Alf i 711i 281. 5 s 1{i M M Li f 85040 RESOLUTION RE: APPROVAL OF USE BY SPECIAL REVIEW FOR OIL AND GAS PRODUCTION FACILITIES IN AN R-1 (LOW DENSITY RESIDENTIAL) DISTRICT - WEEKS ENERGY MINERALS CORPORATION WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners held a public hearing on the 20th day of February, 1985 , at the hour of 2 :00 o 'clock p.m. in the Chambers of the Board for the purpose of hearing the application of Weeks Energy Minerals Corporation, 1000 Security Life Building, Denver, Colorado 80202 , for a Use by Special Review for oil and gas production facilities in an R-1 (Low Density Residential) District on the following described real estate, to-wit: The 141/2 NW4, Section 33 , Township 6 North, Range 65 West of the 6th P.M. , Weld County, Colorado WHEREAS, Section 24 .4.2 of the Weld County Zoning Ordinance provides standards for review of said Use by Special Review, and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, has studied the request of the applicant and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter and, having been fully informed, finds that this request shall be approved for the following reasons: 1 . The submitted materials are in compliance with the application requirements of Section 24 .7 of the Weld County Zoning Ordinance. 2 . It is the opinion of the Board of County Commissioners that the applicant has shown compliance with Section 24 .4 .2 of the Weld County Zoning Ordinance as follows: Pt 1350680 Page 2 RE: USR - WEEKS ENERGY MINERALS a. All mineral resources are fixed in location. The mineral extraction industry is therefore restricted in its operations to those areas where the resources lay. The subject site is zoned R-1 (Low Density Residential) but the site is not platted for residential development. The Comprehensive Plan Policies encourage mineral extraction prior to residential development. Residential development on the subject site could reduce the feasibility of ever developing the minerals in question. Therefore, the proposal is consistent with the policies of the Weld County Comprehensive Plan. b. The proposal is allowed as a Use by Special Review in a Residential Zone District. c. The attached Operation Standards will make the proposal compatible with existing and future development of the surrounding area as permitted by the existing zoning and with future development as projected by the Comprehensive Plan of the City of Greeley. d. The Greeley Planning Commission recommended no objections at its meeting on January 8 , 1985 . The concerns of the Greeley Planning Commission are addressed in the Operation Standards and additional comments. e. Use by Special Review Operation and Design Standards provide adequate protection of the health, safety and welfare of the neighborhood and County. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the application for a Use by Special Review for oil and gas production facilities in an R-1 District on the hereinabove described parcel of land be, and hereby is, granted subject to the following conditions: 1 . The attached Standards for Use by Special Review be adopted and placed on the Use by Special Review plat prior to recording. Page 3 RE: USR - WEEKS ENERGY MINERALS 2 . No building or electrical permits shall be issued for the Use by Special Review area until the plat has been delivered to the Department of Planning Services Office and compliance with Operation Standard #10 has been met. The prescribed Use by Special Review activity shall not occur and building or electrical permits shall not be issued until the Use by Special Review plat has been recorded in the office of the Weld County Clerk and Recorder. 3 . The operator shall submit a copy of a policy of insurance in the amount of five hundred thousand dollars ($500 ,000 .00) insuring the applicant and the County against all claims or causes of action made against either or both the applicant and the County for damages to persons or property arising out of the drilling, maintenance, production or other work done with respect to such proposed oil or gas well. Such policies shall be written by a company authorized to do business in the State of Colorado. Evidence of the insurance policy shall be filed with the Department of Planning Services. In case the insurance policy required shall lapse or become void for any reason whatsoever, the Use by Special Review Permit shall cease to exist until a new insurance policy shall be provided and filed with the Department of Planning Services . All well activity shall be shut-down and all operations and production thereof shall be suspended and discontinued, consistent with safety consideration, until the operator provides evidence of insurance in the prescribed amount. 4 . The applicant shall submit evidence of issuance of an access permit from the Weld County Engineering Department to the Department of Planning Services. 5. The applicant shall submit a revised mylar plat showing the location of a water holding tank and elimination of the pit. The permitted use shall be oil and gas production facilities as described in the submitted application materials, and as located on the Use by Special Review plat. 2 . The drilling and producing of the wells shall comply with the City of Greeley' s Ordinance pertaining to oil and gas development. 