KEISER WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners held a public hearing on the 7th day of August, 1985 , at the hour of 2 : 00 p.m. in the Chambers of the Board for the purpose of hearing the application of G.A. Keiser, 24360 Weld County Road 41 , La Salle, Colorado 80645 , for a Use by Special Review for an auto body repair shop on the following described real estate, to-wit: Part of the Nh SW;, Section 33 , Township 5 North, Range 65 West of the 6th P.M. , Weld County, Colorado WHEREAS, Section 24 .4 . 2 of the Weld County Zoning Ordinance provides standards for review of said Use by Special Review, and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, has studied the request of the applicant and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter and, having been fully informed, finds that this request shall be approved for the following reasons: 1 . The submitted materials are in compliance with the application requirements of Section 24 . 7 of the Weld County Zoning Ordinance. 2 . It is the opinion of the Board of County Commissioners that the applicant has shown compliance with Section 24 .4 . 2 of the Weld County Zoning Ordinance as follows: a. The proposal is consistent with the Comprehensive Plan policies in that the use does not infringe on continued agricultural use in the vicinity or County. The proposal does not appear to have any adverse impacts on the agricultural interests of the County or environment. 'rL11WO 850786 Page 2 RE: USR - KEISER b. The proposal is consistent with the intent of the Agricultural Zone District and is provided for as a Use by Special Review. c. The La Salle Planning Commission has found this request to comply with their Comprehensive Plan. d. No overlay districts affect the site. e. Use by Special Review Operation and Design Standards provide adequate protection of the health, safety and welfare of the neighborhood and County. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the application for a Use by Special Review for an auto body repair shop on the hereinabove described parcel of land be, and hereby is, granted subject to the following conditions: 1 . The attached Standards for Use by Special Review be adopted and placed on the Use by Special Review plat prior to recording. 2 . The prescribed Use by Special Review activity shall not occur nor shall any additional building or electrical permits be issued on the subject property until the Use by Special Review plat has been delivered to the Department of Planning Services Office and the plat has been recorded in the office of the Weld County Clerk and Recorder. 3 . Prior to recording the Use by Special Review plat, the applicant shall satisfy concerns of the La Salle Fire Protection District regarding the wiring of his paint booth. KEISER USR-677 :85 : 20 1 . The uses permitted shall be an auto body repair shop as described in the application materials on file with the Department of Planning Services and subject to the Operation Standards hereon. 2 . The applicant shall furnish the La Salle Fire Protection District with a complete drawing of the paint and body shop. 3 . The vehicles associated with the subject Use by Special Review permit shall not be stored outdoors for a period longer than seven (7) days. 4 . The applicant shall comply with the design standards for the Use by Special Review, Section 24 .5 et seq. , of the Weld County Zoning Ordinance. 5 . The applicant shall comply with the Operation Standards for Uses by Special Review, Section 24 . 6 et seq. , of the Weld County Zoning Ordinance. 6 . Representatives or members of the Weld County Health Department and Weld County Department of Planning Services shall be granted access onto the site at any reasonable time in order to insure the operations carried out on the site comply with the Operation Standards stated herein and all applicable Weld County Regulations. 7 . The Use by Special Review area shall be limited to the plans shown herein and governed by the Standards as stated above and all applicable Weld County Regulations. Any material deviations from the plans and/or Standards as shown or stated above shall require the approval of an amendment of the Permit by the Weld County Planning Commission and the Board of County Commissioners before such changes from the plans and/or Standards are permitted. Any other changes shall be filed in the office of the Department of Planning Services. 8 . The property owner and/or operator of this operation shall be responsible for complying with all of the above stated Standards. Noncompliance with any of the above stated Standards may be reason for revocation of the Permit by the Board of County Commissioners . Assistant County Attorney, Bruce Barker, made this matter of record. Gloria Dunn, Planning Department representative, read the favorable recommendation of the Planning Commission into the record. Ms. Dunn said the recommendation includes three conditions and eight Operation Standards. Lou Rieker, Attorney representing the applicant, came forward to explain. Dave Keiser came forward to answer questions of the Board. Commissioner Lacy moved to approve this Use by Special Review request for G.A. Keiser for an auto body repair shop. Commissioner Yamaguchi seconded the motion. The motion carried unanimously. A quorum was present. The summary of the last regular meeting of the Weld County Planning Commission held on June 18, 1985, was approved as distributed. CASE NUMBER: