Permit number 1277 was issed to allow a 14'x75' mobile home to be placed on site as an accessory to farm dwelling. Later in 1977 the classification principal dwelling was created. Consequently the planning staff has decided that all accessory to farm should be reclassified as principal dwelling when practical . The planning staff has stated that permit 1277 is no longer good and therefore Cactus Hill Ranch Company has been deemed to have a mobile home without a zoning permit. The following reasons are presented to the Board of County Commissioners as sufficient grounds to approve this site. 1. The lot has been continually used since 1977 as a mobile home site. The site has been maintained and permitted since this time. Therefore, Cactus Hill Ranch still has the right to use this site. 2. Three mobile homes have been placed on this property since 1977. Each has been given building permits by the county establishing the precident that this has and still is a valid site. 3. The site conforms to the Weld County Planning Commission Policies adopted and in force since September 21, 1971. These policies require that sufficient ground be allowed for the construction of principal dwellings on farm sites and settings. This is the only site on this farm set aside for a farm dwelling and as such conforms to these policies. 4. The proposed site is consistent with the Weld County Comprehensive Plan. This plan demands that prime agricultural land use be maintained. This proposal ensures that prime agricultural land can be maintained by providing adequate housing for the labor required to cultivate and till the soil . Without proper labor it is impossible to maintain agricultural land use. The Comprehensive Plan therefore summons us to set aside this area for adequate housing for the proper superintendence of the land. Board of County Commissioners January 18, 1985 Page 2 5. The state' s agricultural industry would be fostered by this site. Insuring proper housing on the farm will inure to the attraction of employees in the agricultural sector. State law compels therefore to adopt this area as a principal dwelling. (CRS 30-28-155) 6. The organic laws of the United States require us to allow men to live where they may choose, for it states that any government that endeavors to prevent the population of these States from migrating freely is unfit to rule a free people. (USC xxxii) 7. The laws of nature have placed upon man the unalienable Right to multiply and replenish the earth. Man has dominion over all the earth and any law which attempts to limit this Higher Law is unjust and unjustifiable.
