HomeMy WebLinkAbout890864.tiff RESOLUTION RE: APPROVAL OF SERVICE PLAN - BRIGGSDALE FIRE PROTECTION DISTRICT WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, pursuant to Section 32-1-204 , CRS, as amended, a Service Plan concerning the proposed Briggsdale Fire Protection District was filed with the Weld County Board of County Commissioners, and WHEREAS, pursuant to Section 32-1-108 , CRS, as amended, the Board of County Commissioners scheduled a public hearing on the Service Plan to be held at 10 : 00 a.m. on August 2, 1989, and WHEREAS, notice of the date, time and location and purpose of said hearing was duly published in The New News, the County legal newspaper, on July 13 , 20 , and 27 , 1989 , and in the North Weld Herald, a newspaper of general circulation in the area; notice was provided to the Division of Local Affairs of the name and type of the proposed District; and notice of the date, time and location of said hearing was provided to the Petitioners, to the governing body of each municipality and of each special district which had levied an ad valorem tax within the next preceding tax year and which had boundaries within a radius of three (3) miles of the District, and to said Division, as required by Sections 32-1-202 (1) and 32-1-204 (1) , CRS, as amended, and to the Weld County Planning Commission as required by Section 32-1-204 , CRS, as amended, and WHEREAS, the Weld County Planning Commission studied and considered the Service Plan at its meeting on July 18 , 1989 , at which time said Commission adopted a Resolution recommending approval of the Service Plan for various reasons as more specifically stated therein, which recommendation was subsequently presented to the Board of County Commissioners at its hearing on this matter by a representative of said Commission, as required by Section 32-1-204 (2) , CRS, as amended, and WHEREAS, the Board did, on August 2, 1989 , conduct a full public hearing on this matter, taking evidence establishing the jurisdiction of the Board to hear this matter and further taking evidence regarding the substantive issues set forth in Section 32-1-203, CRS, as amended, at which hearing all interested parties were afforded an opportunity to be heard, and 890864 Page 2 RE: SERVICE PLAN - BRIGGSDALE FIRE PROTECTION DISTRICT WHEREAS , the Board fully considered the Service Plan and all testimony and other evidence presented to it in this matter relating to said Service Plan, including the favorable recommendation of the County Department of Planning Services, and WHEREAS, the Board, after consideration, finds that the Service Plan and the evidence and testimony presented to the Board meets the criteria contained within Section 32-1-203 , CRS, as amended, and NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that: Section 1 . The Board hereby determines that all of the jurisdictional and other requirements of Sections 32-1-202 and 32-1-204 , CRS, as amended, have been fulfilled, including those relating to the filing and form of the Service Plan, the form and publication of the public notice of the hearing on the Service Plan and the type of public hearing held herein, and that, pursuant to Section 32-1-204 (1 .5) the petitioners did give proper and timely postcard notification of the hearing to the property owners within the district. Section 2. The Weld County Planning Commission has considered this matter as required by law and has recommended approval of the Service Plan. Section 3 . That prior to a decision on the Service Plan, the Board determined that no requests for exclusion of property were submitted. Section 4 . Based upon the information contained within the Service Plan and evidence presented to the Board at the hearing, the Board hereby finds and determines as follows : a. There is sufficient existing and projected need for organized services of the nature proposed in the Service Plan in the area to be serviced by the proposed District; b. The existing services in the area to be served by the proposed District are inadequate for present and projected needs; c. The proposed District is capable of providing economical and sufficient services to the area within its proposed boundaries; 890864 Page 3 RE: SERVICE PLAN - BRIGGSDALE FIRE PROTECTION DISTRICT d. The area to be included within the proposed District will have the financial ability to discharge the proposed indebtedness on a reasonable basis; e. Adequate services are not and will not be available to the area through Weld County, or other municipal or quasi-municipal corporations, including special districts, within a reasonable time and on a comparable basis; f. The facilities and service standards of the proposed District are or will be compatible with the facilities and service standards of Weld County and of each municipality and special district which is an interested party hereto; g. The Service Plan is in substantial compliance with the Weld County Master Plan; and h. The creation of the proposed District will be in the best interest of the area proposed to be served. Section 5 . The Service Plan of the proposed District, be, and hereby is, approved. Section 6 . The Clerk to the Board is hereby directed to advise the Petitioners in writing of this action and to attach