Speckman, Executive Director, Human Resources 4- Purchase of Services Agreement Between Migrant Head Start and Subject: - -- Dr. Cheryl Johnson ---- Enclosed for Board approval is a Purchase of Services Agreement between Human Resources' Migrant Head Start Program and Dr. Cheryl Johnson. The Contractor will provide hearing screening for Migrant Head Start children. The Contractor will be reimbursed $3.00 per child for each hearing screening up to a maximum of $300.00 (100 screening x $3.00 per screening = $300.00) . The Contractor will provide hearing evaluations for Migrant Head Start children requiring this service. The Contractor will be reimbursed $20.00 per child for each hearing evaluation up to a maximum of $400.00 (20 evaluations x $20.00 per screening = $400.00) . 'tJeci 99noa PURCHASE OF SERVICES AGREEMENT THIS AGREEMENT, made and entered into this /7 day of July, 1989, by and between the Weld County Division of Human Resources ' Migrant Head Start Program, hereinafter referred to as "Migrant Head Start," and Dr. Cheryl Johnson, hereinafter referred to as "Contractor." WITNESSETH NOW THEREFORE, in consideration of the mutual covenants herein, the parties hereto agree as follows: 1 . The Contractor will provide hearing screening for Migrant Head Start children. The hearing screening includes determination of a) middle ear function utilizing tympanometry, and b) hearing sensitivity utilizing pure tone threshold screening or awareness and localizatior to calibrated noise makers. The Contractor will be reimbursed $3.00 per child for each hearing screening up to a maximum of $300.00 (100 screenings x $3.00 per screening = $300.00) . 2. The Contractor will provide hearing evaluations for Migrant Head Start children requiring this service. The hearing evaluation includes air and bone conduction thresholds, speech testing, and impedance measurements as appropriate. Hearing evaluations will be conducted for children who do not pass screening when the cause is not a common treatable medical etiology or a known hearing loss which has been appropriately habilitated. The Contractor will be reimbursed $20.00 per child for each hearing evaluation up to a maximum of $400.00 (.'0 evaluations x $20.00 per evaluation = $400.00) . 3. Hearing screening will be conducted at the Head Start building utilizing the School District 6 Hearing Van on July 10, 1989, and July 12, 1989 from 7:00 a.m. to 12:00 noon. 4. Hearing evaluations will be conducted at the University of Northern Colorado (UNC) Lab School . Head Start will provide the transportation of the Migrant Head Start children to UNC. 5. The Contractor understands and agrees that it is to pay all travel expenses associated with fulfilling its service obligation under this Agreement. 6. The total maximum amount to be reimbursed to the Contractor by Migrant Head Start under this Agreement is $700.00. 7. The term of this Agreement is from July 1, 1989 through July 31 , 1989. 8. The Migrant Head Start Program agrees to reimburse the Contractor within 14 days after the Contractor has submitted an invoice for payment. 9. This Agreement may be amended at any time with the written mutual consent of the parties hereto. 8806°'8 10. The Contractor and Migrant Head Start mutually agree to accept that this Agreement may be cancelled by either party after a thirty (30) day written notice has been provided to the other party. In the event funds are withdrawn from the Migrant Head Start Program by the Department of Health and Human Services, this Agreement may be cancelled immediately. 11. Assurances a. The Contractor agrees that it is an independent contractor and its officers, agents, or employees do not become an employee of Weld County, and therefore are not entitled to any employee benefits as Weld County employees , as the result of the execution of this Agreement. b. The Contractor shall provide adequate liability and workers' compensation for all its employees, volunteers, and agents engaged in the performance of this Agreement. Likewise, Migrant Head Start, by and through the Board of Weld County Commissioners , shall provide adequate liability and workers' compensation insurance for all its employees, volunteers , and agents engaged in the performance of this Agreement. c. No officer, member, or employee of Weld County, and no member o-` their governing bodies, shall have any pecuniary interest, direct or indirect, in the approved Agreement or the proceeds thereof. d. The Contractor understands that monitoring and evaluation of the performance of this Agreement shall be conducted by the Weld County Department of Human Resources and the results provided to the Board of Weld County Commissioners . e. The Contractor assures that it will comply with Title Vi of the Civil Rights Act of 1986 and that no person shall , on the grounds of race, creed, color, sex, or national origin, be excluded from participation in, be denied benefits of, or be otherwise subjected to discrimination under the approved Agreement.