USR-677:85:20 dF APPLICANT: G.A. Keiser REQUEST: A Use by Special Review permit for an auto body repair shop. LEGAL DESCRIPTION: Part of the N1 SW1, Section 33, T5N, R65W of the 6th P.M. , Weld County, Colorado. LOCATION: Approximately 11 miles east of La Salle, south of Weld County Road 52 and east of Weld County Road 41. APPEARANCE: Lou Reiker, Attorney, represented the applicant. He stated Mr. Keiser, the farm owner and applicant, had built a storage building for farm use. His son lost the lease he had on a building in La Salle where he was conducting his business, and so he began to conduct his auto body repair shop business in this building. This application is for a Use by Special Review permit to conduct the business at this site. There will be no vehicles stored outside except those waiting for parts. All junk is hauled off once a week. Dave Keiser, owner of the body shop business, stated they had met with the La Salle Fire Department and were trying to conform with their recommendations. Need for Use : The repair work accomplished in the structure under review consists of more than fifty percent agricultural equipment such as truck and tractor body repair and painting. Use Of Surrounding Property: The surrounding property is used for agricultural purposes . Proximity of Proposed Use to Residential Area: The only residence located close to the structure is that of the applicant . The residence is about one hundred fifty feet south of the structure. All other residences are more than fifteen hundred feet from the structure. A small rental unit is located eighteen feet west of the structure. Maximum Number of Users : The maximum number of users of the structure is two . Employee Information: The employees of the business consists of the owner of the business and one helper . The business is operated eight to ten hours a day, five days a week with an occasional extra day to accomplish rush jobs such as farm tractor repair needed . Water Source : The structure is supplied with domestic water from the Central Weld County Water District . There is also an agricultural well located near the structure, but is not used in conjunction with the structure. Vehicular Traffic Information: Vehicular traffic to the facility averages three vehicles per day. The vehicles consist of passenger cars, pickup trucks , farm trucks and tractors . Weights of vehicles will vary according to type, but are of the type that are generally in use in the area . Access Route : Weld County Road 41 serves the subject location. Sewage: Provided by commercial portable sanitary facilities . There is also a cistern type facility provided to catch water used in the body repair operation and which is pumped and hauled off on a regular basis. There is no connection between the waste water from the body shop and the domestic sewage facilities . Fire Protection : Hand operated fire extinguishers are available on the premises. The area is served by the LaSalle Fire Protection District. See letter attached. The painting room is a modular, self-contained unit located within the main structure and when in use is sealed off from the main structure . Animals Located in Special Use Area : None Storm Retention Facilities : The area is not in need of storm retention facilities as it consists of a building and does not create a situation where storm run-off is in need of control. Removal of Debris: All debris is collected in a movable trash bin and is collected weekly by a trash removal service. Landscaping and Erosion Control : The structure is located on a 0 - 1% slope and is in a well graveled and compacted area. No appreciable run-off is experienced in the location due to the very gentle slope of the surrounding area . The structure is bounded on the north by an access lane along a feedlot ; on the east by implement storage buildings ; on the south by a graveled drive approximately sixty feet in width and then by a farm residence which is surrounded by hedge and trees. On the north edge of the area along WCR 41, there is a row of matured trees . The area is a farming area and has the appearance of a well maintained rural setting. Reclamation Procedures : In the event the use of the structure as a body shop should be discontinued, it is anticipated that it would be converted to use as a repair and storage shed for agricultural use. -2- Time Required For Construction: The structure is erected and in use. Consistency With The Weld County Comprehensive Plan : The area is zoned A - Agricultural Use . The structure is located in an area that does not reduce the use of farmable land as it is in the established farm yard and farm equipment storage area. Its general appearance blends in with the farm and the surrounding area. Use Consistent With Area: A major portion of the work done is on vehicles used in farm work. The location is convenient for access by surrounding farmers . The general appearance of the structure does not conflict with appearance of the farming community . Conservation of Land Used for Agricultural Purposes : The structure is located in an established farm yard . No additional land has been removed from farm use. Protection of Health Safety and Welfare of the Area : A building permit has been obtained and compliance with the Weld County Building Code will be made. Compatible Use • The use of the structure is for body repair on automobiles , pickups, larger farm trucks and tractors . Repair of equipment is necessary to accomplish farming