RESOLUTION RE: APPROVE SITE SPECIFIC DEVELOPMENT PLAN AND SPECIAL REVIEW PERMIT FOR A VEHICLE SALES AND SALVAGE OPERATION IN THE I-3 (INDUSTRIAL) ZONE DISTRICT - GARY AND MARY ANN TUTEN WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners held a public hearing on the 13th day of December, 1989 , at the hour of 10 :00 a.m. in the Chambers of the Board for the purpose of hearing the application of Gary and Mary Ann Tuten, 10088 Zenobia Court, Westminster, Colorado 80030, for a Site Specific Development Plan and Special Review Permit for a vehicle sales and salvage operation in the 1-3 (Industrial) Zone District on the following described real estate, to-wit: Part of the S}NW} , Section 20 , Township 1 North, Range 66 West of the 6th P.M. , Weld County, Colorado WHEREAS, said applicants were present, and WHEREAS, Section 24 .4 . 2 of the Weld County Zoning Ordinance provides standards for review of said Special Review Permit, and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, has studied the request of the applicant and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter and, having been fully informed, finds that this request shall be approved for the following reasons: 1 . The submitted materials are in compliance with the application requirements of Section 24 .7 of the Weld County Zoning Ordinance. 2 . It is the opinion of the Board of County Commissioners that the applicant has shown compliance with Section 24 .4 .2 of the Weld County Zoning Ordinance as follows: a. The proposal is consistent with the Weld County Comprehensive Plan' s Industrial and Urban Growth Boundary Goals and Policies. The Cities of Fort Lupton and Brighton have reviewed this proposal and recommended conditional approval. The proposal is consistent with the intent of the I-3 (Industrial) Zone District and is provided for as a Use by Special Review. c. The proposed use is compatible with the existing surrounding land uses which are an oilfield support and service facility, cattle feedlot, railroad, pasture, old U. S. Highway 85 , and farm production. The Special Review Permit Development Standards will ensure the use will be compatible with the existing and future development of the surrounding land uses as permitted by the I-3 (Industrial) and A (Agricultural) Zone Districts. d. No overlay districts affect the site. e. The Special Review Development Standards will provide adequate protection of the health, safety and welfare of the neighborhood and County. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the application for a Site Specific Development Plan and Special Review Permit for a vehicle sales and salvage operation in the I-3 (Industrial) Zone District on the hereinabove described parcel of land be, and hereby is, granted subject to the following conditions: 1 . The attached Development Standards for the Special Review Permit shall be adopted and placed on the Special Review plat prior to recording the plat. The plat shall be delivered to the Department of Planning Services and be ready for recording in the office of the Weld County Clerk and Recorder within 15 days of approval by the Board of County Commissioners . 2 . The Special Review activity shall not occur nor shall any building or electrical permits be issued on the property until the Special Review plat is ready to be recorded in the office of the Weld County Clerk and Recorder. 3 . Prior to recording the plat: a. A copy of a soil erosion control plan and landscaping plan, approved by the West Adams Soil 891299 Page 3 RE: USR - TUTEN Conservation District, shall be submitted to the Department of Planning Services; b. Evidence that the Division of Water Resources has approved a water supply for the proposed Use by Special Review; and c. The Site Specific Development Plan and Special Review Permit is for a vehicle sales and salvage operation in the I-3 (Industrial) Zone District as submitted in the application materials on file in the Department of Planning Services and subject to the Development Standards stated herein. 2 . Approval of this plan may create a vested property right pursuant to Article 68 of Title 24, C.R.S. , as amended. 3 . All salvage materials or materials waiting to be salvaged shall be stored inside a building or visually screened from public right-of-way and adjacent properties as shown herein. 4 . The property shall be maintained at all times in compliance with SARA Title III . 5 . All liquid and solid wastes shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. Specific provisions shall be made to protect against groundwater pollution from spilled hydrocarbon materials. 6 . Any required Emissions Permit shall be obtained from the Air Pollution Control Division, Colorado Department of Health for Emissions. 