BUILDING AND AUTHORIZE CHAIRMAN TO SIGN WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board has been presented with an Intergovernmental Agreement between Weld County and the City of Greeley concerning the issuance of a Building Permit and inspection of construction of a building by Greeley Trading, Inc. , said building to be located partially in the City and partially in the County, and WHEREAS, after review, the Board deems it advisable to approve said Intergovernmental Agreement, a copy of which is attached hereto and incorporated herein by reference. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the Intergovernmental Agreement between Weld County and the City of Greeley be, and hereby is , approved. BE IT FURTHER RESOLVED by the Board that the Chairman be, and hereby is, authorized to sign said Intergovernmental Agreement. Bran ner County Attorney l/ ez 'l �l�/�jf�l�l� Frank Yamagu i L 0053 860480 EXHIBIT A INTERGOVERNMENTAL AGREEMENT CONCERNING GREELEY TRADING, INC. , BUILDING This Agreement, made on this 3rd day of June , 1986 , between the City Council of the City of Greeley, Colorado) thereinafter the "City" ) , and the Board of County Commissioners of the County of Weld , State of Colorado (hereinafter the "County" ) . WHEREAS, the owners of Greeley Trading , Inc. , wish to build and maintain a building which by its location would be approxi- mately one-half in the City and one-half in the County; and WHEREAS , said building would be subject to the Building Codes of both the City and the County; and WHEREAS , it is in the interest of the City and the County to avoid duplicate provision of services under their respective Building Codes; and WHEREAS , the enforcement of building codes and provision of services thereunder is a proper subject of intergovernment agreements as authorized by Section 29-1-201 et sec . , Colorado -Revised Statutes; Article 1I , Section 2-3 , Weld County Home Rule Charter; and •Section 3-7 of the Charter of the City of Greeley. NOW, THEREFORE, in consideration of the foregoing , the City and the County mutually agree and covenant as follows: 1 . The Greeley Trading , Inc. , building to be located on Pt . of the NW1/4 of NE1/4 and part of NE1/4 of NE1/4 , that part of NW1 /4 of NE1 /4 , . Section 33 , Township 6 North , Range 66 , West -of 6th P.M. , Weld County, Colorado . Totaling 4 .9 acres, more or less. / j also known as : 1457-4 1/2 , Weld County Road 64 , Greeley , Colorado shall conform to all applicable building codes -of the City. 2 . The City shall issue all applicable building permits and collect and retain any and all fees for said permits . 3 . The City shall conduct all applicable building inspections and ' collect and retain all fees therefor, if any. • 4 . That Greeley City Charter, Section 3-7 , permits the City Council , by ordinance, to enter into contracts and cooperative or joint activities with other -governmental bodies. B. That Section 29-1-201 et . seg. , C.R.S. , articu- lates a state policy encouraging 'governmental cooperation. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GREELEY, COLORADO, that: Section 2-. The Mayor of the City of Greeley is hereby authorized to execute, for the City of Greeley, an intergovern- mental -agreement with Weld County, a copy of which is attached thereto, labeled "Exhibit A," and incorporated herein by refer- ence, for the purpose of issuance of a building permit to and inspection of construction by Greeley Trading, Inc.
