RE: APPROVE KERSEY TOWN BOARD MEMBER DON ADAMS ' APPLICATION FOR
HOUSING REHABILITATION GRANT
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, on October 22 , 1984 , the Board of County
Commissioners approved a Community Development Block Grant between
Weld County and the Department of Local Affairs, State of
Colorado, for rehabilitation of certain areas of Weld County,
Colorado, including the Town of Kersey, and
WHEREAS, Don Adams, member of Board of Trustees of Kersey, is
disclosing his application for an individual rehabilitation grant,
and
WHEREAS, Don Adams does not serve on any Board which has
authority over the control within the State or individual
rehabilitation grants.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the Board
acknowledges receipt of the disclosure of Kersey Town Board member
Don Adams ' application for an individual rehabilitation grant from
the Weld County Housing Authority.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 7th day of
October, A.D. , 1985.

Dear Mr. Weigardt:
I have reviewed the circumstances described in your request for
opinion dated September 16 , 1985 , and am of the opinion that the
application of Don Adams for a housing rehabilitation grant does
not violate State, Weld County, or Town of Kersey law.
In reviewing this matter, I have considered the rules and
regulations contained in the September 23 , 1983 , Federal Registry,
under Section 570. 611 ; the letter from Ramona Elizade to James
Sheehan, Weld County Housing Authority; have reviewed the contract
of July 16, 1984 , between the State of Colorado and the Weld
County Housing Authority; and the minutes of the Town of Kersey
Board of Trustees' meeting of January 24 , 1984 , and January 4 ,
1985 , and being advised that Mr. Adams became a member of the
Kersey Board of Trustees in April of 1984 , and made application
for a rehabilitation grant on May 8 , 1985 . I also conferred with
the Town Attorney for the Town of Kersey, Don Hoff, regarding any
legislation affecting Mr. Adams.
The information I have available indicates that the Board of
Trustees has not and has never been requested to take formal
action regarding the rehabilitation grants and that Mr. Adams was
not present on the two occasions information was presented to the
Board regarding a rehabilitation program. The Board of Trustees
of the Town of Kersey is not a party to the contract between the
County of Weld and State of Colorado. It does not exercise any
substantial discretionary function in connection with either the
contract or the individual grants or any other pecuniary
transaction. The only transaction is between the Weld County
Housing Authority and the individual grantee, and the only
connection with any agency of the Town of Kersey is that
applications go before the Planning Commission for review of their
application. However, appointments to the Planning Commission are
made by the Mayor under CRS, §31-23-203 , and it is my
understanding that Mr. Adams, as a member of the Board of
Trustees, does not make the appointments to the Planning
Commission at this time.
I would observe that the program regulations require "full public
disclosure" of a potential conflict of interest. I would suggest
that disclosure be made consistent with State law, CRS, §18-8-308 ,
as amended, which provides for disclosure to the Secretary of
State and to the Board of Trustees.
I would be most happy to respond to any further questions from you
or State officials regarding my opinion in this matter.

Dear Mr. David:
A conflict of interest question has arisen concerning an applicant for Weld
County's Community Development Block Grant (CDBG) program. This applicant
is an elected member of the Kersey Board of Trustees.
Since this board has not, and will not, exercise any functions or responsibil-
ities with respect to CDBG activities, we feel we can petition the State Division
of Housing and the Attorney General's Office to make an exception in this case.
As part of this process, the State requires an opinion from the grantee's (Weld
County's) attorney stating that the interest for which the exception is sought
will not violate State or local law.
Enclosed you will find a copy of Weld County's contract with the Colorado
Department of Local Affairs regarding CDBG activities. You will also find
CDBG rules and regulations regarding conflicts of interest and a short descrip-
tion of the applicant's responsibilities as a member of the Kersey Board of
Trustees.

The applicant, Mr. Don Adams, 211 Fifth Street, Kersey, Colorado, has
shown interest in pursuing a housing rehabilitation grant of up to $10,000.
He was elected to the Kersey Board of Trustees in April 1984. Along with
his decision making responsibilities on the board as a whole, he is a mem-
ber of the Finance Committee and Chairman of the Sewer Committee. Mr. Adams
says that he has never been asked to discussy;make recommendations, or vote
on any issue concerning CDBG activities. He has also stated that he waited
to apply during the latter part of the program to make sure that all who
wanted to apply had done so. **
The CDBG housing rehabilitation program is being administered soley by the
Weld County Housing Authority. Applicants within the Kersey city limits
are brought before the Kersey Planning Commission for approval on a case by
case basis. However, Mr. Adams is not a member of this committee.
**Don Adams preliminary application was received May 8, 1985. The first pre-
liminary application was received January 25, 1985.

