RESOLUTION RE: APPROVE USE BY SPECIAL REVIEW FOR GREYHOUND DOG KENNEL (20 DOG MAXIMUM) - JOHN E. AND CAROLYN J. FITCH WHEREAS , the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners held a public hearing on the 19th day of August, 1987 , at the hour of 2 : 00 p.m. in the Chambers of the Board for the purpose of hearing the application of John E. and Carolyn J. Fitch, 7341 Hart Street, Fort Lupton, Colorado 80621 , for a Use by Special Review for a greyhound dog kennel on the following described real estate, to-wit: Lots 1 and 2 , Block 46 , Aristocrat Ranchettes Subdivision, Weld County, Colorado WHEREAS , said applicant, Carolyn J. Fitch, was present, and WHEREAS , Section 24 .4 . 2 of the Weld County Zoning Ordinance provides standards for review of said Use by Special Review, and WHEREAS , the Board of County Commissioners heard all of the testimony and statements of those present, has studied the request of the applicant and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter and, having been fully informed, finds that this request shall be approved for the following reasons: 1 . The submitted materials are in compliance with the application requirements of Section 24 . 7 of the Weld County Zoning Ordinance. 2 . It is the opinion of the Board of County Commissioners that the applicant has shown compliance with Section 24 . 4 . 2 of the Weld County Zoning Ordinance as follows : a. The applicant has demonstrated that the use which would be permitted will be compatible with the existing surrounding land uses . b. The applicant has demonstrated that the uses which would be permitted will be compatible with future development of the surrounding area as permitted by the existing zoning and with proposed future development. 7/ (; ,G 871111 Page 2 RE: USR - FITCH c. The proposal is consistent with the intent of the Agricultural Zone District and is provided for as a Use by Special Review. The applicant has demonstrated that a diligent effort has been made to conserve productive agricultural land in the locational decision for the proposed use. d. No overlay districts affect the site. e. Use by Special Review Development Standards will provide adequate protection of the health, safety and welfare of the neighborhood and County. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the application for a Use by Special Review for a greyhound dog kennel, 20 dog maximum, on the hereinabove described parcel of land be, and hereby is , granted subject to the following conditions : 1 . The attached Development Standards for the Use by Special Review permit be adopted and placed on the Use by Special Review plat prior to recording the plat. 2 . Prior to recording the Use by Special Review plat: a . The applicant shall submit to the Department of Planning Services staff for review and approval, a detailed design and construction plan for the proposed sound-proof structure. The structure shall be approved by the Colorado Racing Commission and United States Department of Agriculture and Plant Health Inspection Service . The design plan shall include the sound-proofing techniques . b. The plat shall be amended to show the six foot solid wooden fence around all runs and the turn out pen. c. The application and plat shall be amended to identify all approved changes to the Use by Special Review permit. d. The existing septic system shall be evaluated and approved by a Colorado Registered Professional Engineer to see if it is adequate for use with the proposed kennel. A copy of this report shall be submitted to the Weld County Health Department and approved. 871111 Page 3 RE: USR - FITCH 4 . Within seven days of approval by the Board of County Commissioners, the applicant shally apply for a Building permit for the existing mobile home that is located on the property. The mobile home shall be removed from the property within six months and replaced by the proposed sound proof structure for the kennel. The Use by Special Review permit is for -a greyhound kennel as submitted in the application materials on file in the Department of Planning Services and subject to the Development Standards stated herein. The maximum number of dogs permitted is 20 . 2 . Dogs shall not be permitted outside of the kennel building between the hours of 8 : 00 p.m. to 7 : 00 a.m. Dogs may be permitted outside between the hours o₹ 7 :00 a.m. to 8 :00 p.m. An additional turn out period shall be allowed between the hours of 9 :30 p.m. and 10 : 00 p.m. 3 . A six foot solid wooden fence shall be constructed to enclose the turn out pen and dog runs . The fence shall be maintained in good condition. 4 . Buildings and grounds shall be kept clean, in good repair, and free of trash. 