The applicant has requested the creation of a lot measuring .88 acres. The staff has further concerns whether adequate access will be available to the proposed lots. Customarily, a 30 foot minimum access easement is required. The applicant shall submit a mylar plat to the Department of Planning Services to be recorded in the office of the Weld County Clerk and Recorder. The Plat shall be prepared in accordance with the requirements of Section 9-2 C. (4) of the Weld County Subdivision Regulations. The plat shall be submitted within sixty (60) days from the date of approval. 2. The recorded exemption plat shall show a minimum foot wide easement for ingress and egress to 4.29 acre parcel. 3. Prior to recording the plat, a copy of a deed shall be submitted to the Department of Planning Services describing the 4.29 parcel, including conveyances of the right to use the ingress and egress easement. 4. The property is located approximately 3 miles west of Eaton, north of Weld County Rd. 74 and east of Weld Co. Rd 29. It is the former Hurrick Beet Dump scale house ground. The request is to obtain approximately .88acre from the Great Western Rail- way Co. This small parcel has been used to provide grounds for a scale house, which surrounding farmers have used to weigh sugar beets. The scale and land have been idle for the past 4 years and will not be used for weigh- ing sugar beets again since all the sugar beets grown in the area are hauled directly to the Greeley factory. We farm land to the north, south and west of this parcel and find it very accessable to use for the weighing of our corn, silage and hay. The scale house and scale which sit on the parcel are owned by Western Sugar Co. Our plan is to purchase this after the approval of this request. Western Sugar has agreed to this. The scale and land will remain as is and will be used for weighing our farm products as well as neighbors. John P. Ascher, President and Chief Executive Officer of Great Western Railway, has given us his approval for tttis request. The Great Western Railway will retain an easement for access of 20' from the south side of the railroad for conduct of Interstate Commerce. North Weld Co. Water service can be made available to this parcel. This parcel is not located in a flood plain, geologic hazard or Weld Co. Air- port overlay district. This application does comply with section 50, overlay district regulations as outlined in the Weld County Zoning Ordinance. This ground has natural boundries on all sides which is how we arrived at the amount of acreage.
