RESOLUTION RE: APPROVE SITE SPECIFIC DEVELOPMENT PLAN AND AN AMENDMENT TO A SPECIAL REVIEW PERMIT TO INCLUDE A DOG KENNEL WITH A MAXIMUM OF 16 DOGS - CATHERINE W. CARIASO WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners held a public hearing on the 1st day of June, 1988 , at the hour of 2: 00 p.m. in the Chambers of the Board for the purpose of hearing the application of Catherine W. Cariaso, 0750 Highway 60 , Loveland, Colorado 80537 , for a Site Specific Development Plan and an amendment to a Special Review permit to include a dog kennel with a maximum of 16 dogs on the following described real estate, to-wit: Part of the NE* , Section 6 , Township 4 North, Range 68 West of the 6th P.M. , Weld County, Colorado WHEREAS, said applicant was present, and WHEREAS, Section 24 .4 . 2 of the Weld County Zoning Ordinance provides standards for review of said Special Review permit, and WHEREAS , the Board of County Commissioners heard all of the testimony and statements of those present, has studied the request of the applicant and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter and, having been fully informed, finds that this request shall be approved for the following reasons : 1 . The submitted materials are in compliance with the application requirements of Section 24 . 7 of the Weld County Zoning Ordinance . 2 . It is the opinion of the Board of County Commissioners that the applicant has shown compliance with Section 24 .4 .2 of the Weld County Zoning Ordinance as follows : a. The proposed Use by Special Review is consistent with the Weld County Comprehensive Plan ' s Urban Growth Boundary Area Goals and Policies . The proposal is located within the urban growth boundary area of the Town of Berthoud . The proposal is consistent with the intent of the Agricultural Zone District and is provided for as a Use by Special Review. c . The activities proposed will be compatible with existing agricultural uses as well as with the future projected agricultural development in the immediate area. The proposed special review will not have any significant traffic or noise impacts. d. . No overlay districts affect the site. e . Special Review Development Standards will provide adequate protection of the health, safety and welfare of the neighborhood and County. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the application for a Site Specific Development Plan and an amendment to a Special Review permit to include a dog kennel with a maximum of 16 dogs on the hereinabove described parcel of land be, and hereby is, granted subject to the following conditions: 1 . The attached Development Standards for the Special Review permit be adopted and placed on the Special Review plat prior to recording the plat. 2. The Special Review activity shall not occur nor shall any building or electrical permits be issued on the property until the Special Review plat has been delivered to the Department of Planning Services Office and the plat is ready to be recorded in the office of the Weld County Clerk and Recorder. 3 . Cariaso AMENDED USR-673 1 . The Special Review permit is for a home business and dog kennel (maximum of 16 dogs) as submitted in the application materials on file in the Department of Planning Services and subject to the Development Standards stated herein. 2 . Approval of this plan may create a vested property right pursuant to Article 68 of Title 24 , C.R.S . , as amended. 3. The applicant shall operate the kiln in accordance with the -Berthoud Fire Protection District regulations. A . The applicant shall maintain recommended improvements to the 'driveway for improved accommodation of two-way traffic. 5 . Animal wastes shall be disposed of in such a manner as not to cause a public health nuisance. 6 . Only dogs which have been debarked will be allowed outside between the hours of 10: 00 P.M. and 7: 00 A.M. 7 . The Special Review permit shall automatically expire upon lease or conveyance by the applicant of the subject parcel. B . All construction on the property shall be in accordance with the requirements of the Weld County Building Code Ordinance. 9 . The property owner or operator shall be responsible for complying with the Design Standards of Section 24 .5 of the Weld County Zoning Ordinance. 10 . The property owner or operator shall be responsible for complying with the Operation Standards of Section 24 . 6 of the Weld County Zoning Ordinance. 11 . Personnel from the Weld County Health Department, Weld County Department of Planning Services , and the Berthoud Fire Department shall be granted access onto the property at any reasonable time in order to ensure the activities carried out on the property comply with the Development Standards stated herein and all applicable Weld County Regulations. 880428 -Page 2 DEVELOPMENT STANDARDS - CA-RIASO 12 . The Special Review area shall be limited to the plans shown herein and governed by the foregoing Standards and all applicable Weld County Regulations . Any material deviations from the plans or Standards as shown or stated shall require the approval of an amendment to the permit by the Weld County Planning Commission and the -Board of County Commissioners before such changes from the plans or Standards are permitted. Any other changes shall be filed in the office of the Department of Planning Services. 