RE : APPROVAL OF USE BY SPECIAL REVIEW FOR A NATURAL GAS
PROCESSING SITE - SCHREIDER OPERATING COMPANY
WHEREAS , the Board of County Commissioners of Weld County,
Colorado , pursuant to Colorado statute and the Weld County Home
Rule Charter , is vested with the authority of administering the
affairs of Weld County, Colorado , and
WHEREAS , the Board of County Commissioners held a public
hearing on the 19th day of February, 1986 , at the hour of 2 : 00
p .m. in the Chambers of the Board for the purpose of hearing the
application of Schreider Operating Company, 1560 Broadway, Suite
775 , Denver , Colorado 80202 , for a Use by Special Review for a
natural gas processing site on the following described real
estate , to-wit :
Part of the SW% SW4f Section 11 , Township 7
North , Range 58 West of the 6th P .M. , Weld
County, Colorado
WHEREAS , Section 24 .4 . 2 of the Weld County Zoning Ordinance
provides standards for review of said Use by Special Review, and
WHEREAS , the Board of County Commissioners heard all of the
testimony and statements of those present , has studied the request
of the applicant and the recommendations of the Weld County
Planning Commission and all of the exhibits and evidence presented
in this matter and, having been fully informed, finds that this
request shall be approved for the following reasons :
1 . The submitted materials are in compliance with the
application requirements of Section 24 . 7 of the Weld
County Zoning Ordinance.
2 . It is the opinion of the Board of County Commissioners
that the applicant has shown compliance with Section
24 .4 .2 of the Weld County Zoning Ordinance as follows :
a. The proposal is consistent with the Comprehensive
Plan policies in that the use does not infringe on
the continued agricultural use in the vicinity or
County. The proposal does not appear to have any
adverse impacts on the agricultural interests of
the County or the environment.

b . The proposal is consistent with the intent of the
Agricultural Zone District and is provided for as a
Use by Special Review.
c. Cory Lambert , the mayor of New Raymer, has
indicated that this proposal is compatible with the
interest of the town and has to objections .
d. No overlay districts affect the site.
e. Use by Special Review Development Standards will
provide adequate protection of the health, safety
and welfare of the neighborhood and County.
NOW, THEREFORE , BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the application for a
Use by Special Review for a natural gas processing site on the
hereinabove described parcel of land be, and hereby is , granted
subject to the following conditions :
1 . The attached Development Standards for the Use by
Special Review permit be adopted and placed on the Use
by Special Review plat prior to recording the plat .
2 . The -Use by Special Review activity shall not occur nor
shall any additional building or electrical mermits be
issued on the property until the Use by Special Review
plat has been delivered to the Department of Planning
Services Office and the plat is ready to be recorded in
the office of the Weld County _Clerk and Recorder.
3 . itathin thirty days of final approval by the Board of
County Commissioners , the applicant shall obtain the
required emissions permit from the Air -Pollution Control
Division, Colorado -Department of Health. Evidence of
approval shall be delivered to the Department of
Planning Services .
4 . Prior to recording the Use by Special Review plat , the
facility shall be inspected by an independent fire
safety expert to determine whether there is compliance
with Article 2 , Section 2 .301 of the Uniform Fire Code .
Evidence showing compliance with the Uniform Fire Code
shall be delivered to the mayor of New Raymer and the
Department of Planning Services .

1 . The Use by Special Review permit is for a natural gas
processing site as submitted in the application materials on
file in the Department of Planning Services and subject to
the Development Standards stated herein.
2 . Within thirty days of approval by the Board of County
Commissioners , the applicant shall provide a list of the
maximum quantities of hazardous substances expected at the
site and emergency phone numbers and addresses of operators
to the State Health Department , Division of Waste Management;
the Weld County Emergency Response Coordinator; and the mayor
of New Raymer. Evidence of this listing and emergency phone
numbers and addresses shall be provided to the Department of
Planning Services prior to the issuance of building permits .
3 . On-site disposal of any wastes shall not be allowed.
4 . All construction done on the property shall be in accordance
with the requirements of the Weld County Building Code
Ordinance.
5 . The property owner or operator shall be responsible for
complying with the Design Standards of Section 24 .5 of the
Weld County Zoning Ordinance.
6 . The property owner or operator shall be responsible for
complying with the Operation Standards of Section 24 .6 of the
Weld County Zoning Ordinance.
7 . Personnel from the Weld County Health Department and Weld
County Department of Planning Services shall be granted
access onto the property at any reasonable time in order to
insure the activities carried out on the property comply with
the Development Standards stated herein and all applicable
Weld County Regulations .

