RESOLUTION RE: APPROVE SITE SPECIFIC DEVELOPMENT PLAN AND SPECIAL REVIEW PERMIT FOR AN AGRICULTURAL SERVICE ESTABLISHMENT (FEED SALES AND FARM EQUIPMENT SALES , REPAIR, AND INSTALLATION) IN THE A (AGRICULTURAL) ZONE DISTRICT - KEITH R. AND SHARON L. BURMAN WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the -Board of County Commissioners held a public tearing on the 14th day of September, 1988, at the hour of 2 : 00 p.m. in the Chambers of the Board for the purpose of hearing the application of Keith R. and Sharon L. Burman, c/o Ted E. Carlson, 1203 9th Street , Greeley, Colorado 80631 , for a Site Specific Development Plan and Special Review Permit for an agricultural service establishment (feed sales and farm equipment sales, repair, and installation) in the A (Agricultural) Zone District on the following described real estate, to-wit: Part of the Si of Section 16 , Township 6 North, Range 66 West of the 6th P.M. , Weld County, Colorado WHEREAS, said applicant was represented by Ted E. Carlson, and WHEREAS, Section 24 .4 .2 of the Weld County Zoning Ordinance provides standards for review of said Special Review Permit, and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, has studied the request of the applicant and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter and, having been fully informed, finds that this request shall be approved for the following reasons: 1 . The submitted materials are in compliance with the application requirements of Section 24 . 7 of the Weld County Zoning Ordinance. 2 . It is the opinion of the Board of County Commissioners that the applicant has shown compliance with Section 24 . 4 .2 of the Weld County Zoning Ordinance as follows: a. The proposed Special Review Permit area is located within the urban growth boundary area of the City of Greeley. The location of the Special Review 880906 7/A/ / 7(2 Page 2 RE: USR - KEITH T. BURMAN Permit area and the attached conditions and Development _Standards make the proposed use consistent with the -Urban On-math Boundary Goals of the Weld County -Comprehensive Plan. b. The proposed use is consistent with the intent of the Agricultural Zone -District in which the use would be located. The proposed use is an agricultural service establishment and is provided for as a Use by Special Review in the Agricultural Zone District. c. The applicant has demonstrated a diligent effort to conserve productive agricultural land in the locational decisions for proposed use. The site is presently used for storage of hay and will continue to be used for the storage of hay as part of the permitted use. d. The use which would le permitted will be compatible with the existing surrounding land uses. Land uses surrounding the site include: Colorado Highway 392 , Weld County Road 29 , crop production, rural residential uses , oil and -gas production, and a boarding kennel. e. The use which mould be permitted will be compatible with the future development of the surrounding area as permitted by the existing zone and with future development as projected by the Comprehensive Plan of the County. f. No overlay districts affect the site. g. Special Review -Development Standards will provide adequate protection of the health, safety and welfare of the neighborhood and _County. NOW, -THEREFORE, RE 7T RESOLVED by the Board of County Commissioners of Meld County, Colorado, that the application for a Site Specific Development Plan and Special Review -Permit for an agricultural service -establishment (feed sales and farm equipment sales, repair, and installation) in the A (Agricultural) Zone District en the hereinabove described parcel of land be, and hereby is, granted subject to the following conditions: 1 . The attached -Development Standards for the Special Review Permit be adopted and placed on the Special Review plat prior to recording the plat. The plat shall 88D906 Page 3 RE: USR - KEITH R. BURMAN be -delivered to the Department of Planning Services and be ready for recording in the Weld County Clerk and Recorder' s Office within 15 days of approval by the Board of County Commissioners . 2 . _The Special Review activity shall not occur nor shall any building or electrical permits be issued on the property until the Special Review plat is ready to be recorded in the office of the Weld County Clerk and Recorder. 3 . Prior to recording, the Special Review plat shall be amended to show a 50 foot right-of-way reservation from the centerline of Greeley No. 2 Canal. 4 . The proposed septic system shall be designed by a Colorado Registered Professional Engineer according to the Weld County Individual Sewage Disposal Regulations. 5 . Prior to any excavation on the Special Review site, the applicant shall notify Golden Buckeye Petroleum Corporation and Associated Natural Gas so high pressure gas lines and low pressure oil flow lines may be located. 