RE: APPROVAL OF USE BY SPECIAL REVIEW FOR SINGLE FAMILY RESIDENCE
ON A PARCEL OF LAND LESS THAN THE MINIMUM LOT SIZE REQUIRED
IN THE AGRICULTURAL ZONE DISTRICT - MARVIN A. BARSTOW
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners held a public
hearing on the 5th day of November, 1986, at the hour of 2: 00 p.m.
in the Chambers of the Board for the purpose of hearing the
application of Marvin A. Barstow, 2000 South College Avenue, #308 ,
Fort Collins, Colorado 80525 , for a Use by Special Review for a
single family residence on a parcel of land less than the minimum
lot size required in the Agricultural Zone District on the
following described real estate, to-wit:
The 5' SE? and Sh Nh SEh, Section 18, Township
8 North , Range 67 West of the 6th P.M. , Weld
County, Colorado
WHEREAS , Section 24 .4. 2 of the Weld County Zoning Ordinance
provides standards for review of said Use by Special Review, and
WHEREAS, the Board of County Commissioners heard all of the
testimony and statements of those present, has studied the request
of the applicant and the recommendations of the Weld County
Planning Commission and all of the exhibits and evidence presented
in this matter and, having been fully informed, finds that this
request shall be approved for the following reasons:
1 . The submitted materials are in compliance with the
application requirements of Section 24 . 7 of the Weld
County Zoning Ordinance.
2. It is the opinion of the Board of County Commissioners
that the applicant has shown compliance with Section
24 . 4 . 2 of the Weld County Zoning Ordinance as follows:

a. The proposal is consistent with the intent of the
Weld County Comprehensive Plan in that it does not
remove prime agricultural land from production and
will not adversely affect the local economy or
environment.
b. The proposed use is consistent with the intent of
the agricultural district in that it allows for the
promotion of agricultural activities and is
permitted as a Use by Special Review in the
district.
c. The uses permitted will be compatible with the
existing surrounding land uses and with future
development of the surrounding areas as permitted
by the Agricultural Zone District.
d. No overlay districts affect the site.
e. Use by Special Review Development Standards will
provide adequate protection of the health, safety,
and welfare of the neighborhood and County.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the application for a
Use by Special Review for a single family residence on a parcel of
land less than the minimum lot size required in the Agricultural
Zone District on the hereinabove described parcel of land be, and
hereby is , granted subject to the following conditions :
1 . The attached Development Standards for the Use by
Special Review permit be adopted and placed on the Use
by Special Review plat prior to recording the plat.
2 . The Use by Special Review activity shall not occur nor
shall any building or electrical permits be issued on
the property until the Use by Special Review plat has
been delivered to the Department of Planning Services
Office and the plat is ready to be recorded in the
office of the Weld County Clerk and Recorder.
3. Prior to recording the plat, the applicant/operator
shall work with the Greeley Soil Conservation District
to develop a conservation plan best suited for the
property. Evidence of an approved plan shall be
submitted to the Department of Planning Services staff.

1 . The Use by Special Review permit is for a single family
residence as submitted in the application materials on file
in the Department of Planning Services and subject to the
Development Standards stated herein.
2 . The Use by Special Review site shall be maintained in
accordance with the soil conservation plan approved by the
West Greeley Soil Conservation District.
3 . All construction done on the property shall be in accordance
with the requirements of the Weld County Building Code
Ordinance.
A. The property owner or operator shall be responsible for
complying with the Design Standards of Section 24 . 5 of the
Weld County Zoning Ordinance.
5. The property owner or operator shall be responsible for
complying with the Operation Standards of Section 24 . 6 of the
Weld County Zoning Ordinance.
6. Personnel from the Weld County Health Department, Weld County
Department of Planning Services , and Greeley Soil
Conservation Service shall be granted access onto the
property at any reasonable time in order to insure the
activities carried out on the property comply with the
Development Standards stated herein and all applicable Weld
County Regulations.
7 . The Use by Special Review area shall be limited to the plans
shown herein and governed by the foregoing Standards and all
applicable Weld County Regulations. Any material deviations
from the plans or Standards as shown or stated shall recuire
the approval of an amendment of the Permit by the Weld County
Planning Commission and the Board of County Commissioners
before such changes from the plans or Standards are
permitted. Any other changes shall be filed in the office of
the Department of Planning Services.
8 . The property owner or operator shall be responsible for
complying with all of the foregoing Standards . Noncompliance
with any of the foregoing Standards may be reason for
revocation of the Permit by the Board of County
Commissioners .

