HomeMy WebLinkAbout871140 RESOLUTION RE: APPROVE CONTINUANCE OF HEARING TO CONSIDER TRANSFER OF CERTIFICATE OF DESIGNATION FOR A SOLID WASTES DISPOSAL SITE AND FACILITY - CIRLCE "M" PARTNERSHIP/McMILL, INC. WHEREAS , the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners held a public hearing on the 26th day of August, 1987 , at the hour of 2 : 00 p.m. in the Chambers of the Board for the purpose of considering the application from Circle "M" Partnership/McMill , Inc. , for the transfer of a Certificate of Designation to operate a solid wastes disposal site and facility in Weld County, Colorado, and WHEREAS, Thomas E. Hellerich, Attorney, represented Circle "M" Partnership/McMill , Inc . , and Kim Houtchens , Attorney, represented Waste Services, Inc. , and WHEREAS, Mr. Hellerich requested that this hearing be continued to allow the Colorado Department of Health to review the operations plan which has been submitted to it, and WHEREAS, after consideration, it was deemed advisable to continue said hearing to October 14 , 1987 , at 2 : 00 p.m. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the hearing to consider the application from Circle "M" Partnership/McMill, Inc. , for the transfer of a Certificate of Designation to operate a solid wastes disposal site and facility in Weld County, Colorado, be , and hereby is, continued to October 14 , 1987 , at 2 : 00 p.m. to allow time for the Colorado Department of Health to review the operations plan. 871140 PL0114 Page 2 RE: CONTINUE HEARING - TRANSFER CERTIFICATE OF DESIGNATION The above and foregoing Resolution was , on motion duly made and seconded, adopted by the following vote on the 26th day of August, A.D. , 1987 . y ��� • IBOARD OF COUNTY COMMISSIONERS ATTEST: L+i WELD COUNTY p, COLORADO Weld County Clerk and Recorder and Clerk to the Board Gor , airman BY: y�i it... 14, ctc �cc � C.W. A public hearing was conducted on August 26, 1987, at 2:00 P.M. , with the following present: Commissioner Gordon E. Lacy, Chairman Commissioner C.W. Kirby, Pro-Tem Commissioner Gene Brantner - Excused Commissioner Jacqueline Johnson Commissioner Frank Yamaguchi - Excused Also present: Acting Clerk to the Board, Mary Reiff Assistant County Attorney, Bruce T. Barker Health Department representative, Wes Potter The following business was transacted: I hereby certify that pursuant to a notice dated March 9, 1987, and duly published March 12, 1987, in the Johnstown Breeze, a public hearing was conducted to consider the request of Circle "M" Partnership/McMill, Inc. for the transfer of a Certificate of Designation for a Solid Waste Disposal Site and Facility. Bruce Barker, Assistant County Attorney, made this matter of record and said this hearing was continued from May 20 to allow the applicant time to submit an operations plan to the State Health Department. Tom Hellerich, attorney representing the applicant, came forward and stated that an operations plan has been submitted to the State Health Department and the State has requested sixty days for review of this plan. He requested that this hearing be continued for the State's review of the submitted plan, together with the fact that only three Commissioners were present today. Wes Potter, Health Department representative, said that the State received the operations plan on August 7 and needs 45 to 60 days for its review. A letter from the State is required before the Commissioners can act. After Mr. Hellerich explained the delay in submitting this plan to the State, Commissioner Kirby moved to continue this hearing to October 14, at 2:00 P.M. The motion was seconded by Commissioner Johnson. Kim Houtchens, attorney for Waste Services, Inc. , objected to continuation of this hearing and asked for denial of the request because the plan was not submitted in a timely fashion. Commissioner Johnson indicated that she would object to a further continuation of this matter, other than for lack of sufficient Commissioners being present. The motion carried unanimously. This Certification was approved on the 31st day of August, 1987.
