HomeMy WebLinkAbout860793.tiff RESOLUTION RE: APPROVAL OF USE BY SPECIAL REVIEW FOR AGRICULTURAL SERVICE FACILITY FOR SUGAR BEET STORAGE - SEKICH FARMS WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado _statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners held a public hearing on the 13th day of August, 198-6 , at the hour of 2 : 00 p.m. in the Chambers of the Board for the purpose of hearing the application of Sekich Farms , P.O. Box 508 , Longmont, -Colorado 80501 , for a Use by Special Review for an agricultural service facility for sugar beet storage an the following described real estate , to-wit: Part of the $1 , Section 19 , Township 3 North, Range 67 West of the -6th -P.M. , Weld County, Colorado WHEREAS, Section 24 .11. 2 of the Weld County Zoning Ordinance provides standards for review of said Use by Special Review, and WHEREAS , the Board of County Commissioners -heard all of the testimony and statements of those present, has studied the request of the applicant and the recommendation of the Weld County Planning Commission and all of the exhibits and evidence presented in this -matter and, having been fully informed, finds that this request shall be approve-d for the following reasons : 1 . The submitted materials are in compliance with the application requirements of Section 24 . 7 of the Weld County Zoning Ordinance. 2. It is the opinion of the Board of County Commissioners that the applicant has shown compliance with Section 24. 4 . 2 of the Weld County Zoning Ordinance as follows: a. The proposal is consistent with the intent of the Weld County Comprehensive Plan . The Comprehensive Plan encourages the development of agribusiness and agriculturally oriented industry provided these enterprises do not adversely affect the local economy or environment. b. The proposed use is an agricultural activity and is, therefore, consistent with the intent of the Agricultural -Zone District. /1/ i Page 2 RE: USR, SEKICH FARMS c. The uses permitted will be compatible with the existing surrounding land uses and with future development of the surrounding area as permitted by the Agricultural Zone District. d. No overlay districts affect the site. e. The Use by Special Review Development Standards will provide adequate protection of the health, safety and welfare of the neighborhood and County. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the application for a Use by Special Review for an agricultural service facility for sugar beet storage on the hereinabove described parcel of land be, and hereby is, granted subject to the following conditions: 1. The attached Development Standards for the Use by Special Review permit be adopted and placed on the Use by Special Review plat prior to recording the plat. 2. The Use by _Special Review activity shall not occur nor shall any building or electrical permits be issued on the property until the Use by Special Review plat has been delivered to the Department of Planning Services Office and the plat is ready to be recorded in the office of the Weld County Clerk and Recorder. 3. Prior to recording the Use by Special Review plat, the plat shall show a total right-of-way of seventy-five (75) feet from the centerline of Colorado State Highway 66. 4 . Prior to the recording of the Use by Special Review plat, the applicant and/or operator shall submit to the Department of Planning Services an agreement between the property owner and the Highland Ditch Company, Outlet #3 Ditch, regarding the ditch crossing shown on the plat map and roadways parallel to the ditch. 5. Prior to the recording of the Use by Special Review plat map, the applicant and/or operator shall submit to the Department of Planning Services an agreement between the property owner and the owners of the Rademacher Lateral Ditch Company concerning the ditch realignment. 6 . Construction of the bridge across the Highland Ditch Company' s Outlet #3 Ditch and the access improvements to 860793 Page 3 RE: USR, SEKICH FARMS Weld County Road 13 shall be completed within thirty days of approval by the Board of County Commissioners or use of the site as a sugar beet dump, whichever occurs first. 7. Prior to recording the Use by Special Review plat, the owner of the ditch pipeline shall submit to the Department of Planning Services an agreement with the owner/operator addressing protection of the pipeline easement. The Use by -Special Review permit is for an agricultural service facility for receiving and storing of sugar beets as submitted in the application materials on file in the Department of Planning Services and subject to the Development Standards stated herein. 2. Access shall be limited to Weld County Road 13 , and shall not be located on the Highland Ditch Company (Outlet #3 Ditch) right-of-way as indicated on the plat map and shall be constructed and maintained to meet the requirements of the Weld County Engineering Department as listed below: A. The entrances are to have paved aprons that consist of six inches of aggregate base course and three inches of asphalt pavement. The apron shall be fifteen feet wide and have a fifty-foot radii and extend fifty feet from the existing pavement. This entrance shall be maintained by the operator of the Use by Special Review permit. B. The fifteen inch CMP culvert shall be extended to maintain a one-way fifteen foot access lane. C. Delineators shall be located on Weld County Road 13 next to the bridge on both sides. D. Weeds shall be removed and the roadway shall be maintained in such a manner as to expose the existing ditch and the edge of the bridge. E. Signs shall be installed at both entrances directing traffic and on Weld County Road 13 stating "Truck Entrance, " in accordance with the Manual on Uniform Traffic Control Devices. 