TAXES: The abstracter' s certificate indicates that there are no unredeemed tax sales affecting the captioned lands but does not certify as to payment of 1987 property taxes. Gentlemen: Based upon my examination of the above-described materials, I find the record ownership of all the captioned lands as of June 20, 1988 at 7 : 45 A.M. to be as stated above, subject, however, to the following comments, exceptions and requirements : 1. The captioned lands were patented into private ownership prior to the date the United States began reserving oil and gas in its patents . REQUIREMENT NO. 1 : None; advisory 2 . The opinion is subject to the rights of all persons in possession of the captioned lands . REQUIREMENT NO. 2 : Obtain and furnish for my examination an Affidavit of Possession showing the history of possession of the captioned lands for the past nine years, being particular to show who is now in possession and under whom they claim. If a tenant is in possession of the lands covered by Lease A, a Tenant ' s Consent Agreement to Lease A should be included in the affidavit. 3 . Tract 1 is subject to a Deed of Trust dated November 6, 1981, recorded January 18, 1982 in Book 959 at Reception No. 1880243 from Bud Clemons for the use of The Federal Land Bank of Wichita securing payment of $50, 000. 00 due January 1, 2015. Tract 2 is subject to a Deed of Trust dated November 25, 1986, recorded November 26, 1986 in Book 1136 at Reception No. 2078622 from Mark A. Justice and Stacey L. Justice for the use of Columbia Savings, a Federal Savings and Loan Association, securing payment of $70, 530 . 00 due December 1, 2016 . These deeds of trust are senior, respectively, to Leases AandB B and have not been subordinated thereto. REQUIREMENT NO. 3 : A. Obtain and record an agreement subordinating the lien of the Deed of Trust recorded in Book 959 at Reception No. 1880243 to Lease A from The Federal Land Bank of Wichita. B. Obtain and record an agreement subordinating the lien of the Deed of Trust recorded in Book 1136 at Reception No. 2078622 to Lease B from Columbia Savings. 4 . The following instruments appear of record: A. Quitclaim Deed dated May 13, 1899, recorded in Book 130 at Page 263 , from E. M. Gigray to Weld County conveying a stri, of l. .nd 30 feet wide off the W/2 NE/4 of the captioned Section. 88081.5 Lyco Energy Corporation July 6, 1988 Page 6 B. Quitclaim Deed dated May 13, 1899, recorded in Book 130 at Page 267 from W. L. and E. E. Umberger to Weld County conveying a strip of land 30 feet wide off the south side of the E/2 NE/4 of the captioned Section. C. Quitclaim Deed dated December 4, 1899, recorded in Book 130 at Page 299 from The Platte Land Company Limited to Weld County conveying a strip of land 300 feet wide off the south side of the S/2 N/2 of the captioned Section. Each of said deeds contains the following language: The above-described strip of land is hereby conveyed for road purposes only and in case the road should at any time be vacated and abandoned by the Board of County Commissioners of Weld County, Colorado, the land hereby conveyed shall revert to the Grantor, herein, his heirs or assigns. For purposes of this opinion, the deeds were not construed as passing title to minerals underlying the strip conveyed, relying on Logan County v. Morris, (Colo. 1961 ) 362 P. 2d 202, but, because of the decision in Farmers Reservoir and Irrigation Company et al. v. Sun Production Company et al. , (Colo. App. 1986 ) 721 P. 2d 1198 , this construction may be open to question and there is a possibility that, under current Colorado law, these deeds passed title to the minerals underlying the strip conveyed . REQUIREMENT NO. 4 : Obtain protection oil and gas leases from Weld County covering the strips of land conveyed by the referenced deeds. 5. Lease A contains an attached Exhibit "A" with numerous special provisions, including provisions affecting surface access, operations and drilling. The exhibit also establishes drilling deadlines which were extended by the extension of Lease A. REQUIREMENT NO. 5 : Be certain to comply with the provisions of Exhibit "A" to Lease A and the extension thereof in connection with all operations on the captioned lands. 6. The NE/4 of the captioned Section was originally sub- divided as set forth in Recorded Exemption 0963-3-1-RE 72 . Apparently, said subdivision included lands in the S/2 NE/4 of the captioned Section, being a part of the lands covered by this opinion. Thereafter, said lands were conveyed in the chain of title and a lease was taken covering said lands by Sunshine Valley Petroleum Corporation from Bud Clemons. In addition, a producing well was completed upon lands covered by the lease in the N/2 NE/4 . Thereafter, by an instrument recorded February 27, 1987 in Book 1147 at Reception No. 2090064, the said recorded exemption was amended to include only lands in the N/2 NE/4 of the captioned Section and the owners thereof executed quitclaim deeds to Bud Clemons reconveying the portion of said lands in the S/2 NE/4 . The referenced oil and gas lease from Bud Clemons to Sunshine Valley Petroleum Corporation, which was dated January 27 , 1986 , recorded February 5, 1986 in Book 1102 at Reception No. 2041929 , is apparently held by production from a well in the NW/4 NE/4 and a pooling declaration which pooled the N/2 NE/4 .