8 . The Use by Special Review area shall be limited to the plans
shown herein and governed by the foregoing Standards and all
applicable Weld County Regulations . Any material deviations
from the plans or Standards as shown or stated shall require
the approval of an amendment of the Permit by the Weld County
Planning Commission and the Board of County Commissioners
before such changes from the plans or Standards are
permitte-d. Any other changes shall be filed in the office of
the Department of -Planning Services .
9 . The property owner or operator shall be responsible for
complying with all of th-e foregoing Standards . Noncompliance
with any of the foregoing Standards may be reason for
revocation of the Permit by the Board of County
Commissioners .

A public hearing was conducted on February 19, 1986, at 2:00 P.M. , with
the following present:
Commissioner Jacqueline Johnson, Chairman
Commissioner Gordon E. Lacy, Pro-Tem

Commissioner C.W. Kirby
Commissioner Frank Yamaguchi
Also present:

The following business was transacted:
I hereby certify that pursuant to a notice dated January 15, 1986, and
duly published January 23, 1986, in the Johnstown Breeze, a public
hearing was conducted to consider the request of Schreider Operating
Company for a Use by Special Review for a natural gas processing site.
Lee Morrison, Assistant County Attorney, made this matter of record.
Debbie de Besche, representative for the Planning Department, read the
Planning Commission's favorable recommendation into the record, with
said recommendation being subject to three Conditions and nine
Development Standards. David Forson, representing Schreider Operating
Company, came forward to answer questions of the Board. No public
comment was made concerning this application. Commissioner Brantner
expressed concerns about fire hazards which might exist at this site.
Mr. Forson said they had not added to the facility, but had placed
another generator there, and he does not feel that safety is a problem
at this site. Ms. de Besche suggested that another Condition be added.
She then read the proposed Condition into the record as follows: "Prior
to recording the Use by Special Review plat, the facility shall be
inspected by an independent fire safety expert to determine whether
there is compliance with Article 2, Section 2.301 of the Uniform Fire
Code. Evidence -showing compliance with the Uniform Fire Code shall be
delivered to the mayor of New Raymer and the Department of Planning
Services." Commissioner. Lacy moved to add Condition #4 as part of the
recommendation. The motion was seconded by Commissioner Kirby and
carried unanimously. Following discussion, Commissioner Lacy moved to
approve the request from Schreider Operating Company for a Use by
Special Review for a natural gas processing site, subject to four
Conditions and nine Development Standards. Seconded by Commissioner
Brantner, the motion carried unanimously.

REQUEST: Use by Special Review permit for a gas processing site
LEGAL DESCRIPTION: Part of the SW} SW} , Section 11, T7N, R58W of the 6th
P.M. , Weld County, Colorado.
LOCATION: Approximately 1.75 miles south of New Raymer, east of Weld County
Road 129 and south of Weld County Road 84.
APPEARANCE:
Dave Forson, Sr. , Consultant, Schreider Operating Company, represented the
applicant. Schreider Operating Company bought this gas processing plant
from another company, and while the plant has been in operation for over
four years, when they applied for a building permit to install new
compressors they were told that the property was improperly permitted to
begin with. The owner had applied for a subdivision exemption but had never
applied for the proper permits. The processing facility is not being
enlarged even though they are adding another compressor. These are electric
compressors and therefore, operation is relatively quiet. There are two
eighteen thousand gallon tanks on the property and these are emptied once or
twice a week.
The Chairman called for discussion from the audience. There was none.
The Chairman asked Mr. Forson if he had reviewed the recommendation,
conditions, and Development Standards as outlined by the Department of
Planning Services staff. He stated he had and has no objections to anything
as stated.
The Chairman asked that reading of the recommendations, conditions, and
Development Standards as outlined by the Department of Planning Services
staff be dispensed with and that they be filed with the summary as a
permanent record of these proceedings.
MOTION:
Paulette Weaver moved Development Standard #3 be amended to read ". . .and to
the mayor of New Raymer. Evidence of this listing and emergency phone
numbers and addresses shall be provided to the Department of Planning
Services prior to the issuance of building permits." Motion seconded by
Lydia Dunbar.

LOCATION: Less than one mile northwest of Keenesburg; north of Weld County
Road 18 and west of Weld County Road 57.
APPEARANCE:
Manual and Anita Balderas, property owners and applicants, stated they
purchased this property for a salvage yard. They live on the property and
they want the property to be clean and neat. The property was formerly used
as a junk yard, and a school bus and repair garage. The town of Keenesburg
had no objections to this request when they met with them.
Debbie deBesche reported this is a nonconforming use, but the information
contained in the nonconforming use file is inconclusive as to what is
allowed and how many acres of the property are involved.

