WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS , a public hearing was held on the 23rd day of
September, 1987 , at 2 :00 p.m. for the purpose of hearing the
application of Robert Comer, d/b/a Plastic Art Products, 1226 East
18th Street, Greeley, Colorado 80631 , requesting a Change of Zone
from C-3 (Commercial) and R-1 (Low Density Residential) to I-2
(Industrial) Zone District for a parcel of land located on the
following described real estate, to--wit:

1 . It is the opinion of the Board of County Commissioners that
the applicant has failed to demonstrate that this request
complies with the criteria of Section 28 .4 . 1 . 2 et. seq. , of
the Weld County Zoning Ordinance which read as follows:
a. That the request for a Change of Zone is consistent with
the Weld County Comprehensive Plan.
b. That the uses which would be allowed on the subject
property by granting the Change of Zone will be
compatible with the existing or future development of
the surrounding neighborhood as permitted by the

A public hearing was conducted on September 23, 1987, at 2:00 P.M. ,
with the following present:

The following business was transacted:
I hereby certify that pursuant to a notice dated August 17, 1987, and
duly published August 20, 1987, in the Johnstown Breeze, a public
hearing was conducted to consider a request from Robert Comer, dba
Plastic Art Products, for a Change of Zone from C-3 (Commercial) and
R-1 (Low Density Residential) to I-2 (Industrial) Zone District. This

Rod Allison, of the Planning Department, requested that the favorable
recommendation of the Planning Commission be incorporated into the
record of this hearing. Randy Howe came forward to represent the
applicant and answer questions of the Board. William Bohlender,
attorney for Jerre Largent, came forward to speak in opposition to this
request. Mr. Bohlender stated that Ms. Largent is concerned about the
noise and the affect of the zoning on the value of her property, also
the fact that this area is a residential neighborhood. (Let the record
reflect that Commissioner Yamaguchi was present to hear Mr. Bohlender's
testimony.) During his presentation, Mr. Bohlender submitted Exhibits
F and G. Commissioner Johnson questioned the difference between the
uses allowed on Commercial and Industrial zoned property and Mr.
Allison responded. Mr. Howe addressed the concerns of Ms. Largent.
Commissioner Kirby moved to deny the Change of Zone from Commercial-3
and R-1, Low Density Residential, to 1-2, Industrial, stating his
reasons. Commissioner Brantner seconded the motion. On a roll call
vote, the motion carried with Commissioner Johnson casting the
dissenting vote.
This Certification was approved on the 28th day of September, 1987.

Zoning Ordinance, a public hearing will be held in the Chambers of the Board
of County Commissioners of Weld County, Colorado, Weld County Centennial
Center, 915 10th Street, First Floor, Greeley, Colorado, at the time
specified. All persons in any manner interested in the following proposed
Change of Zone are requested to attend and may be heard.

The Chairman called for discussion from the members of the audience. There
was none.
The Chairman asked Mr. Comer if he had reviewed the recommendations and
conditions as outlined by the Department of Planning Services. He stated he
had no problem with these except for the setback requirements.
Brian Bingle explained the setback requirements did not pertain to existing
structures. These setbacks would pertain only to future permits.
The Chairman asked Mr. Comer if he had any objections to filing the
recommendations and conditions with the Summary of the Planning Commission
meeting in lieu of reading them into the record? Hr. Comer stated he had no

objections.

