RE: APPROVE REQUEST TO AMEND USE BY SPECIAL REVIEW TO ADD TWO
ADDITIONAL 500-BARREL STORAGE TANKS - ENRON OIL TRADING AND
TRANSPORTATION COMPANY
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners held a public
hearing on the 6th day of May, 1987 , at the hour of 2 : 00 p.m. in
the Chambers of the Board for the purpose of hearing the
application of ENRON Oil Trading and Transportation Company, 7600
East Orchard Road, #301 , Englewood, Colorado 80111 , to amend a
Use by Special Review to add two additional 500-barrel storage
tanks on the following described real estate , to-wit:
Part of the SE4 , Section 22 , Township 8 North ,
Range 66 West of the 6th P.M. , Weld County,
Colorado
WHEREAS, said applicant was represented by Ted McCurdy, and
WHEREAS , Section 24 .4 . 2 of the Weld County Zoning Ordinance
provides standards for review of said Use by Special Review, and
WHEREAS , the Board of County Commissioners heard all of the
testimony and statements of those present, has studied the request
of the applicant and the recommendations of the Weld County
Planning Commission and all of the exhibits and evidence presented
in this matter and , having been fully informed , finds that this
request shall be approved for the following reasons :
1 . The submitted materials are in compliance with the
application requirements of Section 24 . 7 of the Weld
County Zoning Ordinance.
2 . It is the opinion of the Board of County Commissioners
that the applicant has shown compliance with Section
24 . 4 . 2 of the Weld County Zoning Ordinance as follows:
a. The proposal is consistent with the Weld County
Comprehensive Plan in that it permits industrial
development to locate adjacent to existing
incorporated municipalities and in accordance with
the municipalities adopted comprehensive plans
goals and policies.

b. The proposed use is consistent with the intent of
the Agricultural Zone District . The proposed use
will not interfere with the agricultural activities
or other activities related to agriculture. The
proposed use is permitted as a Use by Special
Review in the Agricultural Zone District.
c. The Town of Pierce has found the proposal to comply
with its Comprehensive Plan .
d. No overlay districts affect the site.
e. The applicant has demonstrated a diligent effort to
conserve productive agricultural land in the
locational decision for the proposed use.
f. Use by Special Review Development Standards will
provide adequate protection of the health , safety
and welfare of the neighborhood and County.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the application to
amend a Use by Special Review to add two additional 500-barrel
storage tanks on the hereinabove described parcel of land be, and
hereby is, granted subject to the following conditions:
1 . The attached Development Standards for the Use by
Special Review permit be adopted and placed on the Use
by Special Review plat prior to recording the plat.
2 . The Use by Special Review activity, as proposed in this
application, shall not occur nor shall any building or
electrical permits be issued on the property until the
Use by Special Review plat has been delivered to the
Department of Planning Services Office and the plat is
ready to be recorded in the office of the Weld County
Clerk and Recorder.
3. Within thirty days of approval by the Board of County
Commissioners , improvements to the existing access to
U.S. Highway 85 shall be constructed in accordance with
the requirements of the Colorado Division of Highways .

DEVELOPMENT STANDARDS
ENRON Oil Trading and Transportation Company
Amended USR-560 : 87: 9
1 . The Use by Special Review permit is for a crude oil receiving
station as submitted in the application materials on file in
the Department of Planning Services and subject to the
Development Standards stated herein.
2 . Sign (s) shall be posted at the boundary of the Use by Special
Review site where accesses exist identifying the operator,
lease name, location , and emergency phone numbers , including
area code, where the operator may be reached at all times. In
lieu of the phone number being on the sign, the operator
shall furnish the phone numbers to the Pierce Fire Protection
District, Weld County Dispatch , and the Weld County Office of
Emergency Management.
3 . Improvements to the existing access to U.S. Highway 85 shall
be in accordance with the requirements of the Colorado
Division of Highways.
4 . All construction on the property shall be in accordance with
the requirements of the Weld County Building Code Ordinance.
5. The property owner or operator shall be responsible for
complying with the Design Standards of Section 24 . 5 of the
Weld County Zoning Ordinance.
b . The property owner or operator shall be responsible for
complying with the Operation Standards of Section 24 . 6 of the
Weld County Zoning Ordinance.
7 . Personnel from the Weld County Health Department , Soil
Conservation District , Pierce Fire Protection District , and
Weld County Department of Planning Services shall be granted
access onto the property at any reasonable time in order to
insure the activities carried out on the property comply with
the Development Standards stated herein and all applicable
Weld County Regulations.
8. The Use by Special Review area shall be limited to the plans
shown herein and governed by the foregoing Standards and all
applicable Weld County Regulations . Any material deviations
from the plans or Standards as shown or stated shall require
the approval of an amendment of the Permit by the Weld County
Planning Commission and the Board of County Commissioners
before such changes from the plans or Standards are
permitted. Any other changes shall be filed in the office of
the Department of Planning Services.