Upon the recommendation of the Attorney General 's office, I haveNto make

1. The inclusion of the special conditions as stated in the award
letter. The two special conditions in their entirety were added
in the "Scope of Services".
2. Deletion of the words"`Town of Kersey and Town of Gill " from the
first page of the contract unless the towns are party to the

MINUTES OF TOWN OF KERSEY BOARD OF TRUSTEES SPECIAL MEETING HELD
JANUARY 23, 1984, 7: 30 P.M. , KERSEY MUNICIPAL BUILDING, 332 THIRD
STREET, KERSEY, COLORADO.
Mayor Max Fox called the meeting to order at 7: 39 p.m. Board of
Trustees members present and answering roll call were: Jim
Bruntz, Max Fox, Scott Valentine, and Virgil VanArsdol. Marvin
Wakeman was late . Absent: Dennie Fowler and Dave Gifford . Also
present were: Steve Westerdahl , Jim Sheehan, Elmer Blehm, and
Rolland Bashford .
Mayor Fox opened the public hearing to consider citizen comments
on the grant proposal . No citizens were present .
Jim Sheehan, Executive Director of the Weld County Housing Authority,
explained that they are basically asking the Town to go in with
Weld County to apply for a Community Development Block Grant .
Marvin Wakeman arrived .
Eligible activities for these grants are mainly housing projects,
public facilities, water and sewer projects. Housing projects
have proven to have a high priority. Some economic development
projects have also been funded . The projects funded must above
all benefit low and moderate income persons . The applications
once prepared go to the Department of Local Affairs to be ranked.
The Department of Local Affairs may delegate their review process
to various other agencies such as the Division of Housing.
This process takes about two months. The application deadline is
February 1, 1984 . The applications that are ranked medium and
high are then asked to give a presentation.
Last year, Gill received $288, 000 to rehabilitate 24 owner occupied
dwelling units bringing the units up to County Code, Section 8 Code
and Housing Rehabilitation Standards . They are suggesting that we
apply for funds to rehabilitate 25 dwelling units in Kersey at a
cost of up to $10, 000 each.
Steve Westerdahl said he has been doing this type of work for about
8 years and has also worked with the Urbal Renewal Authority. The
first thing we will do is to make the availability of the dollars
known to the members of the community. In Kersey, we will post
notices at various locations throughout town. The people interested
will then fill out applications . The applicants must own and live
in the property and must meet certain income requirements. If they
meet the requirements, Steve will make a preliminary inspection of
the property. At this point , he will take into account the condition
of the home and the income and characteristics of the inhabitants.
The Town Building Inspector will also make an inspection and Steve
will write up a work description for the property, which will be
sent to general contractors for bids . The low bid will receive
the project . The work must meet code and permits must be
purchased for the building. Steve will make payment to the
contractor based upon satisfactory completion of the work.
The contractors are required to be licensed and to provide
lien waivers. The purpose of the program is to bring these
homes to code so that they are safe and sanitary.
The contractors must also provide proof of liability and workmen' s
compensation insurance, a line of credit with a bank, and letters
of reference from a local building inspector or people for whom
they have done work.

Steve said he did a "windshield survey" of Kersey and thinks that
approximately 33% may be considered substandard homes. None are
dilapidated . If the $10,000 allotted to the home is not enough
for the work required to bring the house to code, the owner may
apply for a low interest loan through FmHA . Mobile homes may
also qualify for this program if the mobile home and the ground
it is placed on are owned by the occupant of the home .
Virgil VanArsdol moved to authorize the Weld County Housing
Authority to apply for the CDBG on behalf of the Town of Kersey.
Marvin Wakeman seconded the motion. All ayes were recorded .
Motion passed .
Steve said he will need some office space in Kersey if possible.
They can also show this space as in-kind contribution on the
grant application. Virgil VanArsdol suggested the back room at
the Senior Center. Steve will check on this.
Virgil VanArsdol moved to adjourn. Marvin Wakeman seconded the
motion. All ayes were recorded. Motion passed . The meeting
adjourned at 8: 51 p.m.

