HomeMy WebLinkAbout871799.tiff ^ ^ This document '.s filmed with January 14, 1987 ,ommunications. nr1e err° esnans ;, JAN i a 198T .,....i, , , DISTRICT COURT, WELD COUNTY, COLORADO Case No. 8 7 C V _ ID c- NOTICE OF HEARING ON PETITION IN THE MATTER OF THE ORGANIZATION OF PINE LAKE SANITATION DISTRICT, WELD COUNTY, COLORADO PUBLIC NOTICE IS HEREBY GIVEN that there was filed in the District Court in and for the County of Weld and State of Colorado, on the 7th day of January, 1987, a Petition entitled "In the Matter of the Organization of the Pine Lake Sanitation District, Weld County, Colorado," which Petition prays for the organization of a special district, pursuant to the provisions of Title 32, article 1, Part 3, Colorado Revised Statutes. Notice is further given that a Service Plan for the proposed District and a Resolution of the County Commissioners of Weld County, Colorado, approving the Service Plan were also filed with the Court in this matter as required by law. Said documents are now on file at the office of the Clerk of the District Court of Weld County, in Greeley, Colorado, and are available for public inspection. The purpose of the proposed District is to provide sanitation facilities as follows: Once formed, the Pine Lake Sanitation District intends to provide for the acquisition, construction, completion, installation, and/or operation and maintenance of a complete local sanitary sewage collection transmission and treatment system. The system may include, but shall not be limited to, collection mains and laterals, transmission lines, lift stations (if necessitated) and all appurtenant facilities, a sewage treatment facility, all required land easement, and rights-of-way. Pursuant to Section 32-1-103(18) C.R.S. , the District may also provide for storm sewers and related flood and surface drainage. The sanitary and/or storm sewer services will he provided within the proposed boundaries of the District (as may be amended by exclusions and/or inclusions) and without the District's boundaries _ pursuant to Section 21-1-1001(k) C.R.S. , at the discretion of the District's Board of Directors and in compliance with the then-existing and applicable state statutes. y 1 871799 6 d yyvC! The proposed District is located entirely within Weld County, Colorado, generally at 7200 East State Highway 14, Ft. Collins, Colorado, and more particularly described as follows: A tract of land located in the Northwest Quarter (NWE) of Section 17, Township 7 North, Range 67 West, of the 6th Principal Meridian, Weld County, Colroado being more particularly described as follows: Considering the North line of the Northwest Quarter (NW}) of said Section 17 to bear South 89° 49' 00" East, and with all bearings contained herein relative thereto; Commencing at the North Quarter Corner of said Section 17; thence along the East line of said Northest Quarter South 00° 22' 47" West, a distance of 46.60 feet to a point on the South right-of-way line of Colorado State Highway 14, as described in Book 1304 on Page 105 of Weld County, Colorado records; thence continuing along said East line of Section 17 South 00° 22' 47" West, 1268.00 feet; thence North 89° 51' 20" West, 684.00 feet; then South 19° 37' 56" West, 185.41 feet; then South 39° 06' 40" West, 235.00 feet; then North 89° 51' 20" West, 332.00 feet to the True Point of Beginning: Thence South 00° 13' 56" West, 380.00 feet; Thence South 29° 21' 10" East, 165.99 feet; Thence South 00° 13' 56" West, 369.00 feet; Thence North 89° 48' 51" West, 428.00 feet; Thence North 59° 21 ' 45" West, 373.35 feet; Thence North 00° 13' 56" East, 413.00 feet; Thence North 54° 42' 20" East, 501.38 feet; Thence South 89° 51' 20" East, a distance of 260.00 feet to the True Point of Beginning. The above described tract contains 12.468 acres, more or less. NOTICE IS FURTHER GIVEN that by an Order of the District Court in and for the County of Weld, a public Hearing on said Petition for organization will be held at the hour of ( ; 3p P .M. , in District Court Room 1 __, at the Weld County Courthouse, Division / , in Greeley, Colorado, on FK,aa-y , the 3p)day of `4noARy , 1987, at which time and place any persons in interest may appear if they so desire. No later than ten (10) days before the Hearing, the owner of any real property located within the proposed Pine Lake Sanitation District may file a petition with the court stating reasons why said property should not be including in the proposed District and requesting that said real property be excluded therefrom. Such petition shall be duly verified and shall describe the property sought to be excluded. The Court shall hear said petition and all objections thereto at the time of the hearing on the Petition for organization and shall determine whether, in the best public interest, said property should be excluded or included in the proposed Pine Lake Sanitation District. In the event the Court orders that the question of the organization or the proposed District be submitted to the electors of the proposed District at an election to be held for that purpose, at said election the electors of the proposed District shall elect five (5) electors of the District who may be nominated by written Petition signed by not less than five (5) electors filed with the Court not less than forty-five (45) days prior to the date of said election. Any petition so filed shall designate therein the name of each nominee and the term for which nominated and shall state that the subscribers thereto and the nominee or nominees designated therein are electors of the proprosed District. Prior to or at the time of filing the Petition, the nominee shall consent, in writing, to serve the term designated in the petition. No petition shall designate any person as a candidate for more than one office, nor shall it place in nomination more names than the number of offices to be filled, nor shall it designate more than one nominee for each office to be filled. No elector shall sign a nominating petition for more than one person for any office to be filled. Those elected shall constitute the Board of Directors of the District, if organized. Two of the original directors are to serve until they or their successors are elected and qualified at the next regular election occurring in any year following that in which the proposed District is organized, and three of the original directors are to serve until the second regular election after organization.