-9. The property owner or operator shall be responsible for
complying with all _of the foregoing Standards. Noncompliance
with any of the foregoing Standards may be reason for
revocation of the permit by the Board of County
Commissioners.

The following business was transacted:
I thereby certify that pur-suant to a notice dated April 15, 1987, and
duly published April 23, 1987, in the Johnstown -Breeze, a public
hearing was conducted to consider the request of -ENRON Oil Trading and
Transportation Company to amend a -Use by Special Review to add two
additional 300-barrel storage tanks. Bruce Barker, Assistant County
Attorney, made this matter of record. Keith 3chuett, Planning
Department representative, read the favorable recommendation of the
Planning Commission, which -is subject to three Conditions and nine
Development Standards, into the record. Ted McCurdy, representative of
the applicant, came forward to answer questions of the Board, and
stated that the appli-cant has no -problems with the recommended
Conditions and Development Standards. No public comment was made
concerning this request. Commissioner Kirby moved to approve the
request of ENRON Oil Trading and Transportation Company to amend a Use
by Special Review. The motion was seconded by Commissioner Johnson and
carried unanimously.
This Certification was approved on the 11th day of May, 1987.

most important `actors in contributing to the finacing of primary and
secondary education today is the authorized revenue base set by the State,
and the assessed valuation of the property. In the letter from the Windsor
S chool District, the authorized revenue base currently is in excess of
33,275.47. So, if in the year 1972 or 1973, the authorized revenue base was
less than 800 dollars, it is obvious that the authorized revenue base has
g one up vent' very rapidly and she would expect because of the problems in
primary and secondary education that the authorized revenue base will
continue to go up. If we in the County have decided that the developer
should help pay for the infrastructure, including the schools, then allowing
any developer to enter an agreement, in this case in terms of helping to
_finance primary and secondary education with a fixed amount that they would
_contribute one-third of a fixed of S3,275.43 leaves the taxpayers and the
County open to pay the difference. Three times the assessed valuation of
t he property will go up normally, but anytime any type of an agreement is
f ired in terms of one-third of a fixed amount then the people of Weld County
would have to come up with more through changes in the assessed valuation of
property, and that she is against. Therefore, she is basing her seconding
of the motion on the new Comprehensive Plan and the belief that developers
in the County should pay for any infrastructure including the schools.
Ivan Gosnell - no; Lynn Brown - yes; -Lydia Dunbar - yes; LeAnn Reid - yes;
Louis Rademacher - Po, because he thinks there is plenty of open space
there. There is over 80 thousand square feet in the stormwater drainage
area where they intend to install the baseball diamond, etc. The children
will not be the same age group and same size and half of them will he in
yards or houses. Therefore he does not feel a lack of open space has
anything to do with this request. Paulette Weaver - Yes, for reasons stated
_earlier. Ann Garrison - yes; Jack Holman - Yes, because he does agree with
both Paulette and Ann. His concern is mostly with the concentration of the
mobile homes in the area, and he feels more open space is needed whether it
be park areas, ball parks, etc. Motion carried with six voting for the
motion and two voting against the motion.

APPEARANCE:
Ted McCurty, Enron Oil, stated they want two more storage tanks within the
existing diked and fenced area. They want to utilize their costs by sending
oil in the area to Cheyenne through a pipeline rather than trucking it to
Sheyenne.
The Chairman asked the applicant if they had reviewed the recommendations,
conditions and Development Standards as outlined by the Department of
Planning Services ' staff. Ee stated they have and have no objections.
however, the suite number shown in the address should be 301 and not 501.
She Chairman called for discussion from the members of the audience. There
was none.
MOTION:
Lydia Dunbar moved Case Number Amended L'SR-560:87:9 for Enron Oil
Transportation and Trading for an amended Use by Special Review permit to
-add two additional 500 barrel storage tanks to their existing facility be
-forwarded to the Board of County Commissioners with the Planning
Commission's recommendation for approval based upon the recommendations,
conditions, and -Development Standards as outlined by the Department of
Planning Services' staff and the testimony heard by the members of the
Planning Commission. Notion seconded by Ivan Gosnell.
The Chairman called for discussion from the members of the Planning
Commission. Discussion followed.
The Chairman asked the secretary to poll the members of the Planning
Commission for their decision. -Ivan Gosnell - yes; -Lynn Brown - yes; Lydia
Dunbar - yes; leAnn Reid - yes; Louis Rademacher - yes; Paulette
Weaver - yes; Ann Garrison - yes; Jack Holman - yes. Motion carried
unanimously.

