I / e u,/ ' ISmuwun I // \ I / ecxe, .m.o•/ /a 40 2 ..2 RESOLUTION RE: APPROVAL OF USE BY SPECIAL REVIEW FOR A CHURCH - COMMUNITY BAPTIST CHURCH WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County -Home Rule Charter, is vested with the authority of administering the -affairs of Weld County, Colorado, and WHEREAS , the Board of County Commissioners held a public hearing on the 18th day of June, 1986 , at the hour of 2 : 00 p.m. in the Chambers of the Board for the purpose of hearing the application of Community -Baptist Church, 331 Cherry Street, Route 4 , -Brighton, Colorado 80601 , for a Use by Special Review for a church on the following described real _estate , to-wit: Part of the SWs SE4, Section 34 , Township 1 North, Range 66 West of the 6th P.M. , Weld County, Colorado WHEREAS, Section 24 . 4 . 2 of the Weld County Zoning Ordinance provides standards for review of said Use by Special Review, and WHEREAS, the -Board of County Commissioners heard all of the testimony and statements of those present, has studied the request of the applicant and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter and, having been fully informed, finds that this request shall be approved for the following reasons: 1 . The submitted materials are ±n compliance with the application requirements of Section 24 . 7 of the Weld County Zoning Ordinance. 2 . It is the opinion of the Board of County Commissioners that the applicant has shown compliance with Section 2-4 . 4 . 2 of the Weld County Zoning Ordinance as follows: a. The proposal is consistent with the Comprehensive Plan and is consistent with the intent of the Agricultural Zone District. The proposal does not appear to have any adverse impacts on the agricultural interests of the County or the environment. h. The proposal is consistent with the intent of the Agricultural Zone District and is provided for as a Use by Special Revi-ew. � � y -86D569 Page 2 RE: USR - COMMUNITY BAPTIST CHURCH c. The use is both compatible with existing agricultural activities and with any future agricultural use as identified in the Comprehensive Plan. d. No overlay districts affect the site. e. Use by Special Review Development Standards will provide adequate protection of the health, safety and welfare of the neighborhood and County. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the application for a Use by Special Review for a church on the hereinabove described parcel of land be, and hereby is , granted subject to the following conditions: 1 . The attached Development Standards for the Use by Special Review -permit be adopted and placed on the Use by Special Review plat prior to recording the plat. 2 . The Use by Special Review activity shall not occur nor shall any building or electrical permits be issued on the property until the Use by Special Review plat has been delivered to the Department of Planning Services Office and the plat is ready to be recorded in the office of the Weld County Clerk and Recorder. 3 . Plans for seeding and surface water runoff shall be submitted by the applicant to the West Adams Soil Conservation District for its review and approval. Evidence of approval shall be provided to the Department of Planning Services within sixty days from the date of approval by the Board of County Commissioners. 4 . Prior to the issuance of building permits, the applicant shall satisfy all requirements of the Brighton Fire Protection District. 5. The Use by Special Review permit is for a church as submitted in the application materials on file in the Department of Planning Services and subject to the Development Standards stated herein. 2. The applicant shall implement and maintain the seeding plan as approved by the West Adams Soil Conservation District. 3 . All construction done on the property shall be in accordance with the requirements of the Weld County Building Code Ordinance. 4 . The property owner or operator shall be responsible for complying with the Design Standards of Section 24 . 5 of the Weld County Zoning Ordinance. 5 . The property owner or operator shall be responsible for complying with the Operation Standards of Section 24. 6 of the Weld County Zoning Ordinance. 6 . Personnel from the Weld County Health Department and Weld County Department of Planning Services shall be granted access onto the property at any reasonable time in order to insure the activities carried out on the property comply with the Development Standards stated herein and all applicable Weld County Regulations . 7 . The Use by Special Review area shall be limited to the plans shown herein and governed by the foregoing Standards and all applicable Weld County Regulations. Any material deviations from the plans or Standards as shown or stated shall require the approval of an amendment of the Permit by the Weld County Planning Commission and the Board of County Commissioners before such changes from the plans or Standards are permitted. Any _other changes shall be filed in the office of the Department of Planning Services. 8 . The property owner or operator shall be responsible for complying with all of the foregoing Standards. Noncompliance with any of the foregoing Standards may be reason for revocation of the Permit by the Board of County Commissioners . 