3 . All tank batteries shall be designed to meet the following standards: - The tank battery cluster shall be bermed to contain the greatest amount of liquid that can be released from the largest tank, assuming a full tank. A six (6) foot chain link fence with three (3) strand barbed wire top shall enclose the tank battery cluster. 4 . All production equipment fixed at the site with a source of ignition, including heater/treator and separators , shall be placed a minimum of twenty-five (25) feet from the well head and fifty (50) feet from the tank battery cluster. The well head shall be a minimum of twenty-five (25) feet from the tank battery cluster. 5 . The applicant shall comply with all Eaton Fire Protection District requirements . 6 . Prior to start-up of the activity, the operator shall provide the Eaton Fire Protection District a list of four (4) names, phone numbers and addresses of responsible parties it can contact in case of an emergency. 7 . Smoking shall not be permitted at any well location or tank battery location at any time, and signs indicating such prohibition shall be placed on the well site and at the tank battery location. 8 . Fire extinguishers shall be maintained on the well site at all times during drilling and production. 9 . Prior to start up of the activity, a metal sign shall be placed on the property indicating the name and telephone number of the person (s) to contact in the event of an emergency. 10 . Petroleum products and compressed flammable gases are hazardous substances per C.R.S. 29-22-107 (2) (a) . Prior to drilling, the applicant shall provide a list of the maximum quantities of hazardous substances expected at the site and emergency phone numbers to the State Health Department - Division of Waste Management, the Weld County Emergency Response Coordinator, and the Eaton Fire Protection District. Evidence of this listing and emergency phone numbers shall be provided to the Department of Planning Services prior to the issuance of building permits. 11 . The drilling and production of any well shall comply with the Colorado Oil and Gas Conservation Commission regulations pertaining to oil and gas drilling rules. 12 . Brine water produced at the site during oil and gas production shall be disposed of by formation injection or into a commercial brine disposal site. 13 . Drilling muds can be used as an agricultural enhancement. The drilling muds MUST be applied and disked into sandy soils with the landowners consent. 14 . Upon cessation of the proposed use, the oil and gas production facilities shall be removed and the land shall be reclaimed to its prior use. 15 . In the event that a final plat subdivision application is submitted within the subject Use by Special Review area to the Weld County Planning Department or the City of Greeley Planning Department, the Operation Standards of USR-661 :84 : 57 shall be reconsidered through the Use by Special Review application process . The intent of this standard is to review the appropriateness of landscaping around the tank battery area and not the proposed use. 16 . The applicant shall comply with the design standards for the Use by Special Review, Section 24 .5 et seq. , of the Weld County Zoning Ordinance. 17 . The applicant shall comply with the Operation Standards for Uses by Special Review, Section 24 .6 et seq. , of the Weld County Zoning Ordinance. 18 . Representatives or members of the Weld County Health Department and Weld County Department of Planning Services shall be granted access onto the site at any reasonable time in order to insure the operations carried out on the site comply with the Operation Standards stated hereon and all applicable Weld County Regulations . 19 . The Use by Special Review area shall be limited to the plans shown hereon and governed by the Standards as stated above and all applicable Weld County Regulations. Any material deviations from the plans and/or Standards as shown or stated above shall require the approval of an amendment of the Permit by the Weld County Planning Commission and the Board of County Commissioners before such changes from the plans and/or Standards are permitted. Any other changes shall be filed in the office of the Department of Planning Services. 20 . The property owner and/or operator of this operation shall be responsible for complying with all of the above stated Standards. Noncompliance with any of the above stated Standards may be reason for revocation of the Permit by the Board of County Commissioners. John McKnight, representing the applicant, came forward to answer questions of the Board. Mr. McKnight said that the correct name of the company is Weeks Energy Minerals Corporation. Mr. Mullen stated that the Planning staff has recommended that portions of Operation Standard #12, referring to brine water disposal , be deleted and that Operation Standard #17 be deleted and the remainder of the Standards be renumbered. Mr. McKnight stated that his company has no problem with the Operation Standards proposed. Don Johnson, operations manager of Weeks, came forward to answer questions concerning procedures used. Kay McElroy, an adjacent property owner, came forward to state her concern about irrigation and domestic water wells in the area. Following discussion, Commissioner Lacy moved to approve the Use by Special Review for Weeks Energy Minerals Corporation, based upon the Planning Commission recommendation with the Operation Standards amended as recommended by the Planning staff. The motion, seconded by Commissioner Brantner, carried unanimously. CASE