RE: APPROVE INTER-GOVERNMENTAL AGREEMENT WITH CITY OF GREELEY AND
AUTHORIZE CHAIRMAN TO SIGN
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with an Inter-
Governmental Agreement between Weld County and the City of Greeley
regarding the Highway 85/"O" Street Intersection Improvement
Project, and
WHEREAS, after review, the Board deems it advisable to
approve said Inter-Governmental Agreement, with the terms and
conditions being as stated in said Agreement, a copy of which is
attached hereto and incorporated herein by reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that said Inter-
Governmental Agreement between Weld County and the City of Greeley
be, and hereby is, approved.
BE IT FURTHER RESOLVED by the Board that the Chairman be, and
hereby is, authorized to sign said Agreement.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 2nd day of
November, A.D. , 1988 .

COUNTY OF WELD, STATE OF COLORADO
INTER-GOVERNMENTAL AGREEMENT
THIS AGREEMENT, made and entered into this 30th day of
November , 1988, by and between the COUNTY OF WELD, State
of Colorado, hereinafter called "County" and the CITY OF GREELEY,
hereinafter called "City" .
WHEREAS, the Highway 85/"0" Street intersection is located
partially in County jurisdiction and partially in City of
Greeley, Colorado, jurisdiction, and
WHEREAS, the interchange is becoming an important link to
area development , and
WHEREAS , a study to determine preliminary construction
alternatives is necessary, and
WHEREAS, the City and the County and Colorado Department of
Highways jointly agreed to fund this consultant study, and
WHEREAS , a $ 45 , 000. total project cost was jointly
determined , and
WHEREAS , $30 , 000 was the estimated total local matching
funds needed for the project , anticipated to be provided equally
by the City and the County, and
WHEREAS, it is in the best interests of the citizens of the
City and County to study alternatives for interchange
modifications .
NOW, THEREFORE, in consideration of the mutual covenants and
conditions hereinafter set forth, the County and City mutually
agree as follows :
1 . The County will provide fifty percent of the local matching
funds not to exceed $15,000. This amount to be paid upon
receipt of an invoice from the City accompanied by the
consultant ' s Notice to Proceed.
2. The City shall be the lead agency and have jurisdiction over
the study upon execution of this agreement , allowing for
full authority in contractual arrangements during the
prosecution of the project.
3. The City shall be responsible for the administration of the
project.
4. The City will monitor the project and provide for progress
reports/meetings which will be open to County review.

5. The City agrees to indemnify the County from any and all
liability, loss or damage the County may suffer as a result
of claims, demands , casts, or judgments against it arising
out of this study.
IN WITNESS WHEREOF, the parties hereto have duly executed
the agreement the day and year first-above written.

Agreement between the City of Greeley and Weld County regarding
the Highway 85/"0" Street Intersection Improvement Project that
we discussed last week. Please review the Agreement , and, if you

If you find the proposed Agreement satisfactory, please obtain
the necessary signatures and return to me for execution .

Dear Drew:
Please find enclosed a copy of a letter from Assistant District
Engineer Doug Ramos regarding Project MP 03-0085-23, S.H. 85 at
"0" Street . Currently, the City has forwarded signed contracts
between the City and the State to the Colorado Division of
Highways for execution.
As suggested in the letter from Mr. Rames , I am requesting that a
copy of the standard contract agreement which could be used
between the County and the City be provided for this project.
If you have any questions regarding this matter, please do not

Dear Gary:
Attached are four copies of a proposed contract between-the Colorado
Department of Highways and the City of Greeley for Project MP 03-0085-23,
K S.H. 85 at "0" Street.
As I discussed with you on the phone several days ago, I feel that
a two-party agreement would simplify the process and the City should
execute a separate agreement with Weld County.
Please have your attorney review the contract. If it is acceptable,
please sign and return three copies. The fourth copy is for your file.
Please do not date the contract as that will be done by the Department.