a certified copy of this Resolution for the purpose of filing the same with the District Court of Weld County. Section 7. All Resolutions, or parts hereof, in conflict with the provisions hereof, are hereby repealed to the extent of such conflict only. Section 8 . Lacy Also present: Acting Clerk to the Board, Mary Reiff Assistant County Attorney, Lee D. Morrison Planning Department representative, Keith Schuett The following business was transacted: I hereby certify that pursuant to a notice dated July 10, 1989, and duly published July 13, 20, and 27, 1989, in The New News, a public hearing was conducted to consider the service plan submitted by the proposed Briggsdale Fire Protection District. Lee Morrison, Assistant County Attorney, made this matter of record. (Let the record reflect that Commissioner Brantner has now arrived.) Keith Schuett, Planning Department representative, entered the favorable recommendation of the Planning Commission into the record. Mr. Schuett said that one telephone call opposing creation of the district was received this morning. Bob Burroughs, Attorney, came forward to represent the proposed district. He said that this is the only area of northeast Weld County without an organized fire district. Volunteer service in the area is presently provided by the Briggsdale Lions Club, with assistance from others. Kay Washburn, chairman of the organizational committee, came forward to answer questions. Mr. Washburn said they plan to provide a fire rescue unit. Public comment favoring formation of this district was offered by Bob White. No further public comment was offered. Mr. Morrison explained the further procedure for formation of this special district and reviewed the findings which the Board is to make. Commissioner Lacy moved to approve the proposed Service Plan, based upon the necessary findings, and noted that no requests for exclusion have been received. Commissioner Brantner seconded the motion, and it carried unanimously. This Certification was approved on the 7th day of August, 1989. The Service Plan is now on file in the office of the Clerk to the Board of County Commissioners, 915 10th Street, Third Floor, Greeley, Colorado, and is available for public inspection between 8:00 A.M. and 5:00 P.M. , Monday through Friday. The proposed Briggsdale Fire Protection District comprises the Weld County RE-1OJ Briggsdale School District, excluding Sections 29, 30, 31, and 32, Township 8 North, Range 63 West of the 6th P.M. , together with 42§ additional sections as outlined on the boundary map. Pursuant to Section 32-1-202, C.R.S. , the Service Plan may not he approved if a petition objecting to the Service Plan and signed by the owners of taxable real and personal property, which property equals more than fifty percent of the total valuation for assessment of all taxable real and personal property to be included in the District, is filed with the Board of County Commissioners no later than ten days prior to the hearing, unless such property has been excluded by the Board of County Commissioners under Section 32-1-203 (3.5) , C.R.S. Pursuant to Section 37-1-305(3) , C.R.S. , the owner of real property within the proposed District may file a petition with the District Court in and for Weld County, stating reasons why said property should not be included with the proposed District and requesting that such real property he excluded therefrom. It is my feeling that if some of the local Briggsdale residents wish to have more fire protection than they already have, then let those people who live close enough to benefit from it, pay for it . We, the Novak Families, live more than ten (10) miles away from Briggsdale. By the time a fire were out of our control here, and assuming the phone was still useable to notify the fire depart- ment, in all probability, the fire would be far beyond putting out in time to save much . The fire department would arrive with less water than what it would require to put such a fire out . The only thing that the Fire Protection Organization would really be accomp- lishing would be to protect a lot of prairie ground from total destruction. One example of prime fire protection, is the town of Grover' s local pub. Their fire department is less than five hundred feet from the establishment that used to be there. The place is in a charred heap now. Where was the fire protection that the pub needed? And a few steps away? What would you suppose would happen to a home and property 10 miles away?? We don't feel that any more fire protection than we already have would be of a great deal of importance . We cannot see paying for something that would be of no use . If a neighbor happed to see a fire in his area and stop by to help put it out, all fine and appreciated . The taxing districts within the service area and within a three mile radius of the proposed district have indicated that they have no conflicts with the proposed district. - It appears that the creation of the proposed special district will be in the best interest of the area proposed to be served. This recommendation is based, in part, upon a review of the application materials submitted by the applicant, other relevant information regarding the request, and the responses of the referral