RE: ACTION OF BOARD CONCERNING RECORDED EXEMPTION NC. 907 - JAMES
T. WESTERVELT, JR.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, on August 13 , 1986 , the Board considered the request
of James T. Westervelt, Jr. , for Recorded Exemption #907 , and
WHEREAS, at the August 13 meeting there was a 2-2 vote, and
the Board determined that Commissioner Lacy, who was excused from
said meeting, would listen to the tape and review the submitted
application , then cast the deciding vote at the Board meeting of
August 20 , and
WHEREAS, at the meeting of August 20 , the Department of
Planning Services advised the Board that the applicant did , after
the meeting of August 13 , produce proof that the subject property
has a legal right-of-way; therefore , it is not necessary for the
Board to take any action on the Recorded Exemption , and
WHEREAS, the Department of Planning Services recommended to
the Board that all application fees be refunded to Mr. Westervelt.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that no action is
necessary concerning Recorded Exemption #907 .
BE IT FURTHER RESOLVED by the Board that all application fees
be refunded to James T. Westervelt, Jr.

Re: Recorded Exemption #RE-9O7
Dear Commissioners:
This request for a recorded exemption is submitted by James T. Westervelt,
Jr. The parcel of land on which this request is being made is described as
the Ni SEI of Section 26, T2N, R68W of the 6th P.M. , Weld County, Colorado.
The property is located one mile west of Evanston on Weld County Road 11.
The parcel of land under consideration is not the total contiguous land
holdings of the applicant.
The request is to divide the property into parcels of 9.001 acres and 71.402
acres, more or less. The applicant wishes to retain the larger parcel and
maintain its present use and sell the smaller parcel as a rural residential
homesite. Both proposed lots would have access and adequate frontage to
Weld County road 11.
Sullivan Ditch creates a natural split within the 80 acres separating
proposed Lot A from Lot B. The majority of Lot B is used for irrigated crop
production. The proposed 9 acre site is idle ground containing 2 farm
outbuildings.
Based upon the submitted information and policies of the County, the
Department of Planning Services staff recommends the request be denied for
the following reasons:
The applicant has not demonstrated that the proposal is consistent with
efficient and orderly development. The 80 acres under consideration is the
north half of a 160 acre parcel owned by Mr. Westervelt. The south half of
the parcel was subdivided by the applicant in 1981. The approval of
Recorded Exemption 506 allowed 1. 155 acres (with existing improvements) to
be split from the 80 acres, which created an additional potential building
mite. The proposal to now subdivide the north half of the 160 acre parcel
will create a potential for 4 residences at this location.

The surrounding area, as evidenced by the parcel identification map (copy
attached) , is characterized by some previous small lot subdivision. It is
the staff's opinion that to continue the pattern of landsplics in the
neighborhood would result in a large, unplanned agricultural subdivision
where the availability of county services are inadequate to meet the needs
of the local residents.
The applicant has not demonstrated that the proposal is in compliance with
the future development plans as, projected by the Tri-Area. The Tri-Area
Planning Commission voted to deny this recorded exemption request on August
5, 1986. A reason that was given for the denial is the concern for
uncontrolled subdividing in the area.
It is the staff's opinion that the granting of this request is not in
compliance with the County Comprehensive Plan. Residential development at
this location has reached a level where there is interference with
agricultural land uses, and the approval of this land split will only serve
to encourage similar proposals in the future.

At our regular meeti-ng of the Tri --Area Planning Commission held
on August 5 , 1986 application from James T . Westervelt , Jr. for
-a recorded exemption was on the agenda .
In checking our records Mr . Westervelt is partners with a Mr.
-Strahan in a business referred to as High Country Turf , which is
same property applying for a recorded exemption . d_arlier in the
year Mr. Strah-an came before this Commission twice requesting a
recorded exemption . Each time a different plan . We approved
application stating it was well Planned usage of land . -Although
we realize this is a different application we voted to deny .
1 . ) Mr. Westervelt was not present to answer questions and ; 2 . )
We see this as possibly turning into what we call "gypsy sub-
divi-ding" which tends to be uncontrollesi in what can be done on
said property .

It is understood that nine (9) shares of the preferred stock of
the Consolidated Lower Boulder Reservoir and Ditch Company were sold to the
City of Lafayette and a covenant filed of record on September 9, 1980 (see
Attachment "8"). 11
It is understood Seller has filed an application for approval of
plan of augmentation in the District Court in and for Water Division Ho. 1, i

State of Colorado, Case No. 80-CW-349 which provides tntsr ,il'a for a Four
Hundred (400) acre-foot storage reservoir and an unnamed 7.08 c.T.s. irriga-
tion well to be completed. It is understood a well (r

available to drill said irrigation well during the calendar year 1981. In C~
the event said permit is not available to Purchaser in sufficient time to

or through the existing pipeline system from the Johnson Well No. 1 to irrigate
the subject acreage. In the event -ditch water is supplied, Purchaser will pay

pay the actual cost of energy necessary to pump the water to the acreage.
This arrangement to supply water shall continue until an alte• late water sys-
tem becomes available to Purchaser. In the event tests indicate a well is not

Item 4. The reason for the exemption is to create a small parcel of
land to resell for profit since the ground is not currently used for
any purpose for various reasons. Most importantly its size, shape,
topography, and soil type are not suitable for agriculture uses.
Item. 5 This proposal is within the policy of the Weld County
Comprehensive plan, additionally; the proposed use for the exemption
is a home site
Item 6. The proposal is consistent with the agriculture zone district.
Item 7. The proposed use is as a home site which would be compatible
with the surrounding area.
Item 8. As the Weld County Comprehensive Plan reads now the use
would not conflict with future development plans , nor would it be •
adversely affected by the master municipality plan of Fredrick.
Item 9. Since the proposed use is for a home site and horse coral
- the proposed use would not be inconsistant with efficient and orderly
development of the surrounding areas.
Item 10. The domestic water will be supplied by Central Weld Water
District. The sewage disposal will be by individual septic system.
Item 11. The property is not located in a flood plain, geological
hazard area or the Weld County Airport overlay district and does
comply with section 50 overlay districts regulations as outlined in
the Weld County Zoning Ordinance.