6 . Prior to the operation of the use on the Special Review site, the applicant shall submit a landscaping plan to the Department of Planning Services. The landscaping plan must be approved by the Greeley Soil Conservation Service and the Weld County Department of Planning Services prior to implementation of the plan. Landscaped areas shall include, at the minimum, the areas adjacent to Weld County _Road 29 and Highway 392 , measured at a right angle from the lot line toward the interior of the lot for a distance of at least ten feet. The landscaping plan shall include, but shall not -be limited to, the -following: seedbe-d preparation, methods of planting, planting dates, weed control, fertilization and maintenance. The plan shall also address the use of gravel on the site to stabilize the surf-ace and may address berming adjacent to the rights-of-way. 88_0906 Page 4 RE: USR - KEITH R. AND SHARON L. AND SHARON L. BURMAN USR-843 1 . The Site Specific Development Plan and Special Review Permit is for an agricultural service establishment (feed sales and farm equipment sales repair, and installation) in the A (Agricultural) Zone District as submitted in the application materials on file in the Department of Planning Services and subject to the Development Standards stated herein. 2 . Approval of this plan may create a vested property right pursuant to Article 68 of Title 24 , C.R.S . , as amended. 3 . Waste oil, waste paints, stains, treatments, antifreeze, and other associated liquid and solid wastes, shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 4 . No permanent disposal of wastes shall be permitted at this site. 5 . The existing cement water tank and separator shall be fenced with three strands of barbed wire. A removable fence shall be placed around the wellhead. 6 . Any structure on the property shall be located a minimum of 200 feet from the wellhead and a minimum of 150 feet from the separator, water storage tank and oil storage tank. 7 . Metal posts , with a minimum diameter of four inches, shall be placed at the northwest and southwest corners of the oil storage tanks, outside of the berm. The posts shall be placed in a hole at least twelve inches in diameter and at least three feet deep. Cement shall be poured around the posts for support. 8 . The access road on the site shall be maintained by the owner or operator and shall be passable for two-wheel drive vehicles. 9. All equipment repairs done on the site shall be performed in an area screened from adjacent properties and public rights-of-way or shall be enclosed in a building. 880906 Page 2 DEVELOPMENT STANDARDS - BURMAN 10 . The buildings to be constructed on the property shall be painted in earth-tone colors and shall be maintained in a neat and orderly manner through building maintenance. 11 . One unlighted identification sign only shall be allowed on the site. The identification sign shall not exceed 16 square feet. 12 . All sales and repair operations on the Special Review site shall be conducted during the hours of daylight only. This restriction shall not apply to operation of administrative offices or repair facilities totally enclosed in a building. 13 . Equipment in the machinery parking area shall be placed in neat and orderly rows with a minimum 12 foot aisle between rows. 14 . The approved landscaping plan shall be maintained on the property. 15 . All construction on the property shall be in accordance with the requirements of the Weld County Building Code Ordinance. 16 . The property owner or operator shall be responsible for complying with the Design Standards of Section 24 . 5 of the Weld County Zoning Ordinance. 17 . The property owner or operator shall be responsible for complying with the Operation Standards of Section 24 . 6 of the Weld County Zoning Ordinance. 18 . Personnel from the Weld County Health Department, Eaton Fire Protection District, and Weld County Department of Planning Services shall be granted access onto the property at any reasonable time in order to ensure the activities carried out on the property comply with the Development Standards stated herein and all applicable Weld County Regulations. 19 . The Special Review area shall be limited to the plans shown herein and governed by the foregoing Standards and all applicable Weld County Regulations. Major changes from the plans or Development Standards as shown or stated shall require the approval of an amendment of the Permit by the Weld County Planning Commission and the Board of County Commissioners before such changes from the plans or Development Standards are permitted. The property owner or operator shall be responsible for complying with all of the foregoing Development Standards. He called the Board's attention to a mis—statement in the Planning Commission minutes and stated that equipment will be available for resale and will be displayed on the property. Keith Burman, one of the applicants, came forward and made further explanations of the proposed operation. He stated that he has no problem with the Development Standards proposed by the Planning Commission. No public comment was offered concerning this request. Commissioner Lacy moved to approve the request of Keith R. and Sharon L. Burman for a Site Specific Development Plan and Special Review Permit, subject to the Conditions and Development Standards contained in the Planning Commission's recommendation. Seconded by Commissioner Johnson, the motion carried unanimously. This Certification was approved on the 19th day of September, 1988. The landscaping plan must be approved by the Greeley Soil Conservation Service and the Weld County Department of Planning Services prior to implementation of the plan. Landscaped areas shall include, at the minimum, the