RESOLUTION RE: APPROVE AMENDMENT TO A SPECIAL REVIEW PERMIT FOR AN EGG PROCESSING, SHIPPING, AND PRODUCTION FACILITY WITH A MAXIMUM CAPACITY OF 1 ,750 ,000 CHICKENS - MILTON G. WALDBAUM COMPANY OF COLORADO WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners held a public hearing on the 30th day of December, 1987 , at the hour of 2 :00 p.m. in the Chambers of the Board for the purpose of hearing the application of Milton G. Waldbaum Company of Colorado, 6339 Weld County Road 47 , Hudson, Colorado 80642 , to amend a Special Review permit for an egg processing, shipping, and production facility with a maximum capacity of 1 ,750 ,000 chickens on the following described real estate, to-wit: Part of the E} , Section 35 , Township 2 North, Range 65 West of the 6th P.M. , Weld County, Colorado WHEREAS, said applicant was represented by Frederick Graves , and WHEREAS, Section 24 .4 . 2 of the Weld County Zoning Ordinance provides standards for review of said Special Review permit, and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, has studied the request of the applicant and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter and, having been fully informed, finds that this request shall be approved for the following reasons: 1 . The submitted materials are in compliance with the application requirements of Section 24 . 7 of the Weld County Zoning Ordinance. 880010 Page 2 RE: AMEND USR - MILTON G. WALDBAUM COMPANY OF COLORADO 2 . It is the opinion of the Board of County Commissioners that the applicant has shown compliance with Section 24 .4 .2 of the Weld County Zoning Ordinance as follows: a. This proposal is consistent with the Weld County Comprehensive Plan' s Urban Growth Boundary area goals and policies. The proposal is not considered an urban type development and the Town of Hudson, in its letter dated October 29 , 1987, indicated they would welcome the proposal provided their concerns are mitigated. These concerns are addressed in the Conditions of approval and the Development Standards. b. The proposed use is consistent with the intent of the Agricultural Zone District and is provided for as a Use by Special Review. c. The proposed uses are compatible with the existing surrounding land uses and with the future development of the surrounding area as permitted by the Agricultural Zone District. d. No overlay districts affect the site. e. Special Review Development Standards will provide adequate protection of the health, safety and welfare of the neighborhood and County. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the application for the amendment to a Special Review permit for an egg processing, shipping, and production facility with a maximum capacity of 1 ,750 ,000 chickens on the hereinabove described parcel of land be, and hereby is , granted subject to the following conditions: 1 . The Special Review activity shall not occur nor shall any building or electrical permits be issued on the property until the Special Review plat has been delivered to the Department of Planning Services Office and the plat is ready to be recorded in the office of the Weld County Clerk and Recorder. 880010 page 3 RE: AMEND USR - MILTON G. WALDBAUM COMPANY OF COLORADO 2 . An ISDS evaluation shall be performed on the existing septic system. Prior to the review by the Weld County -Health Department, the existing septic system shall be _reviewed by a Colorado Registered Professional Engineer, and a copy of that review submitted to the Weld County Health Department. 3 . Prior to recording the Special Review plat, the plat shall be amended to show all structures and the attached Development Standards be adopted and placed on the plat. 4 . The applicant shall submit an Improvements Agreement covering the necessary improvements to Weld County Road 47 as identified by the Engineering Department in its November 10 , 1987 , memorandum. 5 . Prior to the issuance of a building permit or to the start of construction for the proposed expansion of the Special Review activity: a. A manure storage plan for on-site and off-site storage of manure shall be approved by the Weld County Health Department. A copy of the approved plan shall be submitted to the Department of Planning Services. The plan shall include, but not be limited to: 1) Odor abatement 2) Fly control 3) Storage plans 4) Disposal plans 5) Detailed plans to monitor and control nuisance conditions on-site and off 6) Detailed ground water monitoring plan b. A copy of an approved agreement with Panhandle Eastern Pipe Line Company addressing the pipe line right-of-way shall be submitted to the Department of Planning Services . c . The Division of Water Resources shall submit a letter to the Department of Planning Services that indicates that an adequate water supply is available for the proposed uses. 880010 Page 4 RE: AMEND USR - MILTON G. Waldbaum Company of Colorado Amended USR-655 1 . The Special Review permit is for an amended Special Review permit as -submitted in the application materials on file in the Department of Planning Service-s and subject to the Development Standards stated herein. The uses of the property shall be for an egg processing, shipping, and production facility with a maximum capacity of 1 , 750 , 000 chickens. 