860569 HEARING CERTIFICATION DOCKET NO. 86-39 RE: USE BY SPECIAL REVIEW FOR A CHURCH - COMMUNITY BAPTIST CHURCH A public hearing was conducted on June 18, 1986, at 2:00 P.M. , with the following present: Commissioner Jacqueline Johnson, Chairman Commissioner Gordon E. Lacy, Pro-Tem Commissioner Gene Brantner Commissioner C.W. Kirby Commissioner Frank Yamaguchi Also present: Acting Clerk to the Board, Mary Reiff Assistant County Attorney, Lee D. Morrison Planning Department representative, Gloria V. Dunn The following business was transacted: I hereby certify that pursuant to a notice dated May 28, 1986, and duly published June 5, 1986, in the Johnstown Breeze, a public hearing was conducted to consider the application of Community Baptist Church for a Use by Special Review for a church. Lee Morrison, Assistant County Attorney, made this matter of record. Gloria Dunn, Planning Department representative, read the favorable recommendation of the Planning Commission into the record, stating that five Conditions and eight Development Standards are recommended for this Use by Special Review. Allan Van Den Bos, pastor of Community Baptist Church, came forward to answer questions of the Board. He stated the church is currently located in the Town of Lochbuie and wishes to expand. Discussion centered on the availability of water for the site. No public testimony was offered concerning this request. (Tape Change #86-44) Commissioner Lacy moved to approve the requested Use by Special Review, subject to the Conditions and Development Standards as recommended by the Planning Commission. Commissioner Kirby seconded the motion. Ms. Dunn suggested that a sixth Condition be added that the applicant provide evidence of a sufficient water supply. It was the consensus of the Board that this Condition was not necessary. The motion to approve the Use by Special Review carried unanimously. This Certification was approved on the 23rd day of June, 1986. Your answers and suggestions were so very helpful to us . I have updated Gloria V. Dunn of the Weld County Planning Department on how our plans for water are developing. I also discussed with her some of the possibilities which we had discussed for getting the necessary well . We cannot split the land into two parts (church use and parsonage use) as me had hoped. As a result of these various discussions, the Building Committee of our church would like to propose the following : PREFERRED PROPOSAL WHEREAS the Building Committee of Community Baptist Church has seriously considered the various options known to it for obtaining water; and WHEREAS Brighton City water is unavailable to us; and WHEREAS our final hearing before the Weld County Commissioners for approval of our special use and exemption is scheduled for this coming Wednesday, June 18, by which time a letter of recommendation from the Colorado Division of Water Resources is expected; and WHEREAS closing on this property has been long delayed and must be consumated as soon as possible , but cannot happen until we are granted special use and exemption from Weld County, and until we have reasonable assurance of water by the State; and WHEREAS Community Baptist Church would like to landscape and maintain a very small amount of lawn, shrub and flower area becoming of a church; WE PROPOSE that Community Baptist Church obtain a well permit from the Office of the State Engineer, Division of Water Resources to drill a deep, non-tributary well in order to secure water for the operation of our church. Explanations . We need this permit in order to obtain water and in order to close on the land on which we intend to build. With landscaping we expect to average less than 3 acre-feet of water per year. Attendance at Community Baptist Church presently averages in the fiftys . Peak attendance is in the seventies . Maximum seating for worship services in the new first phase building is planned for approximately one-hundred people , with expansion ability for up to 187 people . As the church is able to grow, we may someday double the auditorium and be able to ultimately seat a maximum of 374 people . The church greatly needs to relocate out of the trailer town of Lochbuie where we now have less than adequate facilities with only twelve parking places . ALTERNATE PROPOSAL WHEREAS there is possibility that the Colorado Division of Water Resources may not grant Community Baptist Church a permit to drill a deep non-tributary well ; but, WHEREAS there is already existing at the northern extremity of the proposed tract of land a functioning well which was constructed in or about 1960, and that this well was tested on April 14, 1986 by Tom Spain' s Pump service with their own pump and equipment at which time the well was found to have a static level prior to the test of 205 feet and that the well produced 15 gallons per minute for two hours; and, WHEREAS if it became necessary, Community Baptist Church could have electricity laid almost one-half mile to power this well and then have plumbing laid most of that half mile back to the new church building; WE PROPOSE that if the Colorado Division of Water Resources does not grant Community Baptist Church a permit to drill a deep non-tributary well by the time we need to have water, then Community Baptist Church should seek a change of use for the already existing well and that Community Baptist Church use this well to meet its needs for water inside the church. The farmland would continue to be farmed by the farmer from which they are acquiring the land. Denny Lloyd, Van Schaak Realty, reported the land is shaped irregularly because the church wanted the well included in their property. John Willard, property owner to the north, stated he is not contesting this request, in fact he will help them as much as he can, but wishes the Planning Commission to understand this is not a square piece of land. He wonders if a tract of this size, in such an irregular shape, is really in their best interests. Community Baptist Church is seeking to purchase 22 acres of land from Justin K. Burkhardt for the purpose of building and conducting our church ministries . The land is very long and narrow, bordering the entire west boundry of the SE 1 /4 of section 34 (Township IN, Range 66 West, 6 PM) . The property is 437 feet at the widest and 2640 feet ( .5 miles) long. This 22 acre parcel of land has an old unregistered well at the northern extremity of it where someday ( in the distant future) we wish to build one or two houses (parsonages) for our pastors . We will not be able to afford this for several years to come . Our contract to purchase this land requires that we continue to provide water to Jay Burkhardt for his few remaining cattle until he sells out and retires from raising livestock . The well is presently powered by an old gasoline engine . Mr. Burkhardt presently waters a herd of twenty-four cows and in the past has had as many as forty-five cattle . We would like to maintain this northern well temporarily for livestock