5 . Animal wastes shall be stored and removed for disposal in such a manner as not to cause a public health nuisance. 6 . The greyhound kennel facility shall comply with the Colorado Racing Commission ' s Rules and Regulations pertaining to greyhound kennels . 7 . The Use by Special Review permit shall not be transferable to any successors in interest to the described property and shall terminate automatically upon conveyance or lease of the property to others. 8 . All construction done on the property shall be in accordance with the requirements of the Weld County Building Code Ordinance. 9 . The -property owner or operator shall be responsible for complying with the Design Standards of Section 24 . 5 of the Weld County Zoning Ordinance. 10 . The property owner or operator shall be responsible for complying with the Operation Standards of Section 24 . 6 of the Weld County Zoning Ordinance. 871111 Page 2 DEVELOPMENT STANDARDS - FITCH 11 . Personnel from the Weld County Health Department and the Weld County Department of Planning Services shall be granted access onto the property at any seasonable time -in order to insure the activities carried out on the property comply with the Development Standards stated herein and all applicable Weld County Regulations . 12 . The Use by Special -Review area shall be limited to the plans shown herein and governed by the foregoing Standards and all applicable Weld County Regulations. Any material deviations from the plans or Standards as shown or stated shall require the approval of an amendment of the Permit by the Weld County Planning Commission and the Board of County Commissioners before such changes from the plans or Standards are permitted. Any other changes shall be filed in the office of the Department of Planning Services. 13 . The property owner or operator shall be responsible for complying with all of the foregoing Standards . Noncompliance with any of the foregoing Standards may be reason for revocation of the Permit by the Board of County Commissioners. 871111 HEARING CERTIFICATION DOCKET NO, 87-50 RE: USE BY SPECIAL REVIEW FOR A GREYHOUND DOG KENNEL (35 DOG MAXIMUM) - JOHN E. AND CAROLYN J. FITCH A public hearing was conducted on August 19, 1987, At 2:00 P.M. , with the following present: Commissioner Cordon E. Lacy, Chairman Commissioner C.W. Kirby, Pro-Tem Commissioner -Gene Brantner Commissioner Jacqueline Johnson Commissioner frank -Yamaguchi Also present: Acting Clerk to the Board, Debbie Campbell Assistant County Attorney, Lee D. Morrison Planning Department representative, Keith Schuett The following business was transacted: I hereby certify that pursuant to a -notice dated July 15, 1987, and duly publi-shed August 6, 1987, in the Johnstown Breeze, a -public hearing was conducted to consider a Use by especial -Review application, which was submitted by John F. and -Carolyn J. Fitch, for a greyhound dog kennel (35 -dog maximum) . -This matter was -made of record by Lee Morrison, Assistant County Attorney. Keith Schuett, representing the Planning Department, read the unfavorable recommendation of the Planning Commission into the record. Carolyn Fitch, one of the applicants, came forward to give her presentation. She said the Board should have received $n amended petition which included the following: the number Df dogs be decreased from 35 to 20; a sound-proof garage will be constructed as the kennel facility instead of using the existing mobile home; and trees or shrubs sill not be planted which would increase water usage. During her -presentation, Ms. Fitch addressed concerns of the neighboring land owners, such as odor, noise, the water supply, and fire protection measures and submitted various documents marked as Exhibits K through W. Those who spoke in opposition to this request were: Lorraine Hagelstrom; Jane Lanyon; Mary Geolfos; -tae Ann Brevig; end Enola Wright. -Those who spoke in favor _of this request were Robert Merritt (Tape Change #87-90) and Rose Rage. Mr. Morrison said that since the applicant submitted amendments to the original application, the Board had the option of deciding whether there is a substantial change and if this matter should be referred rack to the Planning Commission for further recommendation. The Board concurred that there is not substantial change and continued with the -hearing. Ms. Fitch earlier had submitted a Request for Issuance of Subpoenas by the Board, and according to legal staff, the Board does not have the authority to issue those subpoenas. Commissioner Kirby moved to approve the Ilse by Special Review application as amended, submitted by John E. and Carolyn J. Fitch, for a greyhound dog kennel. Commissioner Kirby reviewed the Standards the Board considers fora USR. Commissioner Yamaguchi seconded the motion. Mr. Schuett