorder. The plat shall be drawn in
accordance with the requirements of Section 9-2C. (4) of the Weld
County Subdivision Regulations. The plat shall be submitted
within sixty days from the date of approval by the Board of County
Commissioners.

Re: Recorded Exemption #RE-753
Dear Commissioners:
This request for a recorded exemption is submitted by Russell F. and Colleen
M. Tanberg. The parcel of land on which this request is being made is
described as Part of the 8104, Section 11 , T4N, R66W of the 6th P.M. , Weld
County, Colorado. The property is located 2' miles southwest of La Salle on
Weld County Road 33. The parcel of land under consideration is the total
contiguous land holdings of the applicant.
The request is to divide the property into parcels of 1.25 acres and 1 acre,
more or less. Mr. and Mrs. Tanberg wish to retain the larger parcel as
their residence. The 1 acre lot would be sold for use as a residential
site. The applicants propose that one access to Weld County Road 33 be
shared by both properties.
Based upon the submitted information and policies of the County, the
Department of Planning Services staff recommends the request be approved for
the following reasons:
1. The applicant has demonstrated in the submitted application
materials that the request complies the submission
requirements of Section 9-2 C. of the Weld County Subdivision
Regulations.
2. The applicant has demonstrated in the submitted application
materials that the standards and conditions of Section 9-2 E.
(1) (a) through (m) of the Weld County Subdivision
Regulations have been met.

The Department of Planning Services staff recommendation for approval is
conditional upon the following:
1. The applicant shall submit a mylar plat to the Department of Planning
Services to be recorded in the office of the Weld County Clerk and
Recorder. The plat shall be drawn in accordance with the requirements
of Section 9-2 C. (4) of the Weld County Subdivision Regulations. The
plat shall be submitted within sixty (60) days from the date of
approval by the Board of County Commissioners.

This is a request for splitting an area approximately 300.00' X
356.00' from lot A in property described in attached legal.
Purpose and reason for this request is to construct a single
family residence.
This proposal is consistent with policies of the Weld County
Comprehensive plan.
This proposal is consistent with the intent of the zone
district in that there will be no additional farm land
converted in this split.
The uses permitted are for a retired couple to occupy this
home and is compatable with the surrounding land use.
The use permitted will be compatable with the future development
of the surrounding area as permitted by the existing zone and
with future development as projected by the comprehensive plan
of the County of Weld.
This proposal will not be inconsistent with the efficient
and orderly development as there will be no further request
for splitting any of lot A.
SEE ATTACHED MEMO FROM WELD COUNTY HEALTH DEPARTMENT.
This property is not located in a flood plain, geologic hazard,
any airport overlay district, and does comply with section 50-
overlay district as outlined in the Weld County Zoning
ordinance.
Domestic water service to be supplied by Central Weld Water
District.
No farm land will be taken out of production in this request.

at 22654 WCR 33, LaSalle, has been evaluated for its suitability for installing
an individual sewage disposal system. The parcel poses no apparent problems for
the installation of an individual sewage di'sposal. 'ststem. Final approval, however,
cannot be given until a permit is applied for and the appropriate soils analyses
