Alexander, Mildred E . Alexander, and Sharon K. Alexander, dated March 29 , 1989 , with the Agreements being contingent upon the creation of Weld County 71st Avenue Local Improvement District No. 1989-1 ; therefore, said Agreements are null and void. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the creation of a Local Improvement District to be designated as Weld County 71st Avenue Local Improvement District No. 1989-1 be, and hereby is, denied. Our clients file herewith and have previously filed statements protesting the creation of the improvement district. On behalf of the objecting property owners, this letter is intended, pursuant to C.R. S. X30-20-625 , to serve as a statement of written objections on which action against the County may be brought If the County elects to create the proposed district. On behalf of our clients , I object to the creation of the district on the following grounds : 1 . The Board failed to provide proper notice of hearings as required by C.R. S. X30-20-601, et seq. The deficiencies in the notice included, but are not limited to, the following: a . Notices provided to property owners and published did not obtain reference to improvements to be made to 11th and 12th Streets . b. Notice was not published in a paper of general circulation within the time periods required by applicable law. c. Notices published and provided to property owners failed to set forth the probable cost per foot or other unit basis which, in the judgment of the Board , reflects the benefits which accrue to the properties to be assessed, as shown by estimates of the engineer . 890328 Clerk of the Weld County Board of Commissioners April 12, 1989 Page 2 2 . The benefits to be provided by the district are for the general public as opposed to being special or local benefits for the lot owner . 3 . The value of many of the lots , particularly those in the Knauss Second and Third Filing Subdivisions , will not be increased by the amount of the assessment. 4 . The Board has provided disparate treatment to various lot owners and in particular has allowed the Union Colony Bank as owner of 8 lots and the Alexanders as owners of 14 lots to defer the date payment of the assessments due, and has waived all interest which would otherwise be payable by the property owners. Counting the lots owned by these property owners as separate lots is also improper as no improvements have ever been installed within either the Bird or Peterson/Alexander subdivision, no lots have ever been sold, and, for property tax purposes , each of the tracts is taxed as one parcel. 5 . This district was created as a voluntary district which requires the signatures of 50% of the landowners. After the filing of the initial petition, many of the landowners on the petition have reconsidered their position and have resigned petitions in opposition to the district. When the number of consenting landowners is reduced by the number of landowners that have reconsidered their position, the County no longer has 50% of the landowners who would bear the assessments within the district. It is the hope of the landowners who have presented written objections to the creation of the district that the Board will determine that Weld County 71st Avenue Local Improvement District 1989-1 will not be created. Box 758 _`; Greeley, Colorado 80632 FROM: i^ ' We, the undersigned Citizens of Weld County are owners of" record of real property within the area/boundaries of thecpurpii ed ) < local improvement district , known as 71st Avenue/Knaus Subdivision , filings one, two and three, located generally west of the developed portion of the City of Greeley , Weld County, Colorado, contend that our properties will not benefit equally with the properties adjacent to the unpaved roads/streets described in the second paragraph of the "Petition For Local Improvement District" , project 1989-1 , now being considered by the Board of County Commissioners of the County of Weld , State of Colorado. While we the undersigned recognize the slight benefit of having 11th Street , from about one-half way between 75th Avenue and 76th Avenue to 77th Avenue and north on 77th Avenue to U. S. 34 Business, AKA West 10th Street , paved , there is no benefit what—so—ever to our properties, derived from the purposed paving of : 71st Avenue between U. S. 34 Business, AKA West 10th Street , and U. S. 34 By-pass; and 77th Avenue between 11th Street and 12th Street; and 76th Avenue between 11th Street and 12th Street; and 12th Street between 77th Avenue and 76th Avenue, located generally west of the developed portion of the City of Greeley, Weld County, Colorado. We further contend that since our properties are adjacent to • streets that are already paved and we paid for the paving in the price of the property located on: 12th Street between 71st Avenue and 75th Avenue; and 11th Street between 72nd Avenue and about one—half way between 75th Avenue and 76th Avenue; and 72nd Avenue between 11th Street and 12th Street; and the two culdesacs that run in an easterly direction from 72nd Avenue; and 73rd Avenue between 11th Street and 12th Street; and 74th Avenue between 11th Street and 12th Street ; and 75th Avenue between 11th Street and 12th Avenue, located in the same general area mentioned above in paragraph three of this document , will derive no benefit compared to the benefit that would be enjoyed by the owners of property adjacent to the now unpaved streets described in paragraph three of this document that the first petition (Petition For Local_ Improvement District) purposes be paved and the property owners as a whole and across the board be assessed $950. 00 PAGE 1 890328 PETITIr ' AGAINST LOCAL IMPROVEMENT "'STRICT er lot or- parcel . All owners of real estate and property hereinafter described and all persons generally, are hereby notified that the Board of County Commissioners of Weld County, Colorado, has adopted a Resolution declaring its intent to create a local improvement district within an unincorporated area of Weld County, Colorado, to be designated as Weld County 71st Avenue Local Improvement District No. 1989-1, for the purpose of constructing and installing street improvements to include compaction, grading, and paving, together with any necessary incidentals, and to assess the cost of said improvements as proposed by petition of owners of the property who would bear more than one-half of the total proposed assessment within the district, all in accordance with the laws of the State of Colorado. 