gave the Board proposed Conditions and Development Standards, marked as Exhibit X, and read them into the record. During the reading of these, the Board determined that Condition #2 and #3b be deleted and added as Condition #4, "Within seven days of -approval by the Board of County Commissioners, the applicant shall apply for a Building -permit for the existing mobile home that is located on the property." Development Standard #4 was deleted. Ms. Fitch had concerns about Development Standard #2 and #3. The Board added an additional sentence under Standard #2 to Bead, "An additional turn out period shall be permitted between the hours of 9:30 p.m. and 10:00 Ton." and amended Standard 113 to read, "A six foot solid wooden fence shall be constructed to enclose the turn out pen and dog runs." .'_ Page 2 RE: CERTIFICATION - FITCH Commissioner Kirby restated his motion to include these Conditions and Standards as amended. Commissioner Yamaguchi, as the seconder, also agreed. The motion to approve this Use by Special Review for John and Carolyn Fitch carried unanimously. I would like to explain some of the reasons why this appli- cation is so very important to us . My husband, John, has hoped and planned for many years to raise and race Greyhounds . In June of last year we moved from Indiana to Colorado so that John could work for one of the Greyhound farms on Weld County Road 18. In August the farm ran into severe financial difficulty. John was laid- off. We had to move over thirty dogs, two children, and all of our possessions off of the farm quickly. We found an affordable home in Aristocrat Ranchettes . There were obviously many kennels and other animal farms in that neighborhood. We hoped to race the few adult dogs we owned, and gradually improve and increase our stock, so that someday we could operate a full-size racing kennel on one of the large Greyhound farms in this area. In February, we were informed that we needed a USR permit to do this . I have enclosed an Amendment to our USR petition. The amendment contains appropriate solutions to objections which were raised in the Planning Department stage of this pro- ceeding. The Amendment eliminates problems objected to by the Planning Department . It also clarifies the original proposal and underscores our flexibility. We hope you will study the original proposal, the amendment, and the favor- able reorts of the Humane Society, the Racing Commission (yea" bs d)4 and our veterinarian. We believe there would be nothing objectionable about the operation of our small kennel as proposed by the amended petition. We very much hope you will agree . We cannot buy or rent a larger dog farm. The Aristocrat Ranchettes area has long been recognized as an appropriate area for small animal farms . Applicants are reducing the requested number of dogs from thirty-five (35 ) to twenty (20) . Applicants would con- sider a further reduction in the number of dogs if it would facilitate approval of their USR application. 2 . If the Petition for Use by Special Review for a kennel of twenty dogs is granted, applicants will sell the proposed mobile home/kennel , and erect a sound-proof garage . All dogs on the property will be housed in the sound-proof garage between the hours of 10 p.m. and 7 a.m. every night . All dogs over the age of twelve ( 12 ) months will be kept inside the garage at all times , except for brief turn-out periods as described in the original USR application. The indoor kennelling of all dogs at night will eliminate any noise problem. 3 . Applicants will not plant any trees or shrubs which require an artificial water source . This concession by applicants will ensure that water usage by the applicants will not create any problems for the neighborhood. Current water consumption in the Aristocrat Ranchettes averages ten thousand ( 10, 000) gallons per household per month. The applicants use an average of only four thousand (4 , 000 ) gal- lons per month, which figure includes all water used for dogs on this property. 4 . Applicants wish to draw attention to the fact that their Use by Special Review petition encompasses two separate requests . One request is for permission to keep a greater number of dogs than is allowed by right in the agricultural district . However, a separate , and distinct request to keep a mobile home on their property is also included. If their USR petition is granted, applicants are willing to sell the mobile home and build a sound-proof garage for use as a kennel. Colorado and Arizona are the only two states small greyhound kennels are allowed. They sold their property in Indiana and came to Colorado where they obtained a job working for a kennel and where they could also raise some of their own dogs . This