purposes . The investigation included test borings and laboratory testing of samples obtained from these borings. The objectives of this study were to (1) evaluate the subsurface conditions at the site relative to the existing construction and (2) evaluate the existing foundation with respect to the soil conditions encountered in the test borings. SITE EXPLORATION The field exploration, carried out on April 22, 1985, consisted of drilling, logging, and sampling two (2) test borings. The locations of the test borings are shown on the Test Boring Location Plan included in Appendix A of this report. Boring logs prepared from the field logs are shown in Appendix A. These logs show soils encountered, location of sampling, and groundwater at the time of the exploration. The borings were advanced with a four-inch diameter, continuous- type, power-flight auger drill. During the drilling operations, a geotechnical engineer from Empire Laboratories, Inc. was present and made continuous observations of the soils encountered. SITE LOCATION AND DESCRIPTION The site of Keiser's Paint and Body Shop is located at 24360 Weld County Road 41 , northeast of LaSalle, Colorado. At the time of the investigation, a thirty-six (36) by forty-five (45) foot metal covered pole -1- building occupied the site. The building was surrounded by sand and gravel surfaced parking lot and driveways and was relatively flat with poor drainage. Immediately east of the structure existed a wood frame barn, while north existed a driveway and cattle feedlot. A driveway lies south of the building, with a frame house south of the drive. A small frame house lies to the west of the building. LABORATORY TESTS AND EVALUATION Samples obtained from the test borings were subjected to testing in the laboratory to provide a sound basis for evaluating the physical properties of the soils encountered. Moisture contents, dry unit weights, unconfined compressive strengths, water soluble sulfates, pH, and the Atterberg limits were determined. A summary of the test results is included in Appendix B. Consolidation characteristics were also determined, and a curve showing this data is included in Appendix B. SOIL AND GROUNDWATER CONDITIONS The soil profile at the site consists of strata of materials arranged in different combinations. In order of increasing depths, they are as follows: (1 ) Sand and Gravel Surfacing: Overlying the site in the area of the test borings is approximately six (6) inches of a sand and fine gravel surfacing material. (2) Clayey Sand: Underlying the gravel surfacing is approximately two and one-half (2-1 /2) feet of a brown to tan clayey sand. This material is plastic depending upon the varying amounts of silt and fine sand present and exhibits moderate bearing characteristics in its damp to moist natural state. When wetted and loaded, this material consolidates readily. -2- (3) Sand and Gravel: The sand and gravel was encountered in the test borings at a depth of three (3) feet below the surface and extends to depths beyond those explored. This material is relatively clean and poorly graded, containing fine to poor sand with fine gravel and exhibits moderate to high bearing characteristics depending upon depth. (4) Groundwater: At the time of the investigation, no free groundwater was encountered in the test borings to depths greater than fourteen and one-half (14-1 /2) feet below the surface. It should be noted that groundwater levels in this area may change depending upon seasonal variations and irrigation on and/or adjacent to the property, etc. EVALUATION , RECOMMENDATIONS AND DISCUSSION It is our understanding that the existing thirty-six (36) by forty-five (45) foot building is a pole structure supporting a truss roof system. The building has a 4:12 pitched roof with fourteen (14) foot eave height walls. The roof and walls are sheeted with painted steel siding. A concrete slab exists within the structure. It is also our understanding that the posts are five- by six-inch treated wood posts and extend approximately 3'-8" below the finished slab level. These posts are spaced at 7'-6" along the side walls and bear on a 18" diameter by 8" deep concrete pads. We further understand that the building was constructed approximately two years ago. The bottom of footing for the posts is therefore approximately four (4) feet below existing grade. The soil encountered at the site at this level are a relatively clean, poorly graded sand and gravel. Soil pressures under the side wall posts of the building supporting a roof live load (snow load) of thirty (30) pounds per square foot in accordance with the 1982 edition of the Uniform Building Code are approximately three thousand fifty (3050) pounds per square foot. Under pressures of this magnitude, it is our opinion that bearing capacity failure of the sand stratum will not occur. It is also our -3- opinion that under the maximum loading (dead load plus maximum live load) , settlement under the footings should be on the order of one (1) inch. It is our opinion that within the two years since the building has been constructed that half of this settlement has probably occurred and that displacements in the future should be on the order of one-half (1 /2) inch. These displacements are generally considered to be within acceptable tolerances for this type of construction. To minimize additional displacements, it is recommended that wetting of the foundation soils be minimized. It is recommended