be recommended favorably to the Board of County Commissioners for the
following reasons:
1. The submitted materials are in compliance with application
requirements of Section 21 .7 of the Weld County Zoning Ordinance.
2. It is the opinion of the Weld County Planning Commission that the
applicant has shown compliance with Section 21 .5 of the Weld
County Zoning Ordinance as follows:
The request is consistent with the Weld County
Comprehensive Plan as outlined in the Urban Growth
Boundary Goals Section. Urban Growth Boundary Goal 1
recommends urban development should be concentrated in
or adjacent to existing municipalities. The proposed
site is located approximately 2,600 feet east and 1,300
feet north of the incorporated boundaries of the City of
Greeley.
— Urban Growth Boundary Goal 2 states regulations in the
urban growth boundary area should be maintained to allow
the County and municipality to coordinate matters
affecting the orderly development within the urban
growth boundary areas. The Greeley Planning Commission
on July 14, 1987, recommended no objections to the
request for the rezoning application. The Greeley
Planning Staff suggested at this hearing that the area
is changing to such a degree that redevelopment is
warranted, especially when it is in conformance with
Greeley's Comprehensive Plan policies. The site was

originally approved as an industrial use in a commercial
zone by Special Review Permit #755:86:35. The
applicants are requesting an expansion that would be
more suitable to industrial zoning.
- The use allowed on the subject property by granting the
change of zone will be compatible with the surrounding
properties.
- The property under consideration is adequately served by
a well and a City of Greeley water tap. The property is
adequately served by a septic system.
- The street and highway facilities providing access to
the property are adequate in size to meet the
requirements of the proposed zone district. The
existing site is served by one access off of U.S.
Highway 34, and three accesses off of Cherry Avenue.
- The proposed change of zone is not located within a
Geologic or Flood Hazard overlay district, but is
located within the Airport Overlay District. All
structures would need to comply with the Airport Zone
Height Limitations. The height is established at 150'
above the airport elevation or at a height of 4,808 feet
above mean sea level.
The soil conditions on the proposed site will not cause
moderate or severe limitations to the construction of
structures or facilities proposed for the site.
This recommendation is based, in part upon a review of the application
submitted by the applicant, other relevant information regarding the request
and the responses of the referral entities which have reviewed this request.
The Planning Commission's recommendation for approval is conditional upon
the following:
1. No building or electrical permits shall be issued on the property
until the change of zone plat has been delivered to the Department
of Planning Services' office and the plat is ready to be recorded
in the office of the Weld County Clerk and Recorder.

THE DEPARTMENT OF PLANNING SERVICES' STAFF RECOMMENDS THAT THIS REQUEST BE
APPROVED FOR THE FOLLOWING REASONS:
1 . The submitted materials are in compliance with application
requirements of Section 21 .7 of the Weld County Zoning Ordinance.
2. It is the opinion of the Department of Planning Services staff
that the applicant has shown compliance with Section 21 .5 of the
Weld County Zoning Ordinance as follows:
The request is consistent with the Weld County
Comprehensive Plan as outlined in the Urban Growth
Boundary Goals Section. Urban Growth Boundary Goal 1
recommends urban development should be concentrated in
or adjacent to existing municipalities. The proposed
site is located approximately 2,600 feet east and 1,300
feet north of the incorporated boundaries of the City of
Greeley.
— Urban Growth Boundary Goal 2 states regulations in the
urban growth boundary area should be maintained to allow
the County and municipality to coordinate matters
affecting the orderly development within the urban
growth boundary areas. The Greeley Planning Commission
on July 14, 1987, recommended no objections to the
request for the rezoning application. The Greeley
Planning Staff suggested at this hearing that the area
is changing to such a degree that redevelopment is
warranted, especially when it is in conformance with
Greeley's Comprehensive Plan policies. The site was
originally approved as an industrial use in a commercial
zone by Special Review Permit !1755:86:35. The
applicants are requesting an expansion that would be
more suitable to industrial zoning.