areas adjacent to Weld County Road 29 and Highway 392, measured at a right angle from the lot line toward the interior of the lot for a distance of at least ten (10) feet. The landscaping plan shall include, but shall not be limited to, the following: seedbed preparation, methods of planting, planting dates, weed control, fertilization and maintenance. The plan shall also address the use of gravel on the site to stabilize the surface and may address berming adjacent to the rights-of-way. The Special Review permit is for a Site Specific Development Plan and a Special Review permit for an Agricultural Service Establishment (feed sales, farm equipment sales repair, and installation) in the A (Agricultural) zone district as submitted in the application materials on file in the Department of Planning Services and subject to the Development Standards stated hereon. 2. Approval of this plan may create a vested property right pursuant to Article 68 of Title 24 C.R.S. , as amended. 3. Waste oil, waste paints, stains, treatments, anti-freeze, and other associated liquid and solid wastes, shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 4. No permanent disposal of wastes shall be permitted at this site. 5. The existing cement water tank and separator shall be fenced with three strands of barbed wire. A removable fence shall be placed around the wellhead. 6. Any structure on the property shall be located a minimum of two hundred (200) feet from the wellhead and a minimum of 150 feet from the separator, water storage tank and oil storage tank. 7. Metal posts, with a minimum diameter of four inches, shall be placed at the northwest and southwest corners of the oil storage tanks, outside of the berm. The posts shall be placed in a hole at least twelve inches in diameter and at least three feet deep. Cement shall be poured around the posts for support. 8. The access road on the site shall be maintained by the owner or operator and shall be passible for two-wheel drive vehicles. 9. All equipment repairs done on the site shall be performed in an area screened from adjacent properties and public rights-of-way or shall be enclosed in a building. 10. The buildings to be constructed on the property shall be painted in earth-tone colors and shall be maintained in a neat and orderly manner through building maintenance. 11. This restriction shall not apply to operation of administrative offices or repair facilities totally enclosed in a building. 13. The approved landscaping plan shall be maintained on the property. 15. All Construction on the property shall be in accordance with the requirements of the Weld County Building Code Ordinance. 16. The property owner or operator shall be responsible for complying with the Design Standards of Section 24.5 of the Weld County Zoning Ordinance. 17. The property owner or operator shall be responsible for complying with the Operation Standards of Section 24.6 of the Weld County Zoning Ordinance. 18. Personnel from the Weld County Health Department, Eaton Fire Protection District, and Weld County Department of Planning Services shall be granted access onto the property at any reasonable time in order to ensure the activities carried out on the property comply with the Development Standards stated hereon and all applicable Weld County Regulations. 19. The Special Review area shall be limited to the plans shown hereon and governed by the foregoing Standards and all applicable Weld County Regulations. Major changes from the plans or Development Standards as shown or stated shall require the approval of an amendment of the Permit by the Weld County Planning Commission and the Board of County Commissioners before such changes from the plans or Development Standards are permitted. BURMAN, C/O TED E. CARLSON USR-843 On July 26, 1988, the Greeley Planning Commission recommended objections to granting the Special Review permit because the proposal is not in conformance with the City's Comprehensive Plan policy guidelines for commercial uses along major public rights-of-way. The Planning Commission's concerns were based on the fact that Highway 392 is likely to become a major entryway into the city as the City of Greeley develops land north of the Poudre River and as Fort Collins extends their development area to the east. It is the opinion of the Department of Planning Services' staff that the proposed use will be compatibvle with and will not adversely affect the surrounding area. The possible impacts from this type of use can be mitigated with permit development standards. The proposed use is located approximately one-half mile west of the City of Greeley's long-range expected growth area, which includes lands anticipated to include urban development over the next twenty to thirty years. The location of the proposed use and the timing of the proposed plans for infrastructure in the long-range expected growth area should not interfere with urban development plans projected by the City of Greeley's Comprehensive Plan. Both the State Highway Department and the Weld County Engineering Department have reviewed this request and have recommended approval of the proposal. The submitted materials are in compliance with the application requirements of Section 24.7 of the Weld County Zoning Ordinance. 