7 . No permanent disposal of wastes shall be permitted at this site. 8 . A spillage retention berm shall be required around any tank battery. The volume retained by the spillage berm should be greater than the volume of the largest tank inside the berm. 9. The septic system for the proposed shop facility shall be designed by a Colorado Registered Professional Engineer according to the Weld County Individual Sewage Disposal Regulations. 10 . All waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, blowing debris , and other potential nuisance conditions. 11 . Fugitive dust shall be confined on this site. 891299 Page 2 DEVELOPMENT STANDARDS - TUTEN 12 . Maximum permissible noise level shall not exceed the commercial limit of 70 dB (A) , as measured according to 25-12-102, Colorado Revised Statutes. 13 . Fences used for visual screening shall be maintained in good repair at all times and broken or vandalized materials repaired or replaced with substantially similar kind. The fence shall be solid board fence on the west property line and around the dwelling, all other fences shall be chain link with slates of an earth tone color installed. 14 . Prior to the start of the operation and/or locating vehicles on the property, evidence shall be submitted to the Department of Planning Services that the Weld County Health Department has approved the location and installation of the three recommended groundwater monitoring wells. The water from the three groundwater monitoring wells shall be sampled annually and tested for total petroleum hydrocarbons. The results from these tests shall be submitted to the Weld County Health Department for review. 15. All construction on the property shall be in accordance with the requirements of the Weld County Building Code Ordinance. 16 . The property owner or operator shall be responsible for complying with the Design Standards of Section 24 .5 of the Weld County Zoning Ordinance. 17 . The property owner or operator shall be responsible for complying with the Operation Standards of Section 24 . 6 of the Weld County Zoning Ordinance . 18 . Personnel from the Weld County Health Department and Weld County Department of Planning Services shall be granted access onto the property at any reasonable time in order to ensure the activities carried out on the property comply with the Development Standards stated herein and all applicable Weld County Regulations . 19 . The Special Review area shall be limited to the plans shown herein and governed by the foregoing Standards and all applicable Weld County Regulations. Major changes from the plans or Development Standards as shown or stated shall require the approval of an amendment of the Permit by the Weld County Planning Commission and the Board of County Commissioners before such changes from the plans or Development Standards are permitted. Kirby, Chairman Commissioner Gene R. Brantner, Pro-Tem Commissioner Constance L. Harbert - Excused Commissioner George Kennedy Commissioner Gordon E. Morrison Planning Department representative, Keith Schuett The following business was transacted: I hereby certify that pursuant to a notice dated November 8, 1989, and duly published November 30, 1989, in The New News, a public hearing was conducted to consider the application of Gary and Mary Ann Tuten for a Site Specific Development Plan and Special. Review Permit for a vehicle sales and salvage operation in the I-3 (Industrial) Zone District. Lee Morrison, Assistant County Attorney, made this matter of record. Keith Schuett, Planning Department representative, entered the favorable recommendation of the Planning Commission into the record. Gary Tuten, one of the applicants, came forward to explain this request. He said that this is not intended as a "junk yard", but is to be a "state of the arts" used parts operation. He stated that vehicles will be dismantled, and parts cleaned and shelved. Discussion was held about the type of screening required by the Development Standards. Adjacent property owners Wayne Adams, Jim Adams, and Helen Adams came forward to speak in opposition to this request. They objected to the visual impact of this nature of operation. Mr. Schuett answered questions of the Board as to what would be allowed as a use-by-right in the I-3 Zone District. Mr. Tuten explained that they plan to live on the site, and that they will salvage pickup trucks only. Mary Ann Tuten, the other applicant, said they intend to beautify the area. Chairman Kirby advised the applicants that, with only four Commissioners present, if this hearing should result in a tie-vote, the absent Commissioner would review the record and listen to the tape before casting the deciding vote. Commissioner Lacy reviewed the criteria to be used in considering a Special Review Permit, and moved to approve this request, subject to the Conditions and Development Standards contained in the Planning Commission's recommendation.