following reasons:
1. The submitted materials are in compliance with application
requirements of Section 24.7 of the Weld County Zoning Ordinance.
2. It is the opinion of the Weld County Planning Commission that the
applicant has shown compliance with Section 24.3 of the Weld
County Zoning Ordinance as follows:
- The proposal is consistent with the Weld County
Comprehensive Plan in that it permits industrial
development to locate adjacent to existing incorporated
municipalities and in accordance with the municipalities
adopted comprehensive plans goals and policies;
- The proposed use is consistent with the intent of the
Agricultural zone district. The proposed use will not
interfere with the agricultural activities or other
activities related to agriculture. The proposed use is
permitted as a Use by Special. Review in the Agricultural
zone district.
- The Town of Pierce has found the proposal to comply with
its Comprehensive Plan;
- No overlay districts affect the site.
- The applicant has demonstrated a diligent effort to
conserve productive agricultural land in the locational
decision for the proposed use;

adequate protection of the health, safety and welfare of
the neighborhood and County.
This recommendation is based, in part, upon a review of the application
submitted by the applicant, other relevant information regarding the request
and the responses of the referral entities which have reviewed this request.
The Planning Commission's recommendation for approval is conditional upon
the following:
1. The attached Development Standards for the Use by Special Review
permit be adopted and placed on the Use by Special Review plat
prior to recording the plat.
2. The Use by Special Review activity, as proposed in this
application, shall not occur nor shall any building or electrical
permits be issued on the property until the Use by Special Review
plat has been delivered to the Department of Planning Services'
office and the plat is ready to be recorded in the office of the
Weld County Clerk and Recorder.
3. Within 30 days of approval by the Board of County Commissioners,

I. -The Use by Special Review permit is for a crude oil receiving station
as submitted in the application materials on file in the Department of
Planning Services and subject to the Development Standards stated
thereon.
2. Sign(s) shall be posted at the boundary of the Use by Special Review
site where accesses exist identifying the operator, lease name,
location, and emergency phone numbers, including area code, where the
-operator may be reached at all times. In lieu of the phone number being
on the sign, the operator shall furnish the phone numbers to the Pierce
Fire Protection District, Weld -County Dispatch, and the Weld County
Office of Emergency Management.
3. Improvements to the existing access to State Highway 85 shall be in
accordance with the requirements of the Colorado Division of Highways.
4. All Construction on the property shall be in accordance with the
requirements of the Weld County Building Code Ordinance.
5. The property owner or -operator _shall be responsible for complying with
the Design Standards of Section 24.5 of the Weld County Zoning
Ordinance.
6. The property owner or operator -shall be responsible for complying with
the Operation Standards of Section 24.6 of the Weld County Zoning
Ordinance.
7. Personnel from the Weld County Health Department, Soil Conservation
District, Pierce Fire Protection District, and Weld County Department
of Planning Services shall be granted access onto the property at any
reasonable time in order to insure the activities carried out on the
property comply with the Development Standards stated hereon and all
applicable Weld County Regulations.
8. The Use by Special Review area shall be limited to the plans shown
hereon and governed by the foregoing Standards and all applicable Weld
County Regulations. Any material deviations from the plans or
Standards as shown or stated shall require the approval of an amendment
of the Permit by the Weld County Planning Commission and the Board of
County Commissioners before such changes from the plans or Standards
are permitted. Any other changes shall be filed in the office of the
Department of Planning Services.
9. The property owner or operator -shall be responsible for complying with
all of the foregoing Standards. Noncompliance with any of the
foregoing Standards may be reason for revocation of the Permit by the
Board of County Commissioners.

In our March 12, 1987, letter to you on the ENR011 Oil amended Special
Review we expressed no objections based on the proposed average increase of
four trucks per day. We also noted that the application Site Plan makes
reference to the upgrading of the existing access to State Highway 85.
Since that letter was written we have been informed by our Maintenance
section that the surface of the access to S.H. 85 is deteriorating and needs
to be upgraded. Therefore, improvement of this access by the applicant
should be required as a condition of this request for an amended Special
Review. The applicant should coordinate this work with the Area Highway
Foreman, Bob Sherriff. Our Design section can provide assistance on
surfacing specifications, if necessary.

_COMMENTS:
Access is _directly off of highway 85. An additional access exists off of
Weld County Road 9D which runs to the west and north of the site. The
Pierce lateral canal runs along the access from Weld County Road 90 to its
western and northern side.
The southern land is agricultural for approximately one-half mile, more or
less. The south side of Weld County -Road 90 is the Town of Pierce's
boundary on which the grade school is located.