2. It is the opinion of the Department of Planning Services' staff that the applicant has shown compliance with Section 24.3 of the Weld County Zoning Ordinance as follows: - The proposed Special Review permit area is located within the urban growth boundary area of the City of Greeley. The location of the Special Review permit area and the attached conditions and development standards make the proposed use consistent with the urban growth boundary goals of the Weld County Comprehensive Plan. - The proposed use is consistent with the intent of the agricultural zone district in which the use would be located. The proposed use is an agricultural service establishment and is provided for as a Use by Special Review in the Agricultural zone district. - The applicant has demonstrated a diligent effort to conserve productive agricultural land in the locational decision for the proposed use. Land uses surrounding the site include Colorado Highway 392, Weld County Road 29, crop production, rural residential uses, oil and gas production, and a boarding kennel. - The use which would be permitted will be compatible with the future development of the surrounding area as permitted by the existing zone and with future development as projected by the comprehensive plan of the county. - No overlay districts affect the site. - Special Review Development Standards will -provide adequate protection of the health, safety and welfare of the neighborhood and County. This recommendation is based, in part, upon a review of the application submitted by the applicant, other relevant information regarding the request, and the responses of the referral entities which have reviewed this request. The Department of Planning Services' staff recommendation for approval is conditional upon the following: 1. The attached Development Standards for the Special Review permit be adopted and placed on the Special Review plat prior to recording the plat. Prior to any excavation on the special review site, the applicant shall notify Golden Buckeye Petroleum Corporation and Associated Natural Gas so high pressure gas lines and low pressure oil flow lines can be located. 6. Prior to the operation of the use on the Special Review site, the applicant shall submit a landscaping plan to the -Department of Planning Services. The landscaping plan -must be approved by the Greeley Soil Conservation Service and the Weld County Department of Planning Services prior to implementation of the plan. Landscaped areas shall include, at the minimum, the areas adjacent to Weld County Road 29 and Highway 392, measured at a right angle from the lot line toward the interior of the lot for a distance of at least ten (10) feet. The landscaping plan shall include, but shall not be limited to, the following: seedbed preparation, methods of planting, planting dates, weed control, fertilization, and maintenance. The plan shall also address the use of gravel on the site to stabilize the surface and may address berming adjacent to the rights-of-way. 8809.6 SITE SPECIFIC DEVELOPMENT PLAN SPECIAL REVIEW PERMIT DEVELOPMENT STANDARDS Keith R. and Sharon L. Burman USR-843 1. The Special Review permit is for a Site Specific Development Plan and a Special Review permit for an Agricultural Service Establishment (feed sales, farm equipment sales, repair, and installation) in the A (Agricultural) zone district as submitted in the application materials on file in the Department of Planning Services and subject to the Development Standards stated hereon. 2. Approval of this plan may create a vested property right pursuant to Article 68 of Title 24 C.R.S. , as amended. 3. Waste oil, waste paints, stains, treatments, anti-freeze, and other associated liquid and solid wastes, shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 4. No permanent disposal of wastes shall be permitted at this site. 5. The existing cement water tank and separator shall be fenced with three strands of barbed wire. A removable fence shall be placed around the wellhead. 6. Any structure on the property shall be located a minimum of two hundred (200) feet from the wellhead and a minimum of one hundred fifty (150) feet from the separator, water storage tank and oil storage tank. 7. Metal posts, with a minimum diameter of four inches, shall be placed at the northwest and southwest corners of the oil storage tanks, outside of the berm. The posts shall be placed in a hole at least twelve inches in diameter and at least three feet deep. Cement shall be poured around the posts for support. 8. The access road on the site shall be maintained by the owner or operator and shall be passible for two-wheel drive vehicles. 9. All equipment repairs done on the site shall be performed in an area screened from adjacent properties and public rights-of-way or shall be enclosed in a building. 10. The buildings to be constructed on the property shall be painted in earth tone colors and shall be maintained in a neat and orderly manner through building maintenance. 11. All sales and repair operations on the Special Review site shall be conducted during the hours of daylight only. This restriction shall not apply to operation of administrative offices or repair facilities totally enclosed in a building. 