AND PEGGY WATKINS WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners, pursuant to its authority under Section 30-28-101 (10) (d) , CRS, as amended , did determine at a public meeting held in the Chambers of the Board , that a certain parcel of land , to be divided into two parcels , as shown on the plat known as Recorded Exemption No. 982 , does not come within the purview of the definition of the terms , "subdivision" and "subdivided land" , and WHEREAS, the request for Recorded Exemption No. 982 was submitted by James J. and Peggy Watkins for property which is located in part of the SE;, Section 36 , Township 2 North , Range 66 West of the 6th P.M. , Weld County, Colorado, being more particularly described in the plat which shall be provided by the applicants and known as Exhibit "A" , said plat to be recorded , and WHEREAS, this request is to divide the property into parcels estimated to be approximately 8 acres and 8 acres, and WHEREAS, the Board deems it appropriate to grant said request for a Recorded Exemption subject to the following conditions: 1) The applicant shall submit a mylar plat to the Department of Planning Services to be recorded in the office of the Weld County Clerk and Recorder. The plat shall be prepared in accordance with the requirements of Section 9-2 C. (4) of the Weld County Subdivision Regulations. The plat shall be submitted within 60 days from the date of approval. 2) A Weld County septic permit is required for the proposed home and its septic system shall be installed according to the Weld County Individual Sewage Disposal Regulations. 3) An ISDS Evaluation by the Weld County Health Department shall be necessary prior to issuing the required septic permit on the existing system. 870178 Page 2 RE: RE #982 - JAMES AND PEGGY WATKINS 4) The following note shall be placed on the Recorded Exemption plat prior to recording the plat : a) The Division of Water Resources will make one additional well permit available on the property. b) The well permit will be limited to in-house use only. Outside use for lawn and garden irrigation or livestock is prohibited . c) Prospective lot purchasers should be made aware of the limitations on water use. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the hereinabove described parcel of land be, and hereby is , exempt from the definition of the terms , "subdivision" and "subdivided land" . BE IT FURTHER RESOLVED by the Board that this approval is subject to the hereinabove mentioned conditions. The parcel of land on which this request is being made is described as part of the SEI of Section 36, T2N, R66W of the 6th P.M. , Weld County, Colorado. The property is located approximately 2.5 miles east of Fort Lupton, on Weld County Road 14. The parcel under consideration is the total contiguous land holdings of the applicant. The request is to divide the property into two parcels of 7.5 acres and 7.5 acres, more or less. There is an existing residence and other improvements on the east half of the parcel. The parcel of land is located in an urban growth boundary area. The Fort Lupton Planning Commission and the Weld County Health Department have reviewed the application materials and have no objections to the request. The Division of Water Resources has also reviewed the application and has recommended approval if certain conditions are complied with. The staff has concerns whether adequate water will be available for the potential uses of this property if the Division of Water Resources' conditions of approval are met. The Division of Water Resources' conditions are identified in its letter of February 25, 1987. The staff recommends that the Board of County Commissioners consider this request and determine if the standards of Section 9-2 E. Watkins are respectfully requesting through the Department of Planning and Board of County Commissioners that a recorded exemption be allowed to seperate approxmately seven and one half (7.5) acres more or less, from the approximately fifteen ( 15) acres that we now own. The purpose of this request is to seperate the fifteen ( 15) acre parcel into two (2) , seven and one half (7.5) acre parcels. The purposal is consistant with the policies and the zone district of the WeLd County Comprehensive Plan. The parcels are in an agriculture district and will remain in agriculture uses. There are homes on acreages located adjecent to this land. The size of the lots is consistant with developement of the surrounding land and will not interfere with developement as the property is large enough to fit into future developements. There is an existing well on the property at this time, permit no. 96128. This office will make one additional well permit available. Since a well permit will be available, we can recommend approval . The new well will be limited to in-house use only. Outside use for lawn and garden irrigation or livestock is prohibited. We ask that potential purchasers be made aware of this limitation and that it be reflected in plat notes and covenants. We also ask that this letter be made available to lot purchasers. With this and other proposals involving individual wells, we ask that well permit applicants submit a copy of our letter of approval with their application. This simplifies our review and will expedite processing of their permits.
