HomeMy WebLinkAbout891324.tiff RESOLUTION RE: APPROVE AFFILIATION AGREEMENT WITH UNIVERSITY OF COLORADO HEALTH SCIENCES CENTER PREVENTIVE MEDICINE RESIDENCY PROGRAM AND AUTHORIZE CHAIRMAN TO SIGN WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board has been presented with an Affiliation Agreement with the University of Colorado Health Sciences Center Preventive Medicine Residency Program, and WHEREAS , the terms and conditions of said Agreement are as stated in the copy being attached hereto and incorporated herein by reference, and WHEREAS, after study and review, the Board deems it advisable to approve said Agreement . NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the Affiliation Agreement with the University of Colorado Health Sciences Center Preventive Medicine Residency Program be, and hereby is, approved. BE IT FURTHER RESOLVED by the Board that the Chairman be, and hereby is, authorized to sign said Agreement. The above and foregoing Resolution was, on motion duly made and seconded, adopted by the following vote on the 20th day of December, A.D. , 1989 , nunc pro tune December 13, 1989 . Harbert / 7 George ;3Ce d County Attorney Gord y I/ 'f` r -, "ft/ ,: 891324 AFFILIATION AGREEMENT THIS AGREEMENT, entered into as of the 13th day of December, 1989, by and between the University of Colorado Health Services Center General Preventive Medicine Residency Program, hereinafter referred to as "Program" and the Weld County Health Department, hereinafter referred to as "Health Department" . WITNESSETH WHEREAS, that the University of Colorado Health Sciences Center offers a general preventive medicine residency program, and WHEREAS, the Health Department has certain facilities available for educational experiences and desires to provide such facilities for educational purposes in the residency program, and WHEREAS, the Health Department and Program desire to establish an ongoing policy structure in regard to their respective responsibilities, and WHEREAS, the Health Department and Program desire to reduce their agreements to writing, NOW THEREFORE, in consideration of the foregoing premises and the covenants and agreements hereinafter set forth, the parties agree as follows: 1. RESPONSIBILITIES OF THE PROGRAM a. The Program shall select and provide the residents to be assigned to the residency program. Residents provided will be based on an approval process which includes approval of Health Department Director. b. The Program shall orient all residents assigned to the department facility to the policies and protocols of the department prior to their commencement of clinical experience activities at the department. c. The Program faculty, staff and residents, are not to be considered Health Department employees for any purpose and said persons may not hold themselves out as employees or agents of the Health Department or otherwise make any representation or commitments on behalf of the Health Department. d. Participating residents shall carry mandatory health insurance coverage under the University's health insurance program or show proof of enrollment in a comparable accident and sickness health insurance plan. e. The University is covered by workmen's compensation insurance. This coverage shall cover all residents enrolled in the residency program. f. The Program faculty and residents shall adhere to the rules, regulations, procedures and standards of the Health Department. 891324 2. RESPONSIBILITIE F THE DEPARTMENT a. The Health Department shall recognize the responsibility to maintain a learning environment conducive to sound educational and clinical experiences. The Health Department shall provide a well-rounded practice experience in public health that includes the content areas of public health administration and management, program evaluation, disease surveillance and control, environmental and occupation health. b. The Health Department has ultimate responsibility for the quality of care given to patients. Health Department staff in the areas to which residents are assigned shall be responsible for orienting residents to department policies and protocols, particularly where special rules and regulations are necessary. c. The Health Department shall permit residents, staff and faculty of the residency program to utilize facilities such as the library, lounges, conference rooms, audio visual equipment or other teaching equipment consistent with the regulations and policies set by the Health Department. d. The Health Department staff shall communicate with program representatives concerning any problems that might arise due to a resident's performance. A written report shall be provided to the faculty or staff member of the program who is in charge of resident supervision. e. The Health Department shall provide for such supervision as is prearranged in consultation with the program. Such designated resident supervisors may provide evaluation statements concerning performance, however, program staff shall have the final responsibility for evaluation performance and assigning residents. The Health Department shall maintain no educational records concerning any resident assigned to the Department facilities. All documents in regard to a resident's performance shall be forwarded to the program upon the resident's completion of the clinical experience. 3. JOINT RESPONSIBILITIES AND TERMS OF AGREEMENT a. This Agreement shall commence as of December 13, 1989 and continues in full force and effect indefinitely. This agreement may be terminated by either party during its term only for cause and that party seeking to terminate the agreement shall provide the other party written notice of alleged cause. The alleged breaching party shall have thirty (30) calendar days after receipt of notice to remove the cause or cure the breach. If the cause is removed or the breach cured within that 30 day period, the contract shall remain in force and effect. In the event the cause is not removed the breach is not cured within the 30 day period, the party providing notice may thereafter terminate the agreement. b. During the term of this agreement, arrangements shall be made for periodic meetings between a representative of the Program and the Health Department to promote understanding of and adjustments to any operation or activity involved herein. c. Both parties agree that they shall conduct their activities under the auspices of this Agreement in accordance with state and federal non-discrimination laws. 891324 d. Both parties agree to comply with Title VI of the Civil Rights Act of 1986, and that no person shall on the grounds of race, creed, color, sex or national origin, be excluded from participation in or be otherwise subjected to discrimination under this agreement. e. It is agreed by both parties that any causes of action arising out of this agreement shall be venued in the courts of Weld County, Colorado, to the extent that those courts are reposed with subject matter jurisdiction. Both parties agree to submit themselbes to the personal jurisdiction of those courts. f. This agreement shall be contrued in accordance with the laws of the State of Colorado. g. This agreement constitutes the entire agreement between the parties and supercedes all prior written and oral agreements. Any changes, modifications, supplementation or amendments to this agreement must be reduced to writing and signed by the parties which are signatory hereto. h. Any waiver by either party of any term or provision in this contract at any one time shall not constitute a waiver of any other or all provisions. Any waiver of any part or provision of this agreement at any one time shall not constitute a waiver for all times. 4. FINANCIAL COMMITMENT a. The Health Department will not be responsible for providing support for the first resident provided for this program, however, the department agrees to attempt to provide 50% support for each resident placed with the department for the duration of their rotation. Amount: For the first resident, there will be no cost. County Citizens Affected: Clients and other citizens who will access the services of the Health Department. Program Summary: The residency program will provide a resident to Weld County Health Department on a rotating basis. WCHD will provide the resident a well-rounded practical experience in public health. Benefit to Health Department: This program will help strengthen the cooperation between WCHD and the University of Colorado Health Sciences Center.
