RESOLUTION
RE: APPROVE AGREEMENTS AND GRANTS OF EASEMENTS AND RIGHT TO USE
AND MAINTAIN STRUCTURES PLACED IN EASEMENTS WITH VARIOUS
INDIVIDUALS AND AUTHORIZE CHAIRMAN TO SIGN
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with Agreements and
Grants of Easements and Right to Use and Maintain Structures
Placed in Easements with H.F. Markus; John Ells, Jr. ; and Roy M.
and Maureen C. Martin, and
WHEREAS, said Agreements are for conveying to the City of
Greeley a ten-foot permanent easement for the purpose of placing
an underground sewer pipeline for service to the Weld County
Business Park, and
WHEREAS, after study and review, the Board deems it advisable
to approve said Agreements and Grants of Easements, copies of
which are attached hereto and incorporated herein by reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the Agreements and
Grants of Easements and Right to Use and Maintain Structures
Placed in Easements with H.F. Markus; John Ells, Jr. ; and Roy M.
and Maureen C. Martin, be, and hereby are, approved.
BE IT FURTHER RESOLVED by the Board that the Chairman be, and
hereby is, authorized to sign said Agreements and Grants of
Easements.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 20th day of
July, A.D. , 1988 .

THIS AGREEMENT, made and entered into this day of
, 1988, by and through the Weld County Board of
County Commissioners , P.O. Box 758 , Greeley, Colorado 80632 ,
hereinafter referred to as "County" , and H.F. Markus, 2229 12th
Street Road, Greeley, Colorado 80631, hereinafter referred to as
"Grantor" for the benefit of the City of Greeley, State of
Colorado, hereinafter referred to as "City" .
WITNESSETH:
WHEREAS, County is developing a property in the North half of
the North half of the Northwest quarter of Section 31 , Township 6
North, Range 65 West of the 6th P.M. , Weld County, Colorado- to
which sewer services are to be provided by the City of Greeley,
and
WHEREAS, Grantor owns property through which it is necessary
to place an underground sewer pipeline for service to the County
property, and
WHEREAS, the service will be provided by the City of Greeley
and the Grantor desires to dedicate to the City a ten (10) foot
permanent easement for a right-of-way for the purposes herein set
forth.
NOW, for the mutual covenants and agreements as set forth
herein the parties agree as follows:
1 . Grantor hereby grants and conveys to the City of
Greeley, a ten (10) foot permanent easement for a right-of-way for
the purposes hereinafter set forth. The easement shall be
described as follows:
The East ten (10) feet of the West forty (40)
feet of the property described in the deed
recorded in Book 524 , Reception No. 1446120,
the records of the Weld County Clerk and
Recorder, excepting for an existing office
building which extends over a distance of
twenty-four and one half (24 1/2) feet of said
ten foot easement. All of the above property
is located in the Southwest Quarter of the
Northwest Quarter of Section 32, Township 6
North, Range 65 West, Weld County, Colorado.
2 . The permanent right-of-way shall entitle the City, its
successors and assigns to install, construct, relocate, alter,
repair, inspect, maintain, remove, and operate, an underground

sewer pipeline, and all appurtenances thereto. A part of the
easement shall be used for the placement of a fill slope for new
road construction.
3. The County, the entity installing said pipeline for the
benefit of the City, shall bury said pipeline, fill all trenches
to the original ground surface or higher, compact backfill as
necessary to avoid settlement, and remove and restore all
improvements to pre-existing condition.
4 . In consideration therefor and in lieu of condemnation,
the County agrees to pay a sum of money as established by an
independent third party M.A.I . certified land appraiser, said sum
to be paid within five working days of receipt of final appraisal
for the property from the appraiser.
5. The parties hereto agree that the terms and condition of
this Agreement shall not be merged into the grant of easement.