3 . Portable chemical sanitary facilities shall not be used on the property. A vault constructed according to the Weld County Individual Sewage Disposal System Regulations shall be used for the individual sewage disposal system. 4 . Wastes and trash shall be disposed of in an approved landfill. No on-site disposal of sugar beets shall be allowed. 860793 Page 2 RE: DEVELOPMENT STANDARDS - USR, SEKICH FARMS 5 . Sugar beets shall be handled and stored at the facility in such a manner that no nuisance is created by _odor, blowing debris, fugitive dust or spoiled sugar beets on or around the facility in accordance with the Weld County Health Department Regulations. 6. All construction done on the property shall be done in accordance with the requirements of the Weld County Building Code Ordinance. 7 . The property owner or operator shall comply with the design standards for Use by Special Review, Section 24 .5 of the Weld County Zoning Ordinance. 8 . The property owner or operator shall be responsible for complying with the Operation Standards of Section 24. 6 of the Weld County Zoning Ordinance. 9 . Personnel from the Weld County Health Department , Weld County Engineering Department, and Weld County Department of Planning Services shall be granted access onto the property at any reasonable time in order to insure the activities carried out on the property comply with the Development Standards stated herein and all applicable Weld County Regulations. 10 . The Use by Special Review area shall be limited to the plans shown herein and governed by the foregoing Standards and all applicable Weld County Regulations. Any material deviations from the plans or Standards as shown or stated shall require the approval of an amendment of the Permit by the Weld County Planning Commission and the Board of County Commissioners before such changes shall be filed in the office of the Department of Planning Services . 11. The property owner or operator shall be responsible for complying with all of the foregoing Standards . Noncompliance with any of the foregoing Standards may be reason for revocation of the Permit by the Board of County Commissioners. 860793 HEARING CERTIFICATION DOCKET NO. 86-49 RE: USE BY SPECIAL REVIEW FOR AN AGRICULTURAL -SERVICE FACILITY (SUGAR BEET STORAGE) , SEKICH FARMS A public hearing was conducted on 13th day of August, 1986, at 2:00 P.M. , with the following present: Commissioner Jacqueline Johnson, Chairman Commissioner Gordon E. Morrison Planning Department representative, Gloria Dunn The following business was transacted: I hereby certify that pursuant to a notice dated July 14, 1986, and duly published July 31 , 1986, in the Johnstown Breeze, a public hearing was conducted to consider the request of Sekich Farms for a Use by Special Review for an agricultural service facility for sugar beet storage. Chairman Johnson informed the applicant that since there were only four Commissioners present, in case of a tie vote, the absent Commissioner would review the record, listen to the tape, and cast the deciding vote. The Assistant County Attorney, Lee Morrison, made this matter of record. Gloria Dunn, representing the Planning Department, read the favorable recommendation of the Planning Commission, saying that this recommendation is subject to 7 Conditions and 11 Development Standards. Scott Anderson, representing Western Sugar Company, came forward to answer questions of the Board. He said Sekich Farms has no objections to the proposed Conditions and Development Standards. Discussion was held concerning a ditch and pipeline easement agreement. Mr. Anderson said this agreement has been executed. Ms. Dunn said that the execution of this Agreement has satisfied Conditions 5 and 7. Commissioner Kirby moved to approve the request for a sugar beet storage facility submitted by Sekich Farms, basing his motion on the recommendation of the Planning Commission. The motion, seconded by Commissioner Brantner, carried unanimously. This Certification was approved on the 18th day of August, 1986. REQUEST: Use by Special Review permit for an agricultural service facility (sugar beet storage) LEGAL DESCRIPTION: Part of the Si of Section 19, T3N, R67W of the 6th P.M. , Weld County, Colorado LOCATION: Approximately 5.5 miles west of Platteville; north of Colorado State Highway 66 and east of Weld County Road 13 APPEARANCE: Robert Abrams, Agricultural Manager, Western Sugar Company, represented the applicants. He reported the Sugar Company has looked a long time for such a site. It will take care of approximately 45, growers in the area. He also explained their intended layout of the equipment and beet piles on the land. NOTICE: Louis Rademacher asked to be excused from participating in this request because of a conflict of interest. `ear. ne EyHi 131T N Summary of the Weld County Planning Commission Meeting August 5, 1986 Page 4 There are approximately three thousand acres of beets in the area and Mr. Abrams reviewed where the majority of traffic -would be coming from. This facility -will take care of the farmers in the Longmont area. There will be two pilers on the property and there will be about three hundred truck loads of beets per day coming into this facility. After beet harvest, there brill be approximately one hundred trucks per day hauling beets from the site to the sugar factory. They have a five year lease on this land with one year approval after that. Plans have been made to protect the irrigation ditch running through the property. They have applied for and been granted a dust abatement permit. The Chairman called for discussion from the members of the audience. Louis Rademacher, surrounding property owner, spoke in support of this request providing the irrigation ditch running through the property is protected