9. At such time the property ceases to be farmed , the
applicant/operator shall reseed the property to native
grasses by the following planting season.

The following business was transacted:
I hereby certify that pursuant to a notice dated October 15, 1986, and
-duly published October 23, 1986, in the Johnstown Breeze, a public
hearing was conducted to consider the request of Marvin A. Barstow for
a Use by Special Review for a single family residence on a parcel of
land less than the minimum lot size required in the Agricultural Zone
District. Chairman Pro-Tem Lacy explained that, there- being only four
Commissioners present, if this hearing should result in a tie vote, the
absent Commissioner would listen to the tape of this hearing and review
the record prior to casting the deciding vote. Lee Morrison, Assistant
County Attorney, made this matter of record. Debbie de Besche,
representing the Planning Department, read the favorable recommendation
of the Planning Commission into the record. This recommendation is
subject to three Conditions and nine Development Standards. Jerry
McRae, Engineer with McRae and Short, represented the applicant. He
requested that the testimony from the previous hearing, Docket Number
86-67, be incorporated into this hearing. He also explained that the
parcel under consideration at this hearing is currently all under
cultivation. No public testimony was received concerning this request.
Commissioner Brantner moved to approve this request for a Use by
Special Review, based upon the recommendation of the Planning
Commission. The motion was seconded by Commissioner Kirby and carried
unanimously.

MOTION:
Ann Garrison moved Case Number USR-757:86:37 for Marvin a Barstow for a Use
by Special Review permit for a single family residence on a parcel of land
which is less than the minimum required in the agricultural zone district be
forwarded to the Board of County Commissioners with the Planning
Commission's recommendation for approval based upon the recommendations as
outlined by the Department of Planning Services staff and the conditions and
Development Standards as amended. Motion seconded by LeAnn Reid.
The Chairman called for discussion from the members of the Planning
Commission. Discussion followed.
The Chairman asked the secretary to poll the members of the Planning
Commission for their decision. Lynn Brown - Yes, but she still has some
concerns over the size of the parcels that we are dealing with. Ivan
Gosneli - Yes; LeAnn Reid - Yes; Paulette Weaver - No, she is concerned
about finding a proliferation of this kind of subdivision in the County and
until we, as a County Government and as a county citizen, discuss the
concept of the 160 acres that we currently have in the Comprehensive Plan
she would be very reluctant to approve divisions of this size under 160
acres. Ann Garrison - Yes, because this would be putting the land into its
second best use, and she would agree to that with two constraints. The
first constraint, that the quality of the land be protected by the County,
and the second constraint, that the quality of life with the current and
future neighbors be protected. Jack Holman - No, he has always been of the
-opinion that once we do start something like this in an area like this then
there is no way to stop it. As you recall, some of the testimony from the
adjacent landowner was that he would like to do the same thing. Once we do
-open land up for this type of residential area we run into a problem
maintaining it down to that size. Motion carried with four voting for the
motion and two voting against the motion.

Gerry McRae, P.E. , McRae and Short Engineering Consultants, Inc. ,
represented the applicant. He asked that the testimony from the previous
case be applied to this request. This parcel is half grass and half pasture
and lies between the two 120 acre parcels. There is a residence on this
property and a well. It would be up to the owner to decide if he wishes to
destroy the current house and rebuild or remodel the existing house.
The Chairman called for discussion from the members of the audience. There
was none.
AMENDMENT:
Ann Garrison moved the conditions and Development Standards be amended to
include condition #3 and Development Standards #2 and 9 as amended in Case
Number USR-757. Motion seconded by Paulette Weaver.
The Chairman called for discussion from the members of the Planning
Commission. Discussion followed.
Debbie deBesche reported the recommendations, conditions, and development
standards are identical for Cases Number USR-757, 758, and 761 with the
-exception of the legal description.
The Chairman asked the secretary to poll the members of the Planning
Commission for their decision. Lynn Brown - Yes; -Ivan Gosnell - No, he
would prefer to see the entire parcel returned to native grasses. LeAnn
Reid - Yes; Paulette Weaver - Yes; Ann Garrison - Yes; Jack Holman - Yes.
Motion carried with five voting for the motion and one voting against the
-motion.
The Chairman asked Mr. McRae if he had any objections to the
recommendations, conditions, and Development Standards as stated and
amended. He stated he had no objections. The Chairman asked that reading
of these documents be dispensed with and that they be filed with the summary
as a -permanent record of the proceedings.