operation ran into financial difficulty so they found their property in Aristocrat Ranchettes Subdivision. They have been inspected by the Health Cepartment, the Humane Society, and the Racing Commission. If Shis request is approved they will make arrangements to keep their dogs in -at night . Greyhound racing provides a boost to the Colorado economy. Tape 285 — Side 1 They currently have fourteen dogs. The dogs are let out in runs six times a -day. They Tick up after the dogs each time they have been out. If this request is approved, they would putµin additional screening. Their request is for thirty-five dogs, but they would agree to less than that. The mobile home being used for a kennel is not hooked up to any utilities. This is an agricultural -area. There are a lot of animals in this area in addition to three other kennels in Aristocrat. Thera are five additional greyhound farms 3n the immediate area. They would be willing to meet with almost any _concessions in order to stay here. The Chairman called for discussion from the members of the audience. 871111 Summary of the Weld County Planning Commission Meeting June 2, 1927 Page 7 Lorene Hagelstrom, surrounding Troperty owner and former realtor, spoke against this request. She felt they should have xhecked the toning requirements prior to _purchasing the property. A single—wide mobile home is too hot to be used as -a kennel. Water in Aristocrat is so scarce there is not -enough for -human needs. Also, while she was selling real estate she had a chance to sell -a property for a kennel. She called the Planning Department to check on the zoning requirements and it cost her a sale. Mrs. Lanyon, surrounding property owner, spoke against this request. There are lots of dogs in Aristocrat, and at tight when they all -begin to howl it is impossibl-e to get any test . Also, with a kennel next to ther properties she would never be able to sell her land or recoup -her investment. Virgil Miller, Superintendent, Aristocrat Water Company, stated -he in in sympathy with the pitches, but there is not water enough for the people, let alone the animals in Aristocrat. Their water tomes from two swells, and the community owns the water system. Nancy Lerner, surrounding property owner, spoke against this request because of the-noise. Jack Bond, surrounding property owner, spoke against this request because of the noise and lack of water. Lee Morrison explained the Planning Commission has to lack at each case individually. The people of Aristocrat can get together and change the zoning, but there would be uses shat are existing now which would be hard to change. Janet Green, surrounding property owner, spoke against this request. Thera are supposedly three existing kennels in -Aristocrat, but she was only aware of one. She is going to get a petiti-on started so there could be no more dog kennels in the -Aristocrat Ranch-ettes Subdivision. Mr. Wright, surrounding property owner, submitted a petition with over one hundred signatures in opposition to this request . This petition was retained as evidence. She also spoke against this request -because of the noise. Mrs. Fitch stated they would like to take further steps to reduce the noise. They will have to bring in their dogs at night. They have no water outside of the home. They have attached a letter from their veterinarian that each dog does not drink more than a quart a day. They use no water to wash down the area because according to greyhound rules, the dogs are to be kept on sand. A small amount of water is used to wash the counter tops in the kitchen of the mobile home the -dogs are in, etc. There are -many dogs in the area and when the coyotes set the dogs off howling it does get quiet noisy. There are, however, may other animals in the area which also make noise, such as horses, cows, roosters, etc. Many other animals in the area create greater health problems than their dogs because they are not cleaned up after. 871111 Summary of the Weld County Planning Commission Meeting June 2, 1987 Page 8 The Chairman asked Brian Bingle to read the recommendations of the Department of Planning Servi-ces' staff into the record. It is realized there are a lot dogs and other problems in the area that the residents need to work on, but the _Planning Commission does not need to add to these problems by recommending approval of another -dog kennel. The Commissioners, in the past, have tried to offer some help, and we hope the people in the area will be able to carry this through so some of the problems can be corrected. By recommending denial of the request, the Planning Commission may keep from adding to the problems that are already existent. Motion carried unanimously. Although Aristocrat Ranchettes is in