NUMBER: USR-661:84:57 APPLICANT: Weeks Energy Corporation REQUEST: A Use by Special Review Permit for Oil and Gas Production Facilities in an "R-1" (Low Density Residential) District LEGAL DESCRIPTION: Of NW', Section 33, T6N, R65W of the 6th P.M. , Weld County, Colorado LOCATION: One (1) mile east of the Greeley City Limits; south of Weld County Road 64 and east of L'.S. Highway 85 APPEARANCE: John McKnight, Land Man, and Dave Swan, Field Superintendent, Weeks Energy Corporation, reported they want to put in an oil and gas well at this site. They feel the area is agriculturally oriented even though it is zoned Residential-One, and there is other oil and gas activity in the area. They plan to drill to the Codell Formation and if they do get a gas well, there is a natural gas pipeline in the area which they plan to tap into. They have met with the city of Greeley and will install the well according to the city's recommendations. They do not agree with the city's recommendation that coniferous trees be planted around the tank battery area and neither does the property owner. However, if this is a requirement they will comply with it. They have now decided to use tanks to store production water in rather than pits. The production water will then be disposed of at an acceptable brine water site. Mike Mullen reported this property is zoned Residential-One, but it has never been platted. The Chairman asked Mr. McKnight and Mr. Swan if they had reviewed the recommendations, conditions, and operation standards as outlined by the Department'' of planning Services staff. They stated they had and have concerns regarding the planting of coniferious trees, the required insurance policy, which they have only received a binder on, and the requirements concerning the city's regulations of well installations. The Chairman called for discussion from the audience. Kay McElroy, adjacent property owner, stated she was concerned about contamination of domestic and irrigation wells in the area. • Summary of the Weld County Planning Commission Meeting January 22, 1985 Page 5 Mike Mullen amended the conditions as outlined by the Department of Planning Services staff to include item number five to read as follows: 5. The permitted use shall be oil and gas production facilities as described in the submitted application materials, and as located on the Use by Special Review plat. 2. The drilling and producing of the wells shall comply with the City of Greeley's Ordinance pertaining to oil and gas development. 3. All tank batteries shall be designed to meet the following standards: - The tank battery cluster shall be bermed to contain the greatest amount of liquid that can be released from the largest tank, assuming a full tank. - A six (6) foot chain link fence with three (3) strand barbed wire top shall enclose the tank battery cluster. 4. All production equipment fixed at the site with a source of ignition, including heater/treator and separators, shall be placed a minimum of twenty-five (25) feet from the well head and fifty (50) feet from the tank battery cluster. The well head shall be a minimum of twenty-five (25) feet from the tank battery cluster. 5. The applicant shall comply with all Eaton Fire Protection District requirements. 6. Prior to start-up of the activity, the operator shall provide the Eaton Fire Protection District a list of four (4) names, phone numbers and addresses of responsible parties it can contact in case of an emergency. 7. Smoking shall not be permitted at any well location or tank battery location at any time, and signs indicating such prohibition shall be placed on the well site and at the tank battery location. 8. Fire extinguishers shall be maintained on the well site at all times during drilling and production. 9. Prior to start up of the activity, a metal sign shall be placed on the property indicating the name and telephone number of the person(s) to contact in the event of an emergency. Prior to drilling the applicant shall provide a list of the maximum quantities of hazardous substances expected at the site and emergency phone numbers to the State Health Department - Division of Waste Management, the Weld County Emergency Response Coordinator, and the Eaton Fire Protection District. Evidence of this listing and emergency phone numbers shall be provided to the Department of Planning Services prior to the issuance of building permits. 11. The drilling and production of any well shall comply with the Colorado Oil and Gas Conservation Commission regulations pertaining to oil and gas drilling rules. 12. Brine water produced at the site during oil and gas production shall be disposed of by formation injection or into a commercial brine disposal site or into an on-site pond. If disposed into an on—site pond the pond shall be constructed in accordance with the standards and specifications of the Weld County Health Department. A letter from the Weld County Health Department approving the pond construction shall be submitted to the Department of Planning Services. 13. Drilling muds can be used as an agricultural enhancement. The drilling muds MUST be applied and disked into sandy soils with the landowners consent. 