2 . The applicant shall remove, handle, and stockpile manure from the facility in a manner that will _prevent nuisance conditions. The manure piles shall not be allowed to exist or deteriorate to a condition that facilitates excessive odors, flies, insect pests, or pollutant run-off. The manure storage sites shall have a water-tight surface which does not permit seepage or percolation of manure pollutants into the ground. 3 . The manure storage plan shall be maintained at all times. 4 . Flies and fly breeding shall be controlled year-round. 5 . Waste oil, -waste paints, stains, treatments, spent drug containers, empty livestock dip containers, anti -freeze, pesticides and other associated liquid and solid wastes shall be stored and removed for final disposal in a manner that protects against surface and ground water contamination. 6 . Any new septic system shall be designed by a Colorado Registered Professional Engineer according to the Weld County Individual Sewage Disposal Regulations. 7 . Any soil not covered by gravel or hard surface shall be seeded to a vegetative cover such as a cool season grass, crested wheat grass, or fairway grass. 8 . No run-off associated with the subject site, as allowed by the Special Review permit, shall be allowed to flow off the property of the owner and/or operator onto the land of surrounding property owners without their written consent. 880010 Page 2 _DEVELOPMENT STANDARDS - WALDBAUM 9 . All fire hydrants shell be inspected by the Hudson Fire Protection District annually and shall be maintained in working order at all times. 10 . All construction on the property shall be in accordance with the -requirements of the Weld County Building Code Ordinance. 11 . The property owner or operator shall be responsible for complying with the -Design Standards of Section 24 .5 of the Weld County Zoning Ordinance. 12 . The property owner or operator shall be responsible for complying with the Operation Standards of Section 2-4 .-6 of the Weld County Zoning Ordinance. 13 . Personnel from the Weld County Health Department, Hudson Fire Protection District, and Weld County Department of Planning Services shall be granted access onto the -property at any reasonable time in order to insure the activities carried out on the property comply with the Development Standards stated herein and all applicable Weld County Regulations. 14 . The Special Review area shall be limited to the plans shown herein and governed by the foregoing Standards and all applicable Weld County Regulations. Any material deviations from the plans or Standards as shown or stated shall require the approval of an amendment of the permit by the Weld County _Planning Commission and the Board of County Commissioners before such changes from the plans or Standards are permitted. Any other changes shall be filed in the office of the Department of Planning Services. 15 . The property owner or operator shall be responsible for complying with all of the foregoing Standards. WALDBAUM COMPANY OF -COLORADO A public hearing was _conducted on December 30, 1987, at 1:00 P.M. , with the following present: Commissioner Gordon E. Lacy, Chairman Commissioner C.W. Kirby, Yro-Tem Commissioner Gene Brantner - Excused Commissioner Jacqueline Johnson Commissioner Trani( Y-amaguchi Also present: Acting Clerk to the $Hard, Mary -Reiff Assistant County Attorney, Lee D. Morrison Planning Department representative, Keith tthuett The following business -was transacted: I hereby certify that pursuant to a notice dated December 7, 1987, and duly published -December 17, 1987, in the Johnstown Breeze, a public hearing was conducted to -consider the request of Milton G. -Waldbaum Company of Colorado for an amendment to a -Special Review permit for an egg processing, shipping, and production facility -with a maximum capacity of 1,750,000 thickens. Chairman Lacy explained to those present that, only four Commissioners being present today, if this hearing should result in a tie vote, the absent Commissioner would listen to the tapes and review the -record of this hearing before casting the deciding vote. Lee Morrison, Assistant County Attorney, made this matter of record. 