SEAL``` • rl►O WINS SWIM Notary Pub c My Commission expires: APPLICATION FOR SUBDIVISION EXEMPTION STATEMENT Western Gas Supply Company (WestGas) , a wholly owned subsidiary of Public Service Company of Colorado, is making this request for a Subdivision Exemption in conjunction with the Major Facilities of a Public Utility Use by Special Review application submitted to Weld County on February 2, 1987. WestGas is proposing to Construct the Yosemite Gas Quality Station in Weld County. This facility is designed to maintain the correct Btu value of the natural gas supplies delivered by WestGas to Public Service Company for their distribution in the Denver/Boulder service area. A "Lease and Option to Purchase" was secured from Arnold Grenemyer Sr. and Irene M. Grenemyer on the six and one-half acre site selected for construction of the proposed facility. A warranty deed will be secured from the Grenemyer's sometime in February, 1987. Upon obtaining the warranty deed and submitting for recordation, a copy will be supplied to the Weld County Department of Planning Services. This site is located at the intersection of Weld County Roads No. 4 and No. 19 in the Northwest One-Quarter of Section 34, Township 1 North, Range 67 West of the Sixth Principal Meridian. The proposed site is outside of any flood plain, and is not situated within any aquifer recharge area or "Flood Hazard Overlay District". The nearest flood plain is for the South Platte River and is located approximately two miles to the east. According to the "Weld County Thoroughfare Plan" , County Road No. 19 appears as an arterial road. This road has an existing sixty-foot wide right-of-way and will require an additional twenty-foot set back on either side for future right-of-way. This requirement has been taken into account and allowed for in the design of the Yosemite Station Plan. The Yosemite Station will not require any changes or improvements to the existing County Roads, resulting in no additional cost to the taxpayer. WestGas will be responsible for all required services, including: water, telephone, electric and installation of a septic system. Water consumption will be limited to drinking water and sanitary facilities located on the site. A septic system will be installed, due to lack of a sewer system in the area. A permit for this septic system will be obtained from the Weld County Health Department and all their requirements will be met. All state noise and air pollution requirements will also be met. The major benefit resulting from the approval of this request will be the establishment of the opportunity for WestGas to deliver lower cost natural gas from its northern system to its gas customers in the Denver/Boulder service area. Each party shall bear its customary closing costs. 3 . The purchase price for the option property to be purchased shall be calculated at $8500 per acre, said acreage to be determined by a survey obtained by the Lessee from an indepen- dent certified surveyor. Such price shall be increased by 3 .5% per year for such calendar year which has passed to the date of the exercise of the option, commencing in 1987 and counting the calendar year in which the option is exercised. 4 .
