RE: APPROVE CERTAIN DOCUMENTS CONCERNING THE HOKESTRA PIT AND
AUTHORIZE CHAIRMAN TO SIGN
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with certain documents
concerning the Hokestra Pit , located in NE}NE} , Section 2 ,
Township 2 North, Range 68 West of the 6th P.M. and SE}SE$ ,
Section 35 , Township 3 North, Range 68 West of the 6th P.M. , Weld
County, Colorado, and
WHEREAS, said documents include a Mined Land Reclamation
Division Regular (112) Permit, Performance Warranty, Industrial
Wastewater Discharge Application, and Use by Special Review
Application, and
WHEREAS, after review, the Board deems it advisable to
approve the aforementioned documents, copies of which are attached
hereto and incorporated herein by reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that said documents
concerning the Hokestra Pit be, and hereby are, approved.
BE IT FURTHER RESOLVED by the Board that the Chairman be, and
hereby is , authorized to sign said documents .
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 6th day of
July, A.D. , 1988 .

6. Do you anticipate the need for changing or adding the discharge point(s)
as mining progresses? If so, briefly explain. At this point in time,
only one discharge point will be used for the proposed pond.
7. A location map designating the facility property and discharge points
shall be submitted. The map shall be from a 7-1/2 or 15 minute USGS
quad sheet or a map of comparable scale. A north arrow shall be shown.
Any public water supply intakes within a 5 mile downstream of the
facility shall also be identified, if known.
8. A legible general sketch of the site shall be submitted and include
appurtenant facilities (buildings, ponds, diversion ditches, stockpiles,
etc. ) , stream location, numbered discharge points, sampling and flow
monitoring points. Sketch shall be on paper 8 1/2 x 11 inches. Please
label the outfalls on the sketch to correspond with numbers listed in
Table 9A.
9. For each outfall provide, on Table A, a description of: (1) All
operations contributing wastewater to the effluent , including water
associated with crushing or washing, sanitary wastewater, groundwater
and stormwater runoff; (2) The average flow contributed by each
operation; and (3) The treatment received by the wastewater plus an
identification of chemical additives. Continue on additional sheets if
necessary .

10. Method of flow measurement for each discharge (i .e. 90 v—notch weir, pump
capacity, parshall flume , etc. ) . Designate whether currently installed or
proposed. -
The pond will be de-watered by electric plump so the flow will be taken from
the cap of ptmip to maintain serviceable levels in the pond.

KNOW ALL MEN BY THESE PRESENTS, THAT:
WHEREAS, the Colorado Mined Land Reclamation Act, CRS as amended,
34-32-101 et seq. (the "Act") , as amended, provides that no permit may be
issued underlie Act until the Mined Land Reclamation Board (the "Board" )
receives a performance warranty (or warranties) that is a written promise to
comply with all applicable requirements of the Act.
WHEREAS, Weld County (the "Operator"), has
a plied for a permit to conduct a mining operation known as Hokestra
Pit No. 2 (the "Operation") on certain lands in [field
County, Colorado. These lands are described in the permit application, as
amended and supplemented, and are referred to herein as the "Affected Lands".
WHEREAS, in its application for the permit, the Operator has agreed
to be bound by all requirements of the Act and all applicable rules and
regulations of the Board, as amended from time to time.
WHEREAS, the Board has determined, in accordance with the Act, that
the estimated costs of reclamation with regard to those affected lands
in Weld County which are now or may become subject to the permit
are those amounts for the stated periods of time as set forth in the financial
warranty, which may be amended from time to time to reflect revised estimates
of said costs of reclamation.
WHEREAS, the Operator hereby gives the Board a performance warranty
pursuant to Section 34-32-117(2) of the Act, and herein promises the Board
that it will comply with all applicable requirements of the Act with regard to
those Affected Lands.
NOW, THEREFORE , the Operator hereby promises the Board that it will
comply with all applicable requirements of the Act and rules and regulations
of the Board with respect to the Affected Lands.
FURTHER, the Operator hereby promises the Board that it will comply
with all of the terms of the application for a permit, as amended and
supplemented, as well as any conditions attached to the permit by the Board.

Further, the Operator promises the Board, pursuant to 34-32-112(1 ) (d)
of the Act, that it has the lawful authority to enter upon the Affected Lands
to conduct mining operations, including, but not limited to, reclamation. The
Operator further recognizes the right of the Board to enter to reclaim lands
affected by the operation.
The description of lands herein is for convenience of reference only,
and no error in such description, nor any revision of the permitted mining
area, nor the disturbance by the Warrantor of lands outside of the permitted
mining area shall alter or diminish the Operator's obligation hereunder, which
shall extend to the reclamation of all such lands disturbed.
The obligation of the Operator hereunder is such that, if the
Operator shall successfully comply with the requirements of the Act,
applicable rules and regulations, and the permit, then the Board, upon a
finding that the Operator has so complied, shall release this performance
warranty, and the Operator from its obligation hereunder, to the extent that
the Board determines that such compliance has been accomplished. The
obligation of the Operator hereunder shall continue until released in whole or
in part by the Board in accordance with applicable law.
In further satisfaction of the requirements of the Act, the Operator
has attached hereto its financial warranty, which may be amended from time to
time. The Operator agrees that it will maintain a financial warranty (or

warranties) for the estimated costs of reclamation in good standing for the
entire life of the permit.
If the Board determines that the Operator is in default under this
performance warranty and has failed to cure such default, although written
notice of such default and ample time to cure such default have been given,
the Operator' s financial warranty shall be subject to forfeiture.
This performance warranty may be executed in multiple copies, each of
which shall be treated as an original , but together they constitute only one
agreement, the validity and interpretation of which shall be governed by the
laws of the State of Colorado.
The provisions hereof shall bind and inure to the benefit of the
parties hereto and their successors and assigns.

REGULAR (112) OPERATION
APPLICATION PACKAGE
Applicability
This package applies to a mining operation which affects more than 10 acres
and extracts more than 70,000 tons of mineral and/or overburden per calendar
year. If you pan to conduct a mining operation which satisfies these
criteria, then you should follow the instructions provided in this package for
filing an application.
Filing Requirements
You should obtain the Mineral Rules and Regulations from the Division
($2.00/copy) and read Rules 2 and 6. To apply for a Mining and Reclamation
Permit for a regular operation, five copies of the "Regular Operation (112)
Application Form" and Exhibits A-P and an application fee must be submitted to
the Division. This package containrthe 'pplication form and instructions for
preparing information for attachment as Exhibits A-P.
Application Review Procedures
Upon receipt of the application form, exhibits and application fee, the
Division will review them and notify you within 10 days whether they contain
the minimum information required by the Mined Land Reclamation Act and Rule 2
of the Mineral Rules and Regulations. If the application contains this
information, then it will be considered "complete", and you will be notified
to proceed with the notification requirements of Rule 2. If the application
does not contain the minimum information, then you will be notified of the
information required to make it "complete".
Your application will be scheduled for consideration by the Mined Land
Reclamation Board within 90 days after it is deemed "complete". You will be
notified of the date when the Board will consider your application. The Board
will decide whether all of the applicable information and notice requirements
of the Act and Regulations have been satisfied and whether the criteria in
Sections 115 and 120 of the Act apply. You wilfle notified of the Board's
decision concerning the application.
Please note, additional information may need to be added to the application
after a "complete" determination in order to satisfy the applicable
requirements of the Mined Land Reclamation Act and the Mineral Rules and
Regulations. The Division will notify you of any additional information
requirements within the 90 day processing time period.