that positive drainage away from the building be provided. In addition, it is recommended that the downspouts be provided with splash blocks to divert the runoff from the roof area well beyond the foundation backfill. GENERAL COMMENTS This report has been prepared to aid in the evaluation of the foundation system. Every effort was made to provide a comprehensive evaluation of the structure through careful location of the test borings and a thorough analysis based upon our understanding of the structure's foundation. Suggested Specifications for Placement of Compacted Earth Fill and/or Backfills. GENERAL A soils engineer shall be on-site to provide continuous observation during filling and grading operations and shall be the owner's repre- sentative to inspect placement of all compacted fill and/or backfill on the project. The soils engineer shall approve all earth materials prior to their use, the methods of placing, and the degree of compaction obtained. MATERIALS Soils used for all compacted fill and backfill shall be approved by the soils engineer prior to their use. The upper two (2) feet of compacted earth backfill placed adjacent to exterior foundation walls shall be an impervious, nonexpansive material . No material , including rock, having a maximum dimension greater than six inches shall be placed in any fill . Any fill containing rock should be carefully mixed to avoid nesting and creation of voids. In no case shall frozen material be used as a fill and/or backfill material . PREPARATION OF SUBGRADE All topsoil , vegetation (including trees and brush), timber, debris, rubbish, and other unsuitable material shall be removed to a depth satisfactory to the soils engineer and disposed of by suitable means before beginning preparation of the subgrade. The subgrade surface of the area to be filled shall be scarified a minimum depth of s.ix inches, moistened as necessary, and compacted in a manner specified below for the subsequent layers of fill . Fill shall not be placed on frozen or muddy ground. C-2 PLACING FILL No sod, brush, frozen or thawing material , or other unsuitable material shall be placed in the fill , and no fill shall be placed during unfavorable weather conditions. All clods shall be broken into small pieces, and distribution of material in the fill shall be such as to preclude the formation of lenses of material differing from the surrounding material . The materials shall be delivered to and spread on the fill surface in a manner which will result in a uniformly compacted fill . Each layer shall be thoroughly blade mixed during spreading to insure uniformity of material and moisture in each layer. Prior to compacting, each layer shall have a maximum thickness of eight inches, and its upper surface shall be approximately horizontal . Each successive 6" to 8" lift of fill being placed on slopes or hillsides should be benched into the existing slopes, providing good bond between the fill and existing ground. MOISTURE CONTROL While being compacted, the fill material in each layer shall as nearly as practical contain the amount of moisture required for optimum compaction or as specified, and the moisture shall be uniform throughout the fill . The contractor may be required to add necessary moisture to the fill material and to uniformly mix the water with the fill material if, in the opinion of the soils engineer, it is not possible to obtain uniform moisture content by adding water on the fill surface. If, in the opinion of the soils engineer, the material proposed for use in the compacted fill is too wet to permit adequate compaction, it shall be dried in an acceptable manner prior to placement and compaction. COMPACTION When an acceptable, uniform moisture content is obtained, each layer shall be compacted by a method acceptable to the soils engineer and as specified in the foregoing report as determined by applicable standards. Compaction shall be performed by rolling with approved tamping rollers, __cam_ — pneumatic-tired rollers, three-wheel power rollers, vibratory compactors, or other approved equipment well-suited to the soil being compacted. If a sheepfoot roller is used, it shall be provided with cleaner bars attached in a manner which will prevent the accumulation of material between the tamper feet. The rollers should be designed so that effective weight can be increased. MOISTURE-DENSITY DETERMINATION Samples of representative fill materials to be placed shall be furnished by the contractor to the soils engineer for determination of maximum density and optimum moisture or percent of Relative Density for these materials. Tests for this determination will be made using methods conforming to requirements of ASTM D 698, ASTM D 1557, or ASTM D 2049. Copies of the results of these tests will be furnished to the owner, the project engineer, and the contractor. These test results shall be the basis of control for all compaction effort. DENSITY TESTS The density and moisture content of each layer of compacted fill will be determined by the soils engineer in accordance with ASTM D 1556, ASTM D 2167, or ASTM D 2922. Any material found not to comply with the minimum specified density shall be recompacted until the required density is obtained. Sufficient density tests shall be made and submitted to support the soils engineer' s recommendations. The results of density tests will also be furnished to the owner, the project engineer, and the contractor by the soils engineer. C-4 Hello
