RE: APPROVE INTERGOVERNMENTAL AGREEMENT BETWEEN WELD COUNTY,
COLORADO, AND THE TOWN OF GARDEN CITY AND AUTHORIZE CHAIRMAN
TO SIGN
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with an
Intergovernmental Agreement between Weld County and the Town of
Garden City for the application for funds for a CDBG Housing
Rehabilitation Program , and
WHEREAS, the terms and conditions are as stated in the
Intergovernmental Agreement, a copy of which is attached hereto
and incorporated herein by reference, and
WHEREAS , after review, the Board deems it advisable to
approve said Intergovernmental Agreement.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the Intergovernmental
Agreement between Weld County, Colorado, and the Town of Garden
City be, and hereby is, approved.
BE IT FURTHER RESOLVED by the Board that the Chairman be, and
hereby is, authorized to sign said Intergovernmental Agreement.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 5th day of
January, A.D. , 1987. ��

INTERGOVERMENTAL AGREEMENT o

THIS AGREEMENT, entered into this lailhday of Q BCE P'\%E(t, , 19 , by and
between the BOARD OF COMMISSIONERS OF WELD COUNTY, COLORADO, a body politic of tip
State of Colorado, hereinafter called "the County" and the Town of GA toad ,ty ,,
a body politic hereinafter called "the City."
WITNESSETH:
WHEREAS, pursuant to the Housing and Community Development- Act of 1977, as
amended, hereinafter called "the Act", the United States, acting by and through
the Secretary of the Department of Housing and Urban Development, hereinafter called
"HUD", is making available to the State certain funds for community development
activities as set forth in the Act; and
WHEREAS, the State of Colorado, through the Department of Local Affairs, has
the legal authority to provide funds to counties for community development activ-
ities; and
WHEREAS, the County has indicated a willingness to submit a program proposal
to the State to carry out the Housing Rehabilitation program within their juris-
diction; and
WHEREAS, the parties hereto desire to provide assurances and delineate
the areas of cooperation between the County and the City with respect to Housing
Rehabilitation activities;
NOW, THEREFORE, in furtherance of said Resolution, and in consideration of
the mutual conditions, covenants and agreements herein contained, it is agreed
by and between the parties as follows:
1. Planning the Housing Rehabilitation Program. The Parties, through their
executives and staff, shall cooperate with each other in developing the housing
rehabilitation program proposal, with all parties giving due consideration to the
needs of its citizens and goals, objectives, rules and regulations of the Act.
2. Term of Agreement. This agreement shall remain in full force and effect
until the program proposal is approved by the State and a contract executed by
all parties. In the event the program proposal is approved by the State, this
agreement shall remain in effect through the completion of program activities.
3. Authorization to submit a proposal. The County is authorized to submit
a proposal to the State on behalf of the City to apply for funds under the
Community Development Block Grant Program and to act on behalf of the City, with
regard to any subsequent negotiations, presentations or information in conjunction
with the grant application.
4. The City shall have no obligations or responsibilities, financial or
otherwise, concerning the administration of Community Development Block Grant
Housing Rehabilitation Program and the County agrees to indemnify the City from
any and all liability, loss or damage the City may suffer in connection with the
administration of the project upon approval of the proposal.