purposes and we would like to hold it for future parsonage (domestic) use . Our immediate need is to build a new church building close to the south (opposite ) end of this property off of Weld County Road 2 . Our present congregation runs up to 70 people on Sunday mornings. We desire to immediately build a church which mill seat a maximum of 187 people . Future additions could someday accomo-date 374 people . Construction is just waiting for procurement of this land which is pending approval from you for water and from the Weld County Planning Board. On the south end of our property Community Baptist Church will need sufficient water to provide water for drinking, for restrooms, and for watering a very small amount of lawn, flowers and shrubbery between the parking areas and the church. (Note the enclosed sketch which reveals our very conservative plans for lawn, flowers, and shrubbery space ) . Electricty is available to us at the south end adjacent to Weld County Road 2 where we plan to build the new church building. It will cost us an exorbitant amount of money to have Union R.E.A. run electricity one-half mile north to the old well . It would also cost a lot to run plumbing back south to the new church . We are also concerned about what measures we might have to take to ensure proper water pressure . (The church will be slightly downhill from the northern well . ) We suspect that the most economical and efficient thing to do is to have a new additional well drilled for domestic use down at the south end of this property near the church. Would we not be better off doing this than for us to convert the existing upper northern well to electricity and have to pipe water one-half mile down to the south portion for the church and simultaneously try to maintain one stock tank at the north where the well is located? We want to do what is right and best. We would like to expedite the process of approval in order to procure this land and begin building as soon as possible . Please advise us so that we can make proper applicati-on the first time with you good folks at the Colorado Division of Water Resources. The church may someday wish to provide a parsonage as housing for its pastor or additional staff . Such ministries are distant future possibilities, but as such are not being considered in the present first-phase building plans . NEED FOR USE. Community Baptist Church is preparing to build and operate a church upon this land in order to continue and to expand its present ministries to our growing communities around us . We need such approval in order to consumate the purchase of this land . Upon purchase , we are ready to implement plans to immediately build a first phase church building for worship and Christian educational M ministries (eg, Sunday School , Vacation Bible School , Children' s Clubs, etc. ) . Community Baptist Church has been in existence for nearly fourteen years . The church presently owns title to three properties within the town of Lochbuie . All of these facilities are overcrowded, poorly located and inadequate for our ministries. We -need to relocate in order to maintain and to expand our present ministries . It is our understanding that developers plan to build 14, 000 homes in what is known as the Bromley Park Development (Adams County) immediately across the road from our proposed church site . We need to be able to minister to the people of our area. The nearest church to us is in Hudson (7 miles away) or in Brighton. This land is ideally located to continue our ministries to the present and growing areas around Lochbuie . TYPES OF EXISTING USES ON SURR_QUNDING -PROPERTIES . All immediately surrounding properties are presently being used for agricultural purposes only . Weld County Road 2 borders the property to the south . The land across this road is presently being used for agricultural purposes , but is in P.U.D. for development purposes in Adams County. PISTANCE TO RESIDENTIAL STRUCTURES. Only three residences are located in the area . One (owned by the seller's nephew) is . 23 miles to the west of the proposed property. Another house is approximately one-half mile to the north (on Weld County Road 4) . The third residence is . 25 miles to the east and is owned by the seller of the proposed property. MAXI-MUM NUMBER OF USERS AND MEMBERS. Our church presently ministers to approximately eighty constituents . Attendance averages approximately sixty. In our present location in the trailer town -of Lochbuie we face serious limitations with our facilities, parking, access, visibility, etc. The first unit building which we propose to build will seat a maximum of 200 people for worship services . TIME TABLE FOR CONSTRUCTION AND START-UP: Arrangements are pending upon purchase of the property to begin construction as soon as possible through Baptist Church Buildings of Baptist Mission of North America. Normal construction time of the church building for this organization is three months . Section 3: WRITTEN MATERIALS AND SUPPORTING DOCUMENTS It is the intent of the Purchaser to erect a church on the property. Most of the area will remain as it presently is. The land to the west is presently agricultural , however, with the accelerated development taking place in the area, it is only a matter of time until this land becomes residential and commercial sites . The land to the east is agricultural , however with the frontage on Weld County Road 2 (sometimes known as 168th Avenue or Baseline Road) and the land across the street being plotted in part for commercial use and with Weld County Road 2 becoming a -main arterial , the probability of this land remaining agricultural is nil ; the land to the north is likewise agricultural and the anticipated population growth is approximately 3-5 years before further development will occur. The land is level to gradually sloping; it is not in a flood plain, geologic hazard area or airport overlay district area. The well is already on the property which will supply adequate water for the facility . The City of Brighton has plans to expand its present water supply which will front said property .
