FREY WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, on July 24 , 1985 , the Board of County Commissioners held a public hearing to consider an application for a Use by Special Review for a motocross race track facility for Vince P. Frey, and WHEREAS, the Board was advised that the applicant, Vince P. Frey, failed to post a sign on the subject site ten days in advance of the public hearing, and WHEREAS, said site is described as being the Wh of Section 5 , Township 2 North, Range 64 West of the 6th P.M. , Weld County, Colorado, and WHEREAS, the Board determined that the applicant shall post a sign on the subject site no later than August 4 , 1985 , and this hearing shall be continued to August 14 , 1985 , at 2 :00 p.m. , at which time all testimony and evidence shall be considered. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the hearing to consider the Use by Special Review for a motocross race track facility for Vince P. Frey, on the hereinabove described parcel of land, be, and hereby is, continued to August 14 , 1985 , at 2 :00 p.m. BE IT FURTHER RESOLVED by the Board that Vince P. Kirby Commissioner Gordon E. Lacy, Excused Commissioner Frank Yamaguchi Also present: Acting Clerk to the Board, Tommie Antuna Assistant County Attorney, Bruce T. Barker Planning Department representative, Rod Allison The following business was transacted: I hereby certify that pursuant to a notice dated July 10, 1985, and duly published July 11, 1985, in the Johnstown Breeze, a public hearing was conducted to consider the request of Vince P. Frey for a Use by Special Review for a motocross race track facility. Bruce Barker, Assistant County Attorney, made this matter of record. He explained that the applicant had failed to properly post the subject property and; therefore, the Board does not have the jurisdiction to hear the matter at this time. The applicant was neither present nor represented. Commissioner Brantner moved to continue this matter to August 14, 1985, at 2:00 P.M. Chairman Johnson seconded the motion. Terry Reese came forward to ask which newspaper this matter would be published in. Chairman Johnson advised him that it would not be advertised again because it is being continued to a date certain. The motion carried with Commissioner Yamaguchi voting nay.
