RE: APPROVE INTERGOVERNMENTAL AGREEMENTS BETWEEN WELD COUNTY AND
THE TOWNS OF AULT, NUNN, AND HUDSON AND AUTHORIZE CHAIRMAN TO
SIGN
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with Intergovermental
Agreements between Weld County and the Towns of Ault, Nunn, and
Hudson regarding implementation of a Rental Rehabilitation
Program, and
WHEREAS, the terms and conditions of each Agreement are as
stated in said Agreement, and
WHEREAS, after review, the Board deems it advisable to
approve said Intergovernmental Agreements, copies being attached
hereto and incorporated herein by reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the Intergovernmental
Agreements between Weld County and the Towns of Ault, Nunn, and
Hudson regarding implementation of a Rental Rehabilitation
Program, be, and hereby are, approved.
BE IT FURTHER RESOLVED by the Board that the Chairman be, and
hereby is, authorized to sign said Intergovernmental Agreements.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 6th day of
December, A.D. , 1989 .

INTERGOVERNMENTAL AGREEMENT

THIS AGREEMENT, entered into this 02/ day of /C—i`—n'- -"-' ' I/I,
by and between the Board of Commissioners of Weld County, Colorado, a body politic of

WITNESSETH:
WHEREAS, pursuant to the Housing and Urban-Rural Recovery Act of 1983, hereinafter
called "the Act," the United States, acting by and through the Secretary of the
Department of Housing and Urban Development, hereinafter called "HUD," has made available
to the state of Colorado certain funds for the implementation of a Rental Rehabilitation
Program; and
WHEREAS, the state of Colorado, through the Department of Local Affairs, has the
legal authority to provide funds to counties for Rental Rehabilitation activities; and
WHEREAS, the Town has expressed interest in allowing the program to operate within
its jurisdiction; and
WHEREAS, the County has indicated a willingness to submit a program proposal to
the state to carry out the HUD Rental Rehabilitation Program; and
WHEREAS, the parties hereto desire to provide assurances and delineate the areas
of cooperation between the County and the Town with respect to Rental Rehabilitation
Program activities.
NOW, THEREFORE, in furtherance of said resolution, and in consideration of the
mutual conditions, covenants and agreements herein contained, it is agreed by and between
the parties as follows:
1) Planning the Rental Rehabilitation Program: The parties, through their executives
and staff, shall cooperate with each other in developing the Rental Rehabilitation
proposal, with all parties giving due consideration to the needs of its citizens
and goals, objectives, rules and regulations of the Act;
2) Term of Agreement: This Agreement shall remain in full force and effect for so long '
as the parties to this Agreement are pursuing Rental Rehabilitation funding for said
proposed program or, if awarded, carrying out such program activities. Any party to
this Agreement may, however, terminate its participation in this Agreement six months
after providing written notice of such termination to the other party to this
Agreement. This Agreement may be terminated at any time by agreement of all parties
to this Agreement unless a grant contract is in effect with the state. In this case,
the state must approve such termination and arranicaznts fcr comrlr_tir:g the program.
3) Authorization to submit a proposal: The County is authorized to submit a proposal
to the state on behalf of the Town to apply for funds under the HUD Rental
Rehabilitation Program, and to act on behalf of the Town with regard to any
subsequent negotiations, presentations or information in conjunction with the grant
application;
4) Responsibilities: The Town shall have no obligations or responsibilities, financial
or otherwise, concerning the administration of the Rental Rehabilitation Program, and
the County agrees to indemnify the Town from any and all liability, loss or damage
that the Town may suffer in connection with the administration of the program upon
approval of the proposal.

Dear Clerk to the Board,
Enclosed please find Intergovernmental Agreements from the towns of Ault,
Nunn and Hudson, for our administration of a 1989 Rental Rehab Program.
We require each Agreement to be executed by the Chairman, and we require
resolutions as well. These Agreements will be forwarded to the Colorado
Division of Housing as supplements to our 1989 Rental Rehab Program application,
which the Commissioners have already approved.