LOCATION: Approximately 3.5 miles northwest of Black Hollow Reservoir; west

NOTE: All references to the center 80 acre parcel shall apply to this
case. It contains the existing house and well. Half of this
property is farmed in dryland wheat and half is native grasses.
APPEARANCE:
Gerry McRae, P.E. , McRae and Short Engineering Consultants, Inc. ,
represented the applicant. He stated an error was -made when describing the
location of the previous parcels. This Case, IISR-761, is the middle parcel,
-and contains 80 acres, the house and the well. It is also the parcel that
is half in wheat and half in native grasses. USR-757 is the north parcel
and is entirely in grass. USR-758 is the south parcel and is all farmed
Aryland.
The Planning Commission instructed the clerk to make note of these
corrections.
Gerry McRae asked that all previous testimony be applied to this case with
the exception of the location of the parcels.
Debbie deBesche stated the recommendations, conditions, and Development
Standards are identical to the two previous cases with the -exception of the
legal description.

submitted by the applicant, other relevant information regarding the request
and the responses _of the referral entities which have reviewed this request.
The Planning Commission's recommendation for approval is conditional upon

1. The attached Development Standards for the Use by Special Review
permit be adopted and placed on the Use by Special Review plat
prior to recording the plat.
2. The Use by Special Review activity shall not occur nor shall any

1. The Use by Special Review permit is for a single family residence
as submitted in the application materials on file in the
Department of Planning Services and subject to the Development
Standards stated hereon.
2. The Use by Special Review site shall be maintained in accordance
with the soil conservation plan approved by the West Greeley Soil
Conservation District.
3. All Construction done on the property shall be in accordance with
the _requirements of the Weld County Building Code Ordinance.
4. The property owner or operator shall he -responsible for complying
with the Design Standards of Section 24.3 of the Weld County
Zoning Ordinance.
5. The property owner or operator shall be responsible for complying
with the Operation Standards of Section 24.6 of the Weld County
Zoning Ordinance.
6. Personnel from the Weld County Health Department and Weld County
Department of Planning Services, and Greeley Soil Conservation
Service shall be granted access onto the property at any

I have reviewed all three requests which involve breaking the E 1/2 of
Section 18, T8N, R67W into three parcels for development purposes, all of
which are smaller than the 160 acre requirement .
Th_e E 1/2 of Section 18, TSN, R67W is almost entirely made up of soils
which are C: lass VI , non- irrigated. The proposal by Mr . Barstow is to
divide the :320 ac . into 3 parcels with two 120 ac . parcels or, the north and
south ends and one 80 ac: . parcel in the middle. The north 120 ac . parcel
wi I l be made up of approximately 90 ac . of grassland and 30 ac . non-
irrigated cropland. The middle 80 ac . parcel wi l l be made up of 75 ac . of
non- irrigated cropland and 5 ac . in farmsteads , buildings, etc . The south
120 ac . parcel will be made up of all non- irrigated cropland . All parcels
should be considered for development land with other land use as secondary.
The main criteria for- setting minimum tot size was to set the example
needed to maintain the land in a productive agricultural prospective . The
lands presently in non- i rr- mated cropland are not cropland suited due to
shallow soils , steep slopes and erosion factors that exceed erosion limits
under normal farming practices .
The main concern is that the new landowners will not tie primarily
agricultural oriented and will not have the ava i t ab i I i ty or technical
knowledge to farm the land in a conserving manner . Therefore , I recommend
that those lands presently in non- irrigated cropland be reseeded to grass
( permanent vegetative cover ) to reduce erosion potential and return all
sites to the best suited landuse, grassland , and that the reseeding should
be made a condition of USR approval .

NOTICE OF PUBLIC HEARING
The Weld County Planning Commission will conduct a public hearing on October
7, 1986, at 1:30 p.m. to review a request for approval of a Use by Special
-Review permit for a single family residence on a parcel less than the
_minimum lot size required in the Agricultural Zoned district from Marvin A.
Barstow. The parcel of land is described as part of the Si SE} and Si Ni
SE} of Section 18, T8N, R67W of the 6th P.M. , Weld County, Colorado,
containing 120 acres, more or less. The property is located approximately
3} miles northwest of Black Hollow Reservoir.
The public hearing to be held by the Weld County Planning Commission for the
consideration of the above referenced request will be conducted in the Weld
County Commissioners' Hearing -Room, First Floor, Weld County Centennial
Center, 915 Tenth Street, Greeley, Colorado. Comments or objections related
to the abuve request should be submitted in writing to the Weld County
Department of Planning Services, 915 Tenth Street, Room 342, Greeley,
Colorado 80631, before the above date or presented at the public hearing
on October 7, 1986.

