RE: APPROVE INTERGOVERNMENTAL AGREEMENT BETWEEN WELD COUNTY AND
TOWN OF EATON AND AUTHORIZE CHAIRMAN TO SIGN
WHEREAS , the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS , the Board has been presented with an
Intergovernmental Agreement between Weld County and the Town of
Eaton regarding implementation of a Rental Rehabilitation Program,
and •
WHEREAS , the terms and conditions are as stated in said
Agreement, and
WHEREAS, after review, the Board deems it advisable to
approve said Intergovernmental Agreement, a copy of which is
attached hereto and incorporated herein by reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the Intergovernmental
Agreement between Weld County and the Town of Eaton regarding
implementation of a Rental Rehabilitation Program be, and hereby
is , approved.
BE IT FURTHER RESOLVED by the Board that the Chairman be, and
hereby is , authorized to sign said Intergovernmental Agreement.
The above and foregoing Resolution was , on motion duly made
and seconded, adopted by the following vote on the 12th day of
June , A.D. , 1989 .

INTERGOVERNMENTAL AGREEMENT

THIS AGREEMENT. entered into this 10th day of October
19,8,8 . by and between the BOARD OF COMMISSIONERS OF WELD COUNTY ,
COLORADO, a body politic of the State of Colorado, hereinafter called
"the COUNTY" and the Town...of.._E�tQfL ._. ._...... .. ....._..... , a body politic
hereinafter called " The Town
WITNESSFTH:
WHEREAS. pursuant to the Housing and Urban-Rural Recovery Act of
1983. hereinafter called "the ACT, " the United States. acting by and
through the Secretary of the Department of Housing and Urban
Development , hereinafter called "HUD, " has made available to the State
of Colorado certain funds for the implementation of a Rental
Rehabilitation Program; and
WHEREAS. the State of Colorado, through the Department of Local
Affairs has the legal authority to provide funds to counties for
Rental Rehabilitation activities; and
WHEREAS, the Town has expressed interest in allowing the
program to operate within its jurisdiction; and
WHEREAS, the County has indicated a willingness to submit a
program proposal to the State to carry out the HUD Rental
Rehabilitation ; and
WHEREAS. the partic hereto desire to provide assurances and
delineate the areas of cooperation between the County and the
Town with respect to Rental Rehabilitation activities;

NOW. THEREFORE. in furtherance of said RESOLUTION. and in
consideration of the mutual conditions, covenants and agreements
herein contained, it is agreed by and between the parties as follows:
1 . Planning the Rental Rehabilitation Program: Thn parties,
through their executives and staff , shall cooperate with each other in
developing the Rental Rehabilitation proposal , with all parties giving
due consideration to the needs of its citizens and goals. objectives.

?. Term of the Agreement: This Agreement shall remain in ,ll
force and effect for so long as the parties to this Agreement are
pursuing Rental Rehabilitation funding for said proposed project or .
if awarded, carrying out such project activities. Any party to this
Agreement may, however. terminate its participation in this Agreement
six months after providing written notice of such termination to the
other parties to this Agreement . This Agreement may be terminated at
any time by agreement of all parties to this Agreement unless a grant
contract is in effect with the State. In this case. the State must
approve such termination and arrangements for completing the project.
3. Authorization to Submit a Proposal : The County is authorized
to submit a proposal to the State on behalf of the Town to
apply for funds under the HUD Rental Rehabilitation Program and to act.

negotiations, presentations or information in conjunction with the
grant application.
a. Responsibilities: the Town shall have no
obligations or responsibilities, financial or otherwise, concerning
the administration of the Rental Rehabilitation Program and the County

agrees to indemnify _the Town _ from any and all liability,
loss or damage ..... the _TOwn-_ __.___ __ may suffer in connection with the
administration of the project upon approval of the proposal .
