HomeMy WebLinkAbout891443.tiff AR2187648 ORDINANCE NO. 89-R IN THE MATTFR OF THE REPEAL AND RE-ENACTMENT, WITH AMENDMENTS OF CERTAIN SECTIONS , AND THE ADDITION OF CERTAIN SECTIONS TO ORDINANCE NO. 89 , WELD COUNTY ZONING ORDINANCE, AS CURRENTLY �r0 AMENDED, REVISING AND ADDING CERTAIN PROCEDURES , TERMS , AND 00 REQUIREMENTS . • BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF WELD o COUNTY, COLORADO: a 0 3 WHEREAS, the Board of County Commissioners of Weld County, o x Colorado, pursuant to Colorado statute and the Weld County Home w• Rule Charter, is vested with the authority of administering the • affairs of Weld County, Colorado, and 0 u Log WHEREAS, the Board of County Commissioners has the power and o authority under the Weld County Home Rule Charter and State Statute, including Article 28 of Title 30 , CRS, to adopt zoning r a regulations for the unincorporated areas of the County of Weld , rna and 03 U WHEREAS, the Board of County Commissioners of Weld County, z o H Colorado, has previously adopted Ordinance No. 89 , Weld County cop Zoning Ordinance, establishing a comprehensive revision of the • zoning regulations and zoning maps for the unincorporated areas of the County of Weld, and has adopted amendments in Ordinance No. <fi 89-A through 89-Q, and kog mr 2 WHEREAS, said Ordinance No. 89 , as amended, is in need of ro g revision and clarification with regard to procedures , terms , and • requirements therein. w a NOW, THEREFORE, BE IT ORDAINED by the Board of County Commissioners of Weld County, Colorado, that certain existing o sections of said Ordinance No. 89 , as amended, are repealed and ,N.,o re-enacted , with amendments , and that various sections are added �[u or revised to read as follows: Amend Section 31 . 2 . 8 to read !, 31 . 2 . 8 Feeding of LIVESTOCK within the limitations defined in Section 31 . 5 , bulk requirements and Section 47 , Livestock Feeding Performance Standards . Amend Section 32 . 7 . 8 by adding! Subject to the additional requirements of Section 47 , Livestock Feeding Performance Standards. 891443 Page 2 ORDINANCE #39-R Add a new Section 47 to read: 47 Livestock Feeding Performance Standards 47 . 1 Anyone feeding LIVESTOCK in the unincorporated d, O areas of Weld County shall comply with the o v performance standards enumerated below. 0 cy O 47 . 1 . 1 The property owner shall remove, handle, and J stockpile all manure in a manner that will prevent ca ,a nuisance conditions. The manure piles shall not be 03 allowed to exist or deteriorate to a condition that facilitates excessive odors, flies , insect pests , ,� �j or pollutant runoff. The manure storage site shall ca have a water-tight surface which does not permit o seepage or percolation of manure pollutants into w the ground as approved by the Weld County Health 0 x Department. x 47 . 1 . 2 Suitable chemical and scientific controls shall be x provided for rodent and insect control as approved m a by the Weld County Health Department. wu w z 47 . 1 . 3 Feed bunks , water tanks , feeding devices , and i w associated aprons shall be approved by the Weld o co County Health Department. a o a 47 . 1 . 4 Adequate mechanical means for scraping, grading and wkip cleaning of the property shall be provided at all times . The method of scraping, grading, and m z cleaning of the property shall be approved by the Weld County Health Department. o w 47 . 1 . 5 Drainage facilities or improvements shall be constructed to protect any ADJACENT rivers , streams or, or other bodies of water from pollution as approved N by the Weld County Health Department. o °a r.' 47 . 1 . 6 All runoff retention and containment facilities shall meet and he maintained in accordance with the State Health Department ' s Guidelines of Feedlot Runoff Containment Facilities . The property owner shall be responsible for any additional requirements issued by the Colorado Department of Health, Water Quality Control Division, or the Weld County Health Department. ooU `� Page 3 in p ORDINANCE #89-R U Ca 47 . 1 .7 Groundwater monitoring wells constructed to Weld 0 3 County Health Department standards may be required o x to evaluate impacts on the groundwater table. O H w E 47 . 1 . 10 All associated liquid and solid wastes shall be ow stored and removed for final disposal in a manner that protects against surface and groundwater co ca contamination . The method of disposal shall be w approved by the Weld County Health Department. w 2 N g 47 . 1 . 11 Fugitive dust shall he confined on the property as approved by the Weld County Health Department. U a 47 . 1 . 12 All animals shall be cared for in a humane and o N sanitary manner as approved by the Colorado State o University' s Extension Agent and the Weld County o Health Department. cow If any section, subsection, paragraph, sentence, clause or phrase of this Ordinance is for any reason held or decided to be invalid or unconstitutional, such decision shall not affect the validity of the remaining portion. The Board of County Commissioners hereby declares that it would have passed the Ordinance, and each and every section, subsection, paragraph, sentence, clause and phrase thereof irrespective of the fact that any one or more sections , subsections , paragraphs, sentences, clauses, or phrases might be declared to be unconstitutional and invalid.