13. Equipment In the machinery parking area shall be placed in neat and orderly rows with a minimum twelve (12) foot aisle between rows. 14. The approved landscaping plan -shall be maintained on the property. 15. All Construction on the property shall be in accordance with the requirements of the Weld County Building Code Ordinance. 16. The property owner or operator shall be responsible for complying with the Design Standards of Section 24.5 of the Weld County Zoning Ordinance. 17. The property owner or operator shall be responsible for complying with the Operation Standards of Section 24.6 of the Weld County Zoning Ordinance. 18. Personnel from the Weld County Health Department, Eaton Fire Protection District, and Weld County Department of Planning Services shall be granted access onto the property at any reasonable time in order to ensure the activities carried out on the property comply with the Development Standards stated hereon and all applicable Weld County Regulations. 19. The Special Review area shall be limited to the plans shown hereon and governed by the foregoing Standards and all applicable Weld County Regulations. Major changes from the plans or Development Standards as shown or stated shall require the approval of an amendment of the Permit by the Weld County Planning Commission and the Board of County Commissioners before such changes from the plans or Development Standards are permitted. Any other changes shall be filed in the office of the Department of Planning Services. 20. The property owner or operator shall be responsible for complying with all of the foregoing Development Standards. Noncompliance with any of the foregoing Development Standards may be reason for revocation of the Permit by the Board of County Commissioners. ADDITIONAL COMMENTS KEITH R. AND SHARON L. BURMAN, C/O TED E. CARLSON USR-843 On July 26, 1988, the Greeley Planning Commission recommended objections to granting the Special Review permit because the proposal is not in conformance with the City's Comprehensive Plan policy guidelines for commercial uses along major public rights-of-way. The Planning Commission's concerns were based on the fact that Highway 392 is likely to become a major entryway into the city as the City of Greeley develops land north of the Poudre River and as Fort Collins extends their development area to the east. It is the opinion of the Department of Planning Services' staff that the proposed use will be compatible with and will not adversely affect the surrounding area. The possible impacts from this type of use can be mitigated with permit development standards. The proposed use is located approximately one-half mile west of the City of Greeley's long-range expected growth area, which includes lands anticipated to include urban development over the next twenty to thirty years. The location of the proposed use and the timing of the proposed plans for infrastructure in the long-range expected growth area should not interfere with urban development plans projected by the City of Greeley's Comprehensive Plan. Dear Sirs: Our proposed use is fox an operation which would consist of alfalfa hay storage, farm machinery storage, hay & farm related • machinery sales this would be such items as tractors, tillage equipment, harvest equipment and titled farm vehicles. We want to utilize the land for storage _of hay which is produced on the farm which is also owned by Keith Burman as well as selling agriculturally related products to the local surrounding residents. The surrounding property uses are for production of crops and a boarding kennel fox pets as well as personal residences. The nearest residence is located on the south side of State Highway 392 adjacent to this property, 3 other residences are located within 1/2 mile of the subject. The exact location of the residences are located on an attached map. Ttie total number of employees, users and buyers and patrons will vary but we are proposing 2 full time employees and occasional part time help for the operation. Business would be conducted durin-g business hours without overtime or multiple shifts. North Weld water would supply the water for domestic use on the property. Access to the property would be gained off of Weld County Road 29, to the west of the property. Vehicle traffic to the property would be predominately cars, pickup trucks, farm trucks and occasional semi-trucks for pickup or delivery of alfalfa. High traffic volume is not planned on or expected. Sewage disposal would be by septic system, no public sewage disposal is in the area. Eaton Fire Department serves the subject property with support available from the Windsor Fire Department. Fire alarms would be installed in office structures on the property. Alfalfa hay will be stored in sheds or under cover, the machinery will be stored outside on the property which is approximately 14. 9 acres. 880906 All debris junk and waste will be disposed of and hauled away from the property by a local trash service or taker, to an area landfill on a regular basis. The property is covered with wild and seeded grass and will be maintained to prevent erosion of the land. Upon the cessation of the proposed activity the land would be returned to its present state. Plans are to begin construction of the project as soon as proper steps have been taken to allow the proposed use and be completed by the summer of 1988.
