WHEREAS , the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter , is vested with the authority of administering the
affairs of Weld County, Colorado, and

o O authority under Section 30-28-101 (10) (d) , CRS , as amended, did, at
a public meeting held in the Chambers of the Board, consider the

Dear Commissioners:
This request for a Recorded Exemption is submitted by Mrs. Carolyn Prior,
who has power of attorney from John P. Ascher, President of the Great
Western Railway Company. The parcel of land on which this request is being
made is described as part of the NW} SW} of Section 33, T7N, R66W of the 6th
P.M., Weld County, Colorado. The property is located approximately 3 miles
west of Eaton, north of Weld County Road 74, and east of Weld County Road
29. The parcel under consideration is the total land holdings of the
applicant. The request is to divide the property into (2) parcels of 4.29
acres more or less, and .88 acres more or less. There is a weight scale and
scale house presently owned by Western Sugar Company on the smaller parcel.
The Weld County Health Department and the Town of Eaton have reviewed the
application materials and have no objections to the request.
The staff has found that the Standard 9-2 E. (1) (e) has not been met. The
standard states the minimum size of any building site, tract or lot created
by the recorded exemption procedure shall not be less than one (1) acre,
except where smaller lot sizes are allowed in a special zoning district or
except where specifically exempted by the Board. The applicant has
requested the creation of a lot measuring .88 acres.
The staff has further concerns whether adequate access will be available to
the proposed lots. Customarily, a 30 foot minimum access easement is
required. This applicant is proposing a 20 foot access easement to Lot A.

CONDITIONS OF APPROVAL

Carolyn Prior
1. The applicant shall submit a mylar plat to the Department of
Planning Services to be recorded in the office of the Weld County
Clerk and Recorder. The Plat shall be prepared in accordance with
the requirements of Section 9-2 C. (4) of the Weld County
Subdivision Regulations. The plat shall be submitted within sixty
(60) days from the date of approval.
2. The recorded exemption plat shall show a minimum foot wide
easement for ingress and egress to 4.29 acre parcel.
3. Prior to recording the plat, a copy of a deed shall be submitted
to the Department of Planning Services describing the 4.29 parcel,
including conveyances of the right to use the ingress and
egress easement.
4. Weld County Septic permits are required for any proposed homes and
their septic systems shall be installed according to the Weld
County Individual Sewage Disposal Regulations.

At the Board of County Commissioners meeting this morning; the Board
strongly. recommended that the Priors change their recorded exemption
application to a subdivision exemption application which has the effect of
allowing only one building site instead of two building sites.
The Priors agreed to the change in application type and a 30 foot access
easement on the north side of the parcel. They will be refunded $75.00
which is the difference between the two application fees.

Dear Planning Board:
This request for a recorded exemption is submitted by Ralph and Carolyn
Prior. The parcel of land for which this request is being made is described
as part of the Na, SW, Sec. 33-7-66, Weld County, Colorado. The property
is located approximately 3 miles west of Eaton, north of Weld County Rd. 74
and east of Weld Co. Rd 29. It is the former Hurrick Beet Dump scale house
ground.
The request is to obtain approximately .88acre from the Great Western Rail-
way Co. This small parcel has been used to provide grounds for a scale
house, which surrounding farmers have used to weigh sugar beets. The scale
and land have been idle for the past 4 years and will not be used for weigh-
ing sugar beets again since all the sugar beets grown in the area are
hauled directly to the Greeley factory. We farm land to the north, south
and west of this parcel and find it very accessable to use for the weighing
of our corn, silage and hay. The scale house and scale which sit on the
parcel are owned by Western Sugar Co. Our plan is to purchase this after
the approval of this request. Western Sugar has agreed to this. The scale
and land will remain as is and will be used for weighing our farm products
as well as neighbors.
John P. Ascher, President and Chief Executive Officer of Great Western
Railway, has given us his approval for tttis request. The Great Western
Railway will retain an easement for access of 20' from the south side of
the railroad for conduct of Interstate Commerce.
North Weld Co. Water service can be made available to this parcel. This
parcel is not located in a flood plain, geologic hazard or Weld Co. Air-
port overlay district. This application does comply with section 50, overlay
district regulations as outlined in the Weld County Zoning Ordinance. This
ground has natural boundries on all sides which is how we arrived at the
amount of acreage.
