Home My WebLink About891300.tiff RESOLUTION RE: ACCEPT KIOWA DRIVE IN ARROWHEAD SUBDIVISION FOR FULL MAINTENANCE WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board did, by Resolution dated November 19, 1986 , accept Kiowa Drive in Arrowhead Subdivision for partial maintenance, and WHEREAS, the Weld County Engineer has certified that repair work done to Kiowa Drive meets the County standards for the purpose of acceptance for full maintenance. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that Kiowa Drive, located in Arrowhead Subdivision, 4th Filing, all of which is located in the Northwest Quarter of Section 27, Township 5 North, Range 66 West of the 6th P.M. , Weld County, Colorado, be, and hereby is, accepted for full maintenance as a public road by the County of Weld from Weld County Road 54 across Cheyenne Drive continuing east on Kiowa Drive to the ending of the cul-de-sac. The above and foregoing Resolution was, on motion duly made and seconded, adopted by the following vote on the 13th day of December, A.D. , 1989 . The failed areas were marked, then saw cutting of the asphalt and removal was done. Next, the failed "clay" base was removed and replaced with 12" of A.B.C. Class 6 base, and recompacted. The saw cut edges were tacked before paving. Then 2 1/2" of Grading EX asphalt was machine patched back in. I was present during repairs and find no conflict with the remainder of the project. The Weld County Engineering Department has certified that said repair to Kiowa Drive meets County standards for the purpose of acceptance for full maintenance. At that time, and in accordance with the policy regarding collateral for improvements , the Board of County Commissioners accepted Kiowa Drive for partial maintenance . Partial maintenance is defined in the Resolution of acceptance as including snow removal but excluding any repairs to the street, including the roadway, shoulders, or drainage ditches . Inspections subsequent to acceptance for partial maintenance has revealed that the street did not survive its one-year warranty period in a condition which would allow the County to accept the street for full maintenance. There has been cracking and settling of the pavement, and these deficiencies need to be corrected in conformance with the4replat of the Fourth Filing approved December 11 , 1985 , Weld County policy on collateral for subdivision improvements, and the agreement of July 9 , 1980 , which is reconfirmed by agreement of November 26 , 1985 . Attached is a sketch with locations and dimensions cf the failed areas as well as a dig out repair cross section. I would request that you or your client advise myself or Don Carroll of the Weld County Engineering Department, 356-4000, Ext. 4750 , 933 N. 11th Avenue, P. O. Box 758 , Greeley, CO 80632 , of the time table for repairs to the Kiowa Drive within the next fifteen (15) days . At that time you questioned whether your client had had an opportunity to be advised of the problems with Kiowa Drive prior to my letter to you. I am enclosing copies of letters dated July 7 , 1988 , and October 20 , 1987 , to Mr. Lundvall regarding problems with Kiowa Drive. I have also included a copy of the resolution of acceptance for partial maintenance and a notice letter from you of November 11 , 1986 , indicating that the road had been completed. During our telephone conversation we also agreed that the time for submitting a plan for repair should be extended to September 6 , 1988 , given Mr. Lundvall ' s current absence from the state and this is to confirm that agreement. Because of these deficiencies, it will be impossible to accept Kiowa Drive for full maintenance until repairs are implemented.