14. Upon cessation of the proposed use, the oil and gas production facilities shall be removed and the land shall be reclaimed to its' prior use. 15. In the event that a final plat subdivision application is submitted within the subject Use by Special Review area to the Weld County Planning Department or the City of Greeley Planning Department, the Operation Standards of USR-661:84:57 shall be reconsidered through the Use by Special Review application process. The intent of this standard is to review the appropriateness of landscaping around the tank battery area and not the proposed use. 16. The applicant shall comply with the design standards for the Use by Special Review, Section 24.5 et seq. , of the Weld County Zoning Ordinance. 17. Week Energy Minerals Corporation ("WEMC") believes that this proposal will be consistent with the Well County Comprehensive Plan and that a very small amount of acreage (approximately 1 - 2 acres) will actually be taken out of agricultural production. WEMC's object is to preserve the agricultural land and to reimburse the landowner for any actual loss incurred because of oil and gas production. WEMC also believes that the oil and gas production on this tract of land will be consistent with the development of the city of Greeley. All requirements and standards will be followed as if drilling and production were being done within the city limits of Greeley, when in fact the well is located approximately a mile outside the city limits. This area has been zoned R-1, although the area is basically land supporting agriculture. The wellsite lies over 600' from the nearest dwelling and/or structure. This district has not been developed for residential housing and WEMC believes the proposal is consistent with the intent of the district, both now and in the future. Since there are no precievable plans for residential development in this area, by the time, if ever, residential housing becomes desirable, the production life of the well should be ucuupleted and the signs of the well removed. Oil and gas production on the subject tract of land will be compatible and consistent with the existing surroundings and land uses. The surrounding area is farmland growing crops or raising livestock in feedlots. There are in fact three or four oil and gas wells within a mile east of the proposed location. Also there is a producing well less than a half a mile to the West. WEMC is therefore not the first to drill in the area, and not the first to drill a well in Section 33 which is zoned R-1. The well location is in the Airport Overlay District, Instrument Approach Zone subclassification. All height limitations prescribed by the Weld County Ordinance will be strictly observed. The tallest structure on the site will be one, 300 barrel tank which will not exceed 20' in height. Equipment and structures at the wellsite will consist of one, 300 barrel oil holding tank, one horizontal separator and one wellhead structure. As mentioned above, the highest structure will not exceed 20' . All of the essential requirements of the Colorado Oil and Gas Conservation Commission, Weld County Ordinances will be observed. A berm will be built around the tank and will be of sufficient height to contain liquids in the tank in the event of a leak. The tanks will be setback over 500' from any building. Upon the abandonment of the well, the hole will be plugged in accordance with the Colorado Oil and Gas Conservation Commission regulations, and the abandoned wellsite will be restored to a condition substantially similar to the original condition. The underlying theme throughout drilling and production is safety, not only for the people working at the site, but for the people living in the area. WEMC is well aware of the hazards involved and we will conduct all operations accordingly. WEMC presently operates approximately 200 producing oil and gas wells within the Denver-Julesburg basin. The vehicular traffic into the wellsite will be minimal and will consist of daily inspections made by employees and pumpers in pickup trucks, and approximatley once a week a tanker truck will go into the site on the access road to load oil from the 300 barrel oil holding tank. Tank batteries will be located approximately 500' from the wellhead, the wellsite is more than 500' from the nearest structure. r WEMC will comply with the Weld County Ordinance as well as any requirements. WENC has been working in conjunction with the landowner in order to minimize damage to the agricultural producing lands, to the extent that the well location itself will only consist of a wellhead. As mentioned above the tank battery and separator will be located as close to an entrance and existing access as possible and will be located in an area which is considered wasteland by the surface owner. It is the opinion of the Department of Planning Services staff that the applicant has shown compliance with Section 24.3. 1 et seq. of the Weld County Zoning Ordinance as follows: All mineral resources are fixed in location. The mineral extraction industry is therefore restricted in its operations to those areas where the resources lay. The subject site is zoned R-1 (Low Density Residential) but the site is not platted for residential development. The Comprehensive Plan policies encourages mineral extraction prior to residential development. Residential development on the subject site could reduce the feasibility of ever developing the minerals in question. In case the insurance policy required shall lapse or become void for any reason whatsoever, the Use by Special Review Permit shall cease to exist until a new insurance policy shall be provided and filed with the Department of Planning Services. All well activity shall be shut-down and all operations and production thereof shall be suspended and discontinued, consistent with safety consideration, until the operator provides evidence of insurance in the prescribed amount. 