ELWORTHY WHEREAS , the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS , the Board of County Commissioners held a public hearing on the 15th day of July, 1987 , at the hour of 2 :00 p.m. in the Chambers of the Board for the purpose of hearing the application of Shawn C . Elworthy, 960 Hemlock Drive, Windsor, Colorado 80550 , for a Use by Special Review for a commercial welding shop in the A-Agricultural Zone District on the following described real estate, to-wit: Part of the W} , Section 32 , Township 7 North, Range 67 West of the 6th P.M. , Weld County, Colorado WHEREAS , said applicant was present, and WHEREAS , Section 24 .4 . 2 of the Weld County Zoning Ordinance provides standards for review of said Use by Special Review, and. WHEREAS , the Board of County Commissioners heard all of the testimony and statements of those present, has studied the request of the applicant and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter and, having been fully informed, finds that this request shall be denied for the following reasons : 1 . It is the opinion of the Board of County Commissioners that the applicant has not shown compliance with Section 24 .4 .2 of the Weld County Zoning Ordinance as follows : a. The proposal is not consistent with the Weld County Comprehensive Plan due to the proximity of this location to the Town of Windsor and the existing subdivision. b. The proposal is not consistent with the intent of the district in which the use is located or with existing surrounding land uses . c . ELWORTHY A public hearing was conducted on July 15, 1987, at 2:00 P.M. , with the following present: Commissioner Gordon E. Lacy, Chairman Commissioner C.W. Kirby, Pro-Tem Commissioner Gene Brantner Commissioner Jacqueline Johnson Commissioner Yank Yamaguchi Also present: Acting Clerk to the Board, Mary Reiff Assistant County Attorney, Zee D. Morrison Planning Department representative, Rod Allison The following business was transacted: I hereby certify that pursuant to a notice dated May 27, 1987, and duly published July 2, 1987, in the Johnstown Breeze, a public hearing was _conducted to consider the request of Shawn C. Elworthy for a Use by Special Review for a commercial welding shop in the A-Agricultural Zone District. Lee Morrison, Assistant County Attorney, made this matter of record. Rod Allison, Planning Department representative, read the recommendation of the -Planning Commission for denial of this request into the record and distributed copies of a letter received by the Planning staff regarding this request. Shawn Elworthy, the applicant, came forward to further explain his request. He said he pursues welding mainly as a hobby -and occasionally sells some items. Photographs of the building which he uses were submitted as Exhibits H and I. John Longwell, operations manager of Golden Buckeye Petroleum, came forward and said Mr. Elworthy, who is employed by them, has done some welding for them, and they have used his facility to do some truck repair. Since Golden Buckeye will soon have their own building, much of the inconvenience to the neighbors will soon be eliminated. Residents of the neighborhood who spoke in opposition to this request were: Ron Hoffman, Jim Rutz, and Clint Wells. Mr. Hoffman also presented letters from neighbors who were unable to be present at this hearing. In the discussion which ensued, it was clarified that Mr. Elworthy would be able to weld items for his own use without a Use by Special Review. Commissioner Kirby moved to deny the request for a Use by Special Review, based upon the recommendations of the Planning staff and Planning Commission. -He also reviewed the criteria to be considered for a Use by Special Review. Commissioner Yamaguchi seconded the motion. Commissioners Johnson, Brantner and Lacy each stated that they would vote for the motion. The motion to deny the Use by Special Review carried unanimously. This is in regards to the property -on the East side of County Rd . 15 and North o4 Rd . 74, immediately accross from the Roth Subdivision . As a property owner in the Roth subdivision , I am opposed to the rezoning of this adjacent property so as to allow a commercial welding operation . Property owners in this subdivision did not spent' millions of dollars , collectively speaking , to move to a quiet , country atmospher-e nearly -Four miles from town to have a welding shop ruin those surroundings -overnight . There ar-e many lo-cations that -could support a business of this nature with no ill -eff-ects , -however this area can 't . The problems would be several . The building erected on the property is a large garage and he does some welding here which he considers a hobby because he has a good job. He was not aware that he needed a Use by Special Review permit. He was also not aware he needed a building permit because the property is in the agricultural zone and is not in a subdivision. He did obtain an electrical permit and when the inspection was done, nothing was said about needing a building permit. The proposed site for a Use by Special Review for a commercial welding shop is not compatible with the surrounding land uses. Roth Subdivision is located west and northwest of the proposed site across Weld County Road 15. Roth Subdivision is a residential subdivision containing 57 lots. Approximately 47 single family homes have been built in Roth Subdivision. A typical lot in Roth Subdivision is one acre, more or less, in size containing a custom built home with a landscaped yard. A residential homesite is the principal use. No Use by Special Review permits exists in the Moth Subdivision. We are ademently opposed to this being changed to a commercial zone for the following reasons: 1.) Commercial operations do not fit into the scheme of the area — residential and agricultural zone. 2.) This would set a precedence which would eventually make it hard to stop others wanting to do the same thing. 