V..Sr 4.V..•e.... •W kw it-.M-..• RESOLUTION RE: APPROVAL OF USE BY SPECIAL REVIEW FOR AN OIL AND GAS SUPPORT OPERATION - GOLDEN BUCKEYE PETROLEUM CORPORATION WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter , is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS , the Board of County Commissioners held a public hearing on the 4th day of June, 1986 , at the hour of 2: 00 p.m. in the Chambers of the Board for the purpose of hearing the application of Golden Buckeye Petroleum Corporation, 12600 West Colfax, Suite B-200 , Denver, Colorado 80215 , for a Use by Special Review for an oil and gas support operation on the following described real estate, to-wit: Part of the NWa, Section 18 , Township 4 North, Range 64 West of the 6th P.M. , Weld County, Colorado WHEREAS, Section 24. 4 . 2 of the Weld County Zoning Ordinance provides standards for review of said Use by Special Review, and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, has studied the request of the applicant and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter and, having been fully informed, finds that this request shall be approved for the following reasons: 1. The submitted materials are in compliance with the application requirements of Section 24 . 7 of the Weld County Zoning Ordinance. 2. It is the opinion of the Board of County Commissioners that the applicant has shown compliance with Section 24 . 4. 2 of the Weld County Zoning Ordinance as follows: a. The proposal is consistent with the Comprehensive Plan policies in that the use does not infringe on the continued agricultural use in the vicinity or County. The proposal does not appear to have any adverse impacts on the agricultural interests of the County or the environment. b. The proposal is consistent with the intent of the Agricultural Zone District in that the proposed use does not interfere with agricultural activities in 860532 Page 2 RE: USR - GOLDEN BUCKEYE PETROLEUM CORPORATION the area or the County, and as a Use by Special Review the activity can take place in the district. c. No overlay districts affect the site. d. Use by Special Review Development Standards will provide adequate protection of the health, safety and welfare of the neighborhood and County. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the application for a Use by Special Review for an oil and gas support operation on the hereinabove described parcel of land be, and hereby is , granted subiect to the following conditions: 1 . The attached Development Standards for the Use by Special Review permit be adopted and placed on the Use by Special Review plat prior to recording the plat. 2 . The Use by Special Review activity shall not occur nor shall any building or electrical permits be issued on the property until the Use by Special Review plat has been delivered to the Department of Planning Services Office and the plat is ready to be recorded in the office of the Weld County Clerk and Recorder. The Use by Special Review permit is for an oil and -gas support operation as submitted in the application materials on file in the Department of Planning Services and subject to the Development Standards stated herein. 2. All construction done on the property shall be in accordance with the requirements of the Weld County Building Code Ordinance. 3. The property owner or operator shall be _responsible for complying with the Design Standards of Section 24.5 of the Weld County Zoning Ordinance. 4 . The property owner or operator shall be responsible for complying with the Operation Standards of Section 24 .5 of the Weld County Zoning Ordinance. 5. Personnel from the Weld County Health Department and Weld County Department of Planning Services shall be granted access onto the property at any reasonable time in order to insure the activities carried tut on the property comply with the Development Standards stated herein and all applicable Weld County Regulations. 6 . The Use by Special Review area shall be limited to the plans shown herein and governed by the foregoing Standards and all applicable Weld County Regulations. Any material deviations from the plans or Standards as shown or stated shall require the approval of en amendment of the Permit by the Weld County Planning Commission and the Board of County Commissioners before such -changes from the plans or Standards are permitted. Any other changes shall be filed in the office of the Department of Planning Services. 7 . The property owner or operator shall be responsible for complying with all of the foregoing Standards. They would like to have -a field office in Weld County. This location is a central location in Weld County and they have leased a house and approximately two acres of land from Tud Fry. This will be a place for the men to clean-up, do their paper work, change clothes, warm-up, drink a cup of coffee, -eat their lunch, -and on occasion spend the night. They do mot have a full time secretary so it will not be used as an office in this rapacity. They also store some pipe on the Troperty, but the use of the house will not be changed nor will it be altered or remodeled. They leased this property in 1985 and were not aware they were in violation of the Weld -County -Zoning Ordinance. This application for a Use by Special Review is made to rectify this violation. The Chairman called for discussion from the members of the audience. There was no further discussion. Gloria Dunn reported Condition #3 and Development Standard #2 should be deleted because they are no longer applicable. AMENDMENT: Toug Graff -moved Condition #3 and Development Standard #2 be deleted from the Department of Planning Services staff -requirements. Motion -seconded by Harlan Else. The Chairman called for di-scussion from the members of the Planning Commission. Discussion followed. The Chairman asked the members of the Planning Commission for their decision. Motion carried unanimously. The Chairman asked Mr. Longwell if they had reviewed the -recommendations, -conditions, and Development Standards as outlined by the Department of Planning Services staff and if they had any objections to Condition #3 and Development Standard ill being deleted. The house is used as a place to make copies of gauge sheets and to hold meetings. The yard currently has a small wooden shed for surplus parts storage, and 3 small pipe racks for surplus tubular storage to be used on upcoming wells. This storage is and always will be kept to an absolute minimum. (b) This field office is needed so that our field employees have a place to make copies of gauge reports and to have safety meetings. It is also needed as a place to house a small amount of surplus parts until they can be used on upcoming wells. This office is centrally located to service our 113 wells in Weld County. (c) Agriculture, irrigated & dry land farming, and oil & gas production. (d) 1 house 1/10 mile east on NCR 46 and 1 house 2/3 mile west on WCR 46. (e) The maximun number of users at any one time would be 10 people. This would only occur at a meeting between all 8 field personnel and the Operations Engineers. This is very rare. (f) There is usually 6 or 7 field personnel out in the field 7 days a week generally fran 7 am to 5 pm.