NOTICE OF PUBLIC HEARING
The Weld County Planning Commission will conduct a public hearing on April
7, 1987, at 1:30 p.m. to review a request for approval of an Amendment to
USR-560:87:9 from ENRON Oil Trsdiag and Transportation Company to add two
(2) additional 500 barrel storage tanks. The parcel of land is described as
part of the SE} of Section 22, T8N, R66W of the 6th P.M. , Weld County,
Colorado, containing 3.5 acres, more or less. The property is located
approximately 1 mile north of the City of Pierce, -west of Highway 85, and
north of Weld County Road 90.
The public hearing so be held by the Weld County Planning Commission for the
consideration of the above referenced request will be conducted in the Weld
County Commissioners' Hearing -Room, First Floor, Weld County Centennial
Center, 915 Tenth Street, Greeley, Colorado. Comments or objections related
to the above request _should be submitted in writing so the Weld County
Department of Planning Services, 915 Tenth Street, Room 342, Greeley,
Colorado 80631, before the above date or presented at the public hearing
on April 7, 1987.

Dear Chuck:
Enron Oil Trading and Transportation Company hereby submits the application
for "Use By Special Review" -for permission to set two (2) 5110 Carrel tanks
within the fenced area of the existing crude oil -receiving station and a
API Standard Act Unit.
We believe that our unloading facility is consistent with the Weld County
Comprehensive Plan and the intent of the District in which it will be
located for the following reasons:
Proposed use - Crude oil truck unloading station.
Need for use - Currently crude oil trucks are driving on
Highway 85 to Cheyenne, Wyoming. Need unloading
station to provide more effecient trucking
operation.
Use on surrounding properties - East Highway 25, West Chevron
Oil facility, North and South dry land agriculture.
Distance to residential structures - North Zmile, South Z mile,
East 14 mile, West 3/4 mile.
Maximum number of users - For the proposed Yanks, only one, Enron
Oil Trading and Transportation Company.
Maximum number of employees - 1, number of shifts - 1 , hours of
operation - 24.
Type of water source for intended use - N/A; no water required.

be used. State _Department epartment of Highways Permit No.
483049 dated July 21, 1-983.
Type, size, weight and frequency of vehicular traffic - Type
transport trucks, size 20D bbl, loaded weight -85,000
pounds, frequency average 4 per day, most of which
will be in daylight hours.
Type of sewage facilities - N/A; none required.
Proposed fire protection measures - Existing fire extinguishers,
1-125 lb. Ansul Dry Chemical Wheeled Extinguisher,
2-3D L-B. Ansul Dry Chemical Extinguishers, located
to be most accessible if needed.
Type -and maximum number of animals - N/A; no animals will be con-
centrated on the area.
Type and -size of any waste, stockpile or storage areas associated -
N/A; no waste will be stockpiled, no storage area
other than the proposed two-500 bbl. tank addition.
Type of storm water retention - N/A; no storm water will be retained,
natural drainage, not restricted.
Time schedule -and method of removal and disposal debris, junk and
other waste - Will be removed weekly if there is any by pickup
truck to public dump. This operation does not
generate - waste.
Landscaping plans and erosion control - Land limited to gravel
driveways and tank dikes now existing. Flat ground
does not require special erosion control. Tank
diked area capacity is 23,262 cu. ft. , tanks in-
cluding 2 proposed capacity is 18,528 cu. ft. See
exhibit C-1 attached.
Reclamation procedures to be employed upon cessation of use -
lease agreement with the owner requires restoration
of surface area to as near original condition as
possible.
Time table for construction - Start 15 days after application is
approved. Estimate 15 working days construction
time.

Again, we beli-eve our proposed unloading facility is consistent -with the
Weld County Comprehensive Plan and the intent of the District in which
it is located -for the following reasons:
Consistent -with Weld County Comprehensive Plan — The proposed tanks
will be located within the existing crude oil _re-
ceiving station.
Consistent with the intent of district in which use is located - New
tanks located within -existing crude oil receiving
station. Crude oil -receiving -station is adjacent to
existing Chevron Oil storage and treating facility.
Efforts to conserve -productive agriculture land - Located within
existing crude oil receiving station, no productive
agricultural land will to used.
Provision for protection of health, -safety and welfare — The pro-
posed tanks will be approximately one fourth mile
North of the town of Pierce, Colorado, thus -pro-
viding an adequate buffer in case of emergency
situations. Further the tanks will be locat-ed
within an existing chain link fence to prevent ac-
cidental injury to third parties. Tank dikes around
all tanks _would contain any tank failure.
Uses permitted will be compatible with surrounding land uses - East
Highway 85, West Chevron Oil Storage and Treating
Facility, North and South dry land agriculture class
III, Type 174.
Proposed tankage will be compatible with surrounding area - Located
within existing crude oil receiving station which
is located beyond the area identified as "Future
Growth Area" on the Weld County Future Land Use Map,
dated January 1973.
"Use By Special Review" area is not located in a flood plain,
geologic hazard or Weld County Airport overlay
district area.
Proof that water supply will be available - N/A; no water supply
is required.
Copy of Surface Lease and Joint Occupancy Agreement to show ap-
plicant's interest in property under consideration