1. All persons are further notified that the kind of improvements proposed and the streets to be improved are as follows: Weld County, Colorado, plans to pave 71st Avenue between U.S. 34 Business Route (also known as West 10th Street) and U.S. 34 Bypass; 77th Avenue between U.S. 34 Business Route and 12th Street; 76th Avenue between 11th Street and 12th Street; 11th Street between 77th Avenue and 76th Avenue; and 12th Street between 77th Avenue and 76th Avenue in an area generally west of the developed portion of the City of Greeley, Weld County, Colorado. The improvements include shaping, grading, draining, and paving the above described roads. (Underlining indicates corrections.) The major construction quantities include approximately 5500 tons of hot bituminous pavement. 2. The area to be included within the district includes all lots in Knaus Subdivision, First, Second, and Third Filings, Bird Subdivision, Peterson-Alexander Subdivision, except Lot 5, Block 1 , and all parcels contiguous to 71st Avenue between U.S. Highway 34 Bypass and U. S. Highway 34 Business Route. The district shall also include the rights-of-way of the County roads described in Paragraph 1 herein. 3. The assessment for said improvements may be paid in ten (10) equal annual installments of principal with installments of interest on unpaid installments at an interest rate of ten percent (10%) simple interest per annum. uy� � , :, rl�ti.r.E F /S��ey 890328 4. The assessment will he due and payable without demand within thirty (30) days from and after the final publication of a Resolution assessing the cost of said improvements, against the real property described herein in Paragraph 2. In the event any owner of real property shall fail to pay the whole of such assessment against his or her property within said thirty (30) days, then the whole cost of the assessment against such property shall be payable in not more than ten (10) equal, annual installments of principal with interest on the unpaid installments, as aforesaid. The first of such installments shall be due and payable at such time as may be determined in and by the assessing Resolution or Ordinance and the remainder of said installments shall be due and payable successively on the same day in each year thereafter, unless otherwise determined by the Board of County Commissioners, until they are paid in full. 5. As shown by the estimates of the Weld County Engineer, the total cost of the street improvements to be assessed against the property within the district is estimated not to exceed $118,000.00. This represents an estimate of the cost of the labor and materials for installation by contract of the hot bituminous pavement and base preparation. The Board of County Commissioners, pursuant to CRS 30-20-606, has preliminarily found and determined that each and every described lot or parcel will specifically benefit from the proposed improvements based on the following facts: a. The market value of each of the properties will increase; b. The proposed improvements will adapt the property to a more profitable use; c. There will be an alleviation of fugitive dust, eliminating the health hazards to the benefitted properties and to users of the public roads to be improved; d. The alleviation of fugitive dust will reduce maintenance costs to the subject properties and paving will lessen the maintenance required for a public road; and e. The proposed improvements will facilitate access to each of the properties and thereby increase the convenience of the use of said property. Based on the findings and determinations of the Board of County Commissioners, it is intended that all of the costs of the street improvements will be assessed equally against all of the above described lots and parcels. Property owners are specifically referred to the schedule of estimated proposed assessment on file in the office of the Clerk to the Board from which the approximate amount to be assessed against any particular lot or parcel of property may be determined, but further it is stated that the estimated cost per lot is $950.00, based upon the Engineer's cost divided equally among 124 lots and parcels. It is further stated as the intent of the Board of County Commissioners that should the cost of installation of hot bituminous pavement and preparation of base work exceed the amount of 890328 $950.00 per lot, excluding interest or any penalties, the County of Weld will assume payment of the excess. 6. Upon completion of said improvements, or as soon as the total cost thereof is definitely ascertained, the cost of the total improvements shall be apportioned equally to each of the above described lots and parcels. Notice of such apportionment shall be given and a hearing will be held prior to the adoption of a Resolution or Ordinance assessing such cost, all as provided by law. 7. A Resolution authorizing said improvements will be considered by the Board of County Commissioners on Wednesday, the 12th day of April, 1989, at 10:00 A.M. , or at an adjourned meeting thereafter, in the meeting room of the Weld County Centennial Center, 915 10th Street, Greeley, Colorado. 8. A map, estimate, and schedule showing the approximate amount to be assessed and all Resolutions and proceedings are on file and can be seen and examined by any persons at any time during business hours on or before the date referred to in paragraph 8. 9. All complaints and objections that may be made in writing concerning the proposed improvements by the owner or owners of any real property to be assessed will he heard and considered by the Board of County Commissioners at the meeting specified above, or at some adjournment thereof, before final action shall be taken. 10. Persons are further notified that should written protests in opposition to the district be presented to the Board of County Commissioners including more than 507 of the lots and parcels proposed to be assessed, prior to the hearing described in paragraph 7 herein, the district will not be created.
