RE: APPROVE AGREEMENT BETWEEN WELD COUNTY AND WELD COUNTY
HISTORCAL SOCIETY FOR ARCHAEOLOGICAL SURVEY, STAKING, AND
TREE PLANTING AND AUTHORIZE CHAIRMAN TO SIGN
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS , the Board has been presented with an Agreement
between Weld County and the Weld County Historical Society for the
archaeological survey, staking, and tree planting of the Historic
Site of Fort Saint Vrain , which is owned by Weld County, and
WHEREAS, the terms and conditions are as stated in said
Agreement, a copy being attached hereto and incorporated herein by
reference, and
WHEREAS, after review, the Board deems it advisable to
approve said Agreement.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the Agreement between
Weld County and the Weld County Historical Society be, and hereby
is , approved.
BE IT FURTHER RESOLVED by the Board that the Chairman be, and
hereby is, authorized to sign said Agreement.
The above and foregoing Resolution was, on motion duly made
and seconded , adopted by the following vote on the 8th day of
October, A.D. , 1986 .

CONTRACT FOR WELD COUNTY HISTORICAL SOCIETY' S
USE OF PROPERTY OWNED BY WELD COUNTY, COLORADO,
FOR ARCHAEOLOGICAL SURVEY, STAKING, AND TREE PLANTING
THIS AGREEMENT, made and entered into this 8th day of
October , 1986 , by and between the Weld County Historical
Society, Kay McElroy, President, P. O. Box 609 , Greeley, Colorado
80632 , hereinafter called "Historical Society, " and the Board of
County Commissioners of Weld County, Colorado, 915 Tenth Street ,
Greeley, Colorado 80631 , hereinafter called "County. "
WITNESSETH:
WHEREAS, the Weld County Historical Society desires to
conduct a surface survey of the Historic Site of Fort Saint Vrain,
to place stakes and lines where the original Fort existed, and to
plant trees on the site, and
WHEREAS, the land on which said historic site is located is
owned by Weld County, Colorado, and
WHEREAS , both Historical Society and County desire to enter
into an agreement whereby County allows Historical Society to
perform said surface survey, staking, and tree planting.
NOW, THEREFORE, for and in consideration of the premises and
mutual agreements hereinafter contained, the parties hereto agree
as follows:
1 . County will allow members of Historical Society and/or
its agents, employees, assigns , and archaeological experts to
enter onto the parcel which is described in "Attachment A"
(incorporated herein by reference) for the purpose of conducting a
surface survey, the staking out of the original lines of the Fort,
and the planting of trees on the site.
2 . Historical Society shall:
a. Perform said survey according to accepted
archaeological standards.
b. Inform the Weld County Sheriff' s Office of the date
of the survey, staking, and tree planting.
c. Leave said parcel in substantially the same status
it was in prior to the beginning of said survey,
staking, and tree planting.
3 . This contract shall be for the purpose of survey work ,
staking, and tree planting only. Any archaeological digging or
work subsequent to said survey, staking, and tree planting must be
approved by County in a separate contract.
4. This contract shall in no way be interpreted to obligate
County for the expenditure of public funds for said survey,
staking, and tree planting or any archaeological digging or work
thereafter.
IN WITNESS WHEREOF, the parties have caused this agreement to
be duly executed as of October 8 , 1986.

RESOLUTION ACCEPTING WARRANTY DEED
FROM CASTOR HANSEN & HELEN MARIE PURSE:
WHEREAS, Castor Hansen & Helen Marie Purse have executed a
Warranty Deed to Weld County for a rectangular parcel of land 106?
wide and 127? long being the site of old "Fort St. Vrain" in Section
Twenty-six(26) Township Four (4) North, Range Sixty-seven (67) West
also a right of way for a public road 30" wide in said Section, ma to
to used for ingress and egress to said public monument.
NOW, THEREFORE, BE IT RESOLVED, by the Board of County
Cnmmissioners of Weld County, Colorado, that commend the signers
of said deed for their gift to the public of this historic memorial.
BE IT FURTHER RESOLVED, by the Board of County Commissioners
that they accept this parcel, more particularly described in said deed
and dedicate same to the public.
The above and foregoing resolution was, on motion duly made
and seconded, adopted by the following vote:

WARRANTY DEED
KNOW ALL MEN BY THESE PRESENTS, That we, CASTOR HANSEN
AND HELEN MARIE PURSE, of the City and County of Denver and
State of Colorado, for the consideration of Ten Dollars and
other valuable considerations in hand paid, hereby sell and
convey to COUNTY OF WELD IN THE STATE OF COLORADO, the follow—
ing real property, situate in the County of Weld and State of
Colorado, to-wit:
A rectangular parcel of land 106 feet wide and 127 feet
long, marked at the corners with concrete blocks, being the
site of old "Fort St. Vrain" , as shown on the plat of the Town
of Fort St. Vrain (now vacated), and being on a parcel of land
shown on said plat bordered on the North by Roubidoux Avenue,
on the East by Ceran Place, on the South by Sarpey Avenue and
on the West by Kiowa Street, and, at the approximate center of
which is situate "Fort St. Vrain Monument" , erected in the year
1911 by Centennial State Chapter, Daughters of the American
Revolution, and being located in the Southeast ;quarter ( .374 )
of Section Twenty-six (26 ), Township Four ( 4) North, Range
Sixty-seven (67 ) West of the 6th P. M. ; the plat of Fort St.
Vrain being on file in the Office of the County Clerk and
Recorder of Weld County, Colorado;
Together with a right of way for a public road 30 feet
wide, extending 15 feet on each side of the center line, more
particularly described as follows: Beginning at the Southeast
corner of Section Twenty-six ( 26 ), Township Four ( 4 ) North, Range
Sixty-seven ( 67 ) West of the 6th P. ICI. , thence South 82 deg.
55 min. West 338.6 feet; thence North 85 deg. 53 min. West 216.8
feet; thence North 79 deg. 14 min. West 178 feet; thence North
40 deg. 52 coin. West 958 feet; thence North 50 deg. 56 min. West
165.4 feet; thence North 71 deg. 34 min. West 206.8 feet; thence
North 15 deg. 06 min. East 106 feet, more or less, to the south
end of the rectangular parcel of land above described.
As a further consideration for this conveyance, the
COUNTY OF WELD IN THE STATE OF COLORADO, by accepting this deed
hereby dedicates and agrees to maintain said property as a per-
petual public monument, to be known as "Fort St. Vrain Monument",
to commemorate the location of Fort St. Vrain, built in the year
1837 by Col. Ceron St. Vrain, and the place where General Fremont
reorganized his historical exploring expedition on July 23,
1843, and the frontier post visited by Francis Parkman and Kit
Carson.