13 . The property owner or operator shall be responsible for complying with all of the foregoing Standards. Kirby, -Pro Tem Commissioner Jacqueline Johnson Commissioner Gordon E. Lacy Commissioner Frank Yamaguchi Also present: Acting Clerk to the Board, Mary Reiff Assistant County -Attorney, Lee D. Morrison Planning lepartment representative, Rod Allison The following business was transacted: I hereby certify that pursuant to a notice dated May 9, 1988, and duly published May 11, 1988, in the Platteville Herald, -a public hearing -was conducted to consider the request of Catherine W. Cariaso for a Sits Specific Development Plan and an amendment to a Special Review permit to include a dog kennel with a maximum of 16 dogs. Zee Morrison, Assistant County _Attorney, made this matter of record and stated that this hearing was continued from May 25, because a sign advising of the hearing was not posted ten days prior to that -date as required. Rod Allison, representing the Planning Department, read the favorable recommendation o₹ the Planning Commission into the record. This recommendation was based upon three Conditions and twelve Development Standards. -Catherine Cariaso, the applicant, came forward to answer questions of the Board and said that, in response to comments neighbors made at the Planning Commission, she has had her seven outside dogs debarked. Clyde Sievers, Theodore Schrage, and Dean Hanes, owners of neighboring properties, spoke in opposition to this request. They objected to the noise of the dogs and the possible lowering of their property values. Milissa Culver, D.V.M. , explained that debarking does -not totally silence a dog but cuts down on the volume, and made comments regarding Ms. Cariaso's facilities. Speaking in favor of this request were were Ann Coleman, who has stayed with the dogs when Ms. Cariaso has been gone, and Robert Arnum, who recently purchased a dog from Ms. Cariaso. Ms. Cariaso made further comments and submitted letters from several neighbors. Commissioner Johnson suggested that a Development Standard be added to state that only debarked dogs will be allowed -outside between the hours of 10:00 P.M. and 7:00 A.M. Commissioner Johnson moved to approve this xsquest, subject to the Conditions and Development Standards, with the addition as discussed. Commissioner Yamaguchi seconded the motion. Commissioner Kirby commented that approval of a smaller kennel through the Special. Review permit provides provides control that would not be possible otherwise. The motion carried unanimously. Dear Commissioners: Please be advised that I have been consulted by Mr. Ted Schrage and have been requested to write this letter on behalf of T-ed Schrage and his wife, Ruth Schrage, of 0866 State Highway 60, Loveland, Colorado. Mr. and Mrs. Schrage live in Weld County at a location less than six hundred feet from where Catherine W. Cariaso proposes to continue her dog kennel as mentioned above. Dn behalf of Mr. and Mrs. Schrage, I would like to formally entertheir objection to Weld County approval of this dog kennel operation. This proposed use of property is not computable -with the existing agricultural land uses in the area and the presence of a dog kennel -will unquestionably adversely affect property values in the immediate area. I don't know anyone who is anxious to live within the immediate vacinity of a dog kennel, including myself, and the noise, alone, from barking -logs is enough to constitute a public nuisance and breach of the peace. My clients _certainly hope that if this kennel is approved, one of the required conditions will be that all dogs will be debarked, and furthermore, that the County will follow up on such re- quirement to see that it has been complied with. It Ss my understanding -that the Applicant has agreed previously to -take such action in the future. In addition, I under- stand that the Applicant has agreed that -this use of her property -will be discontinued upon a sale or leasing of the property and -will not, as such, run with the land to a future occupant. We -would also hope that this limitation be placed in effect also. The Allard Animal Hospital has provided veterinary services for dogs belonging to Catherine Cariaso since 1981 . The -majority of the work I have done for her has involved yearly vaccinations for distemper and parvovirus diseases and rabies when due. She vaccinates all adult dogs on schedule and all litters of puppies at 6 weeks of age. Puppies are almost always sold by the time they are 9 weeks old so I seldom see one back for its next scheduled booster at 10 weeks. Catherine produces good quality, healthy puppies which have had almost no medical problems. Her dogs always appear clean, happy, well fed and well cared for when she brings them to the hospital. In addition, I have visited her kennel and noted that they are well housed with adequate shelter and adequate space. She was concerned enough about her relations with her neighbors to have had 7 of her dogs debarked recently. Debarking is not cruel and ' has no psychological effect on the dog. A dog seems to get the same satisfaction from the motion of barking as it does from the sound produced. These dogs may still attempt to bark but the sound, although audible at close range, should not be loud enough to carry to the neighboring houses. If the proposed kennel is not kept clean, the smell will certainly add to the unpleasant odor that sometimes fills our community. It is also believed that property values for other residents would depreciate with the establishment of such a proposed business. It is likewise imperative that this community remain residential rather than becoming a business community. This proposed business may create additional traffic for a community which has been safe and quiet.