3.) R.E. item 2(a) on application response: On numerous occasions we have noticed 3 to 4 pickups and 4 to 6 people. 4.) R.E. item 2(f) on application response: Four to five times a week does not constitute occasional use. Work will sometimes continue until 11:00 P.M. 5.) R.E. item 2(p) on application response: I doubt that any reseeding of property will happen as he has built a dirt bike track for his son and himself that takes up approximately 1 1/2 acres. At present the driveway he uses is dirt and creates mud problems on County Rd. #15 when used after a storm. 870613 6.) R.E. item 3(d) on application response: All equipment and material is not stored within the building. Several pieces of equipment are stored along side the building with quite a bit of pipe. (See attached pictures) 7.) R.E. item 3(f) on application response: There is only one outbuilding of similar size and shape to his in the area. This building was put up in the same manner as his: it was put up quickly and the owner then said he was ignorant about the rules and regulations. Recently a commercial operation (within the last year) it was shut down for zoning violations. This building has long been a sore spot to the people in the area; obvious that it is not compatable with the surrounding area. As for other outbuildings in the area, they consist of storage sheds or animal shelters that are much, much smaller then Mr. Elworthy's building. 8.) His building has hindered our view from our front and totally blocked out our neighbor's view to the south (Rutzs') 9.) We feel it has hurt our property value the way it is and willhurt it even further if a commercial operation is established. 10.) He says he will only use it occasionally for commercial operations. This sounds like good intentions, but I have seen many good intentions abandoned because of changed conditions. This rezoning does not say "For occasional use only." From occasional use comes full time use. 11.) I also feel that if this is passed that it would be a slap in the face to the people of Weld County. It would show that anyone can come in and do what they want without regard to the rules and regulations of Weld County, the UBC, and neighbors rights and feelings. These regulations were put into effect to preserve the rights and feelings of the majority. In this case I am sure the majority of people involved, plus some, would agree with me. (a) I have erected a metal building for the _purpose of -storage of certain equipment in compliance with Weld County Zoning Ordinances, however I would like to _lo some commercial welding from time to time. I use the building and property for my own personal use. Relatives and friends use it for light mechanical work on their cars or welding on their trailers or pick-ups (bumpers, etc) . On an occational basis, I do -some welding for the company I work for, Golden Buckeye Petroleum Corp. -I have built some cattleguards, wellhead railings, bumpers for trucks, headache racks for pick-ups, etc. All of the stated activities are done indoors so as not to create an eyesore for neighbors and any occasional noise is contained inside. I have already erected a fence on the Northwest corner of the building and a berm East of the building to block from view some stored iron and materials. (b) The need for use of the building is to help offset the high cost of my small acreage which I intend to build my home on a later date. (n) The is proper drainage around building and the building is at the top of a small hill. (o) Use of the building is mimimal, so waste is minimal. Trash etc. is hauled to my house to be disposed of weekly by the trash service. Scraps are reused and junk iron is sold. (p) I'm going to reseed the area with pasture grass. I also propose to plant trees on the property and do more landscaping when the home is -built. The driveway to the building will be graveled. This small area of land was non-economical to farm. This is the reason Fred and Gertrude Ziel chooseto obtain a Recorded Exemption # 0705-32-2—RE 918 to sell the propertyto us. It has been and will remain pasture grass except a small corner in which a building has been built. Therefore, the continued use of this land will not endanger any agricultural land. Consistant with the Agricultural Goal #4, the building is adjacent to Windsor City Limits. Consistant with Agricultural Goal #6, we intend to build a home at the site in the future. (b) Covered in (a) above. We intend to build a nice home consistant to Roth and Foster Subdivisions. We are not taking valuable farm ground out of production. (c) Not applicable. Explained in 3. (a) above. The land was not economically productive as farm land. (d) All equipment is stored within a locked building and as stated before, there are fire extinguishers available. All the welding is done inside an enclosed facility. The area is protected by the Windsor Fire Dept. and after contacting them, we found out that it takes approximately 7 minutes to respond to a call in this area. They carry 4000 gallons of water with them. There are no flammable liquids stored in the building, and based on thee facts, there is no danger to the inhabitants of the r06q neigh 8 3 3. (d) neighborhood. The land is far safer now, then when Ziels owned the property. They were issued a warning to clean up a dump area with much trash and debris, lie was going to cover it up with a few inches of dirt and call it good. Before we had a deed to the property we paid to have a dozer come and clean up the health hazard properly. The land in fact is safer than most farms in the area because there are no large fuel tanks on the proerty as most farms have. (e) Existing land uses are residintial and agricultural and use will be compataible because it is no different than the activities of any farm shop.