from cave-ins, etc. Bev Richardson, surrounding property owner, stated that while not really against this request, she felt there was surely a better location for this site. She felt Highway 66 and Weld County Road 13 is a dangerous intersection without adding further traffic. Also, she raises Amazon Parrots. They are fragile and cannot tolerate dust. Neal Richardson, surrounding property owner, spoke against this request. He felt the increased traffic, dust, and unattractiveness of a huge beet pile would decrease his property values. Tape 247 - Side 1 Conrad Hoff lives two miles south of this proposed site. The surrounding terrain made putting the beet dump site at another location in the area very difficult. . The Chairman asked Gloria Dunn to read the recommendations, conditions, and development standards as outlined by he Department of Planning Services into the record. The Chairman asked the applicant if they had any problems with the recommendations of the' staff. They stated they had no problems. Scott Anderson, Western Sugar Company, discussed the underground irrigation line. Paulette Weaver - No, she understands the need for the dump, but she is real concerned about the safety and the crossing. In concern for the health and safety of the people using both highways she is voting against this request. Ann Garrison - Yes, and she hopes that the sugar company will contact the State Highway Department and get them to post warning signs on Highway 66 about the heavy cross traffic. Page 2 This recommendation is based, in part, upon a review of the application submitted by the applicant, other relevant information regarding the request and the responses of the referral entities which have reviewed this request. The Department of Planning Services staff recommendation for approval is conditional upon the following: 1. The attached Development Standards for the Use by Special Review permit be adopted and placed on the Use by Special Review plat prior to recording the plat. 2. The Use by Special Review activity shall not occur nor shall any building or electrical permits be issued on the property until the Use by Special Review plat has been delivered to the Department of Planning Services' office and the plat is ready to be recorded in the office of the Weld County Clerk and Recorder. 3. Prior to recording the Use by Special Review plat, the plat shall show a total right-of-way of seventy-five (75) feet from the centerline of Colorado State Highway 66. 4. Prior to the recording of the Use by Special Review plat the applicant and/or operator shall submit to the Department of Planning Services an agreement between the property owner and the Highland Ditch Company (outlet #3 ditch) regarding the ditch crossing shown on the plat map. 5. Prior to the recording of the Use by Special Review plat map the applicant and/or operator shall submit to the Department of Planning Services an agreement between the property owner and the owners of the Rademacher Lateral Ditch concerning the ditch realignment. Condition of approval: 6. Construction of the bridge across the Highland Ditch Company's outlet #3 ditch and the access improvements to Weld County Road 13 shall be completed within thirty (30) days of approval by the Board of County Commissioners or use of the site as a sugar beet dump, whatever occurs first. DEVELOPMENT STANDARDS Sekich Farms, Inc. USR 746:86:29 1. The Use by Special Review permit is for an agricultural service facility for receiving and storage of sugar beets as submitted in the application materials on file in the Department of Planning Services and subject to the Development Standards stated hereon. 2. Access shall be limited to Weld County _Road 13, and shall not be located on the Highland Ditch Company (outlet #3 ditch) right-of-way as indicated on the plat map and shall be constructed and maintained to meet the requirements of the Weld County -Engineering Department as listed below. A. The entrances are to have paved aprons that consist of six (6) inches of aggregate base course and three (3) inches of asphalt pavement. The apron shall be fifteen (15) feet -wide and have a fifty (50) foot radii and extend fifty (50) feet from the existing pavement. This entrance shall be maintained by the operator of the Use by Special Review permit. B. The fifteen (15) inch CMP culvert shall be extended to maintain a one-way fifteen (15) foot access lane. C. Delineators shall be located on Weld County Road 13 next co the bridge on both sides. D. Weeds shall be removed and the roadway shall be maintained in such a manner as to expose the existing ditch and the edge of the bridge. E. Signs shall be installed at both entrances directing traffic and on Weld County Road 13 stating "Truck Entrance," in accordance with the Manual on Uniform Traffic Control Devices. - - 3. Portable chemical sanitary facilities shall not be used on the property. A vault constructed according to the Weld County individual sewage disposal system regulations shall be used for the individual sewage disposal system. 4. Wastes and trash shall be disposed of in an approved landfill. No on-site disposal of sugar beets shall be allowed. 5. Sugar beets shall be handled and stored at the facility in such a manner that no nuisance is created by odor, blowing debris, and fugitive dust or spoiled sugar beets on or around the facility in accordance with the Weld County Health Department regulations. The property owner or operator shall comply with the design standards for Use by Special Review, Section 24.5 of the Weld County Zoning Ordinance. 8. The property owner or operator shall be responsible for complying with the Operation Standards of Section 24.6 of the Weld County Zoning Ordinance. 