4. Prior to scheduling a meeting before the Board of County Commissioners the applicant shall submit evidence of issuance of an access permit from the Weld County Engineering Department to the Department of Planning Services. OPEPATION STANDARDS USR-661:84:57 ?leeks Energy Corporation 1 . T`e permitted use shall he oil and gas production facilities as described in the submitted application materials, and as located on the Use by Special Review plat. 2. The drilling and producing of the wells shall comply with the City of Greeley' s Ordinance pertaining to oil and gas development. 3. All tank batteries shall he designed to meet the following standards: - The tank battery cluster shall be bermed to contain the greatest amount of liquid that can be released from the largest tank, assuming a full tank. - P six (6) foot chain link fence with three (3) strand barbed wire top shall enclose the tank battery cluster. 4. All production equipment fixed at the site with a source of ignition, including heater/treator and separators, shall be placed a minimum of twenty-five (25) feet from the well head and fifty (50) feet from the tank battery cluster. The well head shall be a minimum of twenty-five (25) feet from the tank battery cluster. 5. The applicant shall comply with all Eaton Fire Protection District requirements. 6. Prior to start-up of the activity, the operator shall provide the Eaton Fire Protection District a list of four (4) names, phone numbers and addresses of responsible parties it can contact in case of an emergency. 7. Smoking shall not be permitted at any well location or tank battery location at any time, and signs indicating such prohibition shall be placed on the well site and at the tank battery location. 8. Fire extinguishers shall be maintained on the well site at all times during drilling and production. 9. Prior to start up of the activity, a metal sign shall be placed on the property indicating the name and telephone number of the person(s) to contact in the event of an emergency. Opera ton Standards Weeks Energy Corporation Page 2 10. Petroleum products and compressed flammable gases are hazardous substances per C.R.S. 29-22-107 (2) (a) . Prior to drilling the applicant shall provide a list of the maximum quantities of hazardous substances expected at the site and emergency phone numbers to the State Health Department - Division of Waste Management, the Weld County Emergency Response Coordinator, and the Eaton Fire Protection District. Evidence of this listing and emergency phone numbers shall be provided to the Department of Planning Services prior to the issuance of building permits. 11 . The drilling and production of any well shall comply with the Colorado Oil and Gas Conservation Commission regulations pertaining to oil and gas drilling rules. 12. Brine water produced at the site during oil and gas production shall be disposed of by formation injection or into a commercial brine disposal site or into an on-site pond. If disposed into an on-site pond the pond shall be constructed in accordance with the standards and specifications of the Weld County Health Department. A letter from the Weld County Health Department approving the pond construction shall be submitted to the Department of Planning Services. 13. Drilling muds can be used as an agricultural enhancement. The drilling muds MUST_ be applied and disked into sandy soils with the landowners consent. 14. Upon cessation of the proposed use, the oil and gas production facilities shall be removed and the land shall be reclaimed to its' prior use. 15. In the event that a final plat subdivision application is submitted within the subject Use by Special Review area to the Weld County Planning Department or the City of Greeley Planning Department, the Operation Standards of USR-661:84:57 shall be reconsidered through the Use by Special Review application process. The intent of this standard is to review the appropriateness of landscaping around the tank battery area and not the proposed use. 16. The city of Greeley has requested landscaping round the tank battery location. The City has indicated that since the property is zone R—I (Low Density Residential) it could be developed in a residential format prior to the termination of the life of the well. No oil or gas operation will begin until an application for permit to drill has been received and approved by the City of Greeley and the State Oil and Gas Commission, and whatever applicable fees are paid. Well permits that have been issued but not completed must comply and be issued a new permit . 2. A "No Trespassing Zone" will be established three hundred ( 300) feet from the work site and roped off with a watch- person assigned on a twenty four ( 24) hour basis during drilling and fracturing. The watchperson shall be assigned until the site is adequately fenced according to City Standards . 