Mayor Delbert Glover called the meeting to order at 7: 39 p.m. Board
of Trustees members present and answering roll call were: Dave Gifford ,
Delbert Glover, Larry Homan, Dennis Loose, Jean Sheets, and Virgil Van-

Dave Gifford moved to approve the minutes of the December 4 , 1984 regular
Board of Trustees meeting. Jean Sheets seconded the motion . All ayes
were recorded . Motion passed .

Police Pension Fund Supplemental Appropriation for 1985

Western Technical Services contract for 1985
Virgil VanArsdol moved to renew the contract for Western Technical
Services for 1985 . Jean Sheets seconded the motion. All ayes were
recorded . Motion passed . The Town will retain Western Technical Ser-
vices for the fee of $100 .00 per- month and will receive three (3) hours
of_engineering time per month .
Mayor Glover opened the public meeting on the Community Development
Housing Rehabilitation Program.

Jim Sheehan explained that the Community Development Block Grant Program
has been around actively since 1975 and came about as a result of the
housing Community Development Act of 1974 . The activities of the Progran
are very broad and the intent is to try and address some of
theivee com unit
development needs of the small cities . It is a highly
to be approved for a grant . Jim stated that the grant for Kersey was
actually approved in July, 1984 and that they had expected the program
here to start sooner, but due to a staff change which prompted them to
hire a new Housing Rehabilitation Specialist , Paul Halloran. The term of
the grant will be from now to March 31 . They will be finished with Gill
this month. They are looking at approximately 22 homes to rehabilitate
and the funds committed for these homes are $226 , 000 . The Housing Rehabi
itation Program is a grant program, which means that the ally time pay-
back would be requested would be if the property is sold within a five
year period to someone other than the immediate family . If the home is
sold within the five years, the amount of the grant is prorated .

the work will be put out to bid . Jim encourages local contractors to
bid on this work . All work will have to meet the existing Housing Qualil
Standards of HUD, the county building code and the minumum Housing Rehabi
itation codes . The priority of the program will be to look at anything
that effects the health and safety of the home .
Paul Halloran talked about the application process. There are three
criteria that will be reviewed: 1) You must be a homeowner and reside
in the home , 2) You have to qualify based on income guidelines establisl.

the condition of the house . Each home is eligible for a $10 , 000 grant ,
part of which will go for salaries , contractors , and materials . Paul is
arranging for office hours at the Fort Latham Manor and will be there

three days per week from 9: 00 a .m. to 12: 00 noon, on Monday , Wednesday ,
and F-iday . After the annlication is completed , the information will he
verified and then an inspection of the home will be done by the building
inspector. A work write up will be done, which lists the items to be dor
Then the Planning Commission will review and rank the applications. This
process will be confidential and the Planning Commission will only be giv
the applicants' income , family size, condition of the house, and assests .
The Planning Commission will be given guidelines to approve and deny an
application, and points are assigned for each category. The write up wil
be given to contractors for bids, and then the work can begin in a couple
of weeks. Paul said that applications will be taken through February .
Ben Slater arrived
Paul had a question-answer period with the citizens. This project will
only be for property within the town limits. Income guidelines are:
Moderate income limit for single household, $10, 469; 2-person, $11, 964;
4-person, $14,956.

Kersey Meat ,Processing
Ben Slater and the board members discussed the Kersey Meat Processing
Company and the new agreement of October 15, 1984. Ben stated that we
are getting an extreme shock load at the sewer plant. Kersey Meat ' s kill
included about the same number of cattle for October and November, but
they used about 1/3 less water in November. Ben stated that the Town may
want to consider charging Kersey Meat by the live kill weight per month,
which would save time and expense for Stan and the Town. There is a
formula used to determine BOD per animal . Board members discussed.
Don Adams arrived
Board members discussed further, and Dave Gifford moved to authorize the
Clerk to enforce the October 15, 1984 agreement with Kersey Meat Processir
Company . Jean Sheets seconded the motion . All ayes were recorded . Motic
passed .
Health insurance
Chief Hause had prepared a spread sheet for board members to review.
Gary Skidmore and Terry Hause will be the only employees to change health
insurance. Cliff Dilka will stay with Blue Cross-Blue Shield, and the
Clerk is insured through her spouse' s insurance . Chief Hause stated that
he and Gary would like to change to American Family for health insurance .
Virgil VanArsdol moved to change to American Family Insurance for Terry
Hause and Gary Skidmore effective February 1, 1985. Dave Gifford secondec
the motion. All ayes were recorded . Motion passed .
Dave Gifford moved to authorize the Clerk to change companies for life an(
disability effective February 1, . 1985 for all full-time employees. Jean
Sheets seconded the motion. All ayes were recorded. Motion passed .
Board members discussed providing health insurance for part-time employee:
The Clerk will check to see what the savings will be in 1985 due to
changing insurance companies. This will be discussed at the next meeting
Bids received for sprinkler pipe
One bid was received, from Mulberry Acres for $250 .00 . Jean Sheets moved
to table this for the next meeting. Larry Homan seconded the motion . Al'
ayes were recorded. Motion passed .
Cliff Dilka ' s vacation
Cliff stated that he would like to take the rest of his vacation this
month, which will be four days vacation and one day compensation time .
He would like to take the days sometime after the 14th of this month .