9. Personnel from the Weld County Health Department, Weld County Engineering Department, and Weld County Department of Planning Services shall be granted access onto the property at any reasonable time in order to insure the activities carried out on the property comply with the Development Standards stated hereon and ali applicable Weld County Regulations. 10. The Use by Special Review area shall be limited to the plans shown hereon and governed by the foregoing Standards and all applicable Weld County Regulations. Any material deviations from the plans or Standards as shown or stated shall require the approval of an amendment of the Permit by the Weld County Planning Commission and the Board of County Commissioners before such changes from the plans or Standards are permitted. Any other changes shall be filed in the office of the Department of Planning Services. 11. The property owner or operator shall be responsible for complying with all of the foregoing Standards. A 15' proposed radius is shown for the south side of the northern road. Large trucks exiting the site will not be able to turn left, particularly given the alignment of the approach. 1 do not feel the note restricting tractor-trailer traffic to the south road is enforceable or a solution to the problem. The double entrances were proposed because two narrow roads already exist on either side of the ditch. If the northern entrance cannot be constructed in such a manner to provide safe access to road 13 it should be eliminated. The cost to construct the north access and to construct a bridge over the ditch will certainly be more than the cost of widening the southern road to a reasonable width for two-way truck traffic. The following statements outline the use of the described parcell as per section 2.4. 7 of the Weld County Zoning Ordinance: 1. The land parcell will be used to receive, pile and store sugar beets purchased from beet growers in the area. 2. The pile ground is needed to receive the crop from the area's beet producers in an efficient manner and to pile the beets into large enough piles so as to avoid high rates of beet shrink and quality deterioration. 3. Surrounding properties are agricultural; crop production, cattle feeding and dairy production. 4. The distance to the nearest farm home is across Highway/66. 5. Forty seven sugar beet growers have beet contracts that specify beet delivery in this area. 6. A maximum of ten employees will work on equipment and scales to receive the crop. Normal hours of operation are 6 :30 a.m. until 6:30 p.m. Beet harvest is scheduled from Sept. 24, 1986 until harvest completion. Most of the beet crop will be received by Nov. 1, 1986. Sugar beets in storage will remain until needed by the processing factory's at Greeley, Co. or Ft. Morgan, Co. Beets are to be trucked from the piling site as needed on a 24 hour basis. Both factory's compaigns are planned for completion by Feb. 1, 1987. It is anticipated that all sugar beets will be removed from the property by Jan. 15th of each year. 7. Water for employee use will be brought to the site in containers. 8. Access routes are to be two gate entrances from Highway t6. There will be one-way traffic during the high traffic volume period. 9. Dn a very busy day at their receiving station, up to 4500 tons of sugar beets may be purchased from the area sugar beet growers. If growers trucks average 15 tons per load, approximately 300 truck loads may be anticipated. These would be coming into the station during the 12 hour opening period. 10. Portable. hhemical sanitary facilities will be available for use by employees at the station. These will be removed when the ground is not being used to store sugar beets. 11. Fire extinguishers will be available inrthe scale house for emergency use by employees. 12. No animals are to be on the pile site. 13. No waste other than covered trash_, barrels will be allowed on the r property. 14. The pile site will not affect the natural storm water drainage. 15. Trash barrels are removed by Western Sugar employees and equipment on a semi weekly basis during the harvest period. 16. No landscaping is anticipated. By terms of the lease agreement, buildings and equipment are to be kept in condition so that they do not become unsightly. c ' 17. If this pile ground site should be abandoned, the land willrevert back to farm land. 18. The time table for beginning construction is very critical. Prior to this date, no satisfactory receiving station sight could be located. Western Sugar wishes to move beet piling machinery onto this sight within the next 2-3 weeks. Construction of the scale facility will begin as soon as a use approval is obtained. Beet receiving is scheduled Sept. 24, 1986. Western Sugar, user of the land, and Sekich Inc. owner of the land submit the following statements and documents. 1. The proposed beet piling site will provide beet growers in this part of the county an opportunity to economically market their crop. 2. This piling site is agricultural related. 3. Upon removal of equipment and scale, land will revert back to crop production. 4. Dust will be controlled by water trucks and planted ground cover. 5. These changes to State Highway 66 would be cost prohibitive to Western Sugar. Sekich Farms has agreed to provide an entrance and exit road from Weld County Road 13 to the proposed site (see enclosed change letter to Sekich-Western Sugar lease) . Attached is a new map of the proposed site which is to replace the original proposal. This new drawing indicates that the entrance to the property will be from Weld County Road 13. The weighing scale will be located in the north west corner of the property. Please give this matter your immediate consideration as Western Sugar wishes to expedite construction of the scale facility and move beet receiving machinery to this site.
