Dear Bruce :
I have reviewed the new draft of Ordinance 108-A and there seems to be
several paragraphs that need to have some inclusions as to our comments at
the reviews meeting of January 20 , 1986 .
Article I --General Provisions ; Section III-Definitions , ( 1 ) Conservation
Plan , Page 3
We need ti: add another paragraph which states the following :
"The plan shall also include a soils map , soils descriptions with land
capability classification in accordance with United States Department
of Agriculture Land Capability Classification System. "

The draft left out the requirement of having a plat map showing the
location of the permit . It is recommended Item ( 3 ) should read as
follows :
" ( 3 ) Map ( s ) delineating the proposed area of the permit by Township ,
Range , and Section .
Thereafter , the item numbers will need to be changed to ( 4 ) , i5 :r , ( 6 ) , and
( 7 ) on page 5 .
On page 8 , the third paragraph discusses the exchange of poor cultivated
land for better suited cropland that is in grassland . We suggest that
changes be made in this paragraph to restate the intent .

"Any person presently cultivating lands with land capability
classification classes V-VIII may begin to cultivate grasslands with
class I - IV lands if they first follow the procedure established by
this ordinance to obtain a permit by presenting an approved
conservation plan for the grassland to be plowed and a revegetation
and management plan for the class V-VIII lands . The Board of County
Commissioners may only require the permittee to provide the security
mentioned above in an amount equivalent to 100% of the estimated cost
of revegatating the previously cultivated class V-VIII acreage .
Security may be released after permanent vegetative cover has been
established and the management plan has been satisfactorily
implemented . "
The 108-A amendment does not adequately provide for a change due to
increase in technology . In other words , if a present permittee makes a
change in his conservation plan due to an improved technology , he is
penalized by having to file an amended plan and then becomes subject to
108-A and has to provide revegetation security for his entire plan . It
seems_• to me that there should be a way that these types of plan amendments
could be made and filed without the security requirement . Perhaps a
section on voluntary plan amendments could be added . I am looking for a
way not to punish the good operator who has made the effort to comply with
the system .
