RE: APPROVAL OF RECORDED EXEMPTION NO. 1125 - JOHN AND LESLIE
MAULSBY
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners, pursuant to its
authority under Section 30-28-101 (10) (d) , CRS, as amended, did
determine at a public meeting held in the Chambers of the Board ,
that a certain parcel of land , to be divided into two parcels , as
shown on the plat known as Recorded Exemption No. 1125 , does not
come within the purview of the definition of the terms ,
"subdivision" and "subdivided land" , and
WHEREAS , the request for Recorded Exemption No. 1125 was
submitted by John and Leslie Maulsby for property which is located
in part of the Si , Section 11 , Township 6 North, Range 66 West of
the 6th P.M. , Weld County, Colorado, being more particularly
described in the plat which shall be provided by the applicant and
known as Exhibit "A" , said plat to be recorded, and
WHEREAS, this request is to divide the property into parcels
estimated to be approximately 40 acres and 3 acres.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the hereinabove
described parcel of land be, and hereby is, exempt from the
definition of the terms, "subdivision" and "subdivided land" .
BE IT FURTHER RESOLVED by the Board that this approval is
subject to the following conditions :
1 . The applicant shall submit a mylar plat to the
Department of Planning Services to be recorded in the
office of the Weld County Clerk and Recorder. The plat
shall be drawn in accordance with the requirements of
Section 9-2C. (4) of the Weld County Subdivision
Regulations. The plat shall be submitted within sixty
days from the date of approval by the Board of County
Commissioners.
2 . The Recorded Exemption plat shall show a minimum
thirty-foot-wide easement for ingress and egress to the
40 acre, more or less, parcel.

3 . An ISDS Evaluation on all existing septic systems will
be necessary prior to issuing the required septic
permits on the existing systems .
4 . Prior to recording the plat, a copy of a deed shall be
submitted to the Department of Planning Services
describing the 40 acre, more or less, parcel, including
conveyances of the right to use the thirty-foot ingress
and egress easement.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 23rd day of
November, A.D. , 1988 .

Re: Recorded Exemption #1125
Dear Commissioners:
This request for a recorded exemption is submitted by John and Leslie
Maulsby. The legal description for this parcel is described as part of the
Si of Section 11 , T6N, R66W of the 6th P.M. , Weld County, Colorado. The
property is located approximately 2.5 miles north of the City of Greeley, 2
miles southwest of Eaton, north of Weld County Road 70, and west of Weld
County Road 35. The request is to divide a 43 acre tract of land, which is
the total contiguous land holdings of the applicant, into two lots of 40
acres and 3 acres, more or less.
This particular piece of land has been through various changes over the
years. In May of 1965, Mr. Bartlett deeded to Mr. Chapin a 157 acre parcel.
In December of 1974, Mr. Chapin deeded to Mr. Anderson 114 acres of the
original parcel. Mr. Chapin then proceeded to submit and obtain approval of
a conditional use permit in June of 1975, to place a home on a lot below the
minimum lot size which was the remaining 43 acres. In May of 1980, Mr.
Chapin submitted a lot size variance application so that an application for
a recorded exemption could be applied for as set forth in Section 9-4.A (6)
of the Subdivision Regulations. The lot size variance was denied June tt ,
1980. The criteria used to support the June llth decision were:
1. The proposal was not in compliance with the Weld County
Comprehensive Plan;
2. The proposal was not in conformance with the intent of the
Agricultural Zone District.
3. The Eaton Planning Commission had recommended denial of this
request; and,

4. The minimum lot size in the Agricultural Zone District for
irrigated parcels is 80 acres.
It is the opinion of the Department of Planning Services' staff that
sufficient reasons have not been given by the applicant to warrant creating
an additional lot at this time. The applicant has failed to satisfy the
following criteria as outlined in the Weld County Subdivision Regulations
Section 9-2. E. (a) through (m) :
1 . The proposal is consistent with the intent of the district;
2. The proposal is compatible with the existing surrounding land
uses;
3. The proposal will be efficient and orderly development; and,
4. The proposal is in compliance with the Weld County
Comprehensive Plan.
The property is a 43 acre parcel zoned agricultural. The agricultural zone
district was established to maintain and promote agriculture as an essential
feature of Weld County. It is intended to provide areas for the conduct of
agricultural activities without the interference and encroachment of other
more intensive land uses. The surrounding area as depicted on the Assessors
parcel identification map shows all of Section 11, 1, 2, and 12 as being
made up of large parcels of land ownerships equaling approximately 160 acres
more or less in size. The creation of another lot would allow the
construction of an additional dwelling which could interfere with the
existing agricultural activities and production. The development of rural
areas necessitates the the increased demand for road maintenance, police and
fire protection, school busing, snow removal, utilities, and other urban
services. As density increases, so do service demands.
The staff requests that the Board of County Commissioners consider the
application and determine if the standards of Section 9-2 E. (1) (a) through
(m) have been met.

Requirement No. 4 :
The reason for dividing the property into two lots is that the
Maulsbys have entered into a contract to sell the 3 acre parcel
to the adjacent property owners. This will better utilize the
subject property for all concerned parties.
Requirement No. 5:
This proposal is consistent with the policies of the Weld County
Comprehensive Plan due to the following factors: (1) No lot has
been created by a Recorded Exemption within the past five (5)
years; (2 ) It is an agricultural district and (3) The lot created
by this Recorded Exemption shall have access from Weld County
Road 70 which a county road right of way.
Requirement No. 6:
This proposal is consistent with the intent of the Zone District
which is agricultural.
Requirements No. 7 & 8:
The intended use of the property will be rural residence, which
