Home My WebLink About861144.tiff RESOLUTION RE: AUTHORIZE COUNTY ATTORNEY TO PROCEED WITH LEGAL ACTION TO RECOVER COST OF DEMOLITION WORK - CHURCH OF GOD IN CHRIST WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Weld County Road and Bridge Department, pursuant to a Resolution dated September 24 , 1986 , performed demolition work on Lots 1 , 2 , and 3 , Block 2 , East Side Addition to Eaton, and WHEREAS, said demolition work was done to abate dangerous conditions on the hereinabove described property which is owned by the Church of God in Christ, and WHEREAS, said property was duly posted and a notice was duly published in the County legal newspaper, ten days prior to the meeting, with the Church of God in Christ being properly notified by certified letter that the Board was to consider the matter of recovering the cost of the demolition work at its regular Board meeting of December 1 , 1986 , and WHEREAS, the Church of God in Christ had no representative at the Board meeting of December 1 , 1986 , and no objection was made in its behalf to the entry of this Resolution , and WHEREAS, the Board, at said meeting, determined that this matter be referred to the County Attorney to proceed with appropriate legal action against the owner of said property to recover the cost of the demolition in the amount of $1 ,291.90. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the Weld County Attorney' s Office be, and hereby is , authorized to seek judgment against the Church of God in Christ, owner of Lots 1 , 2, and 3 , Block 2 , East Side Addition to Eaton , to recover the cost of the above mentioned demolition work for a total amount of $1 ,291 .90. 861144 Page 2 RE: DEMOLITION COSTS - CHURCH OF GOD IN CHRIST The above and foregoing Resolution was , on motion duly made and seconded, adopted by the following vote on the 1st day of December, A.D. , 1986. Said meeting will be conducted in the Chambers of the Board, First Floor, Weld County Centennial Center, 915 10th Street, Greeley, Colorado. The demolition work, which was done by the Weld County Road and Bridge Department at the direction of the Board, took place on Lots 1, 2, and 3, Block 2, East Side Addition to Eaton, said Lots being owned by the Church of God in Christ. The Board will hear any protests and consider whether or not the cost should be assessed personally against the owner or by special assessment and lien against the property. Any persons in any manner interested are requested to attend the meeting and may be heard. It has been determined that the total cost of said demolition work is $1,291.90, with a copy of the summary of the cost being available in the office of the Clerk to the Board, Third Floor, Centennial Center, 915 Tenth Street, Greeley, Colorado, between the hours of 8:00 A.M. and 5:00 P.M. , Monday through Friday. GG/msc xc: Chuck Cunliffe, Planning Department RESOLUTION RE: AUTHORIZE DIRECTOR OF ROAD AND BRIDGE DEPARTMENT TO PROCEED WITH DEMOLITION WORK AND SET DATE TO CONSIDER RECOVERING THE COST OF SAID DEMOLITION WORK - CHURCH OF GOD IN CHRIST ' WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS , the Department of Planning Services has advised thE.: Board that the Church of God in Christ is in violation of the Uniform Code for the Aabatement of Dangerous Buildings , and WHEREAS , the Church of God in Christ was issued a citation of said violation on September 21 , 1983 , with only portions of the dangerous building being removed after receipt of said citation , and WHEREAS , remaining portions of the dangerous building are located on property described as the east 28 feet of Lots 1 , 2 _ nc 3 , Block 2 , East Side Addition to Eaton , Weld County, and WHEREAS , after study and review, the Board deems it advisable and in the best interests of the citizens of Weld County to authorize the Director of the Road and Bridge Department to proceed with demolition work to remove the remaining portions o% the dangerous building; and set November 12 , 1986 , as the date to consider recovering the cost of the demolition work.