1Zeith 5chuett, Planning Department representative, read the favorable recommendation of the -Dlanning Commission, which is subject to five Conditions and fifteen Development Standards, Into the record. Frederick Graves, director of operations, came forward to represent the applicant. He _reviewed the plans for this expansion and answered questions of the Board. Public comment was received from Janette Arends, who lives about a mile from the site; Margaret Eichthaler, owner of adjoining property; Robert Turcot, owner of a portion of the mineral rights under the site; John Ochmiller, owner of property on which the applicant stored manure last year; and Robert Clair, representing Panhandle Eastern Pipe Line Company. (Tape Change #87-123) Mr. Graves responded to comments which were made. He also expressed -objection to Condition #4, requiring a Road Improvements Agreement. Chairman Lacy explained that other businesses have been required to enter into a similar agreement. Wes Totter, of the Weld County Health Department, stated that complaints have been received concerning the off-site storage of manure, and -said the applicant has agreed to monitor this more closely and will enter into a contract with farmers obtaining manure to assure that it is properly handled. Mr. Potter also said the Health Department has requested placement of -a liner under the ou-site stockpiling area to prevent percolation into the groundwater. Discussion was held about proposed changes to Condition #5 and it was the consensus of the Board that it be amended to begin, "Prior to the issuance of a building permit or the start of construction for the proposed expansion. .", and to state that -a "detailed groundwater monitoring plan" should be contained in the manure storage plan. Commissioner Johnson moved to approve this request for an amendment to a Special Review permit, subject to the revised Conditions, as outlined above, and the -Development Standards as proposed by the Planning Commission. The sources of water supply are two wells. _0ne well (permit nos. 21010-F, 26948-F, -and 32590-T) has an annual appropriation totaling 70.2 acre-feet. The other well (permit no. 7289-'R) is limited to a historic consumptive use -of 235 acre-feet per year, but must be augmented. Ientral -Colorado Water Conservancy District is providing augmenta- tion water for -permit no. 72-89-R and is an acceptable source of augmentation water. The applicant _does not -have -any other legal source of augmentation water availabl-e -to them at this -time. The applicant's contract with CCWCD, however, only augments for 21 .73 acre-feet per year. Therefore, the applicant has S2 acre-feet of water avail-able per year. We compute the total water required for the -full planned development to be 148 acre-feet per year. Until the applicant can come up with an additional 56 acre-feet of -water per year, we cannot recommend approval of this amendment. The applicant should -either obtain a new well permit for -the additional water, -or contr-act with CCWCD to -augment for more tributary water or a combination of -the two. -When the applicant can demon- strate availability of T4'S acre-feet -per year, we can recommend approval . Wes Potter and Mr. Jeffrey Stoll at their office on Monday, November 16, 1987, and Mr. Potter 's -memorandum to the Weld County Planning Committee dated October 29, 1987, concerning the above- mentioned case for the -proposed expansion of the Milton G. Waldbaum Company of Colorado. The -number one issue in question is in the control of the nuisance factor An the handling, transportation, storage, and -end-use of the product-poultry manure . Not at _issue is the fact that the best use of poultry manure is land application for soil enhancement and plant fertilization purposes . The Waldbaum Company can and has exercised good levels of control over the handling and transportation of the product. This mill continue along with additional improvements . -Problems that have developed -have had to do with storage at neighboring farm -sites and prior to the spreading and incorporation of the product into the soil . storage is most likely to pose a problem during the summer months when fly breeding and odor present obvious problems for neighbors of the storage sites . Our experience is that these problems can be reduced to the point of -extinction through either covering the product and spraying for flies or through an immediate incorporation of the product into the soil . -This spreading process speeds up the dry -down of the product and practically eliminates fly breeding whil-e greatly reducing odor . (9Oo10 As we grow, the Waldbaum Company will need to play an expanded role in the selection of farms and farmers who understand the potential liabilities that xlo along with the product in its use as a fertilizer . This process has already begun with our screening of sites and operators to determine the feasibility before we agree to transport the product . The screening process is still evolving, but it has been a step in the right direction. The process begins with a visitation to the proposed site to see if it has good access and is properly located at an appropriate distance away from neighbors and/or roads . In discussion with the farmer, our representative Harry Bornmann determines if the site will