RESOLUTION RE: GRANT CHANGE OF ZONE FROM AGRICULTURAL (A) TO COMMERCIAL-ONE (C-1) FOR CHARLYNE ZAMORA WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, a public hearing was held on the 17th day of April , 1985 , at 2 :00 p.m. for the purpose of hearing the application of Charlyne Zamora, P.O. Box 495 , Frederick, Colorado 80530 , requesting a Change of Zone from Agricultural (A) to Commercial-One (C-1) for a parcel of land located on the following described real estate, to-wit: Lots 23 and 24 , Block P, Evans Addition and part of Block 6 , Wolff Gardens; located in the SW;, Section 30 , Township 2 North, Range 67 West of the 6th P.M. , Weld County, Colorado WHEREAS, Section 21 .6 . 2 of the Weld County Zoning Ordinance provides standards for review of such a Change of Zone, and WHEREAS, the Board of County Commissioners heard all the testimony and statements of those present, has studied the request of the applicant and the recommendations of the Weld County Planning Commission, and, having been fully informed, finds that this request shall be approved for the following reasons: 1 . The applicant has complied with all the application requirements listed in Section 21 . 7 et seq. , of the Weld County Zoning Ordinance. 2 . The request is in conformance with Section 21 .6 of the Weld County Zoning Ordinance as follows: a. The uses which will be allowed on the subject property by granting the Change of Zone will be compatible with the surrounding land uses. The subject site and surrounding land is zoned Agricultural, but is residential in nature. The Commercial-One (C-1) Zone District which is intended to provide shops and stores furnishing personal services and merchandise primarily for personal, family or household purposes by residents of the area in which it is located will be compatible with the surrounding residential land use. 85G09C Page 2 RE: COZ - ZAMORA b. The Tri-Area Planning Commission has recommended approval of this proposal in its letter dated November 15 , 1984. c. Changing conditions in the area warrant a Change of Zone. As noted above , the area is zoned Agricultural but is residential in nature. The subject site is located in part of two platted subdivisions (Evans Addition and Wolff Gardens) and is one-quarter mile between two incorporated communities (Frederick and Firestone) and is on the main street connecting these two towns. It is not in an undeveloped agricultural area. Changing the zone on the subject site to Commercial-One (C-1) would be acceptable considering the actual residential character of the neighborhood and its location on the main thoroughfare between the above two towns. d. The subject site is served by the Town of Frederick water system. e. The subject site is served by the Tri-Area sanitation system. f. Johnson Street will provide adequate access to the site. g. The proposed Change of Zone is located within a Geologic Hazard Overlay District. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the application of Charlyne Zamora for a Change of Zone from Agricultural (A) to Commercial-One (C-1) on the above referenced parcel of land be, and hereby is, granted subject to the applicant meeting the requirements of Section 27 . 1 (Geologic Hazard Overlay District Development Permit) of the Weld County Zoning Ordinance. Morrison Planning Department representative, Rod Allison The following business was transacted: I hereby certify that pursuant to a notice dated March 6, 1985, and duly published March 14 and April 4, 1985, in the La Salle Leader, a public hearing was conducted to consider the request of Charlyne Zamora for a Change of Zone from Agricultural (A) to Commercial-One (C-1) . _Lee Morrison, Assistant County Attorney, made this matter of record. Rod Allison, representing the Planning Department, read the favorable -recommendation of the Planning Commission, which contained one condition, into the record . Mr. Allison said the condition stated -that the applicant was to meet the requirements of Section 27. 1 of the Weld County Zoning Ordinance, which is a Geologic Hazard Overlay District Development Termit. He said that the applicant has been -working with the Colorado Geological Survey Division and this -department has recommended approval as stated in their letter, which Mr. Allison read into the record. Mr. Allison said that the Planning -staff recommends that one note -be placed on the plat to read as follows: "The Colorado Geological Survey Division shall review and approve any new construction on the western portion of the property prior to the site plan review and building permit approval." Charlyne Zamora, the applicant, came forward to answer questions of the Board. Commissioner Kirby moved to approve the Change of Zone from Agricultural to Commercial-One for Charlyne Zamora with the note, which was recommended by the Planning staff, being placed on the plat. The motion was seconded by Commissioner Lacy and carried unanimously. LOCATION: Northeast of Fort Lupton; east of Weld County Road 31 and north of Dale Avenue James Mayerl reviewed the applicant's request. Ms. Z-amora had previously applied -for Commercial-Two zoning. The Tri-Area Planning Commission recommended this request be denied as did the Department of _Planning Services. The Planning Commission previously recommended denial of the request to the Board of County Commissioners. Ms. Zamora withdrew the request for Commercial-Two zoning and is now applying for Commercial-One zoning. The Tri-Area Planning Commission is now recommending approval fur Commercial-One zoning. Lee Morrison state-d a change of zone cannot be limited to a certain business. If the proposed restaurant did not succeed, or Ms. Zamora decided not to put the business on this property any Commercial-One business designation can be operated on this site. However, a site plan review will need to be submitted to and approved by the staff prior to any other business commencing operation. APPEARANCE: Charlyne Zamora, applicant, stated they wished to open a fast-food restaurant on this site. There are no other changes from their previous request with the exception of a request 2or Commercial-One Zoning. The problem of the illegal land split has also been rectified by returning part of Lot 6, Wolfe Gardens back to her mother.