an unincorporated area, it is a platted subdivision area containing predominantly rural residential land uses. If approved, the proposed kennel may have a significant impact on the development of the existing platted area which has developed and should continue to develop residentially in the future. A 750 square foot kennel building, 35 dogs, dog runs, and sprint field are not recognized characteristics of a residential neighborhood. - The applicant has not adequately demonstrated that the uses which would be permitted will be compatible with future development of the surrounding area as permitted by the existing zoning and with the future development as projected by the comprehensive plan or master plans of affected municipalities. Aristocrat Ranchettes Subdivision is located outside of the City of Fort Lupton's Comprehensive Planning area, but is within the Urban Growth Boundary area identified in the Weld County Comprehensive Plan. The applicant has not adequately demonstrated that there is or will be adequate provision for the protection of health, safety, and welfare of the inhabitants of the neighborhood and the County. In accordance with the Weld County Zoning Ordinance, the intent of a Use by Special Review permit is to consider the potentially greater impacts of uses that are not allowed by right in a zone district. The Ordinance is designed to protect and promote the health, safety, convenience, and general welfare of the present and future residents of Weld County. It is the Planning staff's opinion that the applicant has failed to demonstrate that this proposal could be established and operated in a manner that is compatible with existing and planned residential land uses in the Aristocrat Ranchettes neighborhood. The Department of Planning Services has received eight letters of opposition from property owners living within Aristocrat Ranchettes Subdivision. The property owners are concerned with the existing noise and odors associated with the dog kennel. The applicant's proposed plans for mitigating these negative impacts does not provide adequate provisions for the protection of the health, safety, and welfare of the inhabitants of the neighborhood as indicated by the letters of objection. 2. It is the opinion of the Planning Commission that the proposed use is not in compliance with Section 24.5. 1 .1 of the Weld County Zoning Ordinance. The applicant has not adequately demonstrated that adequate water service in terms of quality, quantity, and dependability is available to the property to serve the proposed uses that will be permitted by the Use by Special Review permit. The applicant's application materials contains a letter dated April 15, 1987, from the Aristocrat Ranchettes Water Project, Incorporated, indicating that water will be available to serve the proposed dog kennel and landscaping on the property. Because of a problem with expansion of the usage of Aristocrat Ranchettes' water system, the Health Department, in its memo of May 8, 1987, is requiring a letter of approval from Aristocrat Ranchettes Water Project, Incorporated, separate from the letter submitted with the application. A copy of the February 13 letter is attached. 2. The applicant submitted several photographs of "neighboring properties", but failed to identify the exact locations of the different properties in relationship to the property under consideration. It is the opinion of the Department of Planning Services staff that the proposed use is not in compliance with Section 24.3 of the Weld County Zoning Ordinance as follows: The applicant has not demonstrated adequately that the uses which would be permitted will be compatible with the existing surrounding land uses. The Weld County Zoning Ordinance sets forth that a Use by Special Review includes those uses which may have greater impact on surrounding uses or potentially more intensive uses than allowed by right in the zone district. Although Aristocrat Ranchettes is in an unincorporated area, it is a platted subdivision area containing predominantly rural residential land uses. If approved, the proposed kennel may have a significant impact on the development of the existing platted area which has developed and should continue to develop residentially in the future. A 750 square foot kennel building, 35 dogs, dog runs, and sprint field are not recognized characteristics of a residential neighborhood. The applicant has not adequately demonstrated that the uses which would be permitted will be compatible with future development of the surrounding area as permitted by the existing zoning and with the future development as projected by the comprehensive plan or master plans of affected municipalities. Aristocrat Ranchettes Subdivision is located outside of the City of Fort Lupton's Comprehensive Planning area, but is within the Urban Growth Boundary area identified in the Weld County Comprehensive Plan. A typical lot in Aristocrat Ranchettes is one acre in size. Residential homesites are the principal uses in the Subdivision. The existing residential uses in Aristocrat Ranchettes are not compatible with the proposed dog kennel. Residential uses will continue to be the predominant land use in the future in this Subdivision. 