RE: ASSESSMENT OF COSTS - WELD COUNTY CASA GRANDE/ENCHANTED HILLS
LOCAL IMPROVEMENT DISTRICT NO. 1989-2
A public hearing was conducted on November 20, 1989, at 9:00 A.M. , with
the following present:
Commissioner C.W. Kirby, Chairman
Commissioner Gene R. Brantner, Pro-Tem
Commissioner Constance L. Harbert
Commissioner George Kennedy
Commissioner Gordon E. Lacy
Also present:
Acting Clerk to the Board, Mary Reiff
Assistant County Attorney, Lee D. Morrison
Director of Engineering Department, Drew Scheltinga
The following business was transacted:
I hereby certify that pursuant to a notice dated October 18, 1989, and
duly published October 26, 1989, in The New News, a public hearing was
conducted to consider the assessment of costs for the Weld County Casa
Grande/Enchanted Hills Local Improvement District No. 1989-2. Lee
Morrison, Assistant County Attorney, made this matter of record. Mr.
Morrison said the notice stated that the assessment would be $977.10
for each of the 154 lots and parcels, and letters of objections have
been received. Mr. Morrison advised that each request would need to be
considered. Drew Scheltinga, Director of the Engineering Department,
said this job was done by Frontier Materials for a total of
$150,473.06. Frontier Materials also paved a short section of Weld
County Road 22. The cost of this additional paving, which was assumed
by the County, was $7,186.43. Mr. Morrison reviewed the letters
received from Rosa Davis; Bernard Teets; Barry and Rose Hanke; Joseph
and Sandra Lewis; and John and Myrna Folsom. Mr. Teets and Mr. Folsom
were present. Mr. Teets stated that his agricultural land on the south
side of Weld County Road 20 receives no benefits. Mr. Folsom stated
that he and his wife own three lots, which they utilize as only one
lot. Mr. Folsom also gave a history of how this local improvement
district was organized. (Tape Change #89-49 during the discussion
following Mr. Folsom's remarks.) Teresa Padilla came forward to
comment about her property. When assured that her property consisted
of only one parcel in the district, she had no further objection. Mike
Sampson, chief appraiser in the Assessor's Office, came forward. He
said he had reviewed the sales of vacant lots within Northmoor Acres
and Antelope Hills prior to and after completion of similar local
improvement districts, and he found that the value of the lots had
increased. Commissioner Lacy commented that Antelope Hills has
established two local improvement districts, one for interior roads and
one for exterior roads. Mr. Morrison reviewed the bases for
establishing whether there will be benefits on the parcels under
consideration, and he informed the Board that they may make
modifications. Commissioner Lacy moved to deny the request of Rosa
Davis and find that an equitable assessment has been made. The motion
was seconded by Commissioner Brantner, and it carried unanimously.
Commissioner Lacy moved to deny the request of Bernard Teets and find
that there is increased property value for the possible future
development of his property. Commissioner Brantner seconded the
motion, and it carried unanimously. Commissioner Brantner moved to
find that Rose and Barry Hanke own one of two legal lots, with the

other lot being owned by J.C. and Pauline Arwood. Seconded by
Commissioner Lacy, the motion carried unanimously. Commissioner Lacy
moved to deny the protest of Joseph and Sandra Lewis and find that this
is an equitable assessment. The motion, seconded by Commssioner
Brantner, carried unanimously. Commissioner Brantner moved to deny the
request of John and Myrna Folsom and find that the assessment by lot is
proper and correct. Commissioner Lacy seconded the motion and noted
that the value of each of the three lots will surely increase.
Chairman Lacy noted the testimony indicated increased value on
unimproved lots. The motion carried unanimously. Commissioner Lacy
moved to approve the Resolution establishing the cost to be assessed
each lot and parcel with said district as $977.10. Commissioner
Kennedy seconded the motion, and it carried unanimously.
This Certification was approved on the 22nd day of November, 1989.