3. Surface casing shall be required a minimum of two hundred fifty ( 250) feet , or fifty ( 50) feet below the base of the Fox Hills Aquifer, whichever is greater. The produc- tion casing shall be stage cemented between the production casing and the drilled hole from a depth of three thousand ( 3000) feet or fifty ( 50 ) feet below the Richards Sands , whichever is greater, to the surface of the ground or to at least one hundred ( 100) feet into the surface casing. This action is being taken in the interest of public safety to prevent any gas migration into any aquifer where water wells are drilled or may be drilled. The deepest producing water zone is known as the° Richards Sands , at approximately three thousand ( 3000) feet . The following information shall be submitted to the City of Greeley or the City' s agent before an operations permit is granted. A. Inducation Resistivity , Bulk Density, Cement Bond , and Perforation Logs . B. The actual count and type of cement used . Oil and Gas Well Rules and Regulations Page 2' 4. All applicants for drilling or fracturing shall bear any expense the City of Greeley may incur to insure that these safety measures are complied with. This may include the hiring of outside consultants or inspectors . 5. All operators shall allow checks or inspections on their sites to insure compliance with these measures . 6. All wells permitted under these provisions shall be monitored and logged a minimum of bi-weekly for the first two weeks after fracturing and once weekly there- after for three months , or to whatever extent the City or the City ' s agent deems necessary . The pressure readings shall be submitted to the. City weekly for three months . 7 . A mud log of each well drilled within the municipal boun- daries of Greeley shall be obtained by placing on the drilling site and utilizing a logging unit manned 24 hours a day while drilling is in progress . The logging unit shall be capable of detecting and identifying the components of any gas encountered in drilling, including both hydrocarbons and carbon dioxide . The logs shall be recorded from the surface of the ground to total depth. Any zones in which gas is detected shall be cemented . A Copy of the mud log shall be submitted to the City immediately upon completion of drilling. 8. Box 86 Greeley, CO 806 32 Dear Milt: I have received a Weld County referral for an application from Weeks Energy Corporation for a Use by Special Review Permit for oil and gas production facilities in an (R-1) Residential Zone District located in the W+NW* of Section 33, T6N, R65W; adjacent to Weld County Road 41 and Weld County Road 64. The land use is agricultural and currently is irrigated cropland. This area is comprised of three soil types (50) Otero sandy loam, 0-16 slope on the northeast; (51 ) Otero sandy loam, 3-5% slope through the middle and (32) Kim loam, 1-3o slope in the southwest portion of the affected area. All three soils are considered prime farmland if irrigated and have an adequate supply of water. However, it appears from the write-up and maps that this well site will be of the common type seen throughout our area and after drilling will not pose a great loss of land from production. Of more concern , however, is the potential of all three of these soils to have a moderate to very rapid permeability. Therefore, any pits dug for collection of water during the drilling process or those pits used later for the collection of water from the seperator process should be checked to insure that they will not allow leachate to contaminate nearby dwellings. Sandstone is relatively shallow in this area and can intercept and carry subsurface water down slope. I have no further comments. A "No Trespassing Zone" will be established 300 feet from the work site and roped off with a watchperson assigned on a 24-hour basis during drilling and fracting . The watchperson shall be assigned until the site is adequately fenced according to City standards . 3 . Surface pipe shall be run to a depth of 100 feet below the deepest aquifer , approximately 3000 feet , and cemented to the surface . This action is being taken in the interest of public safety to prevent any gas migration into the water wells . Approximately 900 water wells are known to have been drilled . It is estimated that another 300 wells exist in unknown locations . The deepest producing water zone is known as the Richards Sands at approximately 3000 feet . The following information shall be submitted to the City or the City ' s agent . A. Induction Resistivity , Bulk Density , Cement Bond , and Perforation Logs . B. In addition, the actual count and type of cement shall be submitted to the City or the City ' s agent . 4 . All applicants for drilling or fracting shall bear any expense the City of Greeley may incur to insure that these safety measures are complied with . The Commission recommended no objection to this use providing that it complies with the City of Greeley ' s setback , fencing , berming , landscaping , and well casing requirements . The developer indicated a willingness to comply with all of these requirements except the landscaping . A cyclone fence with inner woven plastic slatting was proposed by Weeks Energy Mineral . In that the property is zoned R-1 , the potential exists that the area around the well could be developed in a residential format prior to the termination of the life of the well . This makes the provision of the landscaping to buffer the tanks from the surrounding development particularly critical . The fence is not anticipated to adequately buffer the tanks . We would suggest the landscape buffer be comprised of a minimum of eight foot pines planted on twenty foot centers around the fenced area .