entities which have reviewed this request. (3) The Board of County Commissioners may conditionally approve the service plan of a proposed special district upon satisfactory evidence that it does not comply with one or more of the criteria enumerated in subsection (2) of this section. Final approval shall be contingent upon modification of the service plan to include such changes or additional information as shall be specifically stated in the findings of the Board of County Commissioners. (3.5) The Board of County Commissioners may exclude territory from a proposed special district prior to approval of the service plan submitted by the petitioners of a proposed special district. The petitioners shall have the burden of proving that the exclusion of such property is not in the best interest of the proposed special district. Any person owning property in the proposed special district who requests that his property be excluded from the special district prior to approval of the service plan shall submit such request to the Board of County Commissioners no later than ten days prior to the hearing held under Section 32-1-204, but the Board of County Commissioners shall not be limited in its action with respect to exclusion of territory based upon such request. Any request for exclusion shall be acted upon before final action of the County Commissioners under Section 32-1-205. (4) The findings of the Board of County Commissioners shall be based solely upon the service plan and evidence presented at the hearing by the petitioners, planning commission, and any interested party. I feel that there is considerable need for the proposed fire district. Pawnee Fire responds to this area several times each year, sometimes leaving our own district unprotected, unmanned with little or no equip- ment. We must travel 20 to 30 miles from our fire station to provide fire protection and EMS assistance in this proposed fire district. With 24 miles of Colorado Highway 14 running through this proposed district there is a need for fire training and equipment, Haz Mat training and EMS training and equipment. I question the lack of radios in this proposed service plan. Incorporation with Weld County Communication Center is very necessary to provide sufficient fire and EMS protection in this large district and also to communicate with mutual aid departments. I also question the feasibility of supporting a new fire district with 2.5 mills. The equipment needed to support this proposed district is expensive and must be kept in top condition. When our district was formed our mill levy was set too low and we found ourselves in financial trouble. I suggest a minimum levy of 4.5 mills until most of the equip- ment is purchased. After this time the mill levy may be lowered to a maintenance level. Justification for the project is based upon the need for fire protection in this very large area, in which our current fire protection is inadequate because of financing needs and required insurance funding at the present time. DESCRIPTION OF AREA The proposed area comprises the total Weld County RE10J Briggsdale School District, excluding Sections 29, 30 , 31 and 32, Range W63, Township SN, which are included in the Galeton Fire Protection District. Our proposed area is approximately 450 square miles (288,000 acres) , and includes the unincorporated Town of Briggsdale. This proposed service area extends north to the boundaries of the Pawnee RE12 School District, south to the RE50J School District, east to the RE11J School District, and west to the RE9 School District. The proposed district boundaries are shown on the large Weld County map, Exhibit 1. Also, the following property is to be included in the proposed District , to wit: Township 6 North, Range 62 West of the 6th P.M. : All of Sections 5, 6, 7, 8, 17 , 18, 19 , 20, 28 , 29, 30, 31 , 32 and 33. Based on current records of the Weld County Assessors Office, the assessed valuation of the RE10J School District included in our proposed fire district is $5,458,660.00. The total assessed valuation of the entire proposed district is $5,676,850.00. Less the assessed valuation of $18,580.00 on sections 29, 30, 31 , and 32 Range W63, Township 8N. Smith — Director, Division of Fire Safety JUSTIFICATION The present fire protection in the proposed district consists of (1) 1958 2 ton Chev. fire truck. This current truck is operable , but it' s tank is rusty and leaking, and the equipment needs overall improvement. Also, it is usually operated to the fire locations at speeds of approximately 30 to 45 M.P.H. , loaded with water. Our current building facility is presently furnished by Weld County in conjunction with their equipment storage of a motor grader and etc. . The accessibility of this building to our fire organization may be subject to loss, or could possibly be acquired by rental or purchase agreement with Weld County. Presently, the responsibility of fighting grass fires lies under the juris— diction of the Weld County Sheriffs Department. Ed Jordan, the present Sheriff, has strongly encouraged and supported the efforts of our for— mulation committee in creating a Fire District of our own. Previously, we have had to rely on assisstance from Grover, New Raymer and Galeton Fire Services as