STATEMENT DT USE
We -are requesting a "Use by Special Review" to allow one residential home
and appurtenant outbuildings on a 120 acre parcel located in the agricultural zone.
The home and appurtenant outbuildings will be located in the " building envelope"
designated on the plat and contains just under one acre. The ground is currently
in dryland wheat, and the intent is to leave the balance of the ground (approximately
119 acres) in this use. The primary Agricultural usage of the property is being
maintained intact.
This request is to allow a 120 acre unit in an Agricultural Zone with Dry-
land classification, whereas the normal -size is 1b0 acres. This smaller unit will
allow either -a farmer to start with a smaller acreage and less investment OR a
residential unit in an agricultural atmosphere for those who desire an agricultural
life style without a full need to make a living from the farming operation.
The existing uses in the general area are rural residential and agricultural .
There is an existing home one mile south ofthe subject property, and another home
approximately 1-1/2 miles northwest of the site.
Properties in the vicinity vary -from about 5 acres to 640 acres , with most
of the units being about 160 acres.
Only a single family residence with agricultural related structures such as
garages , barns , corrals , etc. as allowed in the Agricultural Zone are teing requested.
No special uses are being requested and all 'proposed uses for agricultural use, farm
animals , waste disposal , fire 'protection, storm water retention facilities, traffic
landscaping, erosion control and reclamation will be as -governed by the Agricultural
Zone.
Electric-al 'power and telephone lines are existing in County Road 15 adjacent
to the 'property. Sewage disposal will be handled by an onsite septic system. Do-
mestic water will he provided by a domestic well . A well 'permit will be obtained
from the State Engineer upon approval of this application. There is an existing water
well in the East Half of Section 18.
Access to this property is directly off of Weld County Road 15. The driveway
access point is shown on the map and was designated to provide good visibility from
both directions and for efficient access to the building envelope.

STATEMENT OF COMPLIANCE
The integrity of the policy of the Weld County Comprehensive Plan will not
be jeopardised as this proposed use will not appreciably affect the present use or
make-up of this dryland area, i .e. a single f-amity residential unit will be allowed
on a 120 acre tract which will remove a minimal amount of land from production. A
ne\ residential unit will increase the tax base without adverse effect on any
utilities or services .
The proposal is consistant with the intent of the agricultural district as
the primary use of the land will remain in its present agricultural use. The soils
in the area are rated as a capability Class Vi , -dryland with severe limitations to
cultivation and crops.
The location of the residential unit was selected for the normal reasons
of home siting i .e. , distance from traffic, view, spare, -etc, The productive agri—
cultural dryland has been conserved to the extent possible with the 'creation of
only a small residential site and access road.
Normal provisions for access , building separation, construction to Codes
etc. will provide the standard protections for the health and safety of the inhabi—
tants of the site, neighborhood and county.
The proposed use is compatible with the existing surrounding uses of dry-
land farming as it is -the same. Only uses permitted on the adjoining properties
will be permitted on this property. The site is -many miles from any urban areas and
appears to be compatible to any future development of the area.
The area does not lie within any -flood plain, geological hazard or airport
overlay districts , and therefore complies with the Zoning Ordinance.
Domestic water will be supplied from a domestic -well . A well permit will
be obtained from the State Engineer on approval of this -application and prior to
the sale of the parcel . Other wells are in operation serving the residential units
in the vicinity.

Available water capacity Is moderate. Effective rooting
depth is 20 to 40 inches. Runoff is slow, and the hazard
of water erosion is moderate to high. The hazard of soil
blowing is moderate.
This unit is used as rangeland.
The potential plant-community on this unit is mainly
blue grama, sand dropseed, prairiesandreed, and
needieandthread. The average annual production of air-
dry vegetation ranges from 700 to 1,800 pounds.
If the range is overgrazed, the proportion of-preferred
forage plants decreases and the proportion of less
preferred forage plants increases. Therefore, livestock
grazing should be managed so that the desired balance
of preferred species is maintained In the plant
community.
Range-seeding is suitable if the range Is in poor
condition. The plants selected for seeding-should meet
the seasonal requirements of livestock or wildlife, or
both. Other management practices that are-suitable for