THIS AGREEMENT, made and entered into this day of

hereinafter referred to as "County" , and JOHN ELLS, JR. , 722 North
Eleventh Avenue, Greeley, Colorado 80631, hereinafter referred to
as "Grantor" for the benefit of the City of Greeley, State of
Colorado, hereinafter referred to as "City" .
WITNESSETH:
WHEREAS, County is developing a property in the North Half of
the North Half of the Northwest Quarter of Section 31 , Township 6
North, Range 65 West of the 6th P.M. , Weld County, Colorado to
which sewer services are to be provided by the City of Greeley,
and
WHEREAS, Grantor owns property through which it is necessary
to place an underground sewer pipeline for service to the County
property, and
WHEREAS, the service will be provided by the City of Greeley
and the Grantor desires to dedicate to the City a twenty (20) foot
permanent easement for a right-of-way for the purposes herein set
forth.
NOW, for the mutual covenants and agreements as set forth
herein the parties agree as follows:
1 . Grantor hereby grants and conveys to the City of
Greeley, a twenty (20) foot permanent easement for a right-of-way
for the purposes hereinafter set forth. The centerline of the
easement shall be described as follows:
Commencing at the West Quarter (W}) Corner of Section
32 , Township 6 North, Range 65 West, of the 6th
Principal Meridian, Weld County, Colorado, and
considering the west line of the Southwest Quarter (SW})
of said Section 32 to bear South 00°00 '20" East, with
all bearings contained herein, related thereto; thence
South 00°00 ' 20" East along the West line of the
Southwest Quarter (SW}) , a distance of 1219 .82 feet;
thence North 89°59 ' 40" East, a distance of 40 .00 feet to
the True Point of Begining; thence South 86°26 ' 56" East,
a distance of 631 .55 feet; thence South 81°10 '07" East,
a distance of 462.80 feet to a point of termination on
the west right-of-way line of U. S. Highway No. 85.
2 . The permanent right-of-way shall entitle the City, its
successors and assigns to install, construct, relocate, alter,
repair, inspect, maintain, remove, and operate, an underground
sewer pipeline, and all appurtenances thereto. A part of the

THIS AGREEMENT, made and entered into this day of

Greeley, a seven (7) foot easement for a right-of-way for the
purposes hereinafter set forth. The easement shall be described
as follows:
The east seven (7) feet of the west forty (40)
feet of the property described in Deed
recorded in Book 1551 , Page 100, Reception No.
1323140 , Weld County records , that lies north
of a point on the west line of said property
which is 2523.7 feet from the southwest corner
of Section 32, Township 6 North, Range 65
West, Weld County, Colorado.
2. The permanent right-of-way shall entitle the City, its
successors and assigns to install, construct, relocate, alter,
repair, inspect, maintain, remove, and operate, an underground
sewer pipeline, and and all appurtenances thereto. A part of the
easement shall be used for the placement of a fill slope for new

Beginning at the east right-of-way line of 11th Avenue
and the north right-of-way line of "H" Street, as
recorded in Book 519, Reception 1441095 of the Weld
County records, and considering the east right-of-way
line of 11th Avenue to bear North 00°16 '00" east, with
all other bearings contained herein relative thereto;
thence North 00°16 ' 00" East, 29. 73 feet; thence on a
curve to the left having a radius of 30.00 feet and a
central angle of 89°29 '00" an arc distance of 46.85
feet, the long chord of which bears South 44°28 '30"
East, a distance of 42.23 feet; thence North 89°13 '00"
West a distance of 29 . 73 feet, more or less, to the
point of beginning. Containing .0043 acres, more or
less.
Also begining at the east right-of-way line of 11th
Avenue and the south right-of-way line of "H" Street as
recorded in Book 519, Reception 1441095, of the Weld
County Records , and considering the east right-of-way
line of 11th Avenue to bear North 00°16 '00" East with