871111 USR-793:87: 19 John E. and Carolyn J. Ftich Page 2 - The applicant has not adequately demonstrated that there is or will be adequate provision for the protection of health, safety, and welfare of the inhabitants of the neighborhood and the County. In accordance with the Weld County Zoning Ordinance, the intent of a Use by Special Review permit is to consider the potentially greater impacts of uses that are not allowed by right in a zone district. The Ordinance is designed to protect and promote the health, safety, convenience, and general welfare of the present and future residents of Weld County. It is the Planning staff's opinion that the applicant has failed to demonstrate that this proposal could be established and operated in a manner that is compatible with existing and planned residential land uses in the Aristocrat Ranchettes neighborhood. The Department of Planning Services has received eight letters of opposition from property owners living within Aristocrat Ranchettes Subdivision. The property owners are concerned with the existing noise and odors associated with the dog kennel. The applicant's proposed plans for mitigating these negative impacts does not provide adequate provisions for the protection of the health, safety, and welfare of the inhabitants of the neighborhood as indicated by the letters of objection. 2. It is the opinion of the Department of Planning Services Staff that the proposed use is not in compliance with Section 24.5. 1 .1 of the Weld County Zoning Ordinance. The applicant has not adequately demonstrated that adequate water service in terms of quality, quantity, and dependability is available to the property to serve the proposed uses that will be permitted by the Use by Special Review permit. The applicant's application materials contains a letter dated April 15, 1987, from the Aristocrat Ranchettes Water Project, Incorporated, indicating that -water will be available to serve the proposed dog kennel and landscaping on the property. Because of a problem with expansion of the usage of Aristocrat Ranchettes' water system, the Health Department, in its memo of May 8, 1987, is requiring a letter of approval from Aristocrat Ranchettes Water Project, Incorporated, separate from the letter submitted with the application. 871111 ADDITIONAL COMMENTS USR-793:87: 19 John E. and Carolyn J. Fitch 1. A zoning violation was issued on February 12, 1987, for the mobile home which is being used to shelter the greyhounds. The applicants would like to keep a maximum of thirty-five dogs . Puppies under the age of twelve months will be kept in secure chain link outdoor runs surrounded by a 6 feet high, continuous and solid, cedar privacy fence . Dogs over the age of twelve months will be kept indoors in new steel crates inside a modern 12 x 50 feet mobile home . A 20 X 50 feet turnout pen will be located between the mobile home/kennel , and the modular house/residence . The turnout pen will be completely surrounded by 6 feet high cedar privacy fence . As is stan- dard procedure in Greyhound care, indoor dogs will be let out inter the turnout pen five times each day. There will be 7 outdoor runs ; 4 of these runs will be 14 x 70 feet , 2 will be 15 x 40, and one will be 30 x 35 feet . All runs will be located directly behind the resi- dence , and will be shielded from view by complete privacy fencing. A 30 x 325 feet , chain link fenced, sprint field will run from east to west along the southern edge of the property. No dogs will be allowed in this pen unless super- vised and dogs will not remain there for more than a few minutes at a time . Fences and structures associated with the use will comply with all setback and offset require- ments , and building codes , and will not interfere with the use of any easements or public rights of way. This will be a very small scale, private operation. No employees will be hired. Members of the public are not expected to visit the facility. Sales of dogs will be rare . If necessary, dogs will most often be sold by telephone through a national magazine , and air shipped to the buyer. Visitors to the kennel should not exceed 5 or 6 persons per year. Traffic will not exceed normal levels of residential usage. Two personal automobiles and