our present available equipment is not sufficiently adequate. Approximately 25 to 35 fire calls are responded to per year; more or less depending on the type of season we have. 890864 We have 5 to 20 volunteers responding to fire calls in our area. These volunteers have no official training, no structured organization and are not insured. Also, our supply of fire fighting equipment is limited and inadequate, further restricting the efforts of volunteers to fight fires properly. Sole funding for the Briggsdale Fire Truck and Ambulance Service is currently provided by the Briggsdale Lions Club. These funds are insuf— ficient to continue operating as we presently are, as funds generated by these means will not cover necessary repairs, maintainance, insurance or equipment purchases. Assuredly, an adequate Fire Service is highly necessary to protect the sta- bility of residential areas, farming and ranching areas (grasslands) , town businesses, and school properties in our proposed fire district. It is evident that our liability responsibilities during any fire responce are highly jeopordized. Through studies conducted by our formulation committee it has been deter- mined that once a fire district has been established and approved by the State Insurance Commission, we can then adequately carry the proper insurance for operating our fire district and it 's equipment. This , in turn, could and would reduce the insurance premiums of most our patrons. FACILITIES • Our Committee proposes to make the following facilities available: TRUCKS : (1) late model , 1 ton , 4wd pickup equipped with a 3 to 4 hundred gallon water tank, sufficient pumping capacity, and all other regulation fire fighting equipment. This truck would be smaller, but would be able to respond to calls more quickly. (2) The committee also recommends we acquire a larger fire truck: 1500 to 3000 gallon capacity, equipped with pump and fire fighting equipment in accor- dance with State Fire District requirements and regulations. This truck could be obtained by bids to other fire districts or through assisstance from the United States Forest Service. The Colorado State Forest Service has offered to buy a new model truck , and will add the necessary fire equipment to it at a very reasonable cost. Our existing 1958, 2 ton truck would still be used along with the newer, better equipped trucks we intend to purchase. AMBULANCE: The present 1969 ambulance assumed by the Fire District will be equipped, according to Fire District Regulations , to qualify as a fire rescue unit. STATION: It is proposed, to lease with the option to purchase, the now existing Weld County Shop. This building in Briggsdale, is an ideal location for a fire equipment storage building and proposed fire sta— tion, and will require a disposal system meeting with Health Protection Service standards. 890864 CALL AND ALARM SYSTEM: A telephone system installed by the Wiggins Telephone Association will include a specified phone number, available to the public , that will ring into a minimum of 20 homes and the fire station. A manually triggered siren will be utilized. STAFF: Fire fighting volunteers will be required to be adequately trained to 1) operate equipment, 2) provide immediate response to fire alarms , and 3) properly protect lives and property. The initial staff will consist of 15-20 qualified volunteer fire fighters and 1 Fire Chief. More volunteers will be recruited as necessary, and we will also elect a 5 member fire board. Completion of the proposed fire district will give the Briggsdale platted area an approximate 8 rating. The rest of the district will remain at 10. 890864 WATER SUPPLY The water supply for the proposed district will consist of the Briggsdale water system. The Crow Valley Grazing Association will also be consulted as to water availability at the numerous stock storage tanks within asso- ciation properties. The Briggsdale Water Board has confirmed that their water supply will be available throughout the year at no charge. There will be a map showing the water sources in each fire unit. RECORDS Colorado field incident reports must be completed upon each fire response , meeting and training. A copy must be kept and filed for district reference. MUTUAL AID AGREEMENTS Our intended facilities and services are compatible with the adjoining districts and will compliment overall fire protection in the county. I I 890864 Service Plan PROPOSED BRIGGSDALE FIRE PROTECTION DISTRICT September 1987 PURPOSE This service plan has been prepared by our Fire District Organizational Committee for the information of the proposed Briggsdale Fire Protection District, to pro- vidc property owners, and other residing persons, and interested parties with reliable information pertinent to the establishment of a fire protection district. Justification for the study is based upon the need for fire protection in the very largo area, in which our fire protection is inadequate because of financing needs, and required insurance funding at the present time. The findings of this report establishes a firm basis from which to project needed facilities and costs thereof. The present Sheriff; Ed Jordan has en- couraged and requested our formulation committee to organize our Fire District.