Consider purchasing a personal computer for 1985
Board members discussed the possibility of purchasinga computer instead
of a typewriter for 1985 . Don Adams will head a committee to study what
type of computer and software would be needed. Delbert Glover, Larry Hon.
and Dave Gifford will also serve on the committee.
New desk for the Deputy Town Clerk
Don Adams stated that he saw a used desk at Mountain States Office Supply
for $150.00. Dave Gifford moved to purchase the desk for $150 .00 at
Mountain States. Jean Sheets seoonded the motion. All ayes were records

Police Commission recommendations
Chief Hause requested approval for $1, 000 in capital outlay that was
budgeted for 1985. He would like to purchase a shotgun, flashlights,
ballistics vests, and a camera . Don Adams moved to approve these pur-
chases. Dennis Loose seconded the motion . All ayes were recorded . Moti
passed .
Chief Hause would also like to purchase $362.00 in supplies, $305.00 for
uniforms, and $193.00 for badges. Don Adams moved to approve these
purchases. Dave Gifford seconded the motion. All ayes were recorded .
Motion passed .
Mayor Glover stated that the Police Commission recommends that Gary
Skidmore be given the title of Assistant Police Chief. Chief Hause state
that Gary deserves recognition for the years he has given the Town and
that Gary also shares in the administrative duties of the department .
This will make him eligible for membership in the International Associate
of Chiefs of Police and the Colorado Chiefs of Police . Continuing educa-
tion opportunities may also be available for Gary. Don Adams moved to
approve the Police Commission' s recommendation to make Gary Skidmore
Assistant Police Chief . Dave Gifford seconded the motion. All ayes were
recorded , Motion passed .
Correspondence and Appropriate Action
Mayor Glover stated that we received a letter from Colorado Intergovern-
mental Risk Sharing Agency notifying us that there is not sufficient
premium committed to institute a workers' compensation pool for 1985.
Mayor Glover explained that he and Don Adams reviewed the CIRSA pool and
had notified them we would participate.
Received information on Private Activity Bonds (P.A .B.)
Received a survey from CML to see which of our municipal officials have
some acquaintance with state and federal officials..
Received information from the Fire and Police Pension Association about
a public hearing on rule making.
Received a water report on Expansion of Water Delivery by Municipalities
and Special Water Districts in the Northern Front Range, Colorado.
Jean Sheets moved to correct the minutes of the November 6 , 1984 meeting
to read that Ella Mae Cox' s 1985 salary will be $363 , 30 per month. Dave
Gifford seconded the motion. All ayes were recorded . Motion passed .
Board members discussed paid holidays for part-time employees. Larry
Homan suggested that the number of hours paid to the employee be based
on the bracket system of 0-10 hours worker per week, 2 hours are paid
for the holiday; 10-20 , 4 hours paid , 20-30, 6 hours. Larry Homan moved
to use this system for paying part-time employees for holidays. Dennis
Loose seconded the motion. All ayes were recorded . Motion passed .

An executive session was called.
The meeting resumed and no action was taken.
Board members discussed snow on the sidewalks. The Police Department
will start issuing summonses for not removing snow on the sidewalks.
Board members discussed the dog and cat problem in town and discussed
the possibility of housing our own stray dogs. No action taken .
Cliff stated that he needed some hose for the pump at the sewer plant .

A discussiaiwas held on the delinquent water bills. This will be on the
agenda for the next meeting, and the Clerk will check the ordinance for
the policy on delinquent accounts.
The Clerk read the bills. Dave Gifford moved to pay the bills. Jean
Sheets seconded the motion. All ayes were recorded. Motion passed.
Mayor Glover adjourned the meeting at 11:02 p.m.