3. On—site disposal of any wastes shall not be allowed.
4. All Construction done on the property shall be in accordance with
the requirements of the Weld County Building Code Ordinance.
5. The property owner or operator shall be responsible for complying
with the Design Standards of Section 24.5 of the Weld County
Zoning Ordinance.
6. The property owner or operator shall be responsible for complying
with the Operation Standards of Section 24.6 of the Weld County
Zoning Ordinance.
7. Personnel from the Weld County Health Department and Weld County
Department of Planning Services shall be granted access onto the
property at any reasonable time in order to insure the activities
carried out on the property comply with the Development Standards
stated hereon and all applicable Weld County Regulations.
8. The Use by Special Review area shall be limited to the plans shown
hereon and governed by the foregoing Standards and all applicable
Weld County Regulations. Any material deviations from the plans
or Standards as shown or stated shall require the approval of an
amendment of the Permit by the Weld County Planning Commission and
the Board of County Commissioners before such changes from the
plans or Standards are permitted. Any other changes shall be
filed in the office of the Department of Planning Services.
9. The property owner or operator shall be responsible for complying
with all of the foregoing Standards. Noncompliance with any of

Dear Sirs :
In December of 1981 , Piedmont Exploration Inc. , began the
installation of a Natural Gas Plant on property leased from Paul
Kugler. The term of the Lease Agreement (attached hereto as
Exhibit A between Piedmont Exploration Inc. and Paul Kugler is
fifteen (15) years .
Piedmont Exploration Inc. filed for relief under Chapter 11 of
the United States Bankruptcy Court , and after approval of the
Bankruptcy Court of Denver, Colorado, sold the New Raymer Plant
to Industrial Gas Services on April 28 , 1983 . Assignment of the
Lease Agreement from Piedmont Exploration Inc. to Industrial Gas
Services is attached as Exhibit B . Industrial Gas Services Inc. ,
sold the New Raymer Plant to Schreider Operating Company on June
1 , 1984 .
In preparation for the installation of a new compressor at the
New Rayner Plant , Schreider Operating Company filed for a
building permit on July 3 , 1985 . Upon making this filing,
Schreider Operating Company was informed that the Natural Gas
Plant , which has been in operation since January , 1981 , was
improperly permitted by Piedmont Exploration Inc. and that
Schreider Operating Company would new be required to file a
Special Use Permit Application.
Schreiner Operating Company protested the directive to file a
Special Use Application due to the costs and time involved for
preparing the permit application. The protest was rejected by
letter from Chuck Cunliffe on July 11 , 1985 .

airport overlay area nor any other restricted area of
Weld County.

terms of quanity, quality, and dependability (e . g . , a well permit or
letter from a water district) .

I ) A copy of the deed or legal instrument identifying the applicant(s )

such easements and rights-of-way upon and over the leased premises as

and from time to time all pipelines, stations, plants, tanks, structures,
machinery, equipment and appurtenances placed by it on the leased premises
where in Lessee's judgment such property is no longer needed or useful
for the operation of the leased premises for the purpose described herein.
Lessee shall have the right to remove any and all machinery, fixtures,
buildings, and personal property placed on the leased premises by Lessee
or by those acting under Lessee. .
6. CONTINUATION OF LEASE : Any sale, transfer,conveyance or
alienation by Lessor of the land and rights of Lessee described in this
leasehold shall be specifically subject to this lease agreement including
all options to renew and renewal periods.

Piedmont Exploration, Inc. (Piedmont) and New Rayner plant Partnership
(::RP) .
WHEREAS, for the benefit of NRP, Piedmont entered into a Lease
Agreement with Paul Kugler on December 17 , 11981, which Lease

WHEREAS, Piedmont has filed a petition for relief under Chapter it

WHEREAS. pursuant to a Settlement Agreement dated
1983, duly approved by the Bankruptcy Court for the District or Colorado,
entered into among Piedmont, Industrial Gas Services, Inc. (IGS) and
the IGS Drilling Program Ltd. 1981-1, being the parties of the NRP,
and T_ransmouncain Industries-, Inc. , Piedmont's parent corporation,
Piedmont surrendered and transferred alD .its r ghtt, titl title and

_ in the NRP to IGS and the IGS Drilling

to execute documents as may be necessary to effect such surrender and

WHEREAS, Piedmont, and NRP by and through IGS and the ICS Drilling

NOW THEREFORE, in consideration of the mutual covenants, represent-
ations and agreements , it is agreed as follows:
I. The above recitals are incorporated herein.
2. Piedmont hereby assigns, transfers, and sets over to NP➢,
all of its right, title and interest in and to the Lease Agreement.
3. NPR hereby agrees to assume all of the duties and obligations
under the Lease.