- The use allowed on the subject property by granting the
change of zone will be compatible with the surrounding
properties.
- The property under consideration is adequately served by
a well and a City of Greeley water tap. The property is
adequately served by a septic system.
- The street and highway facilities providing access to
the property are adequate in size to meet the
requirements of the proposed zone district . The
existing site is served by one access off of U.S.
Highway 34, and three accesses off of Cherry Avenue.
— The proposed change of zone is not located within a
Geologic or Flood Hazard overlay district, but is
located within the Airport Overlay District. All
structures would need to comply with the Airport Zone
Height Limitations. The height is established at 150'
above the airport evaluation or at a height of 4,808
feet above mean sea level.
- The soil conditions on the proposed site will not cause
moderate or severe limitations to the construction of
structures or facilities proposed for the site.
This recommendation is based, in part upon a review of the application
submitted by the applicant, other relevant information regarding the request
and the responses of the referral entities which have reviewed this request.
The Department of Planning Services' staff recommendation for approval is
conditional upon the following:
1 . No building or electrical permits shall be issued on the property
until the change of zone plat has been delivered to the Department
of Planning Services' office and the plat is ready to be recorded
in the office of the Weld County Clerk and Recorder.

Dear Mr. Bingle:
We have reviewed the application from Robert Comer for a Change
of Zone from C-3 and R-1 to I-2, and we have the following comments:
1. The 20-foot right of way reservation along the south side of State
Highway 34 is consistent with our recommended 100-foot total right
of way, 50 feet each side of the highway centerline. We would
prefer that the additional 20 feet be dedicated if this can be
required by county regulations. If dedication is not required, we
ask that the rezoning exclude the 20-foot reservation so that the
cost of future right of way acquisition will not be increased due
to the higher zoning category.
2. The purpose of this rezoning stated in the letter of application is
to provide space for manufacturing and warehousing operations
associated with the existing facilities. We understand that any
future development on the rezoned area would require a site plan
review. Please refer any such future plans to this office for
comments on access and other highway related issues.

PLANNING COMMISSION HEARING DATE: July 14, 1987
PLANNING COMMISSION FUNCTION:
To recommend to the Weld County Planning Commission on development referral conformance
with the Greeley Comprehensive Plan
PROJECT OVERVIEW:
1. The site is 6.84 acres zoned C-3 over the eastern 5/6's and R-1 on the westernmost 1/6 of
the site. An existing manufacturing concern is on the eastern 1/3 of the site. Its two build-
ings contain manufacturing, warehousing, and office support for a plastics product produc-
tion company, Plastic Art Products. There is also a house on the R-1 zoned area.
2. The applicant is applying for a change of zone to unify the site under one consistent zone
classification as well as to have zoning that will give the greatest flexibility, for future devel-
opment over the full 6.84 acres.
3. Surrounding land uses include:
North: Linn Grove Cemetery
South: Agricultural and residential
East: Mixed residential and commercial
West: Mixed residential/commercial and agricultural
4. In September, 1986, the applicant had applied for and received a County USR to permit
completely enclosed industrial uses in a C-3 (Commercial) district. The Greeley Planning
Commission's referral recommendation had suggested approval but also noted that impact on
U.S. 34, effect on public services, and compatibility with surrounding land uses were con-
cerns that should be addressed in site development.
PLANNING REVIEW COMMENTS:
1. The city's rezoning standards suggest one of three criteria be present in order to consider a
rezoning:
-- the existing zoning was established in error and, as such, is incompatible with the goals of
the Comprehensive Plan;
-- the area is changing or has changed to such a degree that it is in the public interest to
encourage redevelopment; or
-- the rezoning is necessary in order to provide for a community-related land use not antici-
pated for in the Comprehensive Plan.
2. Applicable Comprehensive Plan policies suggest four things:
a. (B-3.1, 8-3.2 Location service policies). This site is appropriately located in regard to
policy discussions on the desirability of matching land uses with the city's expected
service plans.
b. (A-3.I, A-312, A-4.1, A-4.3--Industrial use policies). This site is appropriately located in
regard to expressway access and major thoroughfare industrial land use location and mix.
The policies also point out the need to minimize conflicts and promote compatibility.
Expansion of this use would need to address cumulative intensity of use.
c. (A-4.3, B-4.1.1--Roadways). The location of this use at the intersection of a designated
expressway (U.S. 34) and arterial (Cherry Avenue) means adequate right-of-way should be
dedicated, and access should be limited with access in the safest location. This may
mean no expressway access. The State Highway Department should be involved in dis-
cussions.
3. The Planning staff suggests this area is changing to such a degree that redevelopment is
warranted, especially when it is in conformance with Comprehensive Plan policies. This site,
originally approved as an industrial USR in a commercial zone is now requesting an expan-
sion that would be more suitable to industrial zoning.
4. The area zoned industrial to the northwest of this site has had many development requests
including residential multi—family and commercial uses. These uses have generally been
incompatible with the industrial zoning. This suggests that there is a need for zoning compat-
ible with the mix of uses in this area. This includes zoning for this manufacturing use.
5. The off—site impacts associated with this use are controlled by factors unique to this site and
use:
a. The 20' of right-of-way being dedicated along U.S. 34 (arterial) and the 50' setback from
that new right—of—way line provide a setback to buffer intensity of site use.
b. The largely inside manufacturing will limit noise, although air compressors and other
machinery may contribute to noise problems. The applicant should be aware that state
and city standards are set at 55 dBA for residential areas and that this use would have to
comply with those standards at the property line.

