RE: APPROVAL OF RECORDED EXEMPTION NO. 1217 - JACOB D. AND ELLEN
D. KERBS
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners, pursuant to its
authority under Section 30-28-101 (10) (d) , CRS, as amended , did
determine at a public meeting held in the Chambers of the Board,
that a certain parcel of land, to be divided into two parcels, as
shown on the plat known as Recorded Exemption No. 1217, does not
come within the purview of the definition of the terms,
"subdivision" and "subdivided land" , and
WHEREAS, the request for Recorded Exemption No. 1217 was
submitted by Jacob D. and Ellen D. Kerbs for property which is
located in part of the NE* , Section 13, Township 3 North, Range 68
West of the 6th P.M. , Weld County, Colorado, being more
particularly described in the plat which shall be provided by the
applicant and known as Exhibit "A" , said plat to be recorded, and
WHEREAS , this request is to divide the property into parcels
estimated to be approximately 107 acres and 7 acres.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the hereinabove
described parcel of land be, and hereby is , exempt from the
definition of the terms, "subdivision" and "subdivided land" .
BE IT FURTHER RESOLVED by the Board that this approval is
conditional upon the following: 1) The applicant shall submit a
Weld County septic permit for the proposed home and its septic
system shall be installed according to the Weld County Individual
Sewage Disposal System (ISDS) regulations; 2) An ISDS evaluation
by the Weld County Health Department shall be required on all
existing septic systems prior to issuing the required septic
permits on the existing systems; 3) A Flood Hazard Development
Permit shall be required for any new construction or the
substantial improvement of existing structures in the Floodway or
Floodprone Districts located on the property; and 4) The applicant
shall submit a mylar plat to the Department of Planning Services
to be recorded in the office of the Weld County Clerk and
Recorder. The plat shall be drawn in accordance with the
requirements of Section 9-2C. (4) of the Weld County Subdivision
Regulations. The plat shall be submitted within sixty days from
the date of approval by the Board of County Commissioners.

Subject: Recorded Exemption #1217
Dear Commissioners:
This request for a recorded exemption is submitted by Jacob D. and Ellen D.
Kerbs. The parcel of land is described as part of the NE} of Section 13,
T3N, R68W of the 6th P.M. , Weld County, Colorado. The property is located
west of Weld County Road 13 and south of Weld County Road 34, approximately
one mile east of the Town of Mead. This request is to divide a 113.9 acre
tract of land, which is the total contiguous land holdings of the applicant,
into two lots of 107.4 acres and 6.5 acres, more or less.
It is the opinion of the Department of Planning Services' staff that the
applicant has failed to show in the submitted application materials how this
request is consistent with the Weld County Comprehensive Plan and efficient
and orderly development. The guidelines used to allow a division of an
agricultural lot into two separate lots are outlined in Agricultural Policy
Number 7. The intent of this policy is to:
A. Enable the property owner who is retiring an opportunity to
live on or sell the existing farm improvements;
B. Enable the property owner to sell off agricultural land that
is nonproductive for one single family dwelling homesite; and
C. Enable the property owner to provide a residence for direct
members of the farm family and also for workers employed at
the farm.
It is the opinion of the Department of Planning Services' staff that other
alternatives beside the recorded exemption process are available to the
applicant, who has stated in his application that he wants to build a new
home to meet his family's needs. One single family dwelling is located on
the 113 acre parcel.

The level of development and the potential for continued divisions occurring
in this area and on both parcels warrants concern. This 113 acre parcel is
Lot A of a recorded exemption which was approved in 1977. Two other
recorded exemptions have been approved in this section since that time.
Residential development in rural areas necessitates an increased demand for
road maintenance, police and fire protection, school busing, snow removal,
utilities, and other urban services. As density increases, so do service
demands.

A Weld County septic permit is required for the proposed home and its septic
system shall be installed according to the Weld County Individual Sewage
Disposal System (ISDS) regulations.
An ISDS evaluation by the Weld County Health Department on all existing
septic systems will be necessary prior to issuing the required septic
permits on the existing systems.
A Flood Hazard Development Permit will be required for any new construction
or the substantial improvement of existing structures in the Floodway or
Floodprone Districts located on the property.

Dear Planners:
Enclosed you will find a completed application for a recorded exemption along
with the required supportive documentation. The reference property is a portion
NE 1/4 of Section 13, Township 3 North, Range 68 West and known as 15871 Weld
County Road 13, Platteville, Colorado. This tract of land consists of 113.86
acres.
I have just recently purchased this farm and want to build a new home to meet my
family needs and must do a recorded exemption to accomplish this. Once divided,
we will have Lot A consisting of 107.36 acres and Lot B, 6.5 acres with the
present improvements.
My request meets the requirements set forth by Weld County Subdivision Regulations
and complies with the County Comprehensive Plan. The way this division is proposed
makes good sense for a logical and functional division. It will make good sense
also for good farming and conservation practices.
My proposal shall have no adverse affect on neighboring properties and will continue
to be used for agriculture purposes.
My proposal should reduce farm traffic on and off of Road 13 because I will be
living on and farming this property.
As far as utilities are concerned I will have domestic water provided by the
Little Thompson Water District with a tap available off WCR 13. United Power
provides electric service in the area. There is no sewer lines, so I will utilize
a septic system to meet Weld County Health Department requirements.
To quickly recap, I believe my proposal is consistant with the surrounding area
and meets all county requirements for this proposed division.

Re: Service Commitment
Dear Mr. Kerbs :
This letter is in response to your request that the Little
Thompson Water District commit to provide domestic water
service to property located on Weld County Road 13 and 34 ,
southwest of the intersection on Weld County Road 13 .
We can provide service along the west section line of
Section 13, Township 3N, Range 68W, as we have a 6" water
line along Weld County Road 13 .
This commitment will expire on July 1 , 1990 if the tap has
not been purchased and installed by that date.
The current fee for a standard 5/8" x 3/4" residential water
tap is $3 , 000 . 00 and will increase to $4 , 000 . 00 on September
1 , 1989 .
If any improvements are required to District facilities to
provide service, they will be done at the expense of the
person (s) requesting service in accordance with District
Rules and Regulations .