handle the amount of product the farmer has requested. The discussion continues with an explanation of the potential problems that might develop if the farmer does not apply the product according to the seasonal requirements . Follow-up visits are scheduled as needed. It is our intention that through this program we can incorporate the help of the County Extension agent in the best overall use of the product to the benefit of both the farmer and the Waldbaum Company. If necessary, we feel we have a strong economic lever in achieving the co-operation of the farmer . If he will not manage the product _properly, our refusal to supply -more product in the future would result in the loss of a valuable and inexpensive source of fertilizer for his crops . In terms of storage nuisance potential, the risk, as stated above, is greatest in the summer months . This is because a large part of the cropland is under cultivation. For thi-s reason, we feel that a storage site on our property would enable us to do the things necessary to better control the nuisance factor during this period of time . To this extent, we plan a manure story-ge site on our property. The site will be constructed to meet or exceed percolation requirements so as to avoid ground water contamination. These criteria will be worked out with the appropriate Weld County authorities . If it is thought necessary, properly located test -wells will be installed to the level of the first aquifer. We neither want or expect any ground water contamination, and we will wor-k to this end . From our experience, we know we can control fly breeding and odor largely through covering the product . This procese causes the product to -heat naturally to temperatures high enough to kill any fly larvae and also contain the odor until the product -seals over . 880010 We are well aware of the importance of managi-ng this aspect of our business with the same degree of attention and good sense that we employ in the managing of our laying hens . This means a more optimum ambient temperature in the house, along with proper - and adequate removal of moisture. A discussion of adequate housing must in- , dude a study of the contributing factors of heat and moisture production. E� Btu defined: The output of heat produced by a bird is measured in British thermal units (Btu). One Btu is the amount of heat required to raise the temperature of 1 lb of water 1 degree Fahrenheit at or near 39.2°F. Heat production by birds: The data on bird heat production are highly varia- ble because of the contributors involved—type of bird (broilers, growing Se pullets, layers, etc.), caloric value of the feed, ambient temperature, rela- tive humidity, etc. It would require many tables to produce accurate fig- lost ures showing the influence of each. But inasmuch as heat production is (1 discussed as a means toward proper house ventilation, and ventilation re- quirements are not too well established, a composite table (Table 11.1) has been constructed to show averages for all types of birds kept under all types of conditions. The proposed use is an agricultural activity and will support additional farm production in the immediate vicinity by requiring a greater supply of feed grain. The surrounding land usage is agricultural in nature and is compatible with the proposed expansion of this facility. The nearest residential dwelling is located approximately one-half mile North. The expansion of the existing facility is intended to be such that the appearance and surrounding environment will be an asset to the community. No produc- tive land will be utilized with the expansion of this facil- ity. The expansion of the facility will result in excess of 100 persons being employed at this facility. The facility operates on a 24 hour basis with the majority of the employ- ees working normal daytime hours . Water for the facility is to be supplied by existing wells or relocated wells . The permitted flows for the existing wells are 100 gpm for the deep well and 750 gpm for the irrigation well. Fire protection is provided by existing lines and fire hydrants . Reservoir storage is provided on-site to assure adequate volume. Access is provided via County Road 47. Multi-axle trucks generally deliver feed to the facility and semi-trailer trucks carry the eggs and products from the facility to the Colorado market areas . An average of twelve to fifteen tractor—trailer units are anticipated per day. Domestic sewage disposal is provided by on-site septic system. Poultry houses are cleaned daily and manure is trucked to area farms where it is spread on fields and utilized as fertilizer. During growing season when the manure cannot be placed on area farms , it will be stockpiled to be delivered at a later date. The stockpiles will be covered to control odor. Baits and sprays will be used to control flies. A licensed sanitation service provides daily pickup and disposal.