c. The existing tree line provides for a visual and, to a lesser extent, noise screen and should
be retained and maintained.
d. Industrial traffic should only be permitted onto Cherry Avenue to avoid impacts to U.S.
34 and to residential uses.
6. The expansion of this industrial use conforms to Comprehensive Plan policies, and the area
is changing to warrant redevelopment. Any additional industrial development in the area
should, however, be designed so as to enhance the visual appeal of the area. The County
requires 15% of an industrial site to be landscaped. Additionally, the County requires all
outside storage and parking for vehicles over 6,000 gross pounds to be screened from adjoin-
ing rights-of-way and non-industrial zoning districts. This screening, if adequately enforced,
should insure that this development is compatible with adjoining rights-of-way.
ADMINISTRATIVE REVIEW TEAM COMMENTS:
1. The Fire Department noted there is inadequate water service to provide fire protection in this
area. This is a concern for both present and future industrial development in this area.
2. The State Highway Department noted that right-of-way should be dedicated. Also, they
would like to review future site plans for access permit approval.
3. The Public Works Department, Traffic Division, noted right-of-way on U.S. 34 and Cherry
Avenue should be dedicated. They would like to see a copy of the dedication plat.
NEIGHBORHOOD MEETING REQUIREMENTS: N/A

Staff recommends Planning Commission recommend no objections to a zone change to I-2.

property is to provide space for both manufacturing and warehouse operations

On our west property, we are planning on building a 30' x 70' pole barn
south of the current building. The rest of the west property will be used
for our future expansion. However, no other expansion is planned in the
foreseeable future.

2. It is our belief that this proposal is not only consistent with the Weld County
comprehensive plan but would provide an example of success that started several
years ago. The proposals consistancy lies in the goal for job opportunities,
land value improvement, diversification of the economy as well as may others.
In developing commerical areas consistent with providing existing industry and
growth of the future for surrounding municipality.
3. This rezoning will be compatible with the surrounding land uses. There is one
residence adjoining the property. The other land uses are as follows:

b) Cemetery
c) Horse Pens
d) Agriculture Usage
e) Residence
4. To provide adequate water for employees and other requirements we will be using
two sources. For consumption and interior use we will draw from city water
lines described as adequate for current and potential needs by attached document.
5. The soil survey shows a suitability of soils to support all uses allowed in
the proposed zone. See attached document.
6. The road and/or highway facilities providing access to the properties are more
than adequate to meet the requirements of the proposed zone district.
7. No record was found in the information available to Weld County showing a
sand, gravel, or other mineral resource under the subject property.
8. The proposed change of zone area complies with section fifty (50) , overlay
district regulations, as outlined in the Weld County Zoning Ordinance.
9. For a copy of the deeds indicating the applicant's interest in the property
under consideration. See attached documents.
10. We have included a certified list of names, addressess, and corresponding
