Box G, Greeley, Colorado 80632 , for a Site Specific Development Plan and Special Review Permit for a general research laboratory located in the C-3 (Commercial) Zone District on the following described real estate, to-wit: Part of the NW* , Section 32 , Township 6 North, Range 65 West of the 6th P.M. , Weld County, Colorado WHEREAS, said applicant was represented by Robb Casseday, architect, and WHEREAS, Section 24 . 4 .2 of the Weld County Zoning Ordinance provides standards for review of said Special Review Permit, and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, has studied the request of the applicant and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter and, having been fully informed, finds that this request shall be approved for the following reasons: 1 . The submitted materials are in compliance with the application requirements of Section 24 .7 of the Weld County Zoning Ordinance. P2 O-5<5 � , ' 890058 Page 2 RE: USR - MONFORT INCORPORATED 2 . It is the opinion of the Board of County Commissioners that the applicant has shown compliance with Section 24 .4 .2 of the Weld County Zoning Ordinance as follows : a. The proposed Special Review Permit is located within the urban growth boundary area of the City of Greeley. The location of the Special Review area and the attached Conditions and Development Standards make the proposed use consistent with the Urban Growth Boundary Goals and Policies of the Weld County Comprehensive Plan. The City of Greeley Planning Commission recommended conditional approval of the Special Review Permit. These conditions are addressed as Development Standards and additional comments. h. The Special Review Permit proposal is consistent with the intent of the C-3 (Commercial) Zone District. The proposed industrial use is allowed as a Special Review Permit in the C-3 (Commercial) Zone District. c. The proposal is compatible with the existing surrounding land uses and with the future development of the surrounding area as permitted by the Weld County and City of Greeley Comprehensive Plans. Uses on surrounding properties include Valley Irrigation of Greeley, Great Plains Chemical Company, Demuth Construction, and U.S . Highway 85. No objections have been received by the Department of Planning Services staff from surrounding property owners. d. The site is not located in a flood hazard or geological hazard overlay district. The site is located in the transitional zone of the Greeley-Weld County Airport Overlay District. The overlay district permits a building height of approximately 5 , 100 feet above sea level at this site or a structure equal to 400 feet in height. 890058 Page 3 RE: USR - MONFORT INCORPORATED e. Special Review Development Standards will provide adequate protection of the health, safety, and welfare of the neighborhood and the County. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the application for a Site Specific Development Plan and Special Review Permit for a general research laboratory located in the C-3 (Commercial) Zone District on the hereinabove described parcel of land be, and hereby is, granted subject to the following conditions : 1 . The attached Development Standards for the Special Review Permit shall be adopted and placed on the Special Review plat prior to recording the plat. The plat shall be delivered to the Department of Planning Services and be ready for recording in the office of the Weld County Clerk and Recorder within 15 days of approval by the Board of County Commissioners . 2 . The Special Review activity shall not occur nor shall any additional building or electrical permits be issued on the property until the Special Review plat is ready to be recorded in the office of the Weld County Clerk and Recorder. 3 . Prior to the recording of the Special Review plat, the following shall occur: a. The plat shall be amended to show an additional 20 foot right-of-way reservation located south of "O" Street; b. A letter from the Western Hills Fire Protection Service and the Office of Emergency Management acknowledging receipt of the hazardous material safety data sheet shall be submitted to the Department of Planning Services; and c. A landscape plan shall be submitted to the Department of Planning Services for approval. The plan shall include a 10 foot landscaped buffer zone south of and adjacent to the right-of-way for "O" Street. The Site Specific Development Plan and Special Review Permit is for a general research laboratory located in the C-3 (Commercial) Zone District as submitted in the application materials on file in the Department of Planning Services and subject to the Development Standards stated herein. 2 . Approval of this plan may create a vested property right pursuant to Article 68 of Title 24 , C.R.S. , as amended. 3 . All liquid and solid wastes shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. No permanent disposal of wastes or produce shall be permitted at this site. 4 . The property shall be maintained in compliance with the air emissions permit approved by the Colorado Department of Health, Air Pollution Control Division. 5 . The septic systems for the proposed office shall be designed by a Colorado Registered Professional Engineer according to the Weld County Individual Sewage Disposal Regulations. 6 . No on-site disposal of produce of any type shall be permitted at any time. 7 . Produce and feed samples shall be handled and stored at the facility in such a manner so that no nuisance is created by odor, windblown debris, fugitive dust, and spoiled materials . 8 . All construction on the property shall be in accordance with the requirements of the Weld County Building Code Ordinance. 9 . The property owner or operator shall be responsible for complying with the performance standards of Section 33 . 6 of the Weld County Zoning Ordinance. 10 . The property owner or operator shall be responsible for complying with the Design Standards of Section 24 .5 of the Weld County Zoning Ordinance . 890058 Page 2 DEVELOPMENT STANDARDS - MONFORT, INCORPORATED 11 . The property owner or operator shall be responsible for complying with the Operation Standards of Section 24 .6 of the Weld County Zoning Ordinance . 12 . Personnel from the Weld County Health Department, Western Hills Fire Protection District, and Weld County Department of Planning Services shall be granted access onto the property at any reasonable time in order to ensure the activities carried out on the property comply with the Development Standards stated herein and all applicable Weld County Regulations. 13 . The Special Review area shall be limited to the plans shown herein and governed by the foregoing Standards and all applicable Weld County Regulations. Major changes from the plans or Development Standards as shown or stated shall require the approval of an amendment of the Permit by the Weld County Planning Commission and the Board of County Commissioners before such changes from the plans or Development Standards are permitted. Any other changes shall be filed in the office of the Department of Planning Services. 14 . The property owner or operator shall be responsible for complying with all of the foregoing Development Standards. Noncompliance with any of the foregoing Development Standards may be reason for revocation of the Permit by the Board of County Commissioners. 890058 ADDITIONAL COMMENTS USR-864 Monfort, Inc. There is currently 30 feet of right-of-way south of the centerline of "0" Street. The City of Greeley Planning Commission requested the applicant to dedicate a total of 50 feet south of the centerline of "0" Street. It is the policy of Weld County to require the dedication of additional right-of-way when it can be shown that the traffic impacts of the proposed development warrant additional road improvements and right-of-way. Ray McElroy, a neighboring landowner, asked whether any caustic chemicals would be used and about emissions. Mr. Casseday answered these questions. The storage structure is a two hour fire rated building, with a 1 1/2 hour door. It will contain 20% of stored material spilled and has its own halogen fire suppressing equipment. It will be heated and air conditioned to keep temperatures consistent with the storing temperatures required for the stabilization of the chemicals .