one lightweight trailer will be stared in the driveway which leads directly to Hart Street . No new or increased usage of any public right of way will occur from the use , and no ha2ared will be posed by ingress or egress of vehicles from Hart Street . Upon approval of the use , 6 feet high cedar privacy fencing will be constructed to enclose the area designated for the 7 outdoor runs . Interior separations of the runs will be constructed as needed from chain link fencing. The turnout pen between the mobile home/kennel and the residence is surrounded by 6 feet high cedar fencing. Fencing will be inspected by the Colorado Racing Commission and must meet -1- 871111 their security and height standards. The privacy fenci-n-g will buffer the kennel operation from neighboring prop-erties and prevent soil loss from wind. Crass will be planted in areas not used by the dogs . Weeds will not be allowed. Ponderosa pines and Rocky Mountain juniper will be planted around the -perimeter of the property. The -privacy fence, pine trees and shrubs win greatly diminish any nois-e from the dogs confined within. Noise levels will not exceed statutory limits . The Weld County Health Department will conduct a noise report , if requested by the _Planning Department . Water consumption by the operation at maximum capacity will not exceed 10 to 15 _gallons per day. Water of suffi- cient quality, _quantity and dependability will the provided by the Aristocrat Ranchettes Water Troject , Inc . (Please see attached letters from A. R.W. P. , and veterinarian, Dr. E. M. Griffin. ) All pens will be cleaned daily. The turnout pen will be cleaned during each use . Manure win be placed in closed containers . Trash and manure -will be hauled off the pro- perty at least -once each _week. The Colorado Racing Commi- ssion will inspect the property, without notice , for proper sanitation, security, and safety precautions -at least once during each meet (3 -In-on-the) . The County Health Department is also -welcome to inspect the area at any time . The kennel will comply with Air Quality Control Standards . There will be no sewage generated from the use , -other than washing of dog dishes . Wash rater is included in the estimate of water consumption stated above . The current 100D gallon septic tank is quite adequate for this purpose . (See -attached Health Department Certificate and bill for recent pumping of tank. ) There will be no stockpiling of materials on the property. Because of the extremely porous soil on the property ( see soil report , attached) , additional storm water runoff is not anticipated. However, applicants are willing to con- struct -storm water retention facilities if requested. Any lighting used will be interior and will not shine on neighboring properties . Operation of the kennel will not raise the temperature at or beyond the lot line. The -prop- erty is not -within a Geological Hazard or Airport Overlay Disrict . Two operable fire extinguishers are maintained in the kennel , as is required by Racing Com- mission Regulations . John Fitch is licensed by the Colorado State Racing Commission to own and train racing Greyhounds , Carolyn pitch is licensed as an owner, anti their kennel is officially lic- ensed by the State . The Colorado Racing Commission keeps close tabs on their activities, and inspects their kennel several times each year without prior notice . The kennel will meet all Racing Commission, and Health Department Reg- ulations , and all Building Codes . The proposed use is consistent with the Comprehensive Plan , as it does not remove prime agricultural land from production and will be an agricultural activity within an agricultural zone . Greyhound kennels provide maximum bene- ficial use of the sandy soil and dry climate in the region. The State of Colorado receives eight and one half million dollars each year in direct payments from Colorado Greyhound racetracks . Greyhounds raised in the County help support other agricultural endeavors , such as feed mills , grain, beef, poultry, and dairy producers , veterinarians , fencing companies, and construction firms . The proposed use is consistent with existing uses in the area. Special use permits have been granted to three other kennels within Aristocrat Ranchettes. Five large Greyhound farms are located adjacent to the Aristocrat Ran- chettes . Many other small , and large, animal farms operate in this area. The attached diagram shows distances to sur- rounding residences , and uses of properties which border the applicant ' s property. There is a need for a location where the family of average income may be happy, working on their land and raising their own animals . Aristocrat Ranchettes is an ideal location for people like that .