RIGHT-OF-WAY GRANT
Know all men by these presents that Monfort of Colorado,
County of Weld, State of Colorado, hereinafter referred to as "Grantor";
hereby grants and conveys to the City of Greeley, hereinafter referred
to as "Grantee" , a twenty foot (20' ) permanent easement for a right-of-
way for the purposes hereinafter set forth. The centerline of the
right-of-way shall be described as follows:
Commencing at a point on the East right-of-way line of U.S.
Highway No. 85, and the South line of the Northeast Quarter
(NE1/4) , Southwest Quarter (SW1/4) , Township 6 North, Range
65 West, of the 6th Principal Meridian, and considering the
South line of said Northeast Quarter (NE1/4) , Southwest
Quarter (SW1/4) , Section 32, to bear South 84° 50' 18" East,
with all other bearings related thereto; thence North 07° 51'
13" West, along the West right-of-way line of U.S. Highway
No. 85, a distance of 212.47 feet to the True Point of Beginning;
thence North 87° 27 ' 31" East; 330 feet more or less to the West
line of the Union Pacific Railroad right-of-way, being the point
of termination.
The Grantor also hereby grants and conveys to the Grantee, a
temporary easement fifty feet (50 ' ) in width, thirty-five feet ( 35 ' )
to the South and fifteen feet ( 15 ' ) to the North of the centerline,
for construction purposes.
The permanent right-of-way shall entitle the Grantee, it's successors

RIGHT-OF-WAY GRANT
Know all men by these presents that Weld County Bi-Products,
Inc. , 1138 North 11th Avenue, City of Greeley, County of Weld,
State of Colorado, hereinafter referred to as "Grantor" ;
hereby grants and conveys to the City of Greeley, hereinafter referred
to as "Grantee" ; a ten foot (10' ) permanent easement for a right-of-
way for the purposes hereinafter set forth. The easement shall be
described as follows:
The east ten (10) feet of the west forty ( 40) feet of the
property described in Deed recorded in Book 863, Reception No.
1784550, Weld County records, also known as street and number
1110 North 11th Avenue, City of Greeley. Also, the east ten
( 10) feet of the west forty (40) feet along the west line of
Section 32, included in the property described in Book 996,
Reception No. 01926868, Weld County Records. All of the above
property is located in the Southwest Quarter (SW1/4) of the
Northwest Quarter (NW1/4) of Section 32 , Township 6 North, Range
65 West, Weld County, Colorado.
RESTRICTION: A six foot ( 6' ) chain link security fence exists
within the majority of said ten (10) foot permanent easement, and should
any portion of this fence need to be relocated or disturbed during
construction or maintenance operations, said portion of fence shall be
replaced at the sole expense of Grantee.
The permanent right-of-way shall entitle the Grantee, it' s
successors and assigns, to install, construct, relocate, alter,
repair, inspect, maintain, remove, and operate, an underground sewer
pipeline, and all appurtenances thereto.
The Grantee shall bury said pipeline, fill all trenches to the
original ground surface or higher, compact backfill as necessary to
avoid settlement, remove and restore all improvements to pre-existing
condition.

Know all men by these presents that John Ells, Jr. , of the City
of Greeley, County of Weld, State of Colorado, hereinafter referred to
as "Grantor" , hereby grants and conveys to the City of Greeley,
hereinafter referred to as "Grantee" , a seven foot ( 7 ' ) permanent
easement for a right-of-way for the purposes hereinafter set forth.
The east seven (7) feet of the west forty ( 40 ) feet of the
property described in Deed recorded in Book 1551, Page 100, Reception
No. 1323140, Weld County records, that lies north of a point on the
west line of said property which is 2523 .7 feet from the southwest
corner of Section 32, Township 6 North, Range 65 West, Weld County,
Colorado.
The permanent right-of-way shall entitle the Grantee, it' s
successors and assigns to install, construct, relocate, alter, repair,
inspect, maintain, remove, and operate, an underground sewer pipeline,
and all appurtenances thereto. A part of the easement shall be used
for fill slope for new road construction.
The Grantee shall bury said pipeline, fill all trenches to the
original ground surface or higher, compact backfill as necessary to
avoid settlement, remove and restore all improvements to pre-existing
condition.
The Grantee herewith conveys to the Grantor, the sum of
$10.00 and other good and valuable considerations for such
easements, the receipt of which is hereby acknowledged.

Weld County, Colorado, and considering the West line of the
Southwest Quarter (SW1/4) of said Section 32 to bear South
00° 00' 20" East, with all bearings contained herein related
thereto; thence South 00° 00 ' 20" East along the West line
of the Southwest Quarter (SW1/4) , a distance of 1219.82 feet;
thence North 89° 59 ' 40" East